The meeting was called to order at 12:30 p.m.

III. APPROVAL OF MINUTES: January 9, 2007
Action:
It was moved by Commissioner Van Vliet, seconded by Commissioner
Oppenheim, approving the January 09, 2007 meeting minutes. Motion
carried 6-0-1-0, with Commissioner Lambell abstaining.

the garage was converted. She would like to get that approved, but
would need to get the carport approved first. Code indicates an
exception to this process to allow carports to be twenty feet from
the curb as long as they are designed to match the home
architecturally. This item was noticed to the neighbors and he
asked the neighbors to step forward.
Mr. Sam Flores, neighbor presented photos of the house and
stated that he opposed the carport. He stated that the homeowner
should concentrate on beautifying the outside of the home before
constructing a carport. If the carport were approved, in time
everyone would want a carport making the street look bad. He
stated that he had signatures from several neighbors opposing the
carport.
Commissioner Gregory asked if the applicant was putting up the
carport just to meet code. Mr. Bagato stated that was correct. She
would like to keep the converted garage as a bedroom, but to do
that she has to have two covered spaces. Commissioner Gregory
stated that it still conforms to the twenty-foot minimum setback from
curb face. Mr. Bagato stated that is what the ARC has been
approving, but Code indicates it is twenty feet from property line
which pushes it back even further. She didn't have enough room to
do it from the property line that is why she is coming to ARC to ask
for twenty feet from curb.
Commission discussed the carport architecture, style and
landscaping. Commissioner Gregory stated that the landscaping
would have to be done to conform to City requirements. Mr. Flores
was concerned that the homeowner would not keep up the
maintenance of the property. Mr. Bagato stated as a side note that
this matter was here because Code Enforcement was dealing with
the homeowner to fix up the property.
Commissioner Hanson stated that the architecture of this home
was very imposing with the pitch of the roof. If you actually had a
trellis on the outside of that with bougainvillea or something growing
on it, it would soften the look of the house from the street.
Commissioner Vuksic asked if this was the Commission's place to
judge this on the terms of aesthetics only or are we also thinking
about the distance from the street or would this be something the
Planning Commission would take up.

APPLICANT (AND ADDRESS): KRISTI HANSON, INC., 71-185

NATURE OF PROJECT/APPROVAL SOUGHT: Review of
architecture for hillside home.
LOCATION: 607 Rocky Creek
ZONE: R1
Mr. Stendell indicated that this was a hillside home with architecture
that would blend into the hillside with native colors.
Commissioner Lambell stated that she liked the way the house
settled down into the elevation change from the street.
Commissioner Van Vliet stated that it was well designed with nice
use of materials that would blend in with the neighborhood.
Action:
It was moved by Commissioner Oppenheim, seconded by Commissioner
Lambell, to grant approval. Motion carried 6-0-1-0, with Commissioner
Hanson abstaining.
2. CASE NO: MISC. 07-02
APPLICANT (AND ADDRESS): SHAWNA RISNES, 73-180
Catalina, Palm Desert, CA 92262
NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of
a new carport 20 feet from the curb.
LOCATION: 73-180 Catalina
ZONE: R-1
Mr. Bagato presented a request for a carport and stated that the
applicant was not in attendance. He stated that when the applicant
originally bought the house the garage was converted without a
permit. Code requires the applicant to have two covered spaces if

Mr. Bagato indicated that the Code states that reduced setbacks
could be approved by the Commission based on architecture merit.
It could be appealed by the City Council but it would not go to
Planning Commission.
Commission discussed the materials that were proposed for the
carport. Commissioner Van Vliet stated that he was concerned
about the execution of building the carport. He was afraid they
would use 4 X 4s and use all exposed brackets and it would look
awful. Commissioner Vuksic expressed his concerns about the use
of 2 X 8s for that span and wondered what it would look like in five
(5) years.
Commissioner Lopez felt it was strange to have a garage door
there with a trellis in front of it. They added on the building but left
the look of a garage door in front of it. Commissioner Hanson
stated that if you go down Haystack you would find five (5) or six (6)
of them.
Commissioner Vuksic stated that the elevation was different, it was
simple but pure and he could see another layer in front that could
actually be beneficial to the overall aesthetics of the house.
Commissioner Gregory asked how the applicant might be more
successful in her choice of materials. Commissioner Hanson
stated that it should be architecturally detailed.
Action:
It was moved by Commissioner Oppenheim, seconded by Commissioner
Lopez, to continue MISC. 07-02. Motion carried 7-0.
3 CASE NO: PP 05-12
APPLICANT (AND ADDRESS): TAYLOR WOODROW HOMES,
INC., 15 Cushing, Irvine, CA 92618-4200
NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of
Recreation Building, Alegria and Sonrisa product units; Spanish
Walk.
LOCATION: 76-000 Frank Sinatra Drive (former Emerald Desert
site)

