Action:
Commissioner Levin moved and Commissioner Van Vliet seconded, to
approve the December 14, 2010 meeting minutes. Motion carried 6-0-0-1,
with Commissioner Touschner absent.

A. Final Drawings:
1. CASE NO: MISC 10-291
APPLICANT (AND ADDRESS): EGG & DART, LTD, Steven Love,
74-050 Highway 111, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of a
fa�ade renovation, architectural improvements for Egg & Dart, Ltd.
LOCATION: 74-050 Highway 111
ZONE: C-I S.P.
Mr. Swartz presented the project and said this came before the
ARC in September. The Commission recommended that the
applicant provide accurate architectural plans, submit details of A/C
units on the roof, submit cut sheets, provide dimensions on
parapet, show ADA path of travel for trash enclosures, and study
storefront entrance along the parking lot. Mr. Swartz presented a
PowerPoint presentation of the existing building. He pointed out a
proposed gate across the entrance and explained that it is a rolling
gate. He said that on the previous drawings there were arches and
per the Commission's direction it is now flat and the parapets on
the back have been raised.
Mr. Steven Love, Architect addressed the concerns expressed by
the Commission at the previous meeting regarding the doors facing
west. They have decided to inset the doors into the building so that
when the doors are open they won't stick out over the sidewalk and
interfere with public access. Another concern was the parapet
height being adequate enough to hide the A/C equipment. He
pointed out that the units are 36" high and the parapet height will be
58" high.
The Commission discussed the ADA parking and the ramps
provided for path of travel. Mr. Swartz stated that one of the
conditions placed on the plans from Public Works was to update
the current ramps to meet ADA requirements.

Commissioner Levin and the applicant discussed the proposed
sliding gate. Mr. Love stated that it would slide the entire length,
divide up in sections and stack on the right side of the building.
Commissioner Levin suggested that the applicant submit additional
information on the gate.
Commissioner Vuksic had concerns about the overall design of the
building and felt that a building can be any style as long as it is
done well. He said that to have several horizontal joints with what
is essentially almost like a shoe box and a cornice on top doesn't
pass the standard of good design. He explained that this is a tough
style to do and would have to have different components where
different architectural elements were interacting with each other.
He felt that this building would be something they would review for
the industrial area not on Highway 111. Mr. Love stated that the
horizontal members are taken from the Ralph Lauren buildings
around the world and are mimicked on EI Paseo. Commissioner
Vuksic stated it is a nice detail but this building needs more than
that. He said looking at the east elevation he is bothered by it
because it is a huge opening and on the drawing there are no
shadows, which make the building look flatter. On the west
elevation there is very little there to grab onto as far as architecture
merit and suggested breaking the building up into more pieces. Mr.
Love stated that the windows and doors are probably set in 8 to 9"
into the building with profiles that stick out about 5" to create
shadow. Commissioner Vuksic said that may help and asked him
to emphasize that in his plans. He said even if they are recessed a
little this building needs more work on the massing.
Commissioner Levin stated that the perspectives do not match the
building and stated that it was hard for the Commission to make
decisions when there are conflicting exhibits. He asked if there was
enough distance for the gate on the east side to fully open and is
the height of the gate going to conflict with the awning over the door
Mr. Love said that it wouldn't be a conflict and stated that the gate
would stack and be offset like a sliding glass door. He pointed out
the plans for the gate. Commissioner Levin discussed the tracking
system for the gate and recommended that the applicant submit
more detail on the gate and the equipment.

