II1. ORAL COMMUNICATIONS
Ms. Jean Martin, residing at 44276 San Jose, Palm Desert, California, is in
attendance regarding the residence at 44277 Portola. The property owner at this
address, Mr. Otto Holta is requesting a permit for a six patient assisted living
facility, which is R-1 property. This building is presently under construction and
at this point has completely boxed her in. She explained that she can no longer
see sky or anything beyond her patio. The first door of the remodeled home
faces directly into her patio and two other doors face directly into her back yard
and now her privacy is gone. She asked if the Commission had reviewed this
project.

Ms. Grisa stated that this specific project was not reviewed by the Architectural
Review Commission (ARC) because it complied with all the standards of the
zone. Mr. Bagato stated that anyone can do a single family addition as long as it
meets certain requirements and is approved over the counter.
Ms. Martin stated that Mr. Holta did a tremendous amount of landfill. He brought
in monster trucks to fill dirt, not dump trucks. Her side of the wall is about five
and a half feet and she can see everybody walking on the other side of the wall
from shoulders up because he raised the elevation to build this. She felt that
since this will be a six patient facility it is no longer considered a single family
development as there will be patients and care-givers.
Mr. Bagato informed the Commission that Ms. Martin and staff are meeting later
to discuss this issue and explained that this is not something that the ARC looked
at and it is not treated any different than a single family home. He stated that Mr.
Holta is licensed through the state and they allow care of up to six people for
senior care, drug, or alcohol rehabilitation in a single family home. Ms. Martin
asked if it was allowed even if it has a high impact on the neighborhood because
it completely blocks their view of anything. She stated that she has lived in this
house since 1960 and hoped in retirement that she would finally get out into her
yard and do some gardening. She doesn't even open her shutters anymore and
stated that is an absolute disgrace.
Commissioner Gregory felt that the ARC was not the right group to help her and
said that staff could assist her. He asked if Mr. Holta was doing things that were
okay but are impacting Ms. Martin's life does she have any protection even
though it is legal. Ms. Lauri Aylaian, Director of Community Development said
that if it is completely within the zoning requirements then no. Essentially it is the
right of the individual property owner to develop within the zoning standards.
Ms. Martin felt that she doesn't come into consideration at all. Ms. Aylaian said
that as long as Mr. Holta is operating within the development standards for his
zone and as long as Ms. Martin is operating within the development standards for
her zone then neither one of gets to direct what the other does with their
property. Mr. Bagato reminded Ms. Martin of their meeting later in the day.
IV. APPROVAL OF MINUTES: Minutes for the July 14, 2009 meeting will be
reviewed and approved at the next meeting.

A. Final Drawings:
1. CASE NO: MISC 04-297
APPLICANT (AND ADDRESS): SOREN SAMUELSON, 74259

NATURE OF PROJECT/APPROVAL SOUGHT: Approval to add a
carport and entry tower to existing parcel.
LOCATION: 74259 Candlewood Street

Mr. Swartz presented the project and summarized the staff report.
He stated that this project is on the corner of Candlewood and
Abronia Trail and the code allows for older homes to have a carport
from 20 feet from the face of curb. He presented a site plan,
materials and photos of the home and stated that this was noticed
and asked if there was anyone in attendance in favor of or in
opposition. None was noted.
Commissioner Van Vliet asked if this was a garage conversion. Mr.
Swartz stated that it was. Commissioner Vuksic asked if there was
an issue with the setback. Mr. Swartz stated that the code allows
the carport at 20 feet from the face of curb.
The Commission reviewed and discussed the project. Mr. Bagato
stated that the code encourages older dwelling units to be able to
rehab the space and provide more room and bring it to ARC to be
reviewed.
Commissioner Vuksic asked about the materials. Mr. Wendell
Veith, Architect stated that it would be plain concrete block that will
be painted because he has other elements he is putting in a wall
across the front of the house and was trying to make it as simple as
possible to get the contrast with colors rather than with materials.
Commissioner Vuksic asked what material was being used for the
two supporting beams. Mr. Veith stated that they probably would
be glulams and the underside of the carport will be stucco. He
stated that they would keep the existing wood rafters with a wood
fascia but on the other side of the carport it would be stucco.
Commissioner Vuksic asked how he was connecting the glulams to
the rafters. Mr. Veith answered that there will be a six by six post
inside the pilaster. The pilasters are a decoration and not a

