Architectural Review Commission On June 23, 2015, the Architectural Review Commission (ARC) reviewed and approved the project as proposed with a 7-0-1 vote, with Commissioner McIntosh absent. The Commission supported the architectural and landscaping design, and the site location. The Commission stated that the design and materials of the memory care facility make a very attractive building with clean architectural lines and elements. The Commission also stated that the building has appropriate massing in the right locations, and should not impact the neighboring properties. Larrea Memory Care Facility PP 15-128 September 1, 2015 Page 2 of 9 Executive Summary Approval of staffs recommendation would approve a new 20,559-square-foot memory care facility consisting of 31 bedrooms. Each bedroom has two beds per room totaling 62 beds.The facility will have a registered nurse on staff 24 hours a day. Staff believes the registered nurse will alleviate the potential burden on the Fire Department from responding to minor injuries.A Conditional Use Permit (CUP) is required in the R-3 zone to operate a memory care facility. Otherwise, the proposed project meets all other development standards within the R-3 zone. Background A. Property Description: The project is proposed on two (2) parcels, which total 40,521 square feet. The applicant must submit for a parcel map waiver to merge the parcels into one (1). The parcels are located in south Palm Desert on the south side of Larrea Street, east of San Luis Rey Avenue, west of Portola Avenue, and north of Shadow Mountain Drive. One of the parcels has a block wall and some concrete, while the other parcel is vacant. The applicant is proposing to demolish the existing structure.Access to the site is off of Larrea Street on the west side of the property by a two (2)-way-driveway. B. Zoning and General Plan Designation: Zone: R-3, 13,000 (3), Residential Multiple Family General Plan: R-M, Medium Density(4-10) dwelling units per acre C. Adjacent Zoning and Land Use: North: R-3, 20,000(3), Residential Multiple Family/Apartments and parking lot South: R-3, 13,000 (3), Residential Multiple Family/Apartments East: R-3, 13,000 (3), Residential Multiple Family/Apartments West: R-3, 13,000 (3), Residential Multiple Family/Apartments Proiect Description The proposed single-story 20,559-square-foot memory care facility consists of 31 bedrooms, lobby area, dining room and kitchen, family room, greeting room, nurses' room, break room, laundry room, administrative room,therapy room, salon,two(2)activities areas,theater room, and an interior patio/garden. Each bedroom is 323 square feet with two beds,totaling 62 beds throughout the facility. Each room has a closet and restroom. Operating hours are 24 hours a day, seven (7) days a week. The facility would have approximately 45-50 full-time and part-time employees, including three (3) registered nurses working in three(3)eight(8) hour shifts.The operator envisions 16 employees working at one time. Visiting hours are proposed from 8:00 a.m. to 8:00 p.m. The facility offers daily in-house and outside activities seven (7) days per week. In-house activities include movies within the theater room, card games and board games, and salon days. Outside activities include group trips to El Paseo, banking at different banks, restaurants, movies, museums, and parks.Approximately 65 percent of the residents will attend the outside group outings. The operator anticipates the traffic to be light with average daily peak trips between 17 and 24 vehicles. Such trips include visitors, scheduled transportation on community buses, vender deliveries for food and supplies, visits from health services including health care and hospice representatives. The facility will be using small medical equipment such as electronic scales to weigh residents, blood pressure monitors, and oxygen equipment.All use of the equipment will be performed by a registered nurse. A. Architecture: The proposed architecture maintains a contemporary theme with flat roof lines, architectural pop-outs from three (3) to five (5) feet, and thick architectural elements. The facility is single-story with rooflines between ten(10),fifteen(15),and nineteen(19) feet, with an overall height of twenty-two (22) feet. The design includes desert colors that are of smooth stucco finishes ("Home Plate" and "Whisper") and sand stucco finishes("Dry Creek", "Tea Bag", and "Sail Cloth"). Other materials include fiber cement board siding ("Woodland Brown"), faux stone veneer ("Yuma Blend"), metal canopy ("Tea Bag"), aluminum frame windows and doors, aluminum solar louvers, metal equipment screen, and double glazed windows. Each window is recessed by two (2) feet to provide depth. The applicant is also proposing a block wall around the site.The block wall is proposed at six (6) feet in height on the interior and rear property lines. The wall is proposed at five (5) feet in height at fifteen (15) feet from curb along Larrea Street. B. Landscaping: The landscape design consists of a desert theme with species requiring minimal water usage. The project has two indoor patio/garden areas. These areas will be planted per the