Ms. Chafin reported that the applicant proposes a monument sign for Lino's
Independent Mercedes Service, to be located at 74-875 Hovley Lane East.
The building is currently under construction.
The applicant proposes a double-sided sign which will be visible to traffic
traveling both east and west on Hovley Lane East. The sign will be located
in the landscaped area immediately east of the driveway, centered between
the sidewalk and the six-foot block wall which is to be constructed. Staff
recommends that the sign be located a minimum of 12 feet from the face of
curb to ensure the sign is located on private property rather than the public
right-of-way.
The proposed sign will be comprised of a split face block base and a double-
sided can sign encased in stucco. The block and stucco will be painted to
match the building. The can sign will be made of sheet metal, and internal
illumination will be provided with HO lamps (maximum 430 ma output). The
can will have a white background, and the letters will be a maximum of 10
inches in height in Mercedes' trademark blue color (sample available for
viewing at Tuesday's meeting). The sign will indicate the building address
at the top and read "LINO'S, INC. an INDEPENDENT MERCEDES
SERVICE."

The proposed monument sign complies with the requirements of the City's
Sign Ordinance. Staff worked with the applicant to design a sign that will be
integrated with the site according to the architectural plans previously
approved by the Commission, and finds the design aesthetically acceptable.
Staff recommends that the Architectural Review Commission approve the
plans with the following conditions:
1. Block (split face) and stucco, with color to match building color;
2. Sign located minimum of 12 feet from face of curb;
3. Monument sign maximum five-foot height and six-foot width;
4. Letter height maximum 10 inches; and
5. HO lamp output maximum 430 ma.
Commissioner O'Donnell felt that the proposed signage has excessive
verbiage, to which Rose of Lino's Mercedes replied by suggesting that the
street address be eliminated.
Chairman Gregory commented that his concern about the white background
is mitigated by the HO lamp output maximum of 430 ma.
Action:
Commissioner Connor moved, seconded by Commissioner O'Donnell, to
approve the sign with the following conditions: 1) block (split face) and
stucco, with color to match building color; 2) sign located minimum of 12 feet
from face of curb; 3) monument sign maximum five-foot height and six-foot

Ms. Chafin reported that the applicant proposes a non-illuminated wall sign
for Custom Designs in Wood, located at 77-690 Springfield Lane. The
business occupies both Suites A and B, which has a total of 150 lineal feet
of street frontage and faces south.
The applicant indicates that the sign will be located in the middle of the front
elevation, on the fascia above the blue color band, with the top of the sign
even with the height of the building address.
The proposed sign will measure 44 inches high by eight feet long for a total
area of 30 square feet, and as such, falls within the allowable square footage
pursuant to the City's Sign Ordinance. The sign will read "CUSTOM
DESIGNS IN WOOD INC," incorporating the business logo in the word
"WOOD." Bright blue colored PVC material is to be used, and the applicant
has provided a color sample which will be available for the Commission's
review at Tuesday's meeting.
The proposed signage meets the requirements of the City's Sign Ordinance,
and staff believes that the sign is aesthetically acceptable and compatible
with the surroundings.
Staff recommends that the Architectural Review Commission approve the
proposed sign, to be located in the middle of the front elevation, on the fascia
above the blue color band, with the top of the sign even with the height of the
building address.

Commission discussed at length various options with the layout of the
proposed sign.
Eric of Top of the Line Signs clarified that the applicant would prefer the text
to be located above the blue color band with the logo below the blue color
band.
Action:
Commissioner Vuksic moved, seconded by Commissioner Van Vliet, to
authorize staff to approve the revised plans over the counter with the
following conditions: 1) entire sign to be located in the middle of the front
elevation , with the blue color band around building to be incorporated into
the center of the logo element and the text to be located immediately above
the logo. The motion carried 6-0.

