Commissioner Van Vliet moved, seconded by Commissioner Lopez to
approve the minutes of August 26, 2003. The motion carried 5-0-1-1 with

Mr. Smith asked the applicant if they intend to take the existing black
background and replace it with a white background. Stan Swede,
representative for California Marquee, stated that they would like to use
black letters on a white background. Mr. Smith stated that they would
be going from a reasonably controlled light situation to one that has the
potential to be significantly bright. This signage is on the same wall as
where the existing signage is, which is between the two recently
constructed parking structures.
Commissioner Vuksic stated that the white background concerns him
because it really jumps out at you. The sign with the logo above it looks
a little tight. They might need to scale it down a little bit.
Mr. Smith clarified that the seven black rectangles that are shown on
the plans represent areas for the display of movie posters.
Commissioner Van Vliet commented that the poster cases look okay.
Commissioner Gregory stated that there is too much going on in the
space. The background doesn't have to be black and suggested that
they could possibly use brown. He asked if the letters for the signage
had to be a certain height from the ground. Mr. Smith stated that the
height is not an issue relative to an interpretation that was made many
years ago regarding averaging the height around the building.
Commissioner Van Vliet asked if the leaf portion of the signage is a can
sign. Mr. Swede stated that the outline of the palm frond will be a can.
He will not be using a box. He doesn't want to make the sign smaller
because there's no visibility other than to people who are already going
to the theater. The letters for the wording "Palme D'Or" will be 36" for
the "p" and 24" for the lower case letters. The word "Cinemas" will be
21" in height. This is a relatively small sign. Once it's put together it's
not going to be a very powerful sign.
Commissioner Van Vliet asked about the amount of clearance from the
parapet down to the sign and the area above the marquee sign. Mr.
Swede stated that there will be 12" above the marquee and
approximately 18" from the top of the parapet wall.

Commissioner Vuksic stated that the plans that were submitted are not
accurate. It looks much tighter on the plans than what the applicant is
stating.
Commissioner Hanson asked if the proposed marquee is any bigger
that the existing marquee. Mr. Swede stated that it's the same
marquee.
Commissioner Vuksic commented that he's not that concerned about
the size of the letters but the way that it appears on the surface. All he
can go by is the picture that was provided for the commission. It looks
like he's really packed it all on as tight as he possibly could. Mr. Swede
stated that there's still quite a bit of blank wall left and the signage fits
into the scope of the whole building. Commissioner Vuksic stated that
by looking at the exhibit that was given to him, it doesn't look like it fits
nicely proportionately on the surface on which they're mounting it. This
looks like it's too big for the surface.
Commissioner Hanson asked if the palm leaf is an integral part of the
logo. She suggested leaving the wording "Cinemas Palme D'Or" where
it is and adding a smaller sign over the main entrance with the palm
leaf. Mr. Swede stated that the owner would like to have the palm leaf
over the wording, as presented. He asked if he could scale it down by
20%.
Commissioner Gregory suggested reducing the size of the sign
proportionately so that it doesn't go beyond the edge of the marquee.
Mr. Swede thought that the owner could live with that idea.
Commissioner Van Vliet suggested adding a condition stating that there
should be 18" on the top border.
Commissioners Lopez and Hanson stated that sign can be approved at
staff level with the following conditions.
Action: Commissioner Lopez moved, seconded by Commissioner
Hanson for approval subject to (1) scale down signage so that the logo
and business identification signage does not exceed the sides of the
marquee, (2) provide a minimum of 18" on top border and 6" in
remainder, and (3) use black or dark brown background on marquee.
Motion carried 6-0-0-1 with Commissioner O'Donnell absent.

4. CASE NO.: SA 03-113
APPLICANT (AND ADDRESS): QUIEL BROS. SIGN CO., 272 S. "I"

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business
signage. Del Rio's Mexican Restaurant
LOCATION: 73-520 El Paseo
ZONE: C-1
On a minute motion by Commissioner Vuksic, seconded by
Commissioner Oppenheim the commissioner approved the sign subject
to having the curvature of the lower sign matching the radius of the arch
below. Motion carried 6-0-0-1 with Commissioner O'Donnell absent.
Mr. Smith stated that the representative for Quiel Bros. Sign Co. arrived
late for the meeting and would like to discuss the condition that was
placed on the sign by minute motion.
Scott, representative from Quiel Bros., stated that his art department
may have been a little bit "off' on their rendering. If they match the sign
to the existing curvature of the arch then they'll be changing the logo.
They already have several signs within the City that have been
approved and installed. What the commissioner is looking at is that the
sign needs to be centered and evenly spaced over the archway.
Commissioner Van Vliet commented that this is not what the
commission is suggesting. He asked the applicant why he can't match
the radius with the arch below. The applicant stated that it doesn't
match the pattern of the arch of their logos. Commissioner Van Vliet
asked if the sign is already made. The applicant stated that there are
already signs up in the City. Commissioner Van Vliet stated that he
understands that, but wanted to know if this particular sign has been
made. The applicant did not answer the question.
Commissioner Hanson stated that the arch is not the logo. Scott stated
that the sign itself is the logo. Commissioner Hanson stated the arch
on the sign should match the radius of the arch below. Commissioner
Van Vliet commented that the Doug Arrango's sign shown in the photos

matched the arch perfectly and it looked so much better. That's the
right way to do it and should be done that way.
Commissioner denied to reconsider its minute motion action.
Action: Commissioner Vuksic moved, seconded by Commissioner
Oppenheim for approval by minute motion subject to having the
curvature of the lower sign matching the radius of the arch below.
Motion carried 6-0-0-1 with Commissioner O'Donnell absent.
5. CASE NO.: SA 03-114
APPLICANT (AND ADDRESS): DAN HORN, P.O. Box 3958, Palm