residents' choice, which will allow them to enjoy the landscaping. Overall, the landscape design is minimal, but provides for a good balance with the building architecture,while maintaining lowwater usage.The applicant has provided a detailed landscape plan, which is attached to the staff report. Analysis The purpose of the multifamily residential (R-3)district is to provide suitably located areas for residents to live in a variety of housing types at high population densities consistentwith sound standards of public health and safety. The project requires approval by the Planning Commission, since the use of a memory care facility requires a CUP to assure land use compatibility with the surrounding neighborhood and project density. Over the last year, emergency medical responses for residential care facilities have reached an all-time high. There have been a high volume of emergency calls for very minor injuries to which the Fire Department and paramedics have to respond. Many such facilities do not have a registered nurse on staff, which forces the facilities to call 911 for even very minor injuries. The applicant is proposing to have three(3) registered nurses, with each working an eight(8) hour shift, on site at all times. This would alleviate many of the emergency calls, since registered nurses can treat minor injuries. The City is in the process of developing an ordinance for emergency medical responses where new residential care facilities (and other facilities imposing high demand on emergency medical services) would have to pay a fee. No fee has been established or adopted for this project at this time. Staff has placed a condition on the project that if the City adopts an ordinance for emergency medical responses for residential care facilities before the applicant is issued the Certificate of Occupancy for the building, the applicant would be required to pay the emergency response fee. Development Standards: The proposed project complies with the development standards for the R-3 zone. The table below outlines the development standards, what is allowed by code, and what is being proposed. Height: The surrounding properties are being operated as apartments. To the north are the "Selene Apartments", which are single story. To the east are apartments which have a mix of single and two-story units, and further east there are two-story apartments. To the west, there are existing apartments which are single-story, and further west, there are two-story apartments. Directly south of the site are two-story apartments. The R-3 zone allows for two-story buildings at twenty-two (22) feet in height for flat roofs and twenty-four (24) feet for pitch roofs. The proposed facility is single-story, but has an overall height of twenty-two (22)feet, which is allowed by code.Although, the facility is single-story,the two-story height is needed and warranted to carry out the architectural elements and design of the building. This allows the building to have architectural merit and stand out in a positive way within the neighborhood. The proposed height and site location are supported by staff, as they will not adversely impact any viewsheds or diminish property values. Parking: Chapter 25.46 Off-street Parking and Loading requires residential care facilities to provide one (1) parking space per four (4) beds. At 62 beds, the site would need 16 parking spaces. The applicant is also proposing 774 square feet of office use.The code requires one (1) parking space per 250 square feet, which totals three (3) parking spaces. The site as proposed would need 19 parking spaces, and the applicant is proposing 19 parking spaces. The operator envisions no more than 16 employees working at one time, leaving three (3) parking spaces for guest parking. To assure that there is adequate parking, staff has placed a condition of approval on the project that no more than 16 employee vehicles will be allowed at one time. Residents within the memory care facility do not drive, and will not store vehicles on-site. D. Land Use Compatibility: The proposed project is zoned R-3, 13,000 (3) and designated Medium Density Residential in the General Plan. These designations are consistent with the proposed land use and project with the processing and approval of the CUP. Otherwise, the proposed project meets all other development standards in the zone. Residential care facilities require a CUP to assure land use compatibility. When the applicant originally submitted the project, staff had concerns with the use of a memory care facility at this location. After analyzing the surrounding area, a memory care facility is suited for this location and complements the surrounding apartments. If residents within apartment buildings have social gatherings with loud music, it could disturb the surrounding neighborhood.The proposed facilitywould operate in a different fashion and is considered to be a very low intensity use in regards to noise and disturbances to the neighborhood.Also,the facility does have organized day trips to El Paseo where the residents could enjoy the restaurants, shopping, art,and atmosphere. The project is located in south Palm Desert where there is a mix of