II. APPROVAL OF MINUTES
It was moved by Commissioner Connor, seconded by Commissioner Holden, to
approve the minutes of the June 23, 1998 meeting. Motion carried 5-0, with
Commissioner O'Donnell absent.

previously approved signage adding three sets of halo-lit letters on east,

Mr. Smith reported that the application has been withdrawn and
recommended that the matter be tabled.
Action:
Commissioner Connor moved, seconded by Commissioner Holden, to table
the matter. The motion carried 5-0, with Commissioner O'Donnell absent.

NATURE OF PROJECT/APPROVAL SOUGHT: Internally illuminated
monument sign
LOCATION: 74-200 Country Club Drive
ZONE: PR-5
Mr. Alvarez reported that the proposal includes a double-faced internally
illuminated monument sign with a six-foot height maximum and a stucco
finish to match the finish of the church. The the cap will also match the roof
tile on the church. The proposed signage meets the ordinance requirements.
Action:
Commissioner Holden moved, seconded by Commissioner Urrutia, to
approve the plans as submitted. The motion carried 5-0, with Commissioner
O'Donnell absent.

B. Preliminary Plans
1. CASE NO.: PP 98-10
APPLICANT (AND ADDRESS): 3D PARTNERSHIP, 41-865 Boardwalk,
Suite 206, Palm Desert, CA 92211
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
revised site plan and architectural elevations for an office professional park
LOCATION: Northwest corner of Frank Sinatra and Portola
ZONE: PR-5
Mr. Smith reported that the revised site plan takes into account the street
widening, and the revised elevations show a significant reduction in square
footage. Staff recommends approval.
Chairman Gregory asked about the colors for Building D, to which Mr.
Thornberry replied that a diversity of colors is being used for the buildings,
and Building D will be a warm grey color.
Commissioner Urrutia commented that the revisions are definitely an
improvement over the original plans, but noted that some things still need to
be worked out on the site, i.e., grading.
Action:
Commissioner Connor moved, seconded by Commissioner Holden, to grant
preliminary approval for the revised architectural elevations. The motion
carried 5-0, with Commissioner O'Donnell absent.

2. CASE NO.: PP 98-11
APPLICANT (AND ADDRESS): ROBERT RICCIARDI for BRUCE

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of an
8,800 square foot industrial building
LOCATION: Northwest corner of St. Charles Place and Mediterranean
ZONE: SI
Mr. Smith reported that the southwest corner of the building is encroaching
into the setback on St. Charles Place; so it will need to be moved, but there
is adequate room to do so.
Commissioner Urrutia asked if anything has been revised, to which Mr.
Ricciardi replied that the site plan and building elevations have not been
altered because the proposed building meets code requirements; however,
he has made some changes to the landscaping.
Commissioner Urrutia asked if the rear of the building is visible from St.
Charles Place, to which Mr. Ricciardi responded affirmatively.
Commissioner Van Vliet felt that there should be more articulation on the
building elevations, to which Mr. Ricciardi replied that there are lots of
buildings in the area which have very plain walls facing the street.
Chairman Gregory noted that the shrubs are not called out in the plans, to
which Mr. Ricciardi replied that there is a plant list, but they are not called out
because these are only preliminary plans.

Chairman Gregory suggested that the spacing of the trees along the rear
property line be revised in order to avoid damage to the trees by cars being
parked adjacent. Chairman Gregory pointed out that the canopy trees won't
work well so close to the building.
Commissioner Connor expressed concern regarding the amount of gravel
that is to be used as the prime ground cover, but indicated that it may not be
an issue depending on the type of plants used in the surrounding area.
Commissioner Holden suggested that the west elevation be revised to be
similar to the front elevation (south).
Commissioner Connor commented that the single parking space south of the
driveway should be deleted.
Action:
Commissioner Urrutia moved, seconded by Commissioner Holden, to grant
preliminary approval subject to the conditions referenced above. The motion
carried 5-0, with Commissioner O'Donnell absent.

3. CASE NO.: C 98-8
APPLICANT (AND ADDRESS): JOHN NICHOLS & PAUL WEINBERG for

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of storefront
remodel
LOCATION: 73-660 El Paseo
ZONE: C-1
Mr. Alvarez reported that the applicant proposes to recover the columns with
tile, and the new elevation will have a flush surface with a recessed triangular
design element on one elevation and a recessed circular design element on
the other elevation. In order to comply with the code, the mainfront elevation
will be required to meet the five-foot setback from the property line.
Commissioner Urrutia felt that the wing walls should be brought back as far
as possible to increase the visibility of the storefront and display windows,
with which Commissioner Van Vliet concurred, and noted that the wing walls
could be brought back as far as 6'8".
Action:
Commissioner Urrutia moved, seconded by Commissioner Holden, to grant
preliminary approval subject to pulling the wing walls back 6'8" and
maintaining a five-foot setback from the property line. The motion carried
5-0, with Commissioner O'Donnell absent.

