IV. APPROVAL OF MINUTES: April 24, 2012
Action:
Commissioner Van Vliet moved to approve the April 24, 2012 meeting
minutes. Motion was seconded by Commissioner Levin and carried by a
7-0 vote.

A. Finai Drawings:
1. CASE NO: MISC 12-123
APPLICANT (AND ADDRESS): GLEN CEILEY, 304 Evening Star
Lane, Newport Beach, CA 92660
NATURE OF PROJECT/APPROVAL SOUGHT: Approval to permit
the design and construction of a 5' high block wall 12'-6" from curb
along Willow Street.
LOCATION: 46-553 Desert Lily Drive
ZONE:
Mr. Kevin Swartz, assistant planner, stated this was continued from
the last meeting for a wall exception. The applicant is still asking for
a 5' wall 10' from curb along Willow Street and 12' from curb along
Desert Lily. The applicant submitted revisions to his proposal and
is still requesting a 5' wall. He meets code along Desert Lily and as
you come around on Willow Street it maintains 15' per code, but
then it jogs down to 12'-6". The applicant is asking for a wall
exception only on along Willow Street. It was 10' from curb, but the
applicant has pushed it back to 12'-6". Staff recommends approval
because he's only asking for a small portion of the wall. Staff
talked with the Mr. Rover, the concerned neighbor and he was okay
with the changes.
Commissioner Gregory stated there are rules for a reason and
asked what would be the Commission's reason for not insisting on
the letter of the law being followed. Because someday they will
face this again just as they did with the wall across the street being
closer than it should have been.
Commissioner Vuksic said it would be acceptable if there was
some give and take where the wall comes in and out in some areas
and balances out.
MR. HERMANN said they will work this so it looks good. The
homeowner's have a very high quality of taste and value in what
they are trying to do. This isn't going to be a stucco wall with an
ugly concrete cap on it. Right now they are trying to get a little
more room on the one side and then they will get into the design
and development of this wall.

Commissioner Vuksic said the minimum standard in the ordinance
is to be at the setback with pilasters and that's in lieu of any design.
He felt the applicant was doing the minimal requirement except he
was asking to encroach in the setback.
Commissioner Gregory pointed out that they have the beginning of
a step pattern where the wall is closer to the street to the west. He
asked what if they step up again and broaden the curve of the
radius. It would be a logical stepping of the wall and would be a
relatively minor compromise with more give and take.
The Commission and the applicant discussed stepping of the wall
and the area for the shuffle board court, horseshoe pit and pool
equipment.
Commissioner Vuksic said they need to have a meandering wall or
something that had some architectural design value to it to allow
the encroachments.
Commissioner Stendell suggested stepping of the wall and
submitted a drawing. The Commission reviewed the drawing.
Commissioner Gregory said it would be a significant give back and
help the articulation of the wall.
Commissioner Vuksic said there is a theme that is developing by
stepping the wall.
Commissioner Touschner said if the wall is articulated in multiple
locations and steps in and out, then the Commission would
consider impeding into the 15' setback. If not, and it's going to be a
simple straight wall then it will not be approved.
ACTION:
Commissioner Touschner moved to continue Case No. Misc 12-123 subject
to: 1) articulate wall in multiple locations with two or more steps to provide
relief; and 2) design to return for ARC review. Motion was seconded by
Commissioner Stendell and carried by a 7-0 vote.

2. CASE NO: MISC 12-130

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of an
exterior fa�ade renovation; The Shops on EI Paseo.
LOCATION: 73-130 EI Paseo
ZONE: C-1, S.P.
Commissioners Gregory and Vuksic recused themselves.
Mr. Kevin Swartz, Assistant Planner, presented the project and
summarized the staff report. Phase I is being presented today
which is approval of exterior faCade enhancements. Phase II
consists of a Conditional Use Permit (CUP) to allow a restaurant
(Wolfgang Puck) to operate in Building #3. The CUP has not yet
been submitted. Phase III will consist of a parking lot and
landscape enhancements, trash enclosures, and paving material on
the north side of the property. A Water Quality Management Plan
(WQMP) is required and has been submitted to the City Engineer.
Phase III will not be submitted for ARC consideration until the
WQMP is preliminary approved.
Mr. Swartz stated the applicant is seeking preliminary approval of
Phase I, fa�ade enhancement to an existing property on EI Paseo.
The proposal consists of removing a portion of Building #1 creating
two new storefronts, which will face the new pedestrian
environment. This will also create a secondary entrance from the
parking lot. The applicant is also proposing to move two existing
storefronts 5' closer to the street (EI Paseo) for improved visibility of
retail entries and facades. Staff recommends approval of the
fa�ade enhancement subject to commissioner comments.
MR. DAVID DAVIS, architect, presented a PowerPoint
presentation, as well as a color board, materials board, and a
landscape cfrawing. He described the project and said their
concept is to create a strong street presence with a one-story
building.