residential developments.The project does not physically divide an existing community, and does not conflict with any applicable land use plan, policy, or regulation outlined in the General Plan. That the proposed location of the conditional use is in accordance with the objectives of the zoning ordinance and the purpose of the district in which it is located. The proposed location of the project is located in the R-3 Residential Multiple Family zone. The purpose of the zone is to provide suitably located areas for residents to live in a variety of housing types at high population densities consistent with sound standards of public health and safety. The use of a memory care facility is allowed in the zone, subject to the Planning Commission approving a CUP to assure land use compatibility and density within the surrounding neighborhood. The project is located in south Palm Desert where there is a mix of residential developments. The use of the memory care facility as proposed and designed meets the zoning ordinance and the purpose of the district. The facility will blend into an established residential neighborhood offering a low intensity use, which would not cause for any negative disturbances within the neighborhood. The project does not physically divide an existing community, and does not conflict with any applicable land use plan, policy, or regulation outlined in the zoning ordinance. 2. That the proposed location of the conditional use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity. The proposed use will not generate or cause any disturbances within the surrounding area. The business would not be detrimental to the public interest, health, safety, welfare, and materially injurious to properties in the vicinity. No known toxins, combustibles, or environmental hazards will be introduced by the proposed use. Based on consideration of the whole, the proposed project is in accordance with the Palm Desert Municipal Code in regards to land use. 3. That the proposed conditional use will comply with each of the applicable provisions of the zoning ordinance, except for approved variances or adjustments. The memory care facility as conditioned and designed meets the provisions of the zone. The project complies with all building setbacks, lot coverage, building height, and parking of the City's Zoning Ordinance as described in the staff report. There are no variances or adjustments required for approval. 4. That the proposed conditional use complies with the goals, objectives, and policies of the City's General Plan. The General Plan land use designation for the site is "Medium Density Residential" One of the primary objectives stated in the Land Use Element of the General Plan is appropriate residential development that includes single family, condominiums, garden apartments, and affordable housing. The intent of this designation is to encourage development of a wide variety of dwelling unit types at moderate densities. The proposed 31 units on a 40,521 square-foot parcel would be considered a highly dense project if the use were apartments and/or condominiums. Residential care facilities are designed to be dense,because the residents remain strictly on-site and the City does not want to create an abundance of residential care facilities in one area. Staff has determined that the proposed density is sufficient and meets the intent of a residential care facility. Goal 2 of the Commercial Land Use Goals and Policies states "A pattern of commercialland uses conveniently and appropriately distributed throughoutthe City, meeting the community's needs while minimizing the disruption to or incompatibilities with other land uses." The use as proposed and conditioned would complement the other uses within the area. The use would not create tragic, noise, and parking impacts. If residents within apartment buildings have social gatherings with loud music, it could extend into the later evening hours, which would disturb the surrounding neighborhood. The proposed facility would operate in a different fashion and is considered to be very low intensity in regards to noise and disturbances to the neighborhood. This project maintains a land use that is consistent with the goals, policies, and programs of the General Plan. The project is consistent with the General Plan in respect to the proposed business and with the uses in the vicinity. If the project is subject to CEQA, staff must conduct a preliminary assessment of the project to determine whetherthe project is exempt from CEQA review. If a project is not exempt, further environmental review is necessary. Further review from a non-exempt project would result in a Negative Declaration, a Mitigated Negative Declaration, or an Environmental Impact Report (EIR). Generally, an EIR must be prepared if a project may have a significant impact on the environment. In this case, the City of Palm Desert (City), in its capacity as the Lead Agency for this project under the CEQA, has determined that the proposed project request is categorically exempt under Article 19 Section 15332 In-Fill Development Projects(Class 32)of the CEQA;therefore, no further environmental review is necessary.