structural element. Commissioner Vuksic asked if there would be
any exposed connectors and Mr. Veith stated they basically would
be covered with stucco. Commissioner Vuksic stated that the
connectors coming up out of the block columns out to the glulams
should be knife-plated so they don't have a Simpson connector
sitting up there. Mr. Veith said that the wood beam will be sitting on
a six by six so they still could do a connector there. Commissioner
Touschner said that there isn't a pilaster there and asked what it
would be sitting on as it comes in to connect to the building. Mr.
Veith said he would put a column in the building wall and cut it into
the wall and re-plaster it.
Commissioner Touschner stated that architecturally they picked the
right element however there is a HVAC unit on the roof which
seemed odd because they are celebrating the entrance and doing
this pop up but not do anything to hide the unit. Mr. Veith said that
they could put an enclosure around the unit and tie it in
architecturally. The Commission discussed the size of the unit and
the enclosure.
The Commission discussed the column materials and the entry
way. They indicated that the drawings were not drawn correctly
and it doesn't look proportionate. They also discussed the
overhangs and felt there were some odd relationships in the plan
that may look odd when completed. Commissioner Vuksic hoped
that they think about that so they will have a substantial looking
entry tower that doesn't have cutoff eaves and thin walls.
Commissioner Vuksic stated that they could approve this with the
concerns regarding the detailing of the entry tower and that ARC
reserves the right to look at it in the working drawings and make the
applicant change it if the Commission feels that it's going to look
odd
ACTION:
It was moved by Commissioner Vuksic and seconded by Commissioner
Lambell, to approve Case MISC 04-297 subject to: 1) submitting working
drawings and detail of entry tower; and 2) screening of HVAC equipment.
Motion carried 4-1-0-1, with Commissioner Van Vliet voting NO and
Commissioner Levin absent.

2. CASE NO: SA 09-316
APPLICANT JAND ADDRESS): CHAPMAN'S FINE MENSWEAR
73-740 El Paseo, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of
new awning and signage; Chapman's Fine Menswear.
LOCATION: 73-740 El Paseo
ZONE: C-1 SP
Ms. Grisa presented this project and stated the request consists of
adding one new awning with the text Chapman's across the front
and to change out one small awning to the east to match the new
color and shape. Currently, there is not an awning over the main
entrance to the store. The proposed request would be to install a
new black awning with the text Chapman's sewn into the black
fabric with a light box behind for illumination at night. The form
underneath the awning would be curved rather than slanted. A
smaller red awning does exist to the east of the main entrance. This
awning would be replaced to match the adjacent black fabric and
new curved awning above the main entrance. No signage or
illumination is proposed on the smaller awning. Both awnings blend
well with the design and architecture of the building. The shape will
change from a typical slanted awning to one that is curvilinear in
form. Staff understands that the portion of the building with the red
slanted awnings that will remain will become a new tenant space to
be sublet by the building owner. The black awning color and curved
form will help differentiate one business from the other in a building
that was originally one. She informed the Commission that due to
an emergency the sign representative was not in attendance.
Ms. Grisa stated that staff would only recommend that any internal
braces are not seen from the side views as one walks down El
Paseo in either direction. Commissioner Touschner said that if
these awnings are painted black and the frame is black then it will
all disappear and that would help.
The Commission discussed the light box and said that it would
have to run all the way across because that will be supporting the
awning on the side walls. She said that as long as the underside
and the side coming up are dark then it would blend away. If the
box went all the way up to the frame you wouldn't get a little shelf
and it would be perceived as one element. Mr. Vuksic said that the
box didn't have to go end to end because then there would be a

