Action:
Commissioner Van Vliet moved and Commissioner Levin seconded, to
approve the February 22, 2011 meeting minutes with minor changes.

A. Final Drawings:
1. CASE NO: MISC 11-91
APPLICANT (AND ADDRESS): PERMITS TODAY, 140 S. Lake Avenue,
Suite 223, Pasadena, CA 91101
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of storefront
remodel and signage; True Religion.
LOCATION: 73-515 EI Paseo
ZONE: C-1
Mr. Swartz presented the project and said the applicant is redoing two
awnings and adding signage. Staff talked to the applicant because there
was too much signage and recommended they remove the signage from
the awning and keep the blade sign. He stated that the awning is being
upgraded and presented photos of the existing storefront. Existing frames
are being used and the signs will be illuminated.
Commissioner Touschner asked about the arched entryway and Mr.
Hyron Warren, Director of Store Development, said this is the existing
entryway and it sets back from the storefront; like an alcove. He pointed
out that it is more like a funnel; 14' down to 10'.
Commissioner Lambell asked how tall the letters were and Mr. Warren
said the height overall is about 2'-11", which includes "True Religion" and
"Brand Jeans". She asked for the measurements from the top of the arch
to the bottom of the soffit and Mr. Warren said it is 3'-1" from the top of the
arch to the underside of the bulkhead. Commissioner Lambell said there
has to be a little more relief between the top of the sign and the top of the
arch. Mr. Warren suggested increasing it from 3"' to 6"; top and bottom.
Commissioner Touschner asked him to reduce the pinch point and it
would look better. Commissioner Touschner asked the applicant to show
the return on the sign on the east side to be aligned with the front sign.
ACTION:
Commissioner Lambell moved and Commissioner Levin seconded, to grant
approval subject to: 1) showing a 6" relief top and bottom on arch for
signage; 2) show return on the east side sign to be in line with the arch; 3)
removing signage from awning; and 4) return to staff for review and
approval. Motion carried 6-0-1-0, with Commissioner Vuksic abstaining. .

B. Preliminary Plans:
1. CASE NO: MISC 11-58
APPLICANT (AND ADDRESS): KIMLEY HORN & ASSOCIATES, INC.

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of a
new restaurant and signage; Red Lobster.
LOCATION: 72-291 Highway 111
ZONE: P.C.-3
Mr. Bagato presented the project and summarized the staff report. The
applicant is requesting preliminary approval of a new Red Lobster
restaurant located on the northwest corner of Fred Waring Drive and
Highway 111. New handicap parking stalls will be provided for in front of
the proposed restaurant. A preliminary landscape plan has been
submitted for review and has received preliminary approval of the plant
pallet and design concept. The building is designed as Cape Code style
architecture. The building signs are located on the north, east, and south
elevations of the building. The sign submittal also includes vinyl letters that
will be placed on the windows. The south sign facing the interior parking
lot will be a 24 square foot red channel shaped lobster critter. The east
sign facing Fred Waring Drive, totals 50 square feet and is designed as a
cabinet with channel letters attached to it. The panel will be non-
illuminated and the letters will be individually illuminated. The edges of the
cabinet are sealed so that no interior light will be exposed other than the
individual letters. The north sign facing Highway 111 is designed as 24"
individual letters totaling 34 square feet. The proposed design and
signage complies with all the development standards of the zone. Staff
believes that the materials being used and the forms of the building will
provide a well-designed restaurant for the corner of Fred Waring Drive and
Highway 111. The project will require approval of a Water Quality
Management Plan before any building permits are issued for the project.
Color and material boards were presented for the Commission's review.
Mr. John Keen, Site Development Manager, pointed out on the sign facing
Highway 111 will only have letters spelling out Red Lobster and will not
include the lobster critter as shown in the plans. The Commission
reviewed and discussed the signage on Highway 111 side and suggested
they add more signage to that elevation.

