Action:
Commissioner Levin moved and Commissioner Van Vliet seconded, to
approve the January 10, 2012 meeting minutes with minor changes.
Motion carried 6-0-1-0, with Commissioner Vuksic abstaining.

A. Finai Drawings:

APPLICANT (AND ADDRESS): SCM SOLUTIONS LLC, 1281 e.

NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of
construction drawings; Starbuck's
LOCATION: 73-520 EI Paseo
ZONE: C-1, S.P.
Mr. Swartz stated this was continued from the last meeting and said
the applicant has provided a rendering of the how the gate will look
in the rear landscaping, as well as the 8" slope.
Commissioner Vuksic thought the site slopes more than what was
presented and wanted to know how they established the
dimension. Mr. TJ Kucewesky, Representative, said the section
was fairly level and drops a little, but not significantly.
Commissioner Vuksic said according to the rendering the new
railing is aligning with the existing railing on the north end and
asked if that railing was on the existing ramp system. Mr.
Kucewesky said it was on a handicap ramp, but the railing is
located on top of the curb and will be as high as the proposed
railing. Commissioner Lambell asked what the height of the railing
will be and Mr. Kucewesky said it was 2'-8" sitting on top of a smalf
concrete curb. Mr. Swartz provided photos of the curb and the
proposed area of the railing. Commissioner Vuksic noticed the
planter curb was fairly consistent but he thinks they are losing
ground in relation to the height of the building and asked if the
measurement was from the existing sidewalk to the existing curb.
Mr. Kucewesky said it was from the height of the sidewalk to the
top of the proposed patio; 8 '/".
Commissioner Vuksic noticed the proportion in the rendering
looked a lot different than the elevation and asked which one was
more accurate. Mr. Kucewesky said the elevation with the
horizontal panels was correct. Commissioner Vuksic said that
would look better and less cluttered. He asked why they were
putting a railing on the EI Paseo side and Mr. Kucewesky said that
� was basically designed to contain the patio because the tables and

chairs get moved out into the right-of-way and onto the sidewalk.
Mr. Bagato stated that it could become a safety issue if it was in the
right-of-way. Commissioner Vuksic understands the reason for the
railing on San Pablo, but thought it was a shame to have railings on
both sides because it loses any architectural significance and
becomes a very utilitarian looking thing right on EI Paseo.
Commissioner Van Vliet asked if the City was requiring this or were
they doing it on their own and Mr. Bagato said the applicant prefers
the tables and chairs to be out of the right-of-way.
Commissioner Touschner said the railing on the west side is 2'-8"
above the curb but the one on EI Paseo is not on a curb and
wondered if that was also 2'-8" or higher. Mr. Kucewesky said it
was the same. Commissioner Touschner stated the two railings
would not be at the same height and Mr. Kucewesky said the way
the patio is designed it would be level all the way across. The
Commission and the applicant discussed the different heights.
Commissioner Vuksic asked if the top of the curb was at the same
level as the patio and Mr. Kucewesky said starting on the EI Paseo
side of the patio it's flush with the curb and then it goes up 2 '/"
above the curb on the other side to maintain level on the patio.
Commissioner Vuksic asked if the patio was higher than the curb
and Commissioner Stendell said it was 2 '/" to maintain level.
Commissioner Vuksic said don't you need the curb for the patio to
have a place to stop and Mr. Kucewesky said the patio would be
rolled down to meet the curb at that end. Commissioner Van Vliet
thought the curb was going to make up that differential. The
Commission discussed the slope of the curb and suggested
demolishing the old curb and replacing it with a new one so that it is
clean. The Commission continued to discuss the curb and the
slope.
Commissioner Vuksic said these were important details and asked
the applicant if he could see why they were asking all these
questions. Mr. Kucewesky understood and said the way they
looked at the 2" it's not perceptible as you drive by or walk by
unless you are standing there looking for the difference between
the curb and the paver. Commissioner Vuksic thought the
applicant didn't have good answers to the questions. Mr.
Kucewesky said the entire patio will be sloped a little to shed water
and Commissioner Vuksic said 2" was quite a lot when you are
trying to level a chair. Commissioner Stendell asked if they would
have a problem with returning it to the building instead of to the

handicap slope and Mr. Kucewesky said it probably would not be a
problem returning it to the building.
Commissioner Vuksic said if the rail was mounted to the curb how
does it work if the rail actually slopes down and Mr. Kucewesky
said there would be a slight difference at one end of the patio;
about 2 '/4".
Commissioner Vuksic made a motion to approve subject to pouring
a new planter curb to make it level with new patio and returning rail
into the building and not intruding with existing handicap rail.
Commissioner Gregory asked for any further comments. Ms.
Christina Canales, Public Works informed the applicant that the
railing cannot be in the right of way on the EI Paseo side. Mr.
Swartz asked the applicant to resubmit the changes to Building and
Safety.
ACTION:
Commissioner Vuksic moved and Commissioner Stendell seconded, to
grant approval subject to: 1) pouring a new planter curb to make it level with
new patio; and 2) returning rail into the building and not intruding with
existing handicap rail. Motion carried 7-0.
2. CASE NO: SA 12-19
APPLICANT (AND ADDRESS): JUDY KLIMEK, 73-200 EI Paseo,
Suite 3C, Palm Desert, CA
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of
awning and signage; Judy Klimek.
LOCATION: 73-200 EI Paseo, Suite 3C
ZONE: C-1, S.P.
Mr. Swartz presented photos of the building and the proposed
awning and informed the Commission that the awning would not
project into the right of way. The Commission reviewed the plans
and wondered if the awning would extend over the entire portion of
the building. Commissioner Gregory said if the tenant or the
applicant also has the space with the orange windows, then the
awning should run all the way across. If they only have the space
to the left of that door, then it would be okay to cover what they are
proposing.

ACTION:
Commissioner Gregory moved and Commissioner Stendell seconded, to
grant approval as proposed if applicant is not leasing the tenant space next
door; if leasing tenant space next door, then the awning must project the
length of building Motion carried 7-0.

V. ART IN PUBLIC PLACES UPDATE — Commissioner John Vuksic
Commissioner Vuksic updated the Commission on agenda items from the last Art
in Public Places meeting: the Commission approved the art sculptures for the
Palm Springs Art Museum; an art sculpture was approved for the Oracle Plaza;
the fence at Washington Charter has been removed and relocated to the Soccer
Park on Hovley; the Public Art film series has begun; the topic for the student art
and essay contest this year is "My Hopes and Dreams for Palm Desert in 20
years"; and the change out of the art work has begun on EI Paseo.

Commissioner Stendell moved and Commissioner Lambell seconded to adjourn
the meeting. Motion carried 7-0. The meeting was adjourned at 1:05 p.m.
