APPROVAL OF MINUTES: March 27, 2007 Action: It was moved by Commissioner Van Vliet, seconded by Commissioner Lopez, approving the March 27, 2007 meeting minutes. Motion carried 4-0-1-2, with Commissioner Gregory abstaining and Commissioners Lambell and Hanson absent. IV. ORAL COMMUNICATIONS V. CASES: A . ARCHITECTURAL REVIEW COMMISSION � MINUTES APRIL 10, 2007 A. Final Drawings: 1. CASE NO: RV 07-01 APPLICANT (AND ADDRESS): ISAAC SUAREZ, 43-570 Joshua Road, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Request final approval to allow parking of an RV on a side yard. LOCATION: 43-570 Joshua Road ZONE: R1 Mr. Stendell presented photos of an RV and a permitted gate that was constructed to screen it. The gate was attractive and should practically screen the entire RV. The neighbor has submitted a letter stating that he was okay with it and agreed to the increase in the fence height between the properties even though a few feet of the RV would still be exposed. Ms. Beverly Vorwaller, property owner in that neighborhood, was concerned with the number of cars parked at this address and felt that adding an additional vehicle would be detrimental to the entire neighborhood. She was concerned that the cars parked in the applicant's two driveways and on both sides of the street was over burdening the neighborhood. Mr. Isaac Suarez, applicant stated that he was a family member of 10. His mother currently lives at One Quail Place and when family comes to visit her, they park at his house and walk over. Commissioner Gregory stated that the number of cars would be a code enforcement issue and the Commission's charge would be to find ways to mitigate the mass of an RV that would be parked out in the driveway. They were looking at the possibility that the fence and gate would provide some means of concealing it. Ms. Vorwaller stated that she would be opposed to the approval of an RV in light of the fact that there were already so many vehicles parked there. She stated that the applicant has two driveways with at least 10 cars, a motorcycle and a Cushman, and adding a trailer to the mix would be too much. 'I ' .` ARCHITECTURAL REVIEW COMMISSION � MINUTES APRIL 10, 2007 Commissioner Gregory once again stated that the number of cars would be a Code Enforcement issue and the Commission reviews the request for proper screening. Ms. Vorwaller asked if they felt this was properly screened. Mr. Stendell stated that the two neighbors have discussed this issue and agreed to raise the fence between their properties by about 12 to 18 inches, and once the RV is behind the gate, Staff's opinion would be that it was screened sufficiently to the RV ordinance. Mr. Bagato stated that the decision was appealable to the City Council. Commissioner Van Vliet asked how high the fence would be. Mr. Stendell stated that the height would be 6 feet from the high side and a little over 7 feet from the low side. The current fence was 6 feet from the low side; so there would be an eighteen-inch deferential. Commissioner Vuksic stated that it was hard to make a decision because the photos showed the RV in front of the gate. Commissioner Van Vliet stated that there was a question whether it would be substantially screened or not and recommended additional photos be taken with the RV behind the gate. He asked how far the gate sits forward of the house and stated that it would look better if there was room to get the gate back further instead of it projecting towards the street. Mr. Suarez answered that it was 5 feet, but there may be issues with an existing storage shed. Action: It was moved by Commissioner Oppenheim, seconded by Commissioner Vuksic, to grant a continuance to allow Staff to photograph RV behind gate. Motion carried 5-0-0-2, with Commissioners Lambell and Hanson absent. CASE NO: MISC 07-08 APPLICANT (AND ADDRESS): DAVID NELSON, 72-595 Beavertail Street, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval for addition to existing house and garage with an exception on side yard setback towards the front due to an irregular shaped lot. LOCATION: 72-595 Beavertail Street ZONE: R-1 Mr. Stendell stated that the ordinance allows the Architectural Review Commission to reduce the side yard setbacks up to 25% for irregular shaped lots and in this case, the property line grows towards the rear of the property. The design of the addition was nice; therefore the intent of the exception would apply. Commissioner Van Vliet asked what the side yard setbacks were. Mr. Stendell stated that the total would be 14 feet with no side less than 5 feet. The applicant has approximately 16 feet combined total on the back end of the existing house and in the front the total would be around 13 feet. Mr. David Nelson, applicant stated that the average overall was over 7 feet from front to back on each side. The setbacks were being requested to keep the design looking nice and to avoid having a weird shaped house. Action: It was moved by Commissioner Vuksic, seconded by Commissioner Oppenheim, to grant approval. Motion carried 5-0-0-2, with Commissioners Lambell and Hanson absent. 