ACTION:
Commissioner Levin moved to approve the April 12, 2016 meeting

A. Final Drawings:
1. CASE NO: CUP 16-99
APPLICANT AND ADDRESS: ALFREDO ALVIDREZ, 77-530

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve a new single-family home and accessory garage at a
height of 18'.
LOCATION: 77-700 Delaware Place
ZONE: R-E, 40,000
Commissioner Mclntosh recused himself from this case and left the conference room
Mr. Kevin Swartz, Associate Planner, presented a new single-family
home and accessory garage at a height of 18'. This a Conditional
Use Permit because the accessory garage is closer than the rear
setback allows and will have to go to the Planning Commission for
approval. The setback is 50' and the accessory structure will be at
20'. The roof heights of the house and accessory structure are
being reviewed for approval today. He presented the site plan for
the house and said the elevation has a lot of roof pitches to it and
maintains 10' to 15' to an ultimate height of 17'. He then presented
the plans for the accessory garage structure with a roof height of
18' and state this garage will store an RV and the applicanYs work
equipment.
Commissioner Clark asked if the accessory garage is visible to the
property next door and Mr. Swartz said it would be visible to the
neighboring properties to the rear that will be notified during the
Conditional Use Permit process before it goes to Planning
Commission. Commissioner Clark was concerned that it would be
visible to the neighboring properties.
Chair Van Vliet said the applicant is asking for an acceptance of the
50' but none of the architecture from the house is being carried
over to the garage structure which is an 18' box.
Commissioner Vuksic referred to section G2 and said they could
put a pitched roof on there because they have the large truss

depth. They could lower the edge by a few feet and put a tile roof
on it like the house has without losing any ceiling height.
Commissioner Lambell felt the garage looks like a commercial
building in the middle of a residential area and said it needs to have
more articulation. She said that at 18' it will be very visible and not
just from the adjacent properties.
The Commission said the house looked fine because there was a
lot of detail with the stone and tile roof. They reviewed the A/C units
and the chimney and suggested the applicant include the A/C units
in the plans and have that reviewed by staff.
ACTION:
Commissioner Vuksic moved to approve the height for the single-family
home as proposed to allow the applicant to submit the construction plans
for plan check.
The Commission continued the height of 18' for detached garage to allow
the applicant to consider adding a pitched roof similar to the single-family
home; consider lowering the height; adding some pop-ups to break up the
� large rectangular appearance; submit line of sight studies from the
neighboring properties. Motion was seconded by Commissioner Clark and
carried by a 7-0-1 vote, with Clark, Colombini, Lambell, Levin, McAuliffe,
Van Vliet and Vuksic voting YES and Mclntosh abstaining.
2. CASE NO: MISC 15-207
APPLICANT AND ADDRESS: ROTHBART DEVELOPMENT,

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve final construction plans for a new retail/restaurant building
within the Desert Gateway Shopping Center.
LOCATION: 34-100 Monterey Avenue

Mr. Kevin Swartz, Associate Planner, presented the final
construction drawings for a new retail/restaurant building within the
Desert Gateway Shopping Center. He said this is the last pad in the
� Desert Gateway. He went over the conditions of approval from the

previous meeting and stated the applicant has made those
changes.
ACTION:
Commissioner Lambell moved to approve final construction drawings as
presented. Motion was seconded by Commissioner McAuliffe and carried
by an 8-0 vote, with Clark, Colombini, Lambell, Levin, McAuliffe, Mclntosh,
Van Vliet and Vuksic voting YES.
3. CASE NO: MISC 16-128
APPLICANT AND ADDRESS: JEAN Du GOULD, 73-430
Guadalupe Avenue, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve a fence exception to allow the replacement of an existing
wood fence with a 6' high vinyl fence.
LOCATION: 73-430 Guadalupe Ave

Mr. Eric Ceja, Associate Planner, presented a fence exception to
allow the replacement of an existing wood fence with a 6' high vinyl
fence and said that the applicant has hired Lowe's Home
Improvement (Lowe's) to replace the fence. In order for the
Commission to make this exception, staff has to find that the vinyl is
architecturally compatible with the home.
Mr. Mark Powers, Lowes, described the project and explained the
product quality. He produced a materials board with samples of the
vinyl fencing and the tan color selected by the applicant. He said
the material is a premium vinyl material and is guaranteed for two
lifetimes. Mr. Bill Loos, Brett Outdoor Living, stated that the material
is infused with UV protection and will protect it from rubbing off,
chipping off, or fading. To date, they have not had any warranty
issues with any of the products they have installed, which has been
about 10 years. The Commission reviewed and discussed the
samples, the product warranty, articulation, and the gates.
Mr. Ceja said vinyl fencing requires an ARC exception. Staff
thought this was a good opportunity to have Lowe's here to present
the materials and how it functions here in the desert. Staff feels this
is an attractive material and superior to wood. Mr. Powers �
explained that the advantage of the vinyl over a masonry wall is