Ms. Chafin reported the applicant proposes to install three dome-shaped,
burgundy colored awnings at 73-255 EI Paseo, Suite 21. The property
faces north and is separated from the business to the east by a breezeway.
The storefront measures 20'6", and is thus entitled to 20.5 square feet of
signage.
The main awning is proposed for the entryway and will measure nine feet at
the highest point and will project 4'6" out from the building. The bottom 30-
inch portion of the awning is proposed to be in a "Cool Glo Ivory" color and
will feature the words "Randall Chase Gallery" in burgundy adhesive vinyl
letters with a maximum letter height of 12 inches. Pursuant to the City's Sign

Ordinance, the size of the proposed signage proposed falls within the
allowable square footage.
The business owner indicates that the main awning will serve to protect the
afinrork from sun glare which bounces off cars parked in front of the property
on EI Paseo, and during the summer, will protect the artwork from direct sun.
Two faded, scallop-edged awnings currently hang over the srnall display
windows on either side of the entry, and the applicant proposes to replace
them with two burgundy colored awnings which will not include signage.
Although the plans do not indicate dimensions, the colored rendering depicts
awnings which appear to be proportional to the main awning.
The proposed signage meets the requirements of the Sign Ordinance, and
staff believes that the awnings are aesthetically acceptable and compatible
with the surroundings.
Staff recommends that the Commission approve the plans as submitted.
Action:
Commissioner O'Donnell moved, seconded by Commissioner Connor, to
approve the plans with the condition that the bottoms of the three awnings
line up. The motion carried 6-0.

Mr. Alvarez reported that the applicant proposes changes in the business
identification signage at Vacation Inn, 74-695 Highway 111. Sign A will be
modified to add the words "& Suites"to the existing "Vacation Inn Hotel" sign.
This sign is located on the entry wall of the complex. The letters will remain
non-illuminated and will have a gold aluminum background.
Sign B will not be installed.
Regarding Signs D and E, finro sets of 11-inch reverse channel letters will be
installed on the porte-cochere and will read "Vacation Inn." The letters will
be green and will have a gold PVC background to the same height as the
letters to conceal the raceway. No access is available to eliminate the use
of a raceway.
Sign F consists of one set of individual channel letters over the porte-
cochere, and this will be removed. Sign G consists of a double-sided
monument reading "Vacation Inn," and this sign will also be removed.
The sign colors, location and sizes are acceptable and compatible with the
buildings, and staff recommends approval of the proposal as presented.
Action:
Commissioner Connor moved, seconded by Commissioner Van Vliet, to
approve the plans as submitted. The motion carried 6-0.

Chairman Gregory pointed out that the guard house has been moved further
back from the street at the City's request.

grant preliminary and final approval of the plans as presented. The motion
carried 5-0-1, with Chairman Gregory abstaining.

Mr. Smith reported that the plans were previously approved for a dental
office facility, and now the applicant indicates the use will be general office,

Mr. Smith reported that the working drawings are not in conformance with the
preliminary plans which the Commission previously approved. The main roof
line remains at 36 feet, but the tower elements are now proposed to be 40
feet and 44 feet, which is a height increase over the previously approved
plans. Staff finds the revised plans to be superior and would point out that
the pop out balconies provide more undulation to the building exterior.

Commissioner O'Donnell noted that the only height increase in the plan is
with the tower elements, and added that he finds the revised plans far
superior to the previously approved plans, with which Commissioners Van
Vliet, Connor and Gregory concurred.
Action:
Commissioner Lingle moved, seconded by Commissioner O'Donnell, to
recognize the working drawings to be significantly different from the
previously approved preliminary plans, and found them to be an
improvement over the previously approved preliminary plans, and granted
preliminary approval of the revised preliminary plans and final approval of the
working drawings. The motion carried 6-0.
9. CASE NO.: TT 29579

perimeter and typical landscape plan

Mr. Alvarez reported that the applicant received preliminary landscaping
approval for the perimeter and retention basin at the January 11, 2000
meeting. The project is a 16-lot, single cul-de-sac subdivision located at 73-
551 Hovley Lane East. The approval was subject to comments made by
Spencer Knight, the City's Landscape Manager. The plans have been
revised to incorporate the comments made by Mr. Knight. Mr. Knight has
reviewed the working drawings and has made a couple of minor comments
regarding tree and irrigation installation.
The applicant also requests approval of the typical landscape plans for the
three residential models proposed. The only concern staff has with the
typical landscape plans is the need for an additional 24-inch box shade tree
on each lot. The City requires a minimum of two, 24-inch box shade trees
per lot.