Commissioner Touschner discussed the HVAC units and said they cannot
be visible. This restaurant will be right at the corner and the units will be
seen from all possible angles. Mr. Keen said they will work with staff to do
some sight line studies. He said the way A/C units are now being
designed it does create some issues, but they will review and bring back
changes. Commissioner Vuksic suggested individual screens to blend in
with the architecture as opposed to raising the parapets and Mr. Keen said
that would work better for them. Mr. Bagato stated that he will work with
the applicant on the line of site studies and discuss screening options.
Commissioner Touschner discussed the landscaped area on the corner of
Fred Waring and Highway 111 and suggested they plan for public access
in that area. Ms. Melibe Thomas, Kimley Horn & Associates, stated there
will be a storm water retention basin in that area so there won't be the
ability for the public to cut through. Mr. Bagato stated they will be
dedicating a right turn pocket in that area so the landscaping will change.
Commissioner Vuksic had some concerns with the back of the building,
which faces Highway 111. He felt that it still looks like the back of a
building and thought they could add some windows along that corridor to
add some interest. He also felt that signage was important on that
elevation; something that will pop.
The Commission reviewed and discussed the towers and Commissioner
Vuksic suggested they extend all roof forms further back onto the main
roof with the overall roof width matching the entry. He also suggested that
the taller parapet on the right elevation extend past the building about 6',
which might also help with equipment screening.
The Commission reviewed and discussed the egress door and the
mechanical door on the right elevation. Commissioner Touschner pointed
out that the mechanical door faces the corner of Fred Waring and
Highway 111 and suggested they hide both of the doors or move them.
She stated this is a very prominent corner and the doors will stick out.
She suggested that it be painted to blend in with the architecture and add
a canopy piece to provide interest. She stated that if these doors were
along the service corridor this conversation would not be taking place, but
it is at the corner of a major intersection. Commissioner Stendell
explained that if the mechanical door is for the main switch gears and fire
riser they will have bold lettering on them. Commissioner Touschner
pointed out that the applicant realized that the trash enclosure needed to
be screened and feels that the mechanical door needs the same kind of
treatment. Commissioner Vuksic said that since there is a lot of room on
that corner they could add a well-designed screen wall to add another

layer/dimension to completely hide the doors. The applicant said he
would rather do it with landscaping and Commissioner Vuksic said the City
tries to stay away from landscaping as a solution because landscape dies
and never gets replaced. Commissioner Stendell suggested to shed off
the side of the building and create a utility closet on the axis to the trash
enclosure and put it in the alley way. He suggested a 4' x 20' pop-out
shed with a pair of double doors. Ms. Thomas suggested they submit a
rendering of the doors with landscaping and an awning for staff review.
Commissioner Stendell made a motion to continue stating there were
several major areas of concern that need to be addressed and
Commissioner Lambell seconded. Commissioner Gregory asked for any
further comments and Commissioner Levin mentioned the handicap
parking wouldn't work and pointed out that if you come in off Fred Waring
there is no way to make the turn and get in the parking space.
Commissioner Van Vliet asked them to pay special attention to the HVAC
units on the roof and make sure they screen it and that it works with the
architecture because it is so visible up there. Commissioner Vuksic
reiterated his suggestion to add about 10' of windows on the right
elevation, right of the egress door to help that corner.
Commissioner Lambell said they are thrilled that Red Lobster is coming to
the City of Palm Desert and the Commission wants to make it work for the
applicant and for the City. She urged them to go back with these
suggestions and not automatically dismiss them, because it is going to
work.
Ms. Diane Hollinger, Landscape Specialist pointed out that they cannot
move trees to make room for their signage.
ACTION:
Commissioner Stendell moved and Commissioner Lambell seconded, to
continue Case MISC 11-58 subject to: 1) addition of individual screening for
HVAC units to blend in with architecture; 2) addition of more signage on rear
elevation; 3) additional window features on right elevations; 4) all roof forms
need to extend further back onto the main roof; overall roof width should
match entry; 5) taller parapet on right elevation to extend past building six
feet; 6) on right elevation paint mechanical doors to blend in, add a canopy
piece on top and screen with landscaping, or add a well-designed screen
wall; 7) revise handicap parking location; and 8) study signage location with
location of trees. Motion carried 7-0.