Mr. Swartz stated the applicant will have to do a sign program, but
the awnings would be approved today. He reminded the
Commission that the flat work, parking lot, sign program, awning
detail, and landscaping will come back for approval.
Commissioner Lambell was concerned with the possibility of
multiple areas for signage. Not only on the awning, but the taller
parapet and the short parapet below and felt it would get cluttered.
The Commission and the applicant discussed the awnings and the
location of the signage.
Commissioner Levin pointed out that the PowerPoint slide
presented was the opposite of what was presented in the
Commission's packet.
MR. DAVIS said after reviewing the locations of the striped and the
solid black awnings, they are leaning more towards the one
presented on the PowerPoint, which has more striped. He asked if
the Comrnission would be approving where the striped and solid
black would be located or would they be flexible in that area.
Commissioner Van Vliet asked the applicant to study it more and
then bring it back to ARC.
The Commission and the applicant discussed the Spanish Mission
style and the color of the proposed awnings.
Commissioner Touschner told the applicant they need to determine
what their style is and what their signage package will be. She
didn't think it was in their best interest for the Commission to
approve where the awnings will be located.
MR. DAVIS said they are confident they have the awnings in the
right location and mounted at the preferred height. The style is
Mediterranean Classic Spanish, but the Mediterranean comes in
the striped awning and there is also a little bit of contemporary
version of Spanish Mission. They would appreciate it if the
Commission will review and approve the awnings by location,
height, pattern, and color and let them bring back the signage
package for review.

Commissioner Touschner agreed with the first three; location,
height, and detail. However, there are two different elevations and
on one side there is a little too much striped. She wasn't
comfortable and asked him to revisit that.
MR. DAVIS said they are more comfortable with the one presented
on the PowerPoint and understood her comment based on that.
Commissioner Van Vliet asked if they were still planning on putting
signage on the striped awnings. .
MR. DAVIS said that was an option if the flap was solid black only.
He asked the Commission if they need to see where they are
exactly by the pattern or will they give the property owners the
flexibifity on the concept, texture, pattern.
Commissioner Lambell said they are looking for the merit of the
building architecturalty speaking and certainly an awning that is
black and white striped gives a personality that we have to pay
attention to. Right now she could not approve the one presented
on the PowerPoint. She thought the more black and white you're
going to get, the more difficult the signage program will be to
enforce and approve because you have no place to put it. One of
the wonderful things about this building is that you are looking at it
as a whote rather than as individual bits. She asked them not to
break it up with clutter.
MR. DAVIS said the signage will be a combination of plaque wall
signage, blade signage, signage above the awning, and in some
cases they probably will have signage on the flap of the awning.
The Commission discussed the palms trees the appficant will be
adding and removing along EI Paseo.
MR. DAVIS said their plan is to use the ones that are straight and
repurpose the ones that are not straight on another part of the
property.
The Commission asked Mr. Swartz what they were approving
today.

Mr. Swartz said what was being presented for approval was the
exterior fa�ade, and the height and location of the awning. The
applicant will then bring back the landscape, flat work, the sign
program, and awning details.
Commissioner Levin asked about the service entry near the patios
and the parking lot and asked how they have will access the
restaurant.
Mr. Bagato stated that is not uncommon for other restaurants and
pointed out a couple that have outdoor patios next to their service
entry. The deliveries are usually in the morning when they are not
serving food yet. He said those are things they could look at when
they bring in the revised site plan.
MR. DAVIS said trees and shrubs will provide a landscape buffer
between the walkway that connects the parking to the service area.
Time of day and the landscape buffer is their solution.
Commissioner Stendell went back to the awnings and said he
agrees that the awnings will get a little too busy and felt it didn't
lend to any signage on the awning. He liked the proposed awnings
and said it looks a lot better than what is out there now. The
proposed awnings bring continuity to the street. He said they
should try and keep the signage off the stripes. He feels the stripes
will become convoluted.
Commissioner Stendell made a motion to preliminary approve and
Commissioner Levin seconded.
The Commission and the applicant continued to discuss the solid
black and striped awnings.
MR. FLETCHER said they wrestled with the color internally and
came to the conclusion that they wanted a unified look with the
solid black and black and white look. Adding other colors is
something they do not want to do. They want to come to some that
the Commission will be happy with. They wanted to know if the
Commission is comfortable with a black unified awning program for
the development. If not, they will need to revisit.

Commissioner Lambell said she didn't have a problem with the
solid black and the black and white striped. It's how many and
where.
Commissioner Stendell stated it will be determined by the packet
elevation verses the screen elevation.
ACTION:
Commissioner Stendell moved to approve fa�ade as presented in packet
submittal, as well as height and location of awnings as shown in packet.
Applicant to return with sign program along with awning color, parking lot
improvements, landscape plans, and flat work. Motion was seconded by
Commissioner Levin and carried by a 5-0-0-2 vote, with Commissioner
Gregory and Vuksic absent.

VI. ART IN PUBLIC PLACES UPDATE — Commissioner John Vuksic
Commissioner Vuskic pre$ented photos of the new sculptures being placed on Et
Paseo and a brochure of the Palm Springs Museum.
VII. COMMENTS
Mr. Bagato reported that Red Lobster wil� bring in revised structural plans for the
three tower etements. Commissioner Vuksic was concerned with the 7' green
electrical box facing Highway 111. Mr. Bagato will check with the contractor.
Commission discussed the construction of the new DMV on Gerald Ford.
VIII. ADJOURNMENT
Upon a motion by Commissioner Stendell, second by Commissioner Levin, and
by a 7-0 vote the meeting was adjourned at 1:50 p.m.
