1. CASE NO: SA 12-271
APPLICANT (AND ADDRESS): CHARTWELL PROPERTIES, INC.
73-061 El Paseo, Suite 200, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of two pole
signs identifying located at The Shops on El Paseo.
LOCATION: 73-040, 73-061, 73-080, 73-100, and 73-130
ZONE: C-1 SP
Mr. Tony Bagato, Principal Planner, stated this was an approval of two
pole signs identifying The Shops on El Paseo. This request was
denied at a previous Architecture Review Commission (ARC) meeting
and the applicant filed an appeal with the City Council (Council). In the
process of presenting this to the Council, they suggested that the
applicant return to the ARC with Council's suggestions to reduce the
number of pole signs.
Commissioner Vuksic recused himself from this project and left the conference
room.
Mr. Kevin Swartz, Assistant Planner presented photos of the two pole
signs; one in front of Gucci and one in front of Escada. The applicant
is requesting these pole signs to be located near the two valet
stations. Staff is recommending approval.
MR. DAVID FLETCHER, Chartwell Properties, Inc. agreed there were
too many pole signs in that small of an area. However, he still feels it
necessary and desirable to let the pedestrians know they are at The
Shops on El Paseo. By reducing the signs to two, he felt they would
still accomplish their goal by placing them at the valet stations.
The Commission agreed overall that placing them near the valet
stations was a good idea. Commissioner Clark felt that these signs
were an obstruction and created a safety issue on El Paseo.
Commissioner McIntosh suggested placing them in planters to
eliminate clutter. MR. FLECTHER said with the signs being that close
to the tree would not work well. Commissioner Levin thought that with
the valet activity it would be less of a clutter to have the signs located
there. Chair Van Vliet thought by reducing the number of signs from
ten down to two was a good compromise.

ACTION:
Commissioner Levin moved to approve two pole signs located in front of the
valet stands. The applicant shall work with the Public Works department on
the location. Motion was seconded by Commissioner Colombini and carried
by a 6-1-0-1 vote, with Commissioner Clark voting NO and Commissioner
Vuksic absent.
2. CASE NO: MISC 13-193
APPLICANT (AND ADDRESS): RON RUSHING 77-090 Indiana
Avenue, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval to construct
a side entry carport within the front yard 16' back from face of curb.
LOCATION: 77-090 Indiana Avenue
ZONE: R-1
Mr. Kevin Swartz, Assistant Planner, presented a request for a side
entry carport within the front yard, 16' back from face of curb. The
original home was built under the County of Riverside and the single-
car carport was converted into living space. The applicant is
requesting covered parking, but does not meet the R-1 zoning
setbacks. Per Section 25.16.090, C; in order to encourage
rehabilitation of older dwelling units and to provide shaded parking for
vehicles, the architectural review commission (ARC) may approve
well-designed carport structures with a minimum setback of sixteen
feet for side entry, to be measured from the curb face to the front edge
of the carport structure. The applicant is proposing six columns with all
hardware concealed within the columns. The columns will be stuccoed
and painted to match the house. Staff believes the design of the
carport maintains and blends into the architectural style of the home
and the carport design is in keeping with the character of the
neighborhood. Staff has not received any comments in favor or
opposition to this request.
The Commission and staff discussed the required setbacks and staff
indicated they cannot meet the standard setback, but the ARC can
grant them an exception based on architectural design.
Commissioner Vuksic discussed the vents on the house and
suggested the applicant keeping it to one vent. He also discussed the
columns and suggested the applicant make them two equal bays,
centered on the structure.
Commissioner Clark suggested they have a hedge on the side of the
carport to screen the wheels of the vehicle inside the carport.

ACTION:
Commissioner Clark moved to approve subject to: 1) column is centered on
structure on the gable; 2) landscape plan submittal; and 3) one vent instead
of two. Motion was seconded by Commissioner Levin and carried by an 8-0
vote.
MOTE:
Staff requested that an additional item be added to the Agenda. Commission
concurred. It was moved by Commissioner Lam-bell, seconded by Commissioner
Vuksic, adding Case No. MISC 13-306 to the agenda. Motion carried 8-0.
3. CASE NO: MISC 13-306
APPLICANT(AND ADDRESS): JOHN JAUREQUI, 43-760 Warner
Trail, Palm Desert, CA, 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Request final
approval of a color change.
LOCATION:43-760 Warner Trail
ZONE: R-1, 9000
Mr. Kevin Swartz, Assistant Planner, presented a paint color
modification and stated the applicant recently purchased a home
located in the Palm Desert Country Club. He presented photos of the
home, described the colors, and passed around samples.
MR. JOHN JAUREQUI, applicant, stated the house was originally a
tan color. The house in general was a big project with a lot of work
inside and out, and they still have a lot of work with the landscape as
well. They had the opportunity to paint and were unaware of the City
ordinance, or otherwise they would have submitted a request for the
change.
Mr. Bagato, Principal Planner, explained to the Commission that any
substantial change in color requires their approval. The idea is to have
the Commissioners look at the colors along with landscaping since
landscaping can help blend colors. He informed the Commission that
staff has placed information in the Brightside and the Desert Sun
regarding paint color changes, but new residents to Palm Desert are
not aware of this ordinance.
The Commission reviewed the paint swatches and Commissioner
Lambell informed the applicant that the City requires residents to use
desert colors similar to the desert's natural vegetation. Commissioner
Vuksic understands that it can be difficult for the residents to know the

requirements of the city and feels bad that the applicant did not know,
but if he were living across from this house, it would bother him. He
feels the architecture of the house does not warrant such a strong
statement. He said this color was too much for the whole house. MR.
JAUREQUI said they were not looking for a color to stand out, but they
do like the green. He understands that it is a little different from the
other houses in the neighborhood. Unfortunately,they were not aware
of the City ordinance or they would have complied. Commissioner
Clark said staff had mentioned landscaping as a possible way to
mitigate this issue. MR. JAUREQUI explained that he would eventually
do pigmy palms and other landscape.
The Commission agreed this was a good color, but it is just too much.
Commissioner McIntosh said the applicant has an opportunity with the
different massing to keep some of the green as an element and then
as a backdrop use a more subtle accent color. Commissioner Vuksic
thought the applicant would have to paint the majority of the house. He
was also concerned this could set a precedent. Commissioner
Colombini agreed that the house does stand out and felt a warmer
color should be considered to conform to the area. The Commission
suggested toning down the color tremendously and asked the
applicant to work with staff on choosing a color that will work.
ACTION:
Commissioner Vuksic moved to continue Case No. 13-306 until October 22,
2013 subject to applicant working with staff on color choice. Motion was
seconded by Commissioner Clark and carried by an 8-0 vote.

VI. ART IN PUBLIC PLACES UPDATE — Commissioner John Vuksic
Commissioner Vuksic reported that the Commission selected two artists to paint two
of the traffic signal cabinets on Fred Waring; one located by the College of the
Desert and one located on the corner of Town Center Way and Fred Waring. The
Palm Desert Community Gallery's new exhibition, "The Impact of Images" is now on
display and will run through November 16. He stated docents were needed for the
art tours around the city.

VII. COMMENTS
The Commission asked staff if they could notify paint contractors regarding the
proper procedures for color changes within the City.
VIII. ADJOURNMENT
Upon a motion by Commissioner Lambell, second by Commissioner Vuksic, and an
8-0 vote, the Architectural Review Commission meeting was adjourned at 1:30 p.m.