2. CASE NO: PP 06-05 Amendment #1 /TT 36342
APPLICANT (AND ADDRESS): HIGH POINT COMMUNITIES, 20
Enterprise, Suite 320, Aliso Viejo, CA 92656
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of architectural
design of 196 homes; 78 detached cluster homes; 69 attached homes; 49
single family homes; and a private recreation facility for tentative tract
36342 within The University Park.
LOCATION: NWC University Park Drive & College Drive
ZONE: PR-5
Mr. Swartz presented the project and summarized the staff report. The
project architecture is of a Mediterranean architecture design, utilizing a
mix of stucco, recessed windows, vertical columns, and earth tone colors.
The plant selection is in conformance with the City's Landscape
Maintenance Guide and recommendations. While the plans have not yet
received preliminary approval from the City's Landscape Specialist, they
are being reviewed. There are 78 cluster units, 69 attached homes, and
49 single family homes with three conceptual floor plans, with each having
a Spanish, Italian, and Tuscan style. All units are two-story at a maximum
height of 24' per the approved University Park Master Plan. The 196-
home project complies with the General Plan Designation and with the
approved University Park Master Plan. The project as designed will result
in an architecturally attractive residential complex. Quality touches added
to the project include direct garage access for all homes and balconies.
The project also maintains pitch roof elements that provide and create a
diversity on the roofs, which improves the architecture. Mr. Swartz stated
staff had a concern regarding the A/C units. Currently, the A/C units are
not shown on the site plan and staff is recommending that the A/C units
come back to the ARC under a separate review for location approval.
Mr. Steve Lugwig, High Point Communities, stated they purchased this a
little over a year ago and what was approved at the time really doesn't fit
today. He is excited about being the first project out at the University Park
to get it fired back up again. By and large they have been able to stay
within the existing footprint because the curb, sidewalks, gutters, and the
sewer are already there.

Mr. David Kent, KTGY Architect, described each elevation and styles for
the Commission. He said this is a development product that will be a
better benefit to the city because it is a non-attached product, less liability,
and fee simple.
The Commission reviewed and discussed the elevations and
Commissioner Vuksic suggested the following for Plan 1 of the cluster
homes: to show a foam element on the Spanish style going up on all
gables to work with the overall end of the building; apply exposed rafter
tails on the Tuscan elevation; on all elevations the windows on the lower
level should be equally spaced with windows above; fascia and garage
� walls need to be thicker on all elevations. On Plan 2 of the cluster homes
he suggested the following: move the left-sided window on the upper left
elevation over and balance it on the gable. On Plan 3 of the cluster
homes he suggested: popping out the porch on Plan 3-C; increase the
gable on Plan 3-A, and increase the column size to a framed 12" x 12".
Commissioner Vuksic made additional comments overall and asked the
applicant to review the return of the radius for wainscot on all elevations;
on some of the elevations layer the side and rear walls to pop out from
upper level to break down mass; on the single family units on elevation B
make some of the hip roofs gabled to reduce the mass between the
houses. Commissioner Touschner suggested they review the material
used for the side gates so that it works with the architectural style of the
elevations.
ACTION:
Commissioner Vuksic moved and Commissioner Lambell seconded, to
continue subject to: 1) show foam element on Spanish style going up on all
gables to work with overall end of building; 2) on all elevations windows on
lower level should be equally space with windows above; 3) fascia and
garage walls need to be thicker on all elevations; 4) apply exposed rafter
tails on Tuscan elevation; 5) front gates need to work with the architecture
style of the elevation; 6) move the left-sided window on upper left elevation
over and balance on gable; 7) pop out porch on Plan 3-C elevation; 8)
increase gable on Plan 3-A elevation; 9) increase column size to a framed
12 x 12; 10) review turn radius for wainscot on all elevations; 11) on some
elevations layer the side and rear walls to pop out from upper level to break
down mass; 12) on the single family units on elevation B make some of the
hip roofs gabled to reduce the mass between the houses; 13) A/C locations
to be reviewed and approved by staff; and 14) landscape plans must be
preliminarily approved before going to Planning Commission. Motion
carried 5-0-1-1, with Commissioner Levin abstaining and Commissioner
Gregory absent.