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of wall sign
and monument sign for Hovley Gardens.
LOCATION: 74-510 42"d Avenue
ZONE: PR-7
Mr. Smith asked Ron Crisp, representative, how the letters are going to
be mounted on the wall. Mr. Crisp stated that they'll be attached with
screws. The letters are Y2" thick painted aluminum letters. They'll
space the letters approximately '/2" from the wall so that the signage is
on one plane. Commissioner Vuksic asked about the material that will
be used for the mountain ranges. Mr. Crisp stated that everything will
be made out of aluminum.
Action: Commissioner Oppenheim moved, seconded by Commissioner
Van Vliet for approval. Motion carried 4-0-2-1 with Commissioners
Hanson and Lopez abstaining and Commissioner O'Donnell absent.
Commissioner Hanson moved, seconded by Commissioner Van Wet to
add Case Nos. MISC 03-32 and MISC 03-29 to the agenda. Motion
carried 6-0-0-1 with Commissioner O'Donnell absent.

NATURE OF PROJECT/APPROVAL SOUGHT: Request approval of
peach/cream/gray roof the on single family residence.
LOCATION: 73-160 Guadalupe Avenue
ZONE: R-2 (7)
Mr. Smith stated that the applicant is re-roofing a single family home
and is requesting approval of the tri-colored roof tile. Photos of
examples of homes using the proposed roof tile were distributed for the
commission to review and a sample of the the was available.
Mark Christoph, representative for the applicant, stated that a structural
engineer signed off on the tile roof. Commissioner Gregory stated that
the house appears to have a really steep roof for this type of tile. Mr.
Christoph stated that there's a house with a similar roof pitch across the
street with a tile roof. Commissioner Vuksic commented that the roof of
the new Cuistot restaurant has a steep roof with tile. Commissioner
Hanson stated that they use metal ties to tie the tile in so that they stay
on a steep pitch.
Mr. Smith reminded Mr. Christoph that there's a fifteen day appeal
period on all ARC actions. It was recommended that he wait fifteen
days before he begins work on the roof.
Action: Commissioner Hanson moved, seconded by Commissioner
Van Vliet for approval. Motion carried 6-0-0-1 with Commissioner
O'Donnell absent.
7. CASE NO.: MISC 03-29

second unit at single family residence.

Mr. Smith stated that the request by the applicant is for a second unit at
an existing single family home in Avondale Country Club. The
association has approved the request. Under the new ordinance, this is
the only review this item will get. Under the previous ordinance, a
request such as this would require public hearings, legal notices and
Planning Commission review. The State precluded the City from going
through an extensive discretionary process. Now it's an administrative
process. Commissioner Hanson asked what constitutes a "second
unit". Mr. Bagato stated that a second kitchen on a property constitutes
a second unit. All second units will be reviewed by the Architectural
Review Commission. The Code states that the second unit can't be
more than 35% of the main house. The current proposal meets all the
setbacks. They have provided a covered parking space, which is
required. The plans meet all the criteria but it has to be reviewed by the
ARC to see if it compliments the house architecturally. Commissioner
Hanson commented that the second unit appears to match the main
house architecturally.
Mr. Smith stated that the proposed carport structure has not been
shown to the homeowner's association. Don Busk, representative for
the applicant, stated that he showed the HOA but he doesn't have
anything in writing.
Commissioner Van Vliet asked about the floor level of the unit. Mr.
Busk stated that it's at the same level as the main house. There will be
a stem wall and a planter box in front of the stem wall because it's on a
slight hill. Commissioner Van Vliet stated that the grade really goes
down towards the corner. Mr. Busk commented that he could add a
planter box at the front of the house or a 2:1 slope and blend it in with
the other slope that's there. The overall height of the second unit is
lower than the existing main structure (approximately 15'-16' in height).
Commissioner Lopez asked where the air conditioning equipment will
be. Mr. Busk stated that it will be behind the unit and won't be visible
from the street.
Commissioner Vuksic commented that he doesn't see a clear drawing
of a raised planter. Mr. Busk stated that the plans show a dirt berm.
Commissioner Vuksic stated that it won't look good if you plan to stucco
a couple of feet below the floor line. Mr. Busk stated that he'll put dirt
up against it at a 2:1 slope or add a planter in this area. Commissioner
Gregory stated that a 2:1 slope is really steep and it might be difficult to

keep the dirt from eroding. Commissioner Lopez suggested using a 3:1
slope. Mr. Busk stated that he could go 5:1 if that's what the
commission wants. Commissioner Gregory stated that he'll be more
successful if he uses a 3:1 slope.
Action: Commissioner Hanson moved, seconded by Commissioner
Oppenheim for approval subject to a landscape berm being added to
the front of the house at a minimum of a 2:1 slope. Motion carried 6-0-
0-1 with Commissioner O'Donnell absent.