Commissioner Lambell agreed that the east side of the building
needs more architectural merit, as well as the west side. She
requested a rendering that includes the columns. Mr. Love stated
that he would submit photos of the Ralph Lauren building for review
and pointed out the elevations on the drawings. Commissioner
Vuksic stated that this is a stand-alone building and as you go
around the corner you have broad sides with very little architecture
that would make it acceptable for Highway 111. Mr. Love stated
that they will display their product in the windows which will play as
art work on the sides of the building. He explained that they do not
sell architecture or design; they are a private showroom that is only
accessible to architects and designers and not open to the public.
He reminded the Commission that at the last meeting two months
ago, they did not have a problem with the horizontal lines so they
moved forward with that design concept. He stated that this is
timeless classic architectural design.
Commissioner Stendell stated that he liked the original plan that
was submitted, and was under the impression that the applicant
would enhance the drawing to better correct the design. He stated
that even though Ace Hardware is boxy and vertical with this being
next to it, it changes the design. He was hoping for something
along the line of what was submitted previously. Mr. Love stated
that the other looked more like a warehouse. These horizontal
lines are actually indentations that will cause shadows in the
building and is what is seen on the storefronts on EI Paseo.
Commissioner Van Vliet and the applicant discussed the columns.
Mr. Love stated that the columns protrude out from the building 5",
are made of wood and have a flat base. Mr. Swartz presented
internet photos of this type of building and the Commission
reviewed. Commissioner Van Vliet thought they may be creating a
maintenance problem with the wood columns here in the desert.
Commissioner Lambell asked if the material of the columns in the
photo was stone and Mr. Love stated that it would be wood or foam
stuccoed. He stated that the maintenance issue could be valid and
may be swapped out.

Commissioner Van Vliet asked about the planter on the roof that
goes all the way around and Mr. Love said they are considering
putting some greenery at the top that may hang down on the three
sides, similar to The Vintage and The Lakes. Commissioner Van
Vliet suggested this be reviewed by their landscape architect.
Commissioner Van Vliet stated that the lower parapets look like
they are narrower coming into the upper building and not flushing
out on the exterior walls. Mr. Love stated that the parapet on the
west side does flush out, but the crown on the top hangs over so it
makes it look like there is a jog in that wall. On the east side the
building actually sits back farther than the other building and that is
where the gates are set.
Commissioner Levin asked if the power pole on the back side could
be relocated and Mr. Love stated that Edison said they could move
it the east and go underground; underneath Portola and then back
to their building.
Commissioner Vuksic and the applicant discussed the A/C units
and access to them. Mr. Love explained where the units would be
located and as part of their look, this will be an open truss system.
Commissioner Vuksic asked the applicant to submit specifications
on the air conditioning units and to ask their A/C consultant about
how the units will work with the open truss system.
Commissioner Lambell moved for a continuance and Commission
Vuksic seconded. Ms. Diane Hollinger, Landscape Specialist
stated that the landscape plans did not show any plantings on the
roof and felt that there was not enough room for their growth. She
suggested that he show the plants on the roof plan. Commissioner
Van Vliet called for the vote.
ACTION:
Commissioner Lambell moved and Commissioner Vuksic seconded, to
continue Case MISC 10-291 subject to: 1) add more massing to the
building; 2) add more architecture elements on the east side of building; 3)
submit detailed drawings and specifications of gate, 4) submit color pallet to
include colors other than white; and 5) submit specifications of A/C units.
Motion carried 5-0-1-1, with Commissioner Gregory abstaining and
Commissioner Touschner absent.

2. CASE NO: MISC 11-05
APPLICANT (AND ADDRESS): KEN KURTZ, 74-935 Fairway
Drive, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of a
single-family home to increase the allowable lot coverage from 35%
to 36%.
LOCATION: 73-381 Haystack Road
ZONE: R-1 10,000
Mr. Swartz stated this is a vacant lot and is zoned R-1, 10,000
zone. Currently in that zone you are allowed a maximum building
coverage of 35% and the applicant is increasing it 1.2% for a total
of 36.2%. This house meets the height of 15' and also meets the
front, side and rear yard setbacks. The front landscaping is at
3,000 and the applicant will need to submit a full calculation of the
landscaping for the front. If it is over 5,000 he will have to submit to
CVWD.
Mr. Ken Kurtz, applicant stated that he wanted to build this a hair
bigger because the floor plan fits beautiful on the lot. It is the last
house on the street and will not impact anyone in any way, shape
or form. He described the plans and the 24" overflow culvert in the
back alongside his lot and stated that he will be building a little wall
there that will divert any overflow from his property to the street. He
expressed his concern about the request from Public Works to build
a sidewalk and the grade of his driveway.
The Commission reviewed the plans and discussed the drainage
easement and proposed walls. Commissioner Van Vliet liked the
design of the house and said that it will not impact the neighbors
and moved for approval.
ACTION:
Commissioner Van Vliet moved and Commissioner Vuksic seconded, to
grant approval subject to landscape approval. Motion carried 6-0-0-1, with
Commissioner Touschner absent.