3. CASE NO: MISC 07-09 APPLICANT (AND ADDRESS): KEN & DEBBIE STENDELL, P.O. Box 3352, Palm Desert, CA 92261 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of a side entry carport at 16 feet from the curb. The closest element is 16' with some architectural projections that would encroach beyond that and code allows up to 6' of encroachment. Using decorative stone material, they would be creating a new stone element for storage space, which would match the one on the carport. Action: It was moved by Commissioner Oppenheim, seconded by Commissioner Lopez, to grant approval. Motion carried 5-0-0-2, with Commissioners Lambell and Hanson absent. 4. CASE NO: PP 06-05/TT 34626 APPLICANT (AND ADDRESS): W.L. HOMES, LLC., dba JOHN LAING HOMES, 255 E. Rincon Street, Suite 100, Corona, CA 92879 . NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of town home units. LOCATION: 74-815 College Drive ZONE: PR This item was previously approved and a motion was made to withdraw from agenda. Action: It was moved by Commissioner Van Vliet, seconded by Commissioner Vuksic, to grant withdrawal of item from agenda. Motion carried 5-0-0-2, with Commissioners Lambell and Hanson absent. Preliminary Plans: 1. CASE NO: TT 33935 & TT 34391 APPLICANT (AND ADDRESS): PALM DESERT TERRACINA, LLC c/o Trans West Housing, Inc., 47-120 Dune Palms Road, Suite C, La Quinta, CA 92253 NATURE OF PROJECT/APPROVAL SOUGHT: Request preliminary approval of architecture of elevations for Kingston Court East & West and Imperial Court East &West. LOCATION: Tract 33935 at the intersection of Shepard Lane & Kingston Court East and Kingston Court West and Tract 34391 at the intersection of Shepard Lane & Imperial Court East & Imperial Court West. ZONE: R1 Mr. Stendell stated that at the last ARC meeting, the Commission reviewed tract homes for Kingston Court East and West and now the applicant was requesting an additional two 16-tracts on Imperial Court East and West. They were requesting addition of the same units to this second tract for a total of 64 homes located on two streets east and west of Shepard Lane; with nine unit types within the three plans. For the most part, they were responsive to the Commission's comments from the last meeting and modifications were made. Commissioner Vuksic stated that on Plan 3 — Italian Farmhouse there was a 12" wide leg on the tower that looked too thin for the mass that it was supporting. He suggested widening it on both sides by 6" making it 18" wide. Mr. Mark Longstaff, Representative for McKinley Associates stated that they stretched the tower up vertically and changed the egressed window on the side of the tower. It was rocked with the same material that was on the tower to give it the illusion that the tower was going to be a little bigger and a little grander than what it was. He felt that they could widen the tower because there was a bullet window in there now as opposed to an egressed window. Mr. Longstaff stated that they took two of the battered edges off and raised it up 3". He indicated that it was a two by fascia with a little foam pop out. He pointed out that the revised plans showed that the fascia was decreased by three inches. Commissioner Vuksic stated that the foam detail needed to be a little more in proportion and suggested decreasing the curve just a little. He noticed that there were several reveals around the windows and wanted to mention that the intent was not to create a band around the windows and recommended bringing it in closer. Mr. Longstaff stated that it was around 3 inches so they could nail on the window. Action: It was moved by Commissioner Vuksic, seconded by Commissioner Lopez, to grant preliminary approval subject to: 1) increasing the tower entry leg to 18" on Plan 3 - Italian Farmhouse; 2) reducing eave detailing on gabled roof element to an appropriate scale on Plan 1 — French Cottage; and, 3) subject to landscape review by Landscape Manager. Motion carried 4-0-1-2, with Commissioner Gregory abstaining and Commissioners Lambell and Hanson absent. 2. CASE NO: C 06-07 APPLICANT (AND ADDRESS): ROTHBART DEVELOPMENT CORP., 1801 Avenue of the Stars, Ste 920, Los Angeles, CA 90067. NATURE OF PROJECT/APPROVAL SOUGHT: Request preliminary approval of a PetSmart Store. LOCATION: 34-900 Monterey Avenue ZONE: PC-3 Mr. Bagato stated that this item should have been under the final side. He presented the construction drawings and the elevation appeared to be standard, however the roof plan changed from the preliminary and a door was added that wasn't shown previously. Commissioner Vuksic stated that it appeared a lot different from the preliminary plans. Staff is requesting a continuance to speak with their architect to make those changes.