mass at the end of the curved awning. Commissioner Touschner
said that you wouldn't see that because the awning goes in
between the building.
Commissioner Touschner stated that this is a typical detail and is
not matching some of the stuff on the front but it begs you to ask
what the connections look like. Commissioner Gregory stated that
all hardware should be discreetly hidden.
Commissioner Touschner made a motion for approval with the
following comments, that all underside brackets or any connections
are neatly done and are concealed, that the underside of the
canopy especially the one you are walking under has the light piece
continuous from wall to wall, and that it is all painted out black to
blend with the canopy with no shelf on top of the light box. Mr.
Vuksic stated that they should be neatly done but not necessarily
concealed. Most awnings don't have concealed connections, but
you can definitely tell the difference with the ones that have some
quality control to them. Commissioner Gregory stated that it should
then say neatly done as opposed to concealed. Mr. Vuksic asked
how that is policed and Commissioner Van Vliet stated that staff
would review the details.
Commissioner Touschner revised her motion
ACTION:
It was moved by Commissioner Touschner and seconded by Commissioner
Van Vliet, to continue Case SA 09-316 subject to: 1) all underside brackets
& connectors neatly installed; 2) underside of canopy with light piece to be
continuous from wall to wall and painted out black to blend with canopy; 3)
no shelf on light box; and 4) submitting installation shop drawings for
canopy. Motion carried 4-0-1-1, with Commissioner Vuksic abstaining and
Commissioner Levin absent.

The applicant is requesting to build a carport in the front yard of the
existing residence where there is currently not an existing garage.
The first submitted drawing illustrates the interior space that was
likely a garage previously and was at some time converted to living
space. Neither the City of Palm Desert nor the County of Riverside
has records of permits for such a conversion. The carport would be
designed to replicate a trellis at the top of the structure with stucco
columns designed and painted to match the existing columns at the
front of the house. The trellis feature above would be painted to
match the fascia of the existing house. Overall dimensions of the
carport are 16-10" across, 19'- 6-1/2" deep, and 10'— 1/2" high. The
structure would be held up by 4" x 4" posts and wood framed to
create a 10" x 10" column. Under Chapter 25.16.090C, R1 Single-
Family Residential District, City code states, "In order to encourage
rehabilitation of older dwelling units and to provide shaded parking
for vehicles, the architectural review commission may approve well-
designed carport structures with a minimum setback of twenty feet
to be measured from the curb face to the front edge of the carport
structure."
Staff recommends approval of the proposed carport design with the
conditions that the height of the overall structure is lowered to be
more in keeping with the style of the existing ranch home and the
garage is legally converted. Staff would require that both permits be
pulled simultaneously with building finals approved upon
completion of both the conversion and the construction of the
carport.
Mr. George Pejovic, applicant stated that he purchased the home in
April and the garage was already enclosed. He said that he
basically needs a carport because the sun is so brutal on his family
and the vehicle. He stated that the carport will be of quality
construction, freestanding and will match the facing of the existing
house. He asked about the approval of the garage. Ms. Grisa
explained that he will have to pull a permit for the garage to be
legally converted because it is not on file that it is permitted. Even
though he didn't do the changes someone else did and they didn't
pull a permit to legally convert it. She explained that the applicant
would have to pull a permit from Building and Safety and they will
send out an inspector to verify items that were done; electrical
being one of the biggest issues.
Commissioner Vuksic had concerns with this from an aesthetic
level and then from a construction level. He noticed that they are
using 2 x 10s and 2 x 8s to built the carport and was concerned
with how that will hold up over time. He felt that the 2 x 10s should