4. CASE NO.: C 98-9

NATURE OF PROJECT/APPROVAL SOUGHT: New signage and
storefront remodel
LOCATION: 73-125 Highway 111
ZONE: C
Mr. Alvarez reported that the proposed signage exceeds the maximum
allowed by the code; so the applicant will be submitting revised plans, but
would first like the Commission's input. The plans indicate that the parapet
will be increased to a maximum height of 5'6" and a minimum height of 3'0",
and that an awning will be added.
Mr. Karcher clarified that drawings are in error, as he does not intend to add
red awnings.
Commissioner Urrutia commented that a reduction in the amount of signage
will make a big difference.
Commissioner Connor noted that more than three colors are proposed for
the sign, to which Mr. Karcher replied that the blue color is not actually part
of the sign face, but is merely the color of the can, which will not be lit.
Commissioner Urrutia suggested that if the blue color were eliminated, no
other color changes would be required.
Action:
Commissioner Urrutia moved, seconded by Commissioner Van Vliet, to
continue the case at the applicant's request. The motion carried 4-0, with
Commissioner Connor abstaining and Commissioner O'Donnell absent.

5. CASE NO.: CUP 98-11
APPLICANT (AND ADDRESSy NEXTEL COMMUNICATIONS, 17275

NATURE OF PROJECT/APPROVAL SOUGHT: Installation of a wireless
telecommunication facility
LOCATION: 75050 Merle Drive
ZONE: SI
Mr. Alvarez reported that the proposed facility would be located on the north
side of the existing storage facility, and would include an 85-foot monopole
with the equipment to be stored inside the storage area so as not to be
visible. The proposal meets the radius requirement of 300 feet from
residential property; however, this applicant will go before the Planning
Commission for approval of a Conditional Use Permit.
Barbara Sidle of Nextel commented that it would be difficult to disguise the
facility as a tree because of the height of the tower.
Commissioner Holden asked if it is necessary to be so close to Cook Street,
to which Ms. Sidle replied that it could be moved to the east without
impacting facility operations.
Commissioner Urrutia commented that the proposal does not work
aesthetically, and as proposed, it will be visible from Cook Street, which is
a view corridor.
Mr. Smith asked if the same level of service would be provided if the facility
were moved 1,000 feet to the east, to which Ms. Sidle responded
affirmatively.
Commissioner Holden noted that placement is critical, and the facility should
be as far away as possible from main thoroughfares.
Action:
Commissioner Holden moved, seconded by Commissioner Connor, to
continue the case. The motion carried 4-0, with Commissioner Van Vliet
abstaining and Commissioner O'Donnell absent.

6. CASE NO.: MISC 98-10
APPLICANT (AND ADDRESS): JEAN C. LYMAN, 72-833 White Drive,
Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of loft addition
above an existing garage
LOCATION: 72-833 White Drive
ZONE: R-1
Mr. Alvarez reported that the applicant proposes to add a loft over an existing
garage with a gabled roof. It should be clarified that, according to the code
definition, a loft can be no greater than 33.3% of the floor area underneath,
and this proposal exceeds that restriction. This application is before the
Commission due to the fact that the building will exceed 15 feet in height.
Commissioner Urrutia suggested turning the roof 90 degrees to align with the
existing roof.
Action:
Commissioner Holden moved, seconded by Commissioner Urrutia, to
approve the addition subject to meeting the definition of a mezzanine per the
Uniform Building Code, and turning the roof 90 degrees to align with the
existing roof. The motion carried 5-0, with Commissioner O'Donnell absent.

7. CASE NO.: MISC 98-11
APPLICANT (AND ADDRESS): MRS. REA, 43-205 Illinois Avenue, Palm
Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of a six-foot high
chain link fence in the rear yard of a residence
LOCATION: 43-205 Illinois Avenue
ZONE: R-1 (9,000)
Mr. Smith reported that the ordinance does not allow chain link fences. In
this case, wood fencing exists on the sides, and there is a block wall to the
rear. Installation of the chain link fence was in progress when the property
owners' association got involved, and the association submitted a letter to
the City indicating that their bylaws have no provision which prohibits chain
link fence; however, the association would appreciate the City enforcing its
prohibition of chain link fences.
Commissioner Holden asked if the chain link fence is visible from anywhere,
to which Mr. Smith replied that it is only visible from Mrs. Rea's back yard
and her neighbors' back yards.
Mrs. Rea produced letters from her neighbors indicating they have no
objection to the chain link fence.
Action:
Commissioner Holden moved, seconded by Commissioner Urrutia, to
approve the fence. The motion carried 5-0, with Commissioner O'Donnell
absent.
