DENICK, 230 Stone Terrace, Palm Springs, CA 92264 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of residence measuring 16'6" in height LOCATION: 73-295 Desert Rose Drive ZONE: R-1 (12,000) Mr. Alvarez reported that there is a big grade difference, as this property is 10 feet below the rear yard of the adjacent residences. Other houses in the area have a similar height, and the proposed structure will feature hipped roofs. Action: Commissioner Van Vliet moved, seconded by Commissioner Urrutia, to grant approval of the plans as submitted. The motion carried 5-0. 3. CASE NO.: TT 29045 APPLICANT (AND ADDRESSL JOHN STEIGERWALDT for LA PALOMA HOMES, 73-960 Highway 111, Suite 5, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of landscaping LOCATION: Hovley Lane West, west of Portola Avenue ZONE: PR-5 Mr. Alvarez reported that the landscape plans submitted comply with the Commission's previous preliminary approval, and the applicant has incorporated changes recommended by the City's landscape consultant, Eric Johnson. Action: Commissioner Connor moved, seconded by Commissioner Urrutia, to grant approval of the plans as submitted. The motion carried 5-0. 3 ' ` ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES 4. CASE NO.: RV 99-1 APPLICANT (AND ADDRESSk LEE MEADOWS, 43-800 Tennessee, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval to store a recreational vehicle in the front yard LOCATION: 43-800 Tennessee ZONE: R-1 (9,000) Ms. Chafin reported The applicant seeks approval to store his recreational vehicle (RV) in the front yard area at 43-800 Tennessee (Palm Desert Country Club). The applicant's property encompasses two lots, and the applicant indicates that he has stored his RV in the southerly portion of the property for the past five years. The RV is completely screened on the north side by oleanders which are well in excess of 10 feet in height, and is partially screened on the south side by 10-foot high oleanders. On the west side facing the street, the RV is partially screened by a six-foot high, white wrought iron gate with white mesh. Pursuant to the new RV ordinance requirements, staff mailed notices of this meeting to property owners within a 300-foot radius of the subject property. As of July 6, 1999, staff had received only one response from a property owner whose objection related to the fact that there is no application fee. The ordinance requires that the RV be substantially (not completely) screened, and be aesthetically acceptable; so a judgment call is required in this case. Based on a visit to the site, staff found the RV to be substantially screened with aesthetically acceptable materials and design. Staff recommends approval. Mr. Smith noted that any appeals regarding RV cases now go directly to the City Council. Action: Commissioner Holden moved, seconded by Commissioner O'Donnell, to approve the plans with the condition that the property owner plant more oleanders in the bare area along the north side of the parking space to provide additional screening. The motion carried 5-0. 4 Nuo ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES 5. CASE NO.: SA 99-58 APPLICANT (AND ADDRESS): TRIMS & MORE INTERIOR DESIGN, 45- 120 San Pablo Avenue, Suite 2G, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Awnings over windows and doorway LOCATION: 45-120 San Pablo Avenue, Suite 2G ZONE: C-1 Ms. Chafin reported The Commission previously considered this application at its June 22nd meeting. Although staff found the design and color acceptable and recommended approval of the plans as submitted, the Commission did not find the design and color acceptable, and continued the case to July 13, 1999 in order to allow the applicant to incorporate recommended changes. American Awning has indicated that their client is not interested in making any changes, and unless the Commission approves the plans as presented, the intent is to make an appeal to the City Council. Staff recommends that the Architectural Review Commission deny the application. Action: Commissioner Holden moved, seconded by Commissioner Connor, to deny the proposal for reasons specified at the 6/22/99 meeting: 1) the awning element should be continued along the entire north elevation rather than just over the front door; 2)the building already has a lot of architectural features; 3)the awning should be placed above the exposed rafters in order to be in better proportion; 4) the awning over the door on the north elevation would make the door less visible; and 5)the proposed color is not appropriate. CASE NO.: MISC 99-13 APPLICANT (AND ADDRESS MARTHA SUE MACKEY SCHEURER, 30205 Avenue Del Yermo, Cathedral City, CA 92234 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of chain link fence in rear yard LOCATION: 43-135 Delaware Street ZONE: R-1 (9,000) Mr. Alvarez reported that the applicant requests approval of a five-foot chain link fence which was installed without a permit. The fence is located along the common rear yard of two properties. In order for the applicant to obtain a permit, an exception to the City's code is required to allow the use of chain link fencing material in the residential district. It has been the City's policy to look at the individual aesthetic impacts caused by the fence and its visibility from public streets. In this case, the chain link fence is not visible from the