Action:
Chair Van Vliet moved to approve the May 22, 2018 meeting minutes. Motion
was seconded by Commissioner Levin and carried by a 7-0 vote, with Brewer,
Lambell, Levin, McAuliffe, McIntosh, Van Vliet, and Vuksic voting YES.

A. Final Drawings:
1. CASE NO: MISC 18-0009
APPLICANT AND ADDRESS: LULULEMON ATHLETICA, 855 Homer
Street, 41h Floor, Vancouver, BC V613 2W2
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve exterior tenant improvements; replace tile band with stucco,
replace fabric awnings w/wood canopy, adding breeze block walls, new
signage, paint existing storefront mullions, replace two glazing panels
with glass doors; Lululemon Athletica.
LOCATION: 73470 El Paseo, Suite 119

Commissioner Vuksic recused himself from this project and left the room.
Mr. Nick Mellon!, Assistant Planner, presented a proposal for storefront
improvements for Lululemon Athletica; a retail store located on the
corner of El Paseo and San Pablo Avenue. He presented the
renderings, passed around the color board and described the scope of
work to include; a paint color change to all white, changing to a wood
canopy, adding decorative breeze blocks, and changing some of the
wall sconces. He stated that the interior modifications are not subject to
ARC approval and the proposed signage will be approved at staff level.
Staff is concerned that by painting the building all white it will lose some
of the modulation and projections. He is also concerned whether the
breeze block detail will be aligned flush with the vertical projections
because the plans do not show that it will be straightened. Staff
recommends approval subject to some type of modifications that
highlight the modulation on the fagade along El Paseo, adjusting the
breeze block alignments and patching the stucco where needed and
requiring a planning final inspection prior to the issuance of the
Certificate of Occupancy.
Commissioner Lambell asked about the architectural design and MS.
MARYANN ARTAVIA, Lululemon, said she wasn't the architect and
could not answer specific architecture and design question as she was
present to discuss the color. She mentioned that Mr. Melloni had voiced
his concerns with going to a single color and said he recommended
three options for an alternative color scheme. She said Lululemon is
agreeable with going with a two-tone color as opposed to all white.

The Commission discussed the proposed color and suggested adding
another color scheme for differentiation. Commissioner McIntosh
discussed the architecture on El Paseo and said the proposed color
doesn't tie into the architecture that surrounds the building. In reference
to the breeze block he said it is a detail issue and mentioned there may
be difficulties with those integrating properly with the existing
architecture.
The Commission continued the request to allow the applicant to address
concerns regarding color and provide additional information for the
wood canopy members, connection details on the wood trellises, and
the alignment of the breeze block with the columns.
ACTION:
Commissioner McIntosh moved .to continued Case No. MISC 18-0009 subject
to: 1) add another color scheme for differentiation; 2) show size of the wood
canopy members; 3) show connection details on the wood trellis; 4) show details
on framing and mounting of the breeze block; 5) revise plans to show alignment
of vertical columns and proposed breeze block; and 6) clarify the building design.
Motion was seconded by Commissioner Lambe[[ and carried by a 6-0-1 vote,
with Brewer, Lambell, Levin, McAuliffe, McIntosh, and Van Wet voting YES and
Vuksic abstaining.
2. CASE NO: SARC 17-0003
APPLICANT AND ADDRESS: FOUNTAINHEAD SHRUGGED, LLC,
c/o Vasanthi Okuma, 1401 Quail Street, Suite 100, Newport Beach, CA
92660
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
approve a monument sign program: Monterey Crossings.
LOCATION: NEC Monterey Avenue and Dinah Shore Drive
ZONE: P.C. (3) F.C.O.Z.
Mr. Kevin Swartz, Associate Planner, reminded the Commission that
this item came before the Commission on November 28, 2017 for
approval of the sign program. Mr. Swartz went over the
recommendations made at that meeting and said the applicant has
submitted those changes. He stated that the applicant is proposing
three (3) monument signs along Monterey Avenue (Monterey), two (2)
on Dinah Shore Drive (Dinah Shore) and two (2) freeway-oriented signs
in the rear of the property and presented the renderings for each of the
signs. He referred to the three (3) monument signs along Monterey and
noted that larger centers are allowed to place a sign every 1,500 feet;
however, staff does not prefer to see the clustering of signage. If the