how this material will respond during an earthquake; it will flex and
will never crack.
The Commission and Mr. Ceja discussed the criteria from the
Fence and Wall Committee that states that staff has to find that the
vinyl is complimentary to the existing structure. Mr. Ceja said staff
feels the vinyl is compatible to the home's architecture.
ACTION:
Commissioner Vuksic moved to approve. Motion was seconded by
Commissioner Lambell and carried by an 8-0 vote, with Clark, Colombini,
Lambell, Levin, McAuliffe, Mclntosh, Van Vliet and Vuksic voting YES.
B. Preliminary Plans:
1. CASE NO: PP/CUP 16-102
APPLICANT AND ADDRESS: ALLIED ARGENTA
CONSTRUCTION, 409 Santa Monica Blvd #E, Santa Monica, CA
90401
� NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of
preliminarily approving an 8,500 sq. ft. community center and 36
residential units for adults with special needs; ARC Village.
LOCATION: 73-255 Country Club Drive

Mr. Eric Ceja, Associate Planner, presented a proposal to approve
an 8,500 square foot community center and 36 residential units for
special needs adults for Desert ARC. He said this vacant parcel is
owned by the City's Housing Authority and the City has been
working with the applicant to get special needs housing at this site.
The applicant is proposing four two-bedroom units and also a mix
of two- and one-story buildings. He described the position of these
units on the parcel and the location of the parking area. He
described the community center and said it is 25' in height which is
under the 35' height limitation for this zone. It is a one-story building
but there is a raised portion that will house the gym. He passed
around a color board and said the applicant is proposing a mix of
materials. There will be some wood treatments that will enhance
the building and a standing seam metal roof. There are 36 units
,� that will be divided between one- and two-story units. He pointed
out that the second story buildings are to the north and the one-

story units are to the south. He presented the landscape plan and
said there is a heavy planting of trees and shrubs to help block
views to the neighbors to the west and south. He explained that the
two story units were 24' in height and is under the maximum height
for the zone. They do have a Conditional Use Permit that allows for
housing at this site and will make its way up to the Planning
Commission. He said these will be partially pre-manufactured units
off site which will keep the cost down to produce them, and being
sensitive to the neighbors, it will also cut down on construction time
on the site. There will be a mix of colors, materials and landscape
that are all compatible to the desert environment. The architecture
for this site and this type of facility is well done and staff is
recommending approval of this design so it can move forward to
the Planning Commission.
The Commission asked about the views from the neighbors and Mr.
Ceja said they have met with the neighbors and presented this plan
and another meeting is planned. The neighbors have expressed
concern with the view coming from the second story and that is why
the applicant is providing a substantial setback over 30' as well as
two rows of landscaping with trees and shrubs to block those views.
CHUCK O'NEILL, Allied Argenta Construction, discussed the
project and said they have created a community for those with
developmental disabilities to give them an affordable living space.
There are 36 living units and a community center to serve the
population living at this facility. He stated because of the four
easements at this locations for drainage they had very few options
on how to accomplish what they accomplished on this site. They
provided as much setback as they could near the existing homes
and did a lot of landscaping with a walking trail around the site.
They have talked with the neighbors around this site who were very
supportive of this proposal. However, they were concerned about
the second story units and explained what they have done to
mitigate their concerns. Even though some of these units are two-
story there is an elevation change between the two streets and iYs
not a whole story higher than the single levels. He also pointed out
that this project is being built to a LEED Platinum standard and will
be very energy efficient units.
Commissioner Vuksic and MR. O'NEILL had a lengthy discussion
on the building's articulation for the two story units. Commissioner
Vuksic was concerned with the roof detail and asked the applicant
to provide more horizontal and vertical movement to the building's `
mass. He suggested modifying the railings for more interest and to

provide better articulation. MR. O'NEILL said this project is
important to them and they put in a lot of effort to make this happen
and they don't want to be disappointed either. He said they will take
a cost effective look at these suggestions and powerFully create
some differentiation.
The Commission reviewed and discussed the landscape plans, the
building's wood finish and the air conditioning units.
ACTION:
Commissioner Lambell moved to preliminarily approve. Motion was
seconded by Commissioner McAuliffe and carried by an 8-0 vote, with
Clark, Colombini, Lambell, Levin, McAuliffe, Mclntosh, Van Vliet and
Vuksic voting YES.
2. CASE NO: MISC 16-113
APPLICANT AND ADDRESS: TTLC CATAVINA INVESTORS,
LLC, 23 Corporate Plaza #150, Newport Beach, CA 92660
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
� approve recreation amenities and facilities, a perimeter wall and
entry design, perimeter landscape and residential architecture;
Catavina/Aventine.
LOCATION: 38-105 Portola Avenue

Commissioner Mclntosh left at 2:05 p.m.
Mr. Eric Ceja, Associate Planner, presented a proposal to approve
recreation amenities and facilities, a perimeter wall and entry
design, perimeter landscape and residential architecture for
Catavina/Aventine. This tentative track was approved back in 2006
for 159 units. All the units are two-story and includes a centralized
facility for recreation amenities. The main access is off Portola
Avenue with an emergency access off Frank Sinatra Drive. Since
this was approved in 2006, there is a new developer that took over
the property and they want to upgrade the architecture, landscape
design and perimeter walls. He presented the plans and described
the walls and the main entry. He said there are three residential
units; Plan 1, 2, and 3 that are detached and two sets of duplex
� units. He pointed out that the height is 24'. He described each plan

in detail, along with the color scheme and landscape. Staff is
recommending approval.
MR. BOB GARRISON, Tru-Life Companies, said they have met
with the residents at Palm Desert Greens on three different
occasions to keep them apprised on what is going on. He then
introduced his team.
MR. MICHAEL STONE, architect, explained the architecture and
said it adapts well to the environment in the valley and the intent of
the community. He described the changes to the plans and said
each of the plans were adjusted and opened up to create more of a
modern lifestyle influenced by the indoor outdoor space.
Commissioner Clark and MR. GARRISON discussed the open area
on Mount Aventine Drive whether it was needed or not.
Commissioner Clark asked if they would consider adjusting that
area further to the north to give it a more aesthetic appearance to
people driving in. MR. GARRISON and the Commission discussed
that suggestion.
The Commission and MR. STONE discussed the architectural
detail, parking, trash enclosures, cluster mail boxes, water meters
and the HVAC units and meters. They discussed the 2" recess on
the front windows and MR. STONE pointed out that this recess will
be on the front facing windows only and not the side windows. The
Commission suggested they apply a 2" recess on all street fronting
elevations. MR. STONE said they would take this into
consideration.
The Commission and MR. STONE discussed Plan 2X and the
Commission suggested they provide more architecture for that
plan.
ACTION:
Commissioner Vuksic moved to preliminarily approve subject to: 1) 2" x 6"
framing on street fronting elevations; and 2) provide more architecture on
Plan 2X and other plan elevations that are exposed to streets. Motion was
seconded by Commissioner Lambell and carried by a 7-0-1 vote, with
Clark, Colombini, Lambell, Levin, McAuliffe, Van Vliet and Vuksic voting
YES and Mclntosh absent.

C. Miscellaneous Items:
1. CASE NO: MISC 16-117
APPLICANT (AND ADDRESS): BERGMAN DEVELOPMENT

NATURE OF PROJECT/APPROVAL SOUGHT: Discussion of a
4,020 sq. ft retail building directly adjacent to Ralph's.
LOCATION: 7488474998 Country Club Drive
ZONE: P.C.-(2)
Mr. Kevin Swartz, Associate Planner, presented for discussion a
4,020 square foot retail building directly adjacent to Ralph's at
Desert Springs Marketplace. He stated this building will be located
to the west of Ralphs. In speaking with the applicant, there was
some concern from the Fire Department and Public Works
� regarding the new drive aisle and the applicant will now put the
drive aisle on the west side of the building. The design is in keeping
with the overall center. Staff was concerned with the metal trellises
on the west elevation and staff has recommended a stucco pop-out
to put some deviation on that wall. The roof line maintains the
existing roof line of the center. Colors and materials are desert
colors and in keeping with the same overall cotor palette. He said
this pad was part of the original entitlements and will not have to go
to the Planning Commission.
The Commission asked about the color palette and MR. ROBERT
DORN, Director of Development ROIC, stated they will keep the
same color palette that was approved by the Commission two years
ago. The Commission suggested that the proposed colors must
match the existing shopping center.
The Commission and the applicant discussed roof access and
signage. MR. DORN said they will have an interior roof access. Mr.
Swartz said signage is not a part of this process. MR. DORN said
each tenant will submit their individual sign requests.
The Commission discussed the removal of the metal trellis on the
r west elevation and adding architectural pop-outs. Commissioner
Vuksic referred to the offset for the tower and suggested they be

careful with the offset after they add the pop-outs on the west
elevation.
ACTION:
Commissioner Lambell moved to approve subject to: 1) applicant working
with the City on relocating the existing drive aisle to the west side of the
new building; 2) remove the metal trellises on the west elevation and look
at adding pop-outs; 3) the proposed colors must match the existing
shopping center as proposed; and 4) the tile roof must match the existing
center. Motion was seconded by Commissioner Levin and carried by a 7-
0-1 vote, with Clark, Colombini, Lambell, Levin, McAuliffe, Van Vliet and
Vuksic voting YES and Mclntosh absent.
VI. ART IN PUBLIC PLACES UPDATE — Commissioner Vuksic —April 13, 2106
A piece called "Mesa" was donated to the City and will be placed in Civic Center
Park; eighteen (18) pieces of art along with four (4) alternate pieces were
selected for the EI Paseo exhibition; the Art and Essay exhibition, My Favorite
Landmark, is on display in the Community Gallery; the First Weekend event will
be Vision on San Pablo on May 7.