Mr. Stendell stated that the elevations for the most part were on par
with what was approved in the preliminary drawings, except there
were roof drains and rain gutters on most of the units that were not
on the preliminary drawings. He indicated there were no problems
with the architecture and this was one of the new products where
everything would be energy efficient.
The Commission asked the representative why they were putting
these roof drains and rain gutters everywhere. Mr. Tim Day,
representative stated that this was a denser product, they are
closer with more restricted areas between some of them and they
were trying to protect some of that. He indicated that he wasn't
sure if it was absolutely necessary. Commissioner Hanson
suggested they put them only where it creates an issue over an
entry/exit door.
Mr. Stendell asked the Commission to review the plans for the
recreation center. He stated that the Commission never physically
saw a design for this building, however it is in the same style as the
other units.
Commission reviewed the elevation, roof drains and rain gutters.
Commissioner Hanson stated that the drains and gutters were not
needed everywhere.
Action:
It was moved by Commissioner Hanson, seconded by Commissioner
Lambell, to grant approval subject to: 1) limiting roof drains and scuppers to
entry/exit doors only; 2) review of landscaping plans by the Landscape
Manager. Motion carried 7-0.
B. Preliminary Plans:
1. CASE NO: PP 07-01
APPLICANT (AND ADDRESS): RENATA TYLER, LONG DRUGS,
141 North Civic Drive, Walnut Creek, CA 94596
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary
approval of a new 15, 785 square foot Longs Drug Store.

Mr. Bagato stated that Dennis Mitchem, representative requested a
continuance.
Kent Routh, representative from the Historic Preservation
Committee was in attendance and stated that the committee had
been involved with this property and also requested that this item
be continued. He informed the Commission that the Historic
Committee had been asked if this property had a historic
significance and it was determined that it did not. The item that
remains at issue is the old Palm Desert Lodge sign and what will
become of it. There will be a meeting on Tuesday to determine
whether or not the City will warehouse the sign.
Mr. Bagato stated that the Commission was not in favor of the sign
and keeping it would not match the architecture.
Mr. Dick Baxley, Baxley Properties, stated they would rather not
deal with the sign, but would discuss the issue with the committee.
Commissioner Gregory stated that this was a key corner and one of
the aspects of the current structure is that it was set way back from
the corner and "not in your face". If this new building would be laid
out to maximize the use of the site, the architecture should be up
several notches instead of a generic big box type of design.
Commissioner Hanson stated that what was needed was forms that
were interesting and probably different from what Longs is used to
doing, but that corner warrants it. She indicated that she liked the
awning type element and stated that more had to be done with it as
it relates to the architecture. She stated to Mr. Baxley to treat the
structure as a building and not a fa�ade. Mr. Baxley stated that he
would pass along this information.
Action:
It was moved by Commissioner Van Vliet, seconded by Commissioner
Hanson, to continue Case PP 07-1. Motion carried 7-0.

C. Miscellaneous Items:
1. CASE NO: MISC 06-46
APPLICANT (AND ADDRESS): KEITH SPARKMAN, 45-924
Abronia Drive, Palm Desert, CA 92262
NATURE OF PROJECT/APPROVAL SOUGHT: Review of
revised exhibits for a wall exception with a minimum setback of 12
feet from curb.
LOCATION: 45-924 Abronia Drive
ZONE: R1
Mr. Stendell presented revised drawings for a block wall exception
and discussed the type of gap in between each panel of wall.
Commissioner Hanson stated that if the walls were five (5) feet high
12-feet from curb and six (6) feet high 17-feet from curb there
would be about two feet between the walls.
Mr. Stendell stated that the wall would be six (6) feet high 15- feet
from curb leaving adequate room for the palm trees and an eight
(8) inch gap between the walls. The applicant inquired about the
type of material to be used and indicated he liked the look of the
modern precision block, but also asked about keeping it in the
same style as the slump block wall that is currently in the back of
the house on the side. Commissioner Hanson stated that it would
look fine using either slump or precision block.
Commissioner Van Vliet asked for clarification on the gap between
the walls. Commissioner Hanson stated that it would be a
minimum of eight (8) inches. Commissioner Vuksic stated the gap
should be four (4) inches. The Commission discussed the size of
the gap and the dangers of having a gap with the pool located near
the wall. It was suggested utilizing wrought iron panels or block to
enclose the yard.
Action:
It was moved by Commissioner Vuksic, seconded by Commissioner
Lambell, to grant approval of a block wall subject to: 1) five (5) feet high 12-
feet from curb, and six (6) feet high 15-feet from curb; 2) precision block or
slump block with a deep rake joint; and, 3) walls to include a separation no

larger than eight (8) inches utilizing wrought iron or block to fill in separation.
Motion carried 7-0.
NOTE:
Mr. Stendell presented Case PP 05-02/TT 34179/CZ 05-03, which he requested
to be added to the agenda. It was moved by Commissioner Lambell, seconded
by Commissioner Oppenheim, to add this item. Motion carried 6-0-1-0, with
Commissioner Gregory abstaining.

NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of
working drawings of a new three-story condominium complex;
Falling Waters.

Mr. Stendell presented the construction drawings and stated there
were no changes from the preliminary approval and no conditions.
Commission reviewed the elevations.
Action:
It was moved by Commissioner Hanson, seconded by Commissioner
Vuksic, to grant approval subject to landscaping and grading approval prior
to building permits being issued. Motion carried 6-0-1-0, with Commissioner
Gregory abstaining.
VI. ADJOURNMENT
It was moved by Commissioner Hanson, seconded by Commissioner Van Vliet,
to adjourn the meeting. Motion carried 7-0. The meeting was adjourned at 1:00
p.m.