ARC finds it compatible with the center, the Commission can approve
the'three (3) signs. He presented three (3) design options for the signs
on Monterey. Staff is recommending approval with allowing only one (1)
sign on Monterey.
MS. VASANTHI OKUMA, Fountainhead Development, said the
challenge of the signs is the topography of the site and pointed out how
Monterey rises as you travel north. Typically tenants rely on building
signage for identification but the tenants will be depressed 10' or more
so signage along Monterey will be very important. After reviewing the
Commission's suggestions at the meeting in November, they took a
very hard look at all the comments and didn't want to overlook anything.
As far as Fountainhead is concerned, they can live with two (2) signs
and said it's the panels that are important. They came up with clustered
signs that read more individual because they are clustered rather than
having several signs very far apart. She discussed the materials for the
signage and stated they integrated the freeway signs with the
monument signs to create a cohesive package for the entire center.
Commissioner McIntosh was concerned with the amount of monument
signs, as well as the amount of signage on the buildings. MS. OKUMA
said as a regional center this type of signage brings some interest and
liveliness to the entire center. Commissioner McIntosh thought it would
be excessive with three (3) signs along Monterey. He stated that he
likes the design, materials and the lighting concept of the signs and how
it all ties into the buildings. It is just a question of how many signs will
be marching up the Monterey slope. MR. TOM SWEEKA, Developer,
suggested they eliminate one (1) monument sign along Monterey and
shift one (1) farther up Monterey. The Commission was agreeable to
this proposal and discussed the locations for the two (2) remaining
signs. Commissioner Vuksic suggested the second sign be located
farther up Monterey approximately 300' and situated between Pads 3
and 4. He also suggested the two (2) monument signs along Dinah
Shore be separated by 500'. The Commission reviewed and discussed
design options, the proposed six (6) or seven (7) tenant panels, panel
color, font size and lighting.
The Commission reviewed and discussed the freeway-oriented
monuments signs and lighting. Mr. Ryan Stendell, Director Community
Development said a lighting plan will be forthcoming.
Commissioner McIntosh made a motion for approval. Commissioner
Vuksic made the second but had comments regarding the addition of
surface lighting on the perforated metal and not just a backlit silhouette.

- Commissioner McIntosh amended his motion and added that the
exterior illumination shall return to the Commission for review.
Commissioner McAuliffe expressed his concern with the perforated
metal panel design and said these panels come in a limited sheet size
and wondered how they will butt up against each other and how they
will maintain the uniform pattern. He and the applicant reviewed and
discussed his concern.
ACTION:
Commissioner McIntosh moved to approve the sign program subject to: 1)
design of all monument signs shall be Option A with seven (7)' panels and
chard; 2) two (2) monument signs shallbe allowed along Monterey Avenue; 3)
one (1) monument sign shall be located at the corner intersection and the
second monument sign shall be located farther up Monterey Avenue
approximately 300'between Pads 3 and 4;4) the second monument sign along
Dinah Shore Drive shall be located 500' east from the one labeled M2.1 within
the Sign Program; 5) the freeway monument signs shall be Option A with
perforated metal; and, 6) exterior illumination shall return to the Commission
for review and approval. Motion was seconded by Commissioner Vuksic and
carried by a 7-0 vote, with Brewer, Lambell, Levin, McAuliffe, McIntosh, Van
Vliet, and Vuksic voting YES.
B. Preliminary Plans:
1. CASE NO: CUP 17-0023
APPLICANT AND ADDRESS: THE LEAF at 73740, LLC a
CALIFORNIA LIMITED LIABILITY COMPANY, 72650 Fred Waring
Drive #202, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
preliminarily approve fagade changes for The Leaf.
LOCATION: 73740 El Paseo
ZONE: D
Mr. Kevin Swartz, Associate Planner, presented fagade changes for a
cannabis dispensary called The Leaf. In October, 2017, the City Council
adopted a cannabis ordinance to allow six (6) retail locations with one
(1) retail shop located on El Paseo east of Larkspur Lane. This new
retail shop will be located within the former Don Vincent's clothing store
and as part of the selection criteria, the applicant was required to make
extensive fagade enhancements. Mr. Swartz passed around the
materials board, a board displaying the security system and presented

a virtual video of the exterior and interior-of the store. As part of the
conditional use permit, this will move forward to the Planning
Commission for review. "
MR. ROB BERNHEIMER, discussed the exterior and interior
modifications and said the cannabis products will not be visible from El
Paseo. They have created a lobby off the front entrance and the
products will be fully enclosed within an interior room.
Commissioner Vuksic asked the architect to describe the element on
the roof. MR. STEPHEN STEPHANOFF, TBK Design Group, said it is
supposed to-represent an atrium with plants on the inside to represent
a greenhouse. This atrium is a play on their name, The Leaf, and will
have lush faux landscape.
Commissioner Vuksic referred to the elements coming down from the
greenhouse and asked about the ribbed texture on the edge. MR.
STEPHANOFF said it is actually a W faux wood metal square that will
travel all the way around. It will be painted stucco' with the W metal
stacking on top of it with a 3° deep groove.
Commissioner Vuksic and the applicant discussed the vertical glass
system to the left of the entry feature that comes out and angles back
towards the building. MR. STEPHANOFF said it is supposed to be like
a solarium with glass and metal pieces. .
Commissioner Vuksic and the applicant discussed the abstracted
cornice detail on the front and rear elevations. Commissioner Vuksic
suggested they revisit this detail. Commissioner McIntosh felt the
building has a nice form without this detail.
Commissioner Levin pointed out that civil plans were not included with
their submittal and asked where the detector check and fire riser rooms
would be located. MR. STEPHANOFF said they will be located on the
back side of the building.
Commissioner McIntosh referred to the solarium and thought the right-
of-way would be too narrow with the benches, balls and umbrellas.
Since these elements play a dynamic part in the composition of the front
elevation, he suggested moving the solarium in a bit so they can
preserve this element.
The Commission reviewed and discussed the stone cap on the rear
elevation, awnings, lighting, security, signage, and controlling the
intensity of the lighting on the front elevation.