public right-of-way, but is visible to the adjacent neighbor, and the adjacent property owner has objected to the use of chain link fencing and would like the fence to be replaced with either a block wall or a wood fence. The applicant has some vegetation in place to screen the fence, but the majority remains unscreened to both property owners. Staff recommends that the Commission deny the request and direct staff to approve a fencing material consistent with the City's Zoning Ordinance. Ms. Scheurer stated that a wood fence previously existed in the back yard, but was knocked down by falling tree limbs on two occasions. She hired someone to install the fence and thought he had pulled the permits, but apparently that was not done. If the Commission so desires, she would be happy to plant more Bougainvillea to screen the fence. Commissioner O'Donnell suggested painting the chain link fence a green color, and Ms. Scheurer indicated willingness to do so. 6 err/ *400 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES Commissioner Van Vliet was concerned about setting a precedent. Commissioner O'Donnell asked who is responsible for pulling permits, to which Mr. Finley replied that it is the property owner's responsibility. Chairman Gregory suggested installing a wood fence on the neighbor's side of the chain link fence in order to screen it from the neighbor's view, provided that the neighbor was willing to allow it. Action: Commissioner Urrutia moved, seconded by Commissioner Van Vliet, to grant approval of the chain link fence in the rear yard subject to the applicant installing a wood fence on the neighbor's side of the fence (contingent on the neighbor's approval) in order to screen the chain link from the neighbor's view. The motion carried 5-0. 7. CASE NO.: C 98-5 APPLICANT(AND ADDRESSy AMERICAN INVESTMENT GROUP/PALM DESERT LLC for PALMS TO PINES EAST SHOPPING CENTER, 301 Forest Avenue, Suite 200, Laguna Beach, CA 92651 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of revised final working drawings and landscape plans LOCATION: South side of Highway 111 east of Plaza Way ZONE: PC-3 Mr. Smith reported that this item was before the Commission at its meeting of June 22, 1999. At that time, the Commission questioned whether the working drawings were consistent with those given preliminary approval. Staff met with Susan Secoy and the architect of Rite-Aid, Michael Lorenz. The matter was before the Commission several times. The revised preliminary plans were approved March 9, 1999. The plan shown to the Commission on June 22, 1999 was a plan which had been rejected on February 23, 1999 (see minutes of February 23 and March 9, 1999). The applicant has provided the elevation from March 9, 1999 and the elevation 7 ARCHITECTURAL REVIEW COMMISSION JULY 13, 1999 MINUTES page from the current working drawing set. The elevations are substantially similar. Staff recommends that the Commission grant final approval of the working drawings. Commissioner Holden asked what happened to the horizontal mullions that were shown on the preliminary plans, to which Mr. Lorenz replied that they were inadvertently omitted from the working drawings. Commissioner Urrutia noted that the trellis material on the preliminary plan was steel, but is shown as stucco on the final plan, and Mr. Lorenz replied that he would be willing to change it back to steel. Action: Commissioner O'Donnell moved, seconded by Commissioner Van Vliet, to grant approval with the condition that the trellis structures be made of steel and that horizontal mullions be added on each side of the entry. The motion carried 5-0, with Commissioner Urrutia abstaining. 8. CASE NO.: C 99-6 APPLICANT (AND ADDRESS): ROMACORP, INC. 9304 Forest Lane, Suite 200, Dallas, TX 75243 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of signage and landscaping for Tony Roma's Restaurant LOCATION: 73-155 Highway 111 ZONE: C-1 Mr. Smith reported that the Commission previously approved the colors presented by the applicant, but a member of the City Council appealed that decision; so the color palette has been revised to reflect more muted tones, very similar to those used on the building at the southwest corner of Portola and Highway 111. Signage will be similar to that on the Island's restaurant in terms of the transitional color scheme from dark to light going from top to bottom, and the signage will consist of exposed neon channel with black exterior returns. The words "America's Rib Grill" will be regular channel 8 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES letters. Staff recommends approval. Commissioner Urrutia suggested limiting the tower signage to the north elevation only, and Commissioner Holden felt that the use of neon signage should be restricted to the north elevation. Chairman Gregory suggested that a channel letter wall sign be added to the east elevation at the north corner (in lieu of the tower sign on that elevation) and that it be similar to the proposed signage on the south elevation. Action: Commissioner Connor moved, seconded by Commissioner Van Vliet, to grant approval with the following conditions: 1) tower signage be limited to the north elevation; 2) delete tower sign on east elevation and substitute wall signage on east elevation at north corner to match the wall sign on the south elevation. The motion carried 5-0. 