Staff recommends that the Commission grant final landscaping approval,
subject to the comments made by the City's Landscape Manager and a

10. CASE NO.: TT 29579

approval of 16 single-family residences
LOCATION: South side of Hovley Lane, 1500 feet west of Portola

Mr. Alvarez reported that the applicant's proposal will be a continuation of the
subdivision currently under construction to the east known as Sandpiper
Court. In May of 1999, the Commission approved two models, which
eventfully included front yard casitas/third-car garages. The current proposal
is referred to as Sandpiper Court West and will feature identical homes and
options (i.e., casitas/third-car garages) as those currently approved and
under construction to the east.
The previously approved homes included finro plans. Plan 1 totals 2,420
square feet, and Plan 2 totals 2,773 square feet. The units features concrete
tile, hip roofs and stucco walls with cultured stone veneer at the base. The
plans have entry tower elements with a maximum building height of 20'0".
The plans also include an optional 344 square foot casita or a side entry
third-car garage. The casitas/garages also feature concrete tile roofs, stone
veneer and stucco walls. The height of the casitas will be 13'6". The homes
meet the minimum setbacks required by the Planned Residential District.
Although the casitas and garages are not plotted on the lots, the developer
will bring each one back for staff review and approval.

As required on the previous approval, i.e., Sandpiper Court, the fascia
treatment and details on the front elevations are continued around the entire
structure. The casitas and/or third-car garages feature courtyard tie-in walls
and architectural detailing to match the residential structures. Stucco and
trim colors are acceptable.
Staff recommends that the Commission grant final approval of the plans as
submitted.

2. CASE NO.: PP 84-7 Amendment

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
11,492 square foot addition to an existing retail furniture store
LOCATION: 72-111 Highway 111
ZONE: C-1
Mr. Alvarez reported that the appficant requests approval to add 11,492
square feet to the rear of the existing Legacy Home Furnishings store. The
proposal includes a new parking lot in the rear as well as new access from
Rio Del Sol (Rancho Mirage) at the west end of the property. A new drive
aisle will also be created along the north side of the existing building,
connecting the front parking lot and the new rear lot.
Roof tiles, stucco color and finishes with match the existing building. The
new rear entrance will feature an entry element that mimics the existing front
entrance. The addition is compatible with the existing building and meets the
development standards of the General Commercial District. A landscape
plan will follow at a later date.
The building sits on the middle of the City boundary between Rancho Mirage
and Palm Desert. The structure is physically connected befinreen the two
boundaries. The applicant will require approval from the City of Rancho
Mirage to proceed with the project. Staff recommends that the Commission
require all mechanical equipment to be below the parapet walls and that all
existing exposed mechanical equipment also be screened, particularly along
the north side of the building.
Staff recommends that the Commission grant preliminary architectural
approval, subject to the condition that all existing and proposal mechanical
equipment must be screened.

Commissioner Vuksic sketched some modifications on the plans and
suggested that the elevations have line weights and shadows, and
recommended that a roof plan be submitted.
Commissioner Van Vliet indicated that he would like to see the whole project
presented instead of just half of the building.
Mr. Smith indicated that staff will review the matter with the City Attorney to
determine how much latitude the City has with regard to the other half of the
building.
Commissioner Connor felt that the Commission should at least be presented
with drawings which indicate what the proposed addition will look like with
the other half of the building as it currently exists.
Chairman Gregory requested that a landscape plan be submitted with the
revised preliminary plans.
Action:
Commissioner Connor moved, seconded by Commissioner Lingle, to
continue the case to allow the applicant to incorporate modifications
suggested by the Commission. The motion carried 6-0.

