REQUEST FOR CONSIDERATION of a Conditional Use Permit (CUP) to operate a new restaurant, Alps Village, within the Service Industrial zone located at 77-734 Country Club Drive, Suite F. Case No. CUP 15-382 (Robert H. Ricciardi Architects, Palm Desert, California, Applicant). Mr. Kevin Swartz, Associate Planner, reviewed the staff report (staff report is available at www.cityofpalmdesert.org) and recommend approval of the CUP. He offered to answer any questions. Vice Chair Sonia Campbell clarified that there w o alcohol served on the restaurant patio. Mr. Swartz responded that there would ohol served a patio. He said the applicant received approval from epartment of Alco nd Beverage Control. He noted that the applicant d need to ost two sign t state "No Alcohol Beyond this Point." Commissioner DeLuna inquired if amplified music relates to a live band or pre- recorded music. Mr. Swartz responded any live bands. However, the applicant would need to apply for a separate Entertainment Permit for music. Chair Greenwood referred to the demarcation line shown on the plan, and noted that it is incorrect for the indication of liquor beverages on the patio. What needs to transpire is the column line to the glass line is where the demarcation line essentially should be located. Mr. Swartz replied that is correct. Chair Greenwood inquired if there was any feedba the adjacent business owners. Commissioner Del-una inquired if the television would be located centrally around the bar rather than on the exterior walls close to the outside of the building. MR. He referred to the plan, and pointed to the areas where other televisions are located. Commissioner DeLuna asked if the televisions would all be on the same channel or different channels. MR. SANIN responded that the televisions could be set to different channels or events. Commissioner Pradetto asked the applicant if they are for business. MR. SANIN replied yes. Commissioner Pradetto questioned why t p lication efore the Planning Commission. Mr. Bagato explained that per the or ce, the a licant was i approved for a small takeout restaurant (less th 000 s feet, with on 12 tables). However, during the construction proce licant decided to expand the restaurant. For a larger re urant, the ant needed a Conditional Use Permit. Commissioner DeLuna asked het city ` restaurant. MR. With no fu estimon ered, Vice Chair Greenwood declared the public hearing closed. Commission radetto commented that parking is always an issue. While looking over the staff report, he thought parking would be an issue. However, he never hears if there are adequate bike racks. He stated that they have a bias towards motor vehicles and accommodating vehicles, which encourages more vehicle use. He asked how the City could become more sustainable if they maintain a bias towards motor vehicles. Chair Greenwood agreed with Commissioner Pradetto. The code requires a ratio of the overall parking development to be allocated for bike racks. They are also seeing more mandatory electric car stations on commercial development. Vice Chair Campbell commented that most of the businesses in the area close at 5:00 p.m. and she does not see a problem with parking in the evening hours. Chair Greenwood thought it was a valid project for the location. His only concern would be noise for the residential homes. He stated that the City receives noise complaints, the applicant would be sensitive a ake the necessary adjustments to meet those concerns. Vice Chair Campbell moved to waive furt ea and adopt Planning Commission Resolution No. 2662, approving e No. C 15-382, subject to conditions. He offered to answer any questions. iss ° r ra asked how far bees travel from the beehive. Bagato resp ed t es could travel up to three miles, but generally one o miles. Com oner Pr o questioned if the flight path could be controlled. Mr. Bagat at you cannot control the flight path. He noted that the beehive entrance mu ce away from adjacent neighbors. Commissioner Pradetto asked if a six-foot wall is significant to control the bees. Mr. Bagato replied probably not. He said other ordinances he researched required a six-foot wall. He mentioned that a wall does not have to be six feet. Mr. Bagato responded that re-queening could help prevent or reduce the possibility of bees swarming. Commissioner Pradetto inquired if there were any comments related to the re- queening provision. Mr. Bagato said that one of the subcommittee me was in favor of the provision of re-queening every two years. However, ked to a planner for the City of Santa Monica. Mr. Bagato I ved that to be correct. He noted that bees swarm if a beehive gets too big. There is a provision that would allow a beekeeper to bring in a temporary beehive to help eliminate a swarm or catch a swarm. He stated that the provisions are extreme precautions in the event a beehive(s) become a nuisance. Commissioner Pradetto inquired if the ordinance applies to the hillside areas. Mr. Bagato replied that is correct. He said that currently there is no limit in the Residential Estates or Hillside zones. Staff