9. CASE NO.: SA 99-67 APPLICANT(AND ADDRESS)• U.S. SIGNS for AUTO ZONE, 5050 Poplar Avenue #1505, Memphis, TN 38157 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of signage LOCATION: 73-800 Highway 111 ZONE: C-1 Ms. Chafin reported that Chief Auto Parts is changing its business name to Auto Zone, and requests approval to change the signage at its 73-800 Highway 111 location. Existing wall signage consists of an internally illuminated can sign on the wall directly over the entry which measures 18 square feet and is 4'2" in height. The existing sign has four colors (blue, red, yellow and white) with no border area. The proposed sign is an internally illuminated can sign measuring three feet in height and 16 feet in length for a total of 48 square feet. The proposed sign will be centered over the entry and will have four colors (light tomato red, orange, black and white) with six- inch borders at the top and bottom. The other business in the center, 7- Eleven, is directly adjacent to the west and also has an internally illuminated 9 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES can sign. The colors of the proposed sign match those used in the existing 7-Eleven sign. The applicant also seeks to replace the face of the existing monument sign it shares with 7-Eleven with a sign using the same colors and basic design as the proposed wall sign. Staff finds that the proposed signage is consistent with the existing 7-Eleven sign and meets zoning requirements, and, therefore, recommends that the Architectural Review Commission grant approval of the plans as presented. Chairman Gregory recalled that landscaping was required and installed around the monument sign when it was originally constructed, but was subsequently removed. Commissioner Connor suggested that the words "Best Parts in Auto Parts" be deleted from the proposed monument sign. Action: Commissioner O'Donnell moved, seconded by Commissioner Urrutia, to continue the case to allow the applicant to submit landscape plans for the base of the monument sign and to resubmit plans for the monument sign which do not include the words "Best Parts in Auto Parts." The motion carried 5-0. 10. CASE NO.: MISC 99-14 APPLICANT (AND ADDRESSY MIKE FEDDERLY, 43-350 San Luis Rey Avenue, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of chain link fence LOCATION: 73-297 Grapevine ZONE: R-1 Mr. Smith reported that the chain link fence was constructed without benefit of a permit, and because it is located across the street from front yards of single-family dwellings, it is clearly visible from the public right-of-way; therefore, staff recommends denial. 10 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES Action: Commissioner Urrutia moved, seconded by Commissioner Connor, to deny the request because the fencing is across the street from front yards of single-family dwellings. The motion carried 5-0. 11. CASE NO.: PP 98-5 and TT 28818 APPLICANT (AND ADDRESS): MARRIOTT OWNERSHIP RESORTS, 6649 Westwood Boulevard, Suite 500, Orlando, FL 32809-6090 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of landscape plans and preliminary approval of clubhouse, villas and recreation area LOCATION: East side of Monterey between Frank Sinatra and Gerald Ford ZONE: PR-5 Mr. Smith reported At previous Architectural Review Commission meetings, the Commission granted preliminary approval for the maintenance and sales buildings. The current request is for preliminary approval of the clubhouse, guess common facilities building, villas and a children's facility building. The clubhouse/restaurant building sits on a pad 12 feet above the sales building. From the west (parking lot) it is one story in height and has a porte-cachere in front. From the east, (golf course side) the building is two stories in that the lower level contains the gym facility and the cart barn. Architecture includes a clay tile roof, columns and arches. Basically, it reflects many of the features in the sales building. The guest common facilities building houses guest check-in services. Architecture is similar to the clubhouse building with one story on the parking lot side and two stories from the golf course side. The west (parking lot side) elevation includes a porte-cachere. The first phase of the villa portion includes six, three-story buildings with height at the ridge of 36 feet (maximum unit height was approved at 36 feet). Three of the buildings are 1" shaped, while three are straight. Elevations are provided for the street side and golf course side of each building. The golf course side provides balconies with metal railings, while 11 ARCHITECTURAL REVIEW COMMISSION JULY 13, 1999 MINUTES the street side provides an exterior corridor access to each unit. The street elevation also includes a tower element housing the elevator shaft. Roof material is clay tile. The area at the north end of the Phase One villas provides the first recreation (pool) area. This area will include a one-story pool building and children's facility building. The clay tile roof concept continues and tower elements. Landscape plans have been provided for each of these areas. Eric Johnson has reviewed the plant pallet and his comments will be available for the Commission's consideration. The plans did not specify material locations or sizes; so a further preliminary submittal will be necessary. Staff recommends that the Architectural Review Commission grant preliminary approval. Action: Commissioner Holden moved, seconded by Commissioner Connor, to grant approval of the plans as submitted. The motion carried 5-0. 