be 3 1/8 thick glulam beams and the 2 x 8 trellis members should
be 3 x 3 or even glulams as well. He was mostly concerned with
the height of it and it would look odd and expressed that it needed
to be in line with the eave. He noticed that the column detail is
different on the left elevation than the front elevation and thought it
looked better on the front elevation. He asked how they intend to
connect the beams to the columns and the trellis members to the
beams.
Mr. Gary Wagner, representative asked if he was concerned with
the beams themselves or their longevity. Commissioner Vuksic
said that he was concerned with them twisting. Mr. Wagner said
that the architect did all calculations and the weights so all the
construction part is fine. He stated that they would have no problem
using glulams and as far as the attachment to the posts any
brackets will be enclosed with stucco.
Commissioner Vuksic asked about the brackets above the stucco.
Mr. Wagner stated that they could use the heavy steel and stain the
wood a light brown wood color to match the existing overhang.
Commissioner Vuksic said that the exposed parts where there is
wood need to have concealed connectors, otherwise it will look
unfinished. Mr. Wagner said that it was designed into the hip.
Commissioner Vuksic couldn't tell from the drawings because they
didn't get into that and it is something that they need to think about
and take it to the next level and show how they intend to build it.
Commissioner Van Vliet agreed with the comments regarding the
structural members. It is really important to make it work; otherwise
it will twist like crazy. He expressed that beyond the materials he
had a problem with the way it sits out there that it won't enhance
the architecture of the house. Commissioner Gregory asked if it
would help if they dropped it so that it matches the fascia.
Commissioner Van Vliet said that it would help a little, but it still
would look odd. Mr. Wagner said that is why they went to an
architect so that it would meet the calculations for the structure and
Commissioner Van Vliet stated that it could meet all the
calculations and the beams would still sag and that is what they
don't want to have happen.
Mr. Wagner asked if the freestanding part of it is a concern.
Commissioner Van Vliet stated that it was a problem to him, but
that he is only one member of this Commission. Mr. Wagner said
that there wasn't a lot to work with there once the garage has been
closed off. Commissioner Van Vliet stated that it is unfortunate with
garage conversions because it backs you into a corner then you

add something out front that detracts from the architecture of the
house. Mr. Wagner thought that if the pillars look the same as the
entry and it is made of quality material and painted the same color it
would flow back in bringing the height down to what was
suggested.
Mr. Pejovic said that he doesn't have a lot of room to work with but
he wanted it to look nice architecturally. Commissioner Touschner
stated that nothing was going on top of the wood slats so it would
be open and she felt that they would not get the sun control they
are looking for because when the sun is high it will come straight
down through the trellis. Mr. Wagner stated that they are basically
looking for some shade not permanent cover. Commissioner Van
Vliet said that they will not get that much shade because you have
16 inches on center and right now they are 28 inches. There is a
lot of openness between them. Commissioner Vuksic suggested
beefing up the members to bring them closer together.
Commissioner Touschner said that because you have the
intermediate column he needs to be aware of what that will look like
when you open the car doors because chances are that
intermediate column is probably where you want to be opening your
doors.
ACTION:
It was moved by Commissioner Vuksic and seconded by Commissioner
Lambell, to continue Case MISC 09-288 to allow applicant to present
drawings that: 1) bring the height down; 2) incorporate glulams and
decrease spacing between cross members to create more shade; and 3)
conceal connectors. Motion carried 5-0-0-1, with Commissioner Levin
absent.

Ms. Grisa presented this project and stated that this revitalization
plan went to the City Council for a Study Session and they asked to
have the whole project put aside for now, but staff thought we could
get the conceptual approval of the whole design and then move
forward with the signage aspect of the project. These are plans to
unify the entire shopping district of El Paseo that will include
covering street poles, banners, and placement of signage at either
end that will identify the street so visitors can find it easily. The
landscape has been revised and paver patterns have been
proposed.
Mr. Bryce White, Redevelopment Agency stated that the Agency
has been looking at this project for a number of years. When we
first became involved with this the economy was different than it
currently is. The City Council reviewed this back in June and the
consensus was that they were concerned with doing the project at
this time because of the overall cost, however they wanted to move
forward with some of the improvements; in particular the signs.
More recently we have taken this before the Retail Committee to
have them review the signage which they have agreed with. The
project is proposed to return to City Council at the August 27tn
meeting so that we can go ahead and put it out to bid for the
signage portion. He stated that in the packet the Commission has
the overall project and he wanted them to see the entire project in
context. At the present time, they have no plans to do the balance
of the project and currently they are simply putting it on hold. The
project was envisioned to be done over several years in phases,
primarily in the summer time.
Mr. White indicated that the signage portion has four main
elements. The primary signage which is the beginning of the
district at El Paseo and Cabrillo is a large permanent art piece
reminiscent of an Ocotillo with the sign itself super imposed on it.
They are proposing secondary signs at Highway 74 and at San
Pablo to direct traffic up to El Paseo to make visitors aware of the
district. The third element of this package directs traffic once they
are on El Paseo. These will be banner type signs on existing light
signal standards. The fourth element is at the existing fountain
signs just to the east of Highway 74 and just to the west of Portola.
There are existing signs saying El Paseo that are somewhat
undersized for their location with trees overgrowing them and a light
standard in front of one of them. We have improved those and put
granite pillars on the backside to enhance their size and make them