developed one standard for two or four beehives. Commissioner Pradetto commented that for a property on the hillside and it is five acres, the ordinance states the beehives should be ' the backyard which is not applicable for the hillside. Mr. Bagato agreed that the hillside is a little subje Commissioner Pradetto asked if there was iscussio arding beehives in the backyard for hillside properties. Mr. Bagato replied no. He noted that he do ve that specific information. Commissioner DeLuna inquired if there are bee farms. Mr. Bagato replied that there are bee farms. Bee farms are usually associated with regular farms because they help pollinate the crops. He communicated there is still a major decline, and most of the commercial beekeeping is done on farms. He referred to an article included in the staff report, and noted that urban beekeeping is doing better than agriculture beekeeping. What are the recourses if a beekeeper violates the ordinance? Mr. Bagato said that if the City receives a complaint, the beehive would have to be inspected by a Code Officer or a Planner to make sure the beehive(s) meet the regulations. If the beehive is considered a nuisance, the City would fine the beekeeper and could ultimately have the beehive removed. He stated that they are not going to require the registration of beehives, and they would not go out to inspect the beehive when they first come in. The only ti e they would inspect a beehive is when there is a complaint. Commissioner DeLuna asked how the two-year ning process would be monitored. Mr. Bagato communicated that if there i mplaint, the eeper would be asked to provide documentation of the eening. Mr. Bagato responded that the bees are tied to the queen, and they know how to communicate with each other. Therefore, they know which beehive is theirs. Chair Greenwood questioned if there was any feedback on time that would need to be allocated by Code Compliance by having backyard beekeeping as part of the ordinance. Mr. Bagato replied no. He said that other cities a g backyard beekeeping have not had many issues. He communica the biggest issue is perception. If the City required an Administrati a it, they would need to notify the neighbors and consequently the i bors w et scared without realizing what is really happening with th s. Vice Chair Campbell asked if there is a requirement in the ordinance that a beekeeper must notify the neighbors of the beehives. Mr. Bagato responded that staff received an inquiry to find out if beekeeping was allowed on a 10,000-square-foot lot because the beekeeper notified his neighbors to let them know of the beehives. He noted there was not an issue with the beehives; the neighbor was worried having a beehive next door. Commissioner Pradetto clarified that the only way they ould find out about a beehive being a nuisance is through a complaint. Mr. Bagato replied yes. He explained that he would add it to the staff report to the City C nd they could discuss the notification process to neighbors. Commissioner DeLuna asked what the subcommittee's objection to the notification or disclosure is. Mr. Bagato responded that if there is a notification, inherently the neighbor(s) would be opposed to the beehive(s). Mr. Bagato replied yes, if the beehive is deemed a health or public safety issue. The City could have the beehive removed through an abatement process. Chair Greenwood expressed the importance of educating the public, and noted that he would like to be notified if his neighbor was going to do beekeeping in his backyard. Commissioner DeLuna commented that in theory, ' re were 10 houses in a row, she asked if all 10 houses could have beehi . Mr. Bagato replied that is correct. She said a certain amount of beehives should be allowed per square miles. Commissioner Pradetto asked staff if anyone could have a garage band in a residential area. Mr. Bagato replied technically that is correct. Commissioner Pradetto noted that technically everyone in his neighborhood could have a garage band. Other methods to collect these materials are effective but have some limitations: 1. Municipal curbside collections-These programs usually collect textiles and shoes with other recyclables which result in contaminating the product and makes it unfeasible to recycle. 2. Thrift store operators—Only solicit gently worn clothing and U.S. grade collections for sale in their own thrift stores.Also their collection trailers have limited hours and limited drop off locations. 