IV. APPROVAL OF MINUTES: June 23, 2015 and July 14, 2015
Action:
Chair Van Vliet moved to approve the June 23, 2015 meeting minutes. Motion
was seconded by Commissioner Colombini and carried by a 5-0-3 vote, with
Clark, Colombini, Lambell, Van Vliet and Vuksic voting YES, Levin and
McAuliffe absent and McIntosh abstaining.

Commissioner Lambell moved to approve the July 14, 2015 meeting minutes.
Motion was seconded by Commissioner Vuksic and carried by a 6-0-2 vote,
with Clark, Colombini, Lambell, McIntosh, Van Vliet and Vuksic voting YES

V. CASES:
A. Final Drawings:
1. CASE NO: SA 15-140
APPLICANT AND ADDRESS: SOBHY YOUSEF, 1708 North Palm
Canyon, Palm Springs, CA 92267
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve new signage and site improvements; Shell Station.
LOCATION: 77-920 Avenue of the States
ZONE: P.C-2
Mr. Eric Ceja, Associate Planner, said this request for sign changes
and site improvements for a Shell station has been before the
Commission two previous times and based on the Commission's
feedback at the last meeting the applicant has made some changes.
They will demolish the existing monument sign and replace it with a
new rock face that will match the existing walls in that same area. The
existing canopy will remain unchanged with the exception of adding
pump number flags on the columns to identify the pump number. They
will go ahead with the identifying sign on the building itself to identify
the food mart and service center. They will make some site
improvements to clean up the building and the site itself, along with
repainting and touch-up work on the building. Staff is recommending
approval.
Commissioner Clark stated that this building is somewhat of a
landmark building and has been there for years and he now likes what
they are proposing. MR. CRAIG MOJICA, Sign Development, said
they will not make any changes to the canopy except to put up the
"dog ears" for the pump numbers.
Commissioner Clark asked what would be painted and MR. MOJICA
said they will paint the columns, the island forms, and all four sides of
the building. He said the damage on the building will be repaired and
painted and when done it will look like a brand new station.

ACTION:
Commissioner Lambell moved to approve. Motion was seconded by
Commissioner Clark and carried by a 6-0-2 vote, with Clark, Colombini,

2. CASE NO: MISC 15-171
APPLICANT AND ADDRESS: PACIFIC PREMIER
CONSTRUCTION, Attn: Fred Babineau, 42-335 Washington Street,
#F-239 Palm Desert, CA 92211
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of
preliminarily approving a roof height of 18' above grade.
LOCATION: 73-286 Tamarisk Street
ZONE: R-1 12,000
Mr. Eric Ceja, Associate Planner, said this height exception request for
a fagade change on Tamarisk Street came before the Commission at
the last meeting. The owner wants to re-do the fagade of the home
and actually raise portions of it above 15'. He presented a PowerPoint
of the project and pointed out the areas that are proposed above 15'.
The Commission had concerns with the roof-mounted HVAC units and
the applicant has agreed to enclose this area with a single design to
help screen it from the property to the north. There were questions
regarding the long eyebrow on the south side and some of the cornice
details. The applicant has addressed that by shortening the eyebrow
detail so that it is right above the window areas and stops short of the
wall so that it doesn't wrap around the corners. There were concerns
about the inconsistencies shown in the drawings and the applicant has
made revisions to accurately show that the area on the east side of the
home is actually above 15'. For the equipment enclosure, they have
proposed a louvered system that will be painted to match the house
and will only be visible from the west. The Commission also suggested
that internal roof drains be provided. Staff is satisfied with the revisions
and is recommending approval.
Commissioner Clark, who was absent from the previous meeting, stated that he read
the minutes and is up to date on this project.
The Commission and the applicant, MR. JOE BOWEN from Pacific
Premier Construction, discussed the roof drains in detail and the
Commission suggested that the applicant provide internal roof drains.
They discussed the cornice detail and MR. BOWEN said all new
parapets will have a cornice detail that will match the existing detail.

The Commission and the applicant discussed the HVAC screening
and the Commission suggested enclosing the entire area with a solid
rectangle wall, two feet away from the equipment and stuccoed to
match the house. They discussed the eyebrows on the south side and
Commissioner McIntosh said this looks heavy and asked if this could
be something other than stucco to provide an opportunity for
articulation and architecture.
ACTION:
Commissioner Lambell moved to approve subject to: 1) providing internal roof
drains; and, 2) screening HVAC equipment with a solid wall and stucco to
match. Motion was seconded by Commissioner Vuksic and carried by a 6-0-2
vote, with Clark, Colombini, Lambell, McIntosh, Van Vliet and Vuksic voting
YES and Levin and McAuliffe absent.
B. Preliminary Plans:
1. CASE NO: PP/CZ/DA 15-86
APPLICANT AND ADDRESS: PROSPECT COMPANIES, 153 South
Sierra Avenue, Suite 173, Solano Beach, CA 92075
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of
preliminarily approving construction of four (4) new buildings
consisting of 12 memory care units and 15 Assistive Living units;
Legend Gardens.
LOCATION: 73-685 Catalina Way
ZONE: R-1
Mr. Eric Ceja, Associate Planner, said this proposal came before the
Commission on June 25, 2015 for an expansion of the Legend
Gardens on Catalina Way (Catalina) and San Pascual Way (San
Pascual) across from the Joslyn Senior Center. They have an existing
20-unit complex and are proposing to add an additional 27 beds; 15
new assisted living beds and 12 memory care units. The owner has
purchased two single family homes and plans to demolish them and
convert them into part of the expansion. The two new parcels will be
architecturally compatible with the existing site so it will look like one
single facility. At the last meeting, the Commission asked that some of
the blank elevations that face Catalina and San Pascual at the corner
be dressed up in some way and the applicant has proposed a planting
screen with vines to fill in that area. The architecture and paint color
scheme and roof are all designed to match the existing facility and
staff is recommending that the existing facility also be painted so that it
all looks brand new. He said staff is recommending approval. v

Commissioner Clark mentioned there was also a concern with the
screening for the air conditioning units. Mr. Ceja said the HVAC units
will be screened by the roof and parapets as reflected on the plans.
The Commission and Mr. Ceja reviewed and discussed the plans for
the additional units and the architectural style of the buildings. They
discussed the proposed screening device on the east and north
elevation walls and MR. WILLIAM SELL, Erwin Partners Architects,
said the screen is metal lattice that would enable the vines to grow.
The Commission suggested that plantings and architecture be
integrated into the building on the east and north elevation with a
minimum recess of 6 to 8".
ACTION:
Commissioner Vuksic moved to preliminarily approve. Motion was seconded
by Commissioner Clark and carried by a 6-0-2 vote, with Clark, Colombini,
Lambell, McIntosh, Van Vliet and Vuksic voting YES and Levin and McAuliffe
absent.
C. Miscellaneous Items:

VI. COMMENTS
Staff and the Commission discussed the ARC's role in approving height exceptions
and the level of detail for single-family homes.
VII. ADJOURNMENT
Upon a motion by Commissioner Lambell, second by Commissioner Vuksic, and a 6-
0-2 vote, with Colombini, Lambell, McIntosh, Van Vliet and Vuksic voting YES, and
Levin and McAuliffe absent, the Architectural Review Commission meeting was
adjourned at 2:15 p.m.