more appropriate to the district. Finally, in the district itself they
would be putting a variety of banner signs at all the lights that have
existing signalized intersections with light standards; four banners
to an intersection.
Mr. White said that this is the package they will be presenting to the
City Council in August for the signage. The balance of the project
hopefully will be implemented in the future and asked the
Commission for their review and feedback at this time.
Ms. Grisa stated that if the Commission were to grant conceptual
approval we would have the signage come back for a final
approval. For example, on the primary signs on either end of El
Paseo it is showing it as an elevation view so we would want to see
how it connects to the strips and to see what it would look like from
all angles; particularly the one at Town Center Way and Cabrillo at
the other end. Commissioner Touschner thought that it would be
three-sided. Mr. White stated that it is a two-sided sign and he
listed the elements that the sign would be composed of.
Ms. Grisa asked how you would see the sign coming from El Paseo
going north since the sign is oriented east or west on Highway 111.
Mr. White said the sign will be oriented to Highway 111.
Commissioner Vuksic thought that made sense because a huge
majority of the people head east or west on Highway 111.
Commissioner Touschner felt there may be a problem with
reflection especially at night with the headlights and asked if any
thought had been given to that issue. Mr. White stated that the
metal portion will be the ribbons and the signage portion will be
painted. The ribbons are relatively narrow and the metal gives it
some kind of movement. They are not large broad areas to reflect
and will be more like a glitter element.
Commissioner Touschner discussed the size and height of the sign
and hoped that they did some studies in terms of the height and felt
that it was a bit too high. Mr. White said that this was designed for
traffic and from a pedestrian standpoint it is tall but from a traffic
standpoint you can see it at a distance. Commissioner Touschner
stated that as you are coming south you need a three-sided sign
because if it's straight you'll see it on Highway 74. Mr. White stated
the concern there is the limited median as far as the width of it and
part of this proposal is to slightly widen the median. Commissioner
Vuksic disagreed with a three-sided sign because it will add a lot of
bulk and he didn't understand why they would want to orient a huge
sign toward Cabrillo. He asked how much they would widen the
median. Mr. White answered that it would be approximately four

