ORAL COMMUNICATIONS MR. MARK HERNANDEZ, owner of Cedar House Custom Garage Doors, stated he recently moved his business from Indio to Palm Desert and applied for a sign permit. However, staff did not accept the application because the signs were about 3" too big and told him he would need a variance. He pointed out that he has 180 linear feet on the street. Staff suggested he appear before the Commission to ask for some guidance. He explained that he spent $4,000 on the signs and feels that it would be very costly to remove them. Mr. Bagato said under the Brown Act this item has to be placed on the agenda two days prior to the meeting. The Commission can make comments but they would not be able to make any decisions. The Commission wanted to know what the ordinance issue was. Mr. Eric Ceja, Associate Planner, said Mr. Hernandez is limited to 50 square feet total and the signs are about 60 square feet, which would require a variance. ARCHITECTURAL REIN COMMISSION MINUTES July 8, 2014 MR. HERNANDEZ said he has made several improvements to the building and to the landscaping and wants to bring a positive to the community. The Commission asked what the signs were made out of and MR. HERNANDEZ said the signs are Plexiglas laminate and are 5' x 13'. Mr. Tony Bagato, Principal Planner, informed the applicant that he would have to submit an application for a variance and asked him to continue working with Mr. Ceja. I`V. APPROVAL OF MINUTES: June 24, 2014 Action: Chair Van Vliet moved to approve the June 24, 2014 meeting minutes. Motion was seconded by Commissioner Colombini and carried by a 7-0-1 vote, with Clark, Colombini, Lambell, McAuliffe, McIntosh, Van Vliet and Vuksic voting YES and Levin absent. %1, CASES: A. LOCATION: 73-520 El Paseo ZONE: C-1, S.P. Mr. Tony Bagato, Principal Planner said this item has been to the Commission several times and now the applicant has returned with another awning section for the Commission's review. He reminded the Commission what the issues were regarding the color of the columns, color of the railings, and the graphic cuts in the metal. The Commission left the conference room to review the awning. The Commission reviewed the awning section and discussed the graphic cuts. MR. SERGIO GARCIA, applicant, said the owner was okay with the lettering, Cafe des Beaux-Arts, but was concerned with adding the band and the graphics, which consists of grapes and wine bottles. Commissioner Vuksic said the band would be very distinct and wouldn't make it look boxy. MR. Box 12665, Palm Desert, CA 92255 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of a single-family home at a proposed height of 18' located on a vacant lot. LOTION-T_ION- 637-320-030; a vacant property on the south side of Robin Road, east of Warner Trail ZONE: R-E Commissioner McAuliffe recused himself from this project and left the conference room. Mr. Eric Ceja, Associate Planner, presented exhibits for a house Proposed at 18' in height, which is the maximum building height. He explained that anything over 15' has to come to this Commission for review. The zone is residential estate on a one acre parcel. Due to the one acre size of the lot with substantial setbacks and the design of the slope roof staff is recommending approval of the 18' height. The Commission and staff discussed the intent of the code regarding anything over 15' in height. Mr. Bagato said the home has to have architectural merit and be compatible with the existing neighborhood. He also pointed out that there has been some concern with 18' tall buildings next to smaller homes. Commissioner McIntosh felt this was a really large mass. Commissioner Vuksic said it is basically one roof that covers the entire house other than the entry structure. Commissioner Lambell asked the applicant if there was a reason why the entire roof is 18' instead of having a tower element or something to break up the mass. MR. HERBERT JACKSON, owner, said cost was the main reason. Chair Van Vliet asked what portion of the roof is above 15' and MR. JACKSON said it was the center. The Commission reviewed and discussed the slope and the fascia lines. MR. JACKSON said it is no higher than the house across the street and neighboring homes to the east and west. Basically all the homes are the same height. Commissioner McIntosh said if you look at the other homes on the street you can see there is some articulation that breaks it up a bit; like tower elements that cast a shadow. Mr. Ceja said this area was annexed into the City in 1994 so there is an eclectic mix in this neighborhood. Robin Road has a lot more newer homes, some with two-stories. MR. JACKSON said the homeowner told him it was 18'. He also said the reason for the 18' was because he has high ceilings inside and can't do it without it being 18' beyond the slope of the roof unless it is a flat roof which is more expensive and will eventually leak. The Commission reviewed and discussed the slope of the roof. Mr. Bagato said anything that comes before the Commission has to meet certain criteria. He referred to 25.68.040 in the code; that the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. Commissioner Vuksic pointed out the articulation on other homes in the neighborhood. Commissioner Clark suggested changes to the design to break up the mass. MR. JACKSON said it would be very difficult because the framing design has already been completed. The applicant and the Commission discussed some of the changes he could make to the plans. MR. JACKSON stressed again that there were homes similar to his in the neighborhood and in order to have 10' and 11' foot ceilings, it would require an 18' ridge. Commissioner McIntosh said the applicant is asking for an 18' ridge, the Commission's position is to ask for a little more architecture to be more compatible with the neighborhood. Some of the homes are not one big mass. They have large gabled roofs, with other buildings that that creates a depth change and variance that gives interest to the street. MR. JACKSON said he plans to install an RV garage in the back of the house that will have a flat roof. Commissioner McIntosh said that does not help the street scene. He believes it wouldn't hurt the applicant too much to add a little more articulation and relief. Commissioner Vuksic said normally these things aren't that hard to get approved. He also said that this house is over the top simple which he believes is the problem. He didn't feel that it would be too hard as long as he has a designer that is talented. It should be easy to add enough articulation. ACTION: Commissioner Lambell moved to continue Case MISC 14-199 subject to providing more articulation and less roof mass. Motion was seconded by Commissioner Vuksic and carried by a 6-0-2 vote, with Clark, Colombini, Lambell, McIntosh, Van Vliet and Vuksic voting YES and Levin and McAuliffe absent. CASE NO: MISC 14-219 APPLICANT AND ADDRESS: PAUL DEGRAW, 1565 Scenic Avenue #A, Costa Mesa, CA 92626 NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of fagade changes; Lorna Jane. LOCATION: 73-445 El Paseo #101 ZONE: C-1, S.P. Mr. Eric Ceja, Associate Planner, presented exhibits for Lorna Jane a new tenant at the El Paseo Village. He described the proposed changes and passed around the materials board. MR. PAUL DEGRAW, representative, said they are taking about 1,300 square feet out of the corner suite of the previous tenant, Juicy Couture. The Commission reviewed and discussed the plans and asked if they were adding an awning and MR. DEGRAW said if the owner decided to add one, it would come back to the Commission for review. Since the building faces north, he felt that an awning would not be needed. ACTION: Commissioner Vuksic moved to approve. Motion was seconded by Commissioner McAuliffe and carried by a 7-0-1 vote, with Clark, Colombini, Lambell, McAuliffe, McIntosh, Van Vliet and Vuksic voting YES and Levin absent.. B.