12. CASE NO.: CUP 89-4 APPLICANT (AND ADDRESS MILTON W. CHAMBERS ARCHITECT for HOPE LUTHERAN CHURCH, 44-267 Monterey Avenue, Suite B, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of revised preliminary plans for a church addition LOCATION: 45-900 Portola Avenue ZONE: P Mr. Smith reported that in 1989 as part of a Conditional Use Permit application, the City approved a phased expansion of Hope Lutheran Church at Portola and Fairway. Phase I was done several years ago. Recently the applicant completed the parking lot easterly to Lantana. The present request 12 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES is for preliminary approval of revised elevations for the sanctuary proposed on the west side of the site facing Portola and Fairway. The contemporary style stucco building is substantially similar to that shown 10 years ago. On the south side, a sunken garden has been eliminated, as has a basement. In the area of the sunken garden, office space has been added along with a 12-foot wide covered walkway which extends along the south side of the building. When this matter was reviewed in 1989, the height of the building was a critical concern. Ultimately, the City Council approved a building not of exceed 36 feet in height. The current plan shows the building at 36 feet, 11.5 inches and a tower element at 42 feet, eight inches. If the applicant wishes to exceed 36 feet for either or both elements, then the height will have to be reviewed and approved by the City Council. Otherwise, the plan will need to be revised to lower both elements. Staff recommends that the Architectural Review Commission grant preliminary approval, subject to the building height and tower height not exceeding 36 feet unless approved by the City Council. Mr. Chambers clarified that the basement and sunken garden were not part of the original approval, and explained that the reason for the change in height is that the pitch of the roof was modified to 30 degrees to accommodate the windows. Commissioner Urrutia suggested that parking lot tree planters be incorporated on the west side of the building. Commissioner Van Vliet was opposed to the height of the tower, and Chairman Gregory felt that it should be 36 feet. Action: Commissioner Connor moved, seconded by Commissioner Urrutia, to granted approval of the plans as submitted, maximum height 36 feet, 11 inches, subject to parking lot tree planters being incorporated on the west side of the building. The motion carried 3-2, with Commissioner Van Vliet and Gregory dissenting and Commissioner Holden abstaining. 13 ARCHITECTURAL REVIEW COMMISSION JULY 13, 1999 MINUTES 13. CASE NO.: PP 99-10 APPLICANT (AND ADDRESS): SELECT PROPERTIES, 18652 Florida Street, #200, Huntington Beach, CA 92648 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of revised preliminary plans LOCATION: 77-850 Country Club ZONE: PC-2 Mr. Smith reported Earlier this year, the applicant obtained City approval of a master plan of development for the entire 20.5-acre site. At this time, the applicant has submitted plans which cover a little over half of the site, specifically Buildings 7 and 8. The plans show a single-story, 26-foot high stucco building. The south elevation facing the street includes a series of shed roof(clay tile)sections, wood trellis sections and a main entry tower(30 feet) high toward the center to align with the main driveway. This elevation treatment is more contemporary than was shown to the Commission during the master plan review. The stucco will be a smooth finish. Colors have changed from those shown previously. A new sample board will be available for review. Staff recommends that the Architectural Review Commission grant preliminary approval. The second portion of the request is for a car wash on the southeast corner of the site to where a sit-down restaurant was originally proposed. Staff is concerned about a car wash use on this corner because there is not enough screening proposed. Commissioner Urrutia asked how far the car wash would be set back from Country Club Drive, to which Stefan Mudrey of Executive Car Wash replied that it will be 36 feet from the street, and the berm should hide most of the entry door to the washing facility, although it could be raised if necessary. Mr. Mudrey explained that the car wash is modeled after very successful facility in Las Vegas, and it will be automated so that patrons may drive through, and afterwards, they may stop if they wish to have their vehicle 14 ARCHITECTURAL REVIEW COMMISSION JULY 13, 1999 MINUTES vacuumed. Commissioner O'Donnell suggested that the 14-foot overhead door be screened, and Mr. Mudrey replied that the door could be lowered to 10 feet at the entrance, and once inside, the clearance would need to be 14 feet to accommodate the equipment. Commissioner Urrutia suggested moving the building back 10 feet further from Country Club and creating a wall with a trellis on top. Commissioner Urrutia noted that the plan could be flipped so that cars don't stack up at the entry, and added that the architecture of the car wash facility should conform more with that of the entire