feet making the median six feet wide. Commissioner Vuksic stated
that he didn't have a three-dimensional feel for this sign at all and
said that they were showing one side of it and wanted to see what it
looked like from both sides. Mr. White said that they could bring
that back to the Commission.
Commissioner Vuksic was looking at the height of the sign and felt
that it was okay because this sign is for two miles of street and a
mile of retail and felt this was an important sign; unlike a sign on a
building or a monument sign. Mr. White expressed that this would
orient visitors to the valley and believes that this type of sign will
garner that attention. It is bold and will add an artistic element to
the street. Commissioner Touschner asked for a footprint of the
sign.
Commissioner Touschner asked Mr. White to review the base of
the directory sign along El Paseo because she felt that it doesn't
meet ADA because of the height and where it is located.
Commissioner Touschner wondered if there was enough room on
the sidewalk for the shade canopy. Mr. White said that they will not
be on the sidewalk. The kiosks as well as the shade structure will
be situated in bulb-outs, where they will bring out the sidewalk
approximately eight feet so as to not impede pedestrian traffic.
Commissioner Touschner noticed that a couple of these structures
line up exactly with the signage on the buildings, which will make
the retail individual unhappy. Mr. White said that they tried to
space them between buildings. Commissioner Touschner felt the
shade structures made good way finding and they might not
necessarily want every one of them to be the same; maybe
numbered differently or a different color. Mr. White said they are
proposing to put numbers on the light standards for that function.
Another benefit of the bulb-outs, particularly the shade structure is
for the courtesy carts to have a place to stop so visitors can find
them.
Mr. White stated that they were also proposing retrofitting all the
existing sign elements to coordinate them to the street.
Commissioner Lambell asked if this was a part of this review and
Mr. White said that it was only the signage they are going in with
now, but it is part of the project and asked the Commission to
review and approve so staff will know they are headed in the right
direction. At the present time, we are recommending to the City
Council to move forward with the signage portion.

Commissioner Vuksic felt that granite pillars behind the existing
signs could be more interesting. He said that the solution doesn't
relate in any way to the existing sign and he thought you could
have it serve as a backdrop which is its function and incorporating
angled lines to mimic the existing sign with the columns being more
rectangular. He suggested that they all be trapezoidal and each
one a little different; maybe three and not five. Commissioner
Touschner felt that the night shot looked better than the day shot
with the contrast and her thought was that it not be too elaborate so
as not to compete with the art, but it does need something because
it is almost too simple right now. Mr. White stated that they could
bring back drawings with the different trapezoids or it leaning
outward. Commissioner Vuksic stated that the angles should be
subtle to distract from the straight lines.
Commissioner Gregory asked staff what they were looking for from
the Commission. Mr. Bagato stated that staff is looking for
conceptual approval so they can go to City Council to move forward
with the signage at this time. This would be a conceptual approval
with the understanding that they bring it back again with more
details on the actual design of the signage.
Commissioner Vuksic said that the informational kiosk maps need
to be reversed in the direction you are looking. He also touched on
the number of banners and felt that since they were so far apart he
wondered if they needed to have more. Commissioner Touschner
stated that they have to be careful that it doesn't get cluttered. The
signs right now are very delicate and you need to be careful with
too much happening there. The Commission discussed the amount
of banners and flags and Commissioner Gregory stated that the
quantity they have proposed feels comfortable.
Commissioner Vuksic wondered how much shade the shade
structures would provide on the north side of the street. Mr. White
stated that the shade structure is rectangle with an oval canopy
with four seating areas so people should be able to sit on the
shaded side. Commissioner Vuksic pointed out that they need to
make sure they detail the light under the seat where it is tucked up
and under so that at a distance you wouldn't see the bulbs.
Commissioner Touschner felt that a public gathering place would
help El Paseo hugely because it is a really long street and
wondered if there was an opportunity to have a piazza somewhere
with music, vendors, seating and shade. Mr. White said that the
only way they could do that was to take an existing property and

convert it for that purpose, but along the street itself there is really
no space to do that. He pointed out that there will be some slightly
larger pop-outs in some locations.
Commissioner Touschner mentioned that they need to have trash
containers near the seating areas.
ACTION:
It was moved by Commissioner Touschner and seconded by Commissioner
Van Vliet, to grant approval of conceptual drawings with comments to be
addressed as a part of the final drawings review: 1) submit 3-D of signage;
2) submit footprint of project; 3) check into the ADA requirements for the
base of directory signage; 4) kiosk/shade structures should not obstruct
building signage; 5); kiosk light should be tucked up and under the seat and
detailed correctly; 6) the way-finding signs need to tie into existing El Paseo
signage; 7) information kiosk maps need to be reversed — in the direction
you are looking; 8) seating areas need to have trash cans; 9) create angled
backdrop to correlate to the existing fountain sign design; and 10) Robusta
palms may be a potential issue blocking cross views. Motion carried 5-0-0-
1, with Commissioner Levin absent.