3. Unattended donation boxes -These boxes attract graffiti; have overflow problems, security problems, and theft problems. Studies have shown that in order to increase diversion rates of textiles, collection locations need to be convenient and available to the user. The "N.D.R.S." provides an easy and convenient way for people to recycle their used household items and textiles right where they shop, work, and live. The N.D.R.S. is a state of the art collection station that is monitored 24hours a day, collects all recyclables and is conveniently located in large shopping centers and shopping malls, or any area suited for its use (sites with high traffic count and parking lots large enough to accommodate a visible and accessible placement location). Construction The N.D.R.S. was designed to minimize the effects of new construction on our natural resources and on the shopping center. it is a "manufactured" prebuilt structure being delivered and installed on site. It can be relocated with ease and is not a permanent structure. The unit itself is a used 20 foot x 8 foot shipping container which we have repurposed into a donation /recycling station. The container is modified at the closest shipping port depot and then delivered and dropped on the agreed upon spot. Our crew will then assemble the bolt-on parts, solar system, touch screen, and camera system. This should take 1-2 days and will have minimal disturbance on the shopping center. Use Users will be able to use a security chute system to drop their items in the N.D.R.S. anytime that is convenient for them. They simply place their items in the chute and push the handle up and the items are deposited inside the container. Since there are 3 chutes, users will not need to wait in any line and will be able to quickly deposit their items and leave. All chutes are designed to block anyone from entering the container.There is also a Handicapped accessible chute to meet ADA regulations. Users will also have access to a touch screen display where they can register to receive their tax deductible donation receipt, receive a "thank you coupon" from a local retailer, or find out where to donate larger items such as furniture or appliances. Anticipated use will be 20-30 people daily. We do not anticipate any issues with users needing to wait or any significant impact on parking due to the 3 available chutes and the fact that the use of the station will be dispersed throughout the day. Each lot is approximately 6,000 square feet in area, and owned by the City of Palm Desert. B. The parking lot includes 32 new parking spaces, new landscaping, new lighting, an on-site retention basin, and a perimeter block wall and wrought-iron fence. The parking lot is part of the approved Alessandro project, which includes new paving, new curb and gutters, and new landscape for Alessandro from Las Palmas Avenue to Monterey Avenue. All improvements associated with the parking lot are consistent with the Alessandro project. Analysis The Palm Desert Municipal Code allows parking lots on residential properties, subject to approval of a CUP. Parking lots are evaluated for specific design criteria, such as parking stall dimensions, screening, and landscaping. In addition, a CUP application requires the Planning Commission to consider land use compatibility of the use with surrounding properties. A. Land Use Compatibility: The parking lot is adjacent to detached single-family homes to the west, east, and north. Vehicular access is provided directly from Alessandro and no vehicle access into the residential neighborhood. The parking lot configuration will eliminate all thru traffic within San Clemente Circle, and reduce the total number of vehicles that currently access this street. A six (6)-foot high decorative block wall is provided along the northern property line to screen noise and lighting impacts from vehicles. The screening complies with the City's standards for screening parking lots from residential properties, and staff supports the wall design and pedestrian opening. B. Site Improvements: The parking lot complies with the City of Palm Desert's standards for parking lot design, lighting, landscape, and screening. Driveways and aisle widths are 24 feet and 22 feet in width, which comply with the minimum aisle and driveway widths for two-way traffic. In addition, parking stall dimensions are nine (9) feet in width and eighteen (18) feet in length, and are marked using two "white" hairpin stripes. The design of the parking lot improvements for striping, parking stall and drive-aisle dimension comply with design standards for off-street parking set by the Municipal Code and Resolution 01-5. The City requires a minimum of 15 percent of total parking area be dedicated to landscape, and that at least 50 percent of parking stalls are shaded by trees within 10 years. As proposed, the total landscape area of the parking lot equates to 25 percent of the total parking area. The landscape consists of a mix of trees and shrubs, including Mexican Fan Palms, Mexican Birds of Paradise, Agave varieties, and Daleas. Ground covers such as cobble, boulders, and decomposed granite fill in the landscape space. A number of shade trees, including Tipuanas (14), and Palo Verdes (4), are provided within the parking area. These trees are commonly used in other parking lots around the city because they are fast growing and provide shade. Staff believes that the tree species and their placement are sufficient to provide 50 percent shade coverage of the lot within 10 years. Parking lot lighting is not required in the City of Palm Desert; however, staff supports parking lot lighting at this location. The improvements planned for Alessