IV. APPROVAL OF MINUTES: August 14, 2018
Action:
Commissioner Levin moved to approve the August 14, 2018 meeting
minutes with minor changes. Motion was seconded by Commissioner
McAuliffe and carried by a 6-0-1 vote, with Lambell, Levin, McAuliffe,
McIntosh, Van Vliet, and Vuksic voting YES and Brewer absent.

A. Final Drawings:
1. CASE NO: MISC 18-0009
APPLICANT AND ADDRESS: LULULEMON ATHLETICA, 855

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve an awning color change; Lululemon Athletica.
LOCATION: 73470 El Paseo, Suite 119

Commissioner Vuksic recused himself from this project and left the room.
Mr. Nick Melloni, Assistant Planner, presented a modification to a
recent approval for Lululemon. At the last meeting on July 10, 2018,
a request to change the awning color to black was approved. Now
today they are requesting a modification from black to aqua. Staff
feels that an approval of this new awning color would require a
modification of the paint color used on the building and potentially
using lighter tints or either omitting the tan color and opting for a
lighter gray or white on top; something that would work with the aqua.
They are also proposing to keep the existing lighting sconces on the
front elevations to be consistent with the rest of the tenant spaces
and a request to add a graphic that will be placed on the two front
windows on either side of the front elevation. On the original
proposal, the two windows had a vinyl decal applied to them to make
them appear frosted and being proposed today is an opaque graphic.
He pointed out that the One Eleven Development Code has specific
requirements for storefront windows to be transparent. However, the
Commission could make an exception since this is intended to
screen merchandise storage areas. However, with that specific
graphic it might be considered busy and the Commission may
consider using a more geometric pattern or some type of artwork or
design as opposed to a photo or something more fitting to the street.
MS. MARYANN ARTAVIA, Lululemon Athletics, said they are
looking for an approval on the aqua color, however, as a second
option they are proposing pinstriping. Chair Van Vliet asked if the

aqua was a corporate color. MS. ARTAVIA said no but Lululemon is
changing the colors in a lot of their locations and El Paseo is one of
the locations they are hoping to get approval for. In reference to the
vinyl graphic she spoke with Lululemon and they haven't determined
what the actual picture will be and; will make a decision upon a
recommendation from the.Commission.
Commissioner McIntosh asked if they are trying to design this with
characteristics of Palm Springs since the first submittal shadow
blocks were applied to the front elevation and it was sort of mid-
century. MS. ARTAVIA said they are looking to add more color than
the white. Commissioner McIntosh felt the stripes area bit much for
that corner.
Commissioner Lambell said she is having trouble with the way this
project is being presented since this is the third submittal and this
current proposal is a real departure from the black to the aqua and is
very reminiscent of the beach not the desert. She said it is important
that what the Commission is approving is something that is best for
Palm Desert. MS. ARTAVIA said the aqua color is how they want to
represent their brand. Commissioner Lambell was concerned that
the aqua doesn't represent the quality of their product. MS.
ANGELIQUE TRIBELHORN, Lululemon, said they are now
integrating that color into their product line. Commissioner McIntosh
said he didn't find the aqua that offensive and referred to stores on
El Paseo where this color is represented. He said it seems like it
could be incorporated in with the rest of the building colors a little
.better by looking at the whole palette. There are some subtle
adjustments they can do in the building elements and those color
changes will help to embrace the awing color. He said the grays and
whites work really well with the black awnings and he thinks the
composition just needs to be fine-tuned a little bit. He said the
Commission is more concerned with the feeling of the street scene
and something that is visually pleasing.
The Commission reviewed and discussed the window graphic.
Commissioner McIntosh said it was a good concept and felt it was
an interesting mural with blending rColor tones and monochromatic.
The Commission continued to discuss the awning color and
suggested the applicant work on the building paint colors to
complement the proposed aqua color. Commissioner McAuliffe

referred to the orange awnings on the neighboring building and said
it's not the boldness of color that is necessarily an issue it's how the
aqua will look next to the orange because you have to live next to
that. He felt the black next to the orange will work quite well. Overall
where Lululemon 'is headed with the improvements he thinks it is
much better than what is currently there. He suggested they be very
careful as they are looking at those colors to study it from that angle
and said the.orange negatively impacts what they are trying to
accomplish. When they put it together, they have to ask themselves
how does the whole building live.well with the surrounding buildings.
ACTION:
Commissioner Lambell moved to continue Case No. MISC 18-0009 subject
to: 1) window graphic shall be subdued; 2) adjust building colors to
compliment;proposed Aruba (aqua) awning color; and 3) consider relation
of proposed Aruba (aqua) awning color with awnings of adjacent tenants.
Adjust color accordingly to compliment entire fagade. Motion was seconded
by Commissioner Levin and carried by a 5-0-1-1 vote with Lambell, Levin,
McAuliffe, McIntosh, and Van Vliet voting YES, Vuksic abstaining and
Brewer absent.
B. Preliminary Plans:
1. CASE NO: CUP 17-0028
APPLICANT AND ADDRESS: PANTHER BUDS, LLC, 2 Avenida
Andra, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
preliminarily approve fagade changes to existing building; Panther
Buds.
LOCATION: 74725 Joni Drive
ZONE: S.I.
Mr. Eric Ceja, Principal Planner, reminded the Commission that this
proposal for fagade changes for Panther Buds was continued from
June 12, 2018. Panther Buds will operate an approximately 10,000
square-foot cultivation site for cannabis on Joni Drive. At that
meeting, the Commission recommended several items to be

addressed by the applicant. The applicant has returned today with
revised renderings and a material board and samples.
MR. ARMANDO CHAVEZ, designer for GLS Architecture, said all
equipment needed for the HVAC systems will be screened and
access to the facility has been configured to meet ADA standards.
They will be proposing landscape and keeping the palm trees in front
of the building. He went through each recommendation made by the
Commission• at the last meeting:• clearance around the exterior
condensers was increased by V as required by the manufacturer; a
legend and notes were included on the plans; the wall types were
defined• to show new and existing walls; he detailed the soffit
overhang on the west rear building; the transition from the new
facade and the existing CMU block wall was resolved by creating
more reveal and all will be painted the new color; the only equipment
on the roof will be the exhaust fans for the CO2 that will not be visible
from the street as the equipment will be far enough away from the
ridge; all roof drainage will be located within the buildings; the trough
detail on the front of the north east building at street side has been
resolved; he raised the heights of the parapets to screen the existing
equipment; he presented a proposed color and materials board and
discussed the stucco and other materials for the buildings.
The Commission and the applicant reviewed and discussed the
exterior condensers, screening, the color scheme, raising the height
of the property line walls that will be patched and painted and how
the material on the front elevation will transition to stucco on the
south elevation. Commissioner McIntosh was concerned with the
south side of the building being so visible and wondered why it's
being excluded. He pointed out that this Commission looks at how
this will affect the community, as well as the neighbors. The roof edge
details need to tie together and asked the applicant not to overlook
that. MR. CRANFILL said they will modernize that building to look
more like the rest of,the buildings.
MR. CHRIS CRANFILL, Panther Buds, discussed the interior of the
facility with individual air-cooled rooms with manufacturing in some
of the rooms that will be Class 1 compliant. He described the facility
as a controlled access facility with a showroom in the front and
visitors being pre-approved and pre-badged.

Commissioner'Lambell recommended they bring the external ladder
into the interior of the building and the applicants agreed.
Commissioner Vuksic and MR. CHAVEZ discussed the upgraded
packaged units on the front elevation. Chair Van Vliet noted that all
roof-top equipment shall not exceed the height of the parapets and
to consider the curb and roof slope.
Commissioner Vuksic referred to the air handlers inside each flower
room and MR. CHAVEZ said there will be two air handlers in each
bay and the condensers will be external. Commissioner Vuksic
stated that the parapet cap flashing is quite aggressive on the
elevations. However, on the renderings it shows really clean boxes
and in reality there will be an 8" piece of metal on the top of each of
those. Commissioner Vuksic stressed that it's not going to look like
the plans and is a big drop for flashing. MR. CHAVEZ proposed a
clean surface going up without the flashing.
Commissioner Vuksic referred to the yellow color on the materials
board and said normally that color is reserved for accents on the
building and to paint the entire building that color is pretty rough. MR.
CRANFILL said they can have a two-tone on the building and use
the yellow as an accent color. Commissioner Vuksic suggested they
study the colors and use the yellow in limited amounts to provide
some punch,and not be over powering.
Commissioner Vuksic mentioned wrapping the sides of the building
and thinks that on the south side it will be visible at least at the top
and the people in the parking lot next door will see it. He stated
ending material on an outside corner takes a very special artistic
statement to make any sense and suggested completing the form
with the wood material. He and the applicant discussed how they can
wrap that side of the building or create another form with a
termination point. He also suggested when they go around the corner
not to drop the parapet down lower as it has to be the same height.
He and the applicant discussed the pop-out on the north side
elevation, the concrete wall as it changes height, and the element
that wraps around the internal courtyard of the building.
Commissioner McAuliffe circled back to the colors and said most of
the colors are warm, one is a neutral color, and some pretty strong
cool colors. He suggested they look at the significant amounts of cool
colors they are applying to the building and pick one and use the

other two as accents. Right now the amount of cool and warm colors
are a little unsettling.
Chair Van Vliet was concerned with the roof jacks on sloped roofs
being visible and suggested they make sure there is enough room to
slide them down as needed.
ACTION:
Commissioner McIntosh moved to continue Case No. CUP 17-0028 subject
to: 1) roof access shall be internal; 2) all roof-top equipment shall be below
the parapet; 3) clean up detail for the parapet cap flashing; 4) restudy color
scheme and use yellow color in limited amounts; and 5) wrap improvements
around the building side elevations and create form on outside corner.
Motion seconded by Commissioner McAuliffe and carried by a 6-0-1 vote
with Lambell, Levin, McAuliffe, McIntosh, Van Vliet and Vuksic voting YES
and Brewer absent.

Commission and staff discussed Paseo Hotel and Art in Public Places.
VII. ADJOURNMENT
Commissioner Lambell moved to adjourn the Architectural Review Commission
meeting at 2:10 p.m.