Commissioner Vuksic moved to preliminarily approve subject to: 1).revisiting the
front and rear elevation cornice detail; 2) adjusting solarium on front elevation
to preserve benches and umbrellas and approved by staff; 3) adding a dimmer
for lighting strength,on front elevation and recheck for appropriateness; and, 4)
adding a fire riser room. Motion was seconded by Commissioner Levin and
carried by'a 7-0 vote, with Brewer, Lambe[[, Levin, McAuliffe, McIntosh, Vuksic,
and Van Vliet voting YES.
2. CASE NO: CUP 17-0028
APPLICANT AND ADDRESS: PANTHER BUDS, LLC, 2 Avenida
Andra, Palm Desert CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to
preliminarily approve fagade changes for Panther Buds.
LOCATION. 74725 Joni Drive
ZONE: S.I.
Commissioners McIntosh and Vuksic left at 2:40 p.m.
Mr. Kevin Swartz, Associate Planner, presented fagade changes to an
existing building for cannabis cultivation, called Panther Buds. As
previously mentioned, the City Council adopted a cannabis ordinance
in October, 2017 to allow cannabis cultivation in the service industrial
zone. This building is currently the Palms to Pine Automotive on Joni
Drive. He presented the renderings, passed around the materials board
and described the scope of work.
Commissioner Brewer and MR. ARMONDO CHAVEZ, designer,
discussed the A/C units and the height of the parapet that was only 3'-
2" all the way around. Chair Van Vliet said it is required that the parapet
be taller and said the mechanical units cannot be visible from the street.
After further review and discussion with the applicant, Chair Van Wet
suggested submitting a roof plan to show the mechanical equipment
and the screening.
Commissioner Lambell asked about the security system. MR. DANIEL
SENSKE, representative, described the security and surveillance
system that will be provided by a security company. He said the entire
security system was designed as a requirement of Prop 64. .
Chair Van Vliet said it is a very difficult task taking an existing building
and trying to cover the exterior and make it look good. After reviewing
the drawings, he found a lot of inconsistencies in the drawings and lack

of detailing. He reviewed and discussed the condensers in the courtyard
and said they need a 36" clearance on the power side for it to work.
properly and suggested they increase the clearance and redraw the
plans.
Commissioner Van Vliet was confused with the different wall types since
a legend wasn't provided on the plans. He pointed out several items that
needed further review: the overhang on the west side not matching the
elevations; the lack of construction details; providing details on
transitioning from the new and existing construction and how it will blend
seamlessly; the lack of a roof plan to show the mechanical equipment,
screening; internal drainage detail; details-on the gable roof and cap;
and providing consistent and matching plans.
Commissioner McAuliffe said from a security standpoint he suggested
having security mesh on the backside of the gate and asked that those
details be included on the plans. He said it will be very important for this
project to look unified and look like one center rather than in pieces. He
said the color scheme and materials are simple, however the cool color
blended with the warm colors are a little unsettling and suggested they
make the color scheme more harmonious.
ACTION:
Commissioner Lambell moved to continue Case No. CUP 17-0028 subject to:
1) increase clearance on exterior condensers; 2) include legend and notes on
plans; 3) define wall types; 4) show correct soffit overhang on west (back)
building; 5) address transition from new and existing construction to blend in
seamlessly; 6) provide proper detail at gable end on street side of the north
east building parapet; 7) submit roof plan to include mechanical equipment on
existing sloped roofs and possible screening; 8) roof drainage shall be located
within the buildings and not surface mounted on building; 9) provide drainage
trough detail at front of north east building at street side; 10) parapet cap detail
shall be less visible; 11) address color scheme; and 12) plans shall be
consistent and match. Motion was seconded by Commissioner Brewer and
carried by a 5-0-2 vote, with Brewer, Lambe[[, Levin, McAuliffe, and Van Wet
voting YES and McIntosh and Vuksic absent.

VI. COMMENTS
Mr. Swartz introduced the new intern in Community Development; Mr. Justus Swajian.
He graduated from Palm Desert High School and College of the Desert
graduate and recently obtained a B.S. Public policy degree from University
of Southern California. He will be attending Law School at University of San
Diego in the Fall.