C. Miscellaneous
1. CASE NO.: RV 99-9

NATURE OF PROJECT/APPROVAL SOUGHT: Approval to park RV in
front yard
LOCATION: 77-260 Indiana Avenue

Ms. Chafin reported that the subject vehicle is a fifth wheel trailer 24 feet in
length, eight feet wide and eight-and-a-half feet high. The applicant would
like to continue to store the RV in the driveway. The vehicle is partially
screened on the side yard by a tree and a three-foot high Oleander hedge.
The applicant proposes to provide additional screening on the side yard with
more Oleanders. To screen the vehicle on the front yard, the applicant
proposes to plant 15-gallon Ficus or 24-inch box Carolina Cherry hedges.
To screen the vehicle from the street, the applicant proposes to install a vine-
covered cyclone gate or a wrought iron gate with a privacy screen.
The City's RV ordinance requires that recreational vehicles be substantially
(not completely) screened, and be aesthetically acceptable; so a judgment
call is required in this case. Based on the plans submitted and photographs
of the site, staff believes the recreational vehicle would not be substantially
screened.
Pursuant to RV ordinance requirements, staff mailed notices of this meeting
to property owners within a 300-foot radius of the subject property. Staff has
received no comments in response to the notices.
Staff recommends that the Architectural Review Commission deny the
request for approval to store the vehicle in the driveway because the
proposed plan would not substantially screen the vehicle.

Mr. Proulx indicated that the proposed plan incorporates a great deal of
landscaping to screen the vehicle.
Richard Westphal,42-960 Texas Avenue, spoke in opposition of the request,
and indicated that Palm Desert Country Club has had problems in the past
with people utilizing RVs as guest quarters.
Jodean Westphal, 42-960 Texas Avenue, spoke in opposition of the request
and expressed concern about setting an improper precedent.
Commissioner Connor was concerned that the RV would be located so close
to the street and felt that screening would actually create more of a presence
and overpower the streetscape.
Chairman Gregory suggested that Mr. Proulx try to store the vehicle
elsewhere on the site because otherwise it would be too close to the street,
to which Mr. Proulx replied that there is no viable alternative location on the
property. ,
Commissioner Lingle commented that he can empathize with the applicant
because he owns an RV and lives in the area, but indicated that he could not
support the proposal because of its close proximity to the street.
Commissioner Van Vliet acknowledged that this is a difficult situation, and
the applicant appears to have examined every alternative, but unfortunately,
there is no way to screen this vehicle in compliance with the existing
ordinance.
Commissioner O'Donnell concurred with his associates and suggested that
. the only viable solution is off-site storage since the vehicle simply will not fit
in the front yard area.
Action:
Commissioner O'Donnell moved, seconded by Commissioner Lingle,to deny
the request for approval to store the vehicle in the driveway. The motion
carried 6-0.

Ms. Chafin reported that the applicant requests approval for a permit for a
wall which has been constructed within the front yard setback at 76-971
Florida. The subject block wall measures five feet in height and is located
13 feet from the face of the curb.
The Zoning Ordinance requires front yard walls between four feet and six
feet in height to be located no closer than 15 feet from the face of curb. The
Zoning Ordinance authorizes the Architectural Review Commission to make
exceptions to these restrictions.
In touring the neighborhood, it is evident that many of the existing residences
have front yard walls in similar locations. Use of substantial landscaping
material serves to soften the appearance and mitigate the massiveness
created by the wall height.
This request is consistent with others granted by the Commission in this
area. Staff believes that this wall will not have a negative impact on the
surrounding neighborhood, and would suggest that the area in front of the
wall be substantially landscaped pursuant to the plan submitted by the
applicant.
Staff recommends that the Commission approve the request, subject to
implementation of the landscape plan as submitted.
Chairman Gregory commented that the proposed landscaping plan would not
work, and suggested putting vines on the wall, adding Lantanas, and
including a border.

Commissioner Connor suggested using Filiferas rather than Queen Palms.
Action:
Commissioner Van Vliet moved, seconded by Chairman Gregory, to
authorize staff to approve revised plans over the counter with the following
conditions: 1) that additional Lantanas be incorporated into the plan; 2) that
Filiferas be used instead of Queen Palms; 3)that vines be added to the wall;
and 4) that the plan reflect borders. The motion carried 6-0.
3. Appointment of ARC member to Zoning Ordinance Review Committee
(ZORC)
Commissioner O'Donnell volunteered to serve as the Architectural Review
Commission representative on the Zoning Ordinance Review Committee.
4. Recess and reconvene at Bighorn to view grading of four lots
Due to the lateness of the hour, the Commission did not recess and
reconvene at Bighorn to view the grading of four lots.