center. Rick Blomgren of Axcess Architects noted that the design of the center has been simplified to make the main tenant (Gold's Gym) more prominent. Commissioner O'Donnell felt that the trellises should have more structure to them in order to provide more shade. Chairman Gregory wondered why the trellis element on the south elevation is a mix of styles, to which Mr. Blomgren replied that the idea is to make the center appear more like a collection of small building rather than one massive building. Chairman Gregory noted that there is not much landscaping along the front of the building, and suggested adding more. Tom Doczi, the project landscape architect, stated that the landscape plan for the mini-storage area was just received, and landscaping will be incorporated into the front of the building. Along the walkway which connects the court, he is considering adding some cut-outs for trees. Commissioner Urrutia agreed with Commissioner O'Donnell that the trellis should serve more as shade devices rather than just decorative elements, and cautioned the applicant about the type of material used for the trellis, and noted that metal is a better choice than wood due to the area climate. 15 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES Action: Commissioner O'Donnell moved, seconded by Commissioner Van Vliet, to 1)continue approval of the proposed car wash to allow the applicant to make necessary revisions; 2) grant conceptual approval of the landscaping plan; and 3 ) grant preliminary approval of Buildings 7 - 10 with the condition that the trellises should provide more shade and not merely serve as an decorative treatment. The motion carried 5-0, with Chairman Gregory abstaining. 14. CASE NO.: C 98-6 APPLICANT (AND ADDRESSy T. MICHAEL HADLEY ARCHITECTS for ROBERT MCLACHLAN, DDS, 23042 Alcade Drive, Suite F, Laguna Hills, CA 92653 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of final working drawings and landscape plans for a dental office building LOCATION: 73-991 Highway 111 (southwest corner of Highway 111 and Portola) ZONE: C-1 Chairman Gregory reviewed the landscape plan and commented that Bougainvillea La Jolla grows too large for the area it is proposed, and suggested Crimson Jewel or Ooh La La as alternative. Chairman Gregory noted that Honey Mesquite trees lose all their leaves in the winter, and suggested replacing them with Chilean Mesquite. Commissioner Holden noted that the plans do not provide screening for the roof-mounted air conditioning, and suggested that individual screening be used or that the parapet be raised. Action: Commissioner Van Vliet moved, seconded by Commissioner Urrutia, ti grant approval with the following conditions: 1) substitute Crimson Jewel or Ooh La La for the La Jolla Bougainvillea; 2) substitute Chilean Mesquite trees for Honey Mesquite trees; 3) that the roof-mounted equipment be screened by raising the parapet or by using individual screening devices. CASE NO.: SA 99-64 APPLICANT(AND ADDRESSy ARCHITECTURAL NEON for THE ALLEY, 74-990 Joni Drive #3C, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of signage LOCATION: 72-240 Highway 111 ZONE: PC-3 Mr. Smith reported that the applicant sought approval from the City Council regarding a variance from the existing sign program at Waring Plaza in order to allow channel letters rather than reverse channel letters, and the Council granted approval contingent upon the Commission's approval. Mr. Wright commented that he would also like to change the proposed monument sign for the business, and presented a material sample . Action: Commissioner Holden moved, seconded by Commissioner Van Vliet, to grant approval of the proposed wall signage and monument signage. The motion carried 5-0. 16. CASE NO.: PP 98-13 APPLICANT (AND ADDRESS): WAYNE CARLTON CONNOR & ASSOCIATES/HOLDEN & JOHNSON ARCHITECTS for IMAGO GALLERIES, 44-267 Monterey Avenue, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of landscaping LOCATION: 45-406 Highway 74 ZONE: C-1 Mr. Drell reported that now that the visual impact of the building can be easily assessed, the need for additional large scale landscaping to mitigate the building's height and mass is apparent. On the south side, a cluster of W. Filifera or hybrids could be alternated with the cercidiums on the south side of the parking area. On the west side, one of the Washingtonian Robusta clusters should be replaced with Washingtonian Filifera to add more landscape mass or all the palms replaced by hybrids. If hybrids are required, a minimum trunk diameter should be specified in addition to heights. On the 18 ARCHITECTURAL REVIEW COMMISSION J U LY 13, 1999 MINUTES north side, a palm cluster could be added to the planter adjacent to the glass back room. While the adjacent parking lot contains ash trees, the narrow planters will result in a dwarf form and cannot be relied upon to provide the desired visual effect. The plan identifies three art sites which will play an important role in the final appearance of the plan. It would be useful to see the character of the initial pieces so that their contribution can be evaluated. Commissioner Connor stated that he has not had a chance to speak with his client about this issue. Action: Commissioner Urrutia moved, seconded by Chairman Gregory, to continue the case to allow the landscape architect to consult with the client.
