IV. APPROVAL OF MINUTES: September 25, 2012 and October 9, 2012
Action:
Commissioner Van Vliet moved to approve the September 25, 2012 meeting
minutes. Motion was seconded by Commissioner Gregory and carried by a 6-
0-1-2 vote, with Commissioner Colombini abstaining and Commissioners
Clark and Touschner absent.
Action:
Commissioner Levin moved to approve the October 9, 2012 meeting minutes.
Motion was seconded by Commissioner Colombini and carried by a 7-0-0-2
vote, with Commissioners Clark and Touschner absent.

V. CASES:
A. Final Drawings:
1. CASE NO: MISC. 12-298
APPLICANT (AND ADDRESS): TOM KIRK, 73-905 Shadow Lake
Drive, Palm Desert, CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration for
approval of a new side entry carport 16' from the curb, which will
replace an existing carport in the same location.
LOCATION: 73-905 Shadow Lake
ZONE: R-1 12,000
Mr. Tony Bagato, Principal Planner, stated this project is for an
approval of a new side entry carport 16' from the curb to replace the
existing carport in the same location in accordance with R-1 Single
Family zoning. Currently, the code states that if you were to re-build a
brand new carport or garage you have to be 20' from the property line,
which would be an additional 7'. To be approved over the counter you
have to be 27' from the curb or there is a provision where the
Architectural Review Commission (ARC) can approve side entry as
close as 16' with a noticed hearing. As shown in the plans, there is an
existing carport there today and staff feels it is not architecturally
sound. The property has been purchased and is being remodeled to
be more of a contemporary design. Staff is in support of the
applicant's request. This was a noticed hearing and one email was
received from a neighbor who was in favor of the carport.
MR. TOM KIRK, applicant, stated this is a 1959 mid-century home with
a flat roof sloping to the backyard and the southwest views. The
carport will be moved in front to recreate a mid-century feel and the
carport will extend out to the street. The carport projection will go no
further than the previous carport projection and is extremely consistent
with the City's exception policy.
The Commission reviewed the plans and photos and asked for the
structural details.
MR. KIRK said they will submit the plans when they apply for a
building permit. What is being reviewed today was only for the
setback exception.

Commissioner Vuksic asked the applicant to make sure to look at the
connection details so there are no exposed pieces of metal hardware.
ACTION:
Commissioner Lambell moved to approve. Motion was seconded by
Commissioner Levin and carried by a 7-0-0-2 vote, with Commissioners Clark
and Touschner absent.
2. CASE NO: MISC. 12-315
APPLICANT (AND ADDRESS): ROIC CA NOTES II, LLC. Attn:
Robert Duran, 8905 Town Center Drive, Suite 108, San Diego, CA
92122.
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of
approval for exterior modifications; including new paint colors, awnings
and minor architectural: Desert Springs Market Place.
LOCATION: 74-880 Country Club Drive
ZONE: P.C. 4
Mr. Tony Bagato, Principal Planner, stated this is part one of a two
part project for the Desert Springs Market Place. The exterior
modifications are presented today for the Commission's review
including new paint colors, awnings and minor architectural
modifications. Color samples in desert earth tones were presented
for the Commission's review. The Desert Springs Market Place will be
doing a major remodel, as well as landscaping and signage; which will
come back in November. The center has been there for at least 25
years and the applicant wants to clean it up.
MR. BOB DORN, director of construction for ROTC, Inc, gave a brief
history of his company and stated they purchased this severly
neglected center about a year ago. He pointed out the current
architecture and outdated paint colors and presented new elevations
for the upgrading project. He believes that painting the center and
reworking the towers will have a big impact. Then within the next six
to eight weeks they will return to the Commission to present
landscaping and signage. A complete exterior landscaping upgrade
will take place on the corner of Cook Street and Country Club Drive,
as well as the perimeter of the center. They will focus on that corner
which they feel is the most highly visible corner in Palm Desert,
especially with the traffic going to the hotel across the street. He
presented the elevations which included the paint colors, new awnings
and described what they would be remodeling. They will be adding a

Styrofoam cornice to the six towers, the rock will be pulled back, and
the top will have a plaster finish with a backlit logo to highlight the
columns.
MR. DORN explained that they own the whole center, except for Cork
Tree, and will work with Morton's to change out the brown color
throughout their whole building to incorporate colors that tie in with the
center. They are hoping to start painting prior to Thanksgiving, do the
architectural upgrades right after Thanksgiving through December,
and the landscape and signage around February. They would like to
have the entire project completed by March. They will also do a
parking lot upgrade and when they are done they will have a much
improved and repositioned center.
Commissioner Gregory pointed out that this was under Final Drawings
on the agenda, but the Commission was only being shown
photographs of existing and proposed elevations and felt that this was
relatively minor changes.
Mr. Bagato stated this was a minor fagade change and that is why it is
final and landscaping and signage will come back later.
Commissioner Levin asked if there will an overall sign program.
Mr. Bagato said there will be a sign program for the center only, not for
the tenants. The applicant is doing more of a branding for the center
where they will have the logo on the towers. The new monument
signs and directional signs will have that branding as well.
Commissioner Vuksic discussed the cornice detail on the towers. He
pointed out that on the existing building they are lighter than the base
wall color and thought it will look better than the base wall color they
are proposing. He said subtle changes make a big difference.
MR. DORN appreciated the feedback and said Mr. Dave Cuson,
Director of Design will take the time to literally detail every elevation
with the colors he wants and match it for the painters.
The Commission discussed the details on the towers, paint colors in
the rear, the awning colors, and the building color for the stores that
have red logos.
ACTION:
Commissioner Colombini moved to approve storefront modifications. Motion
was seconded by Commissioner Vuksic and carried by a 7-0-0-2 vote, with
Commissioners Clark and Touschner absent.

VI. ART IN PUBLIC PLACES UPDATE — Commissioner John Vuksic
Commissioner Vuksic reported on the recent Art in Public Places meeting on
October 17, 2012. A sculpture named "Steel Roots" is being considered for the Civic
Center Park. Over the next two weeks, new art pieces will be installed in the
medians on El Paseo. The art pieces proposed for the Coachella Valley Water
District were turned down by their Board. However, different art will be considered
at another location for better visibility. Due to an over abundance of docents, there
will be no docent training until further notice. The Commission accepted "My
American Idol" as the theme and title for the 2013 student art and essay contest.
VII. COMMENTS
The Commission discussed the Forest Lawn Mortuary project and the LG's building.
VIII. ADJOURNMENT
Upon a motion by Commissioner Stendell, second by Commissioner Levin, and a 7-
0-0-2 vote, with Commissioners Clark and Touschner absent, the Architectural
Review Commission meeting was adjourned at 1:05 p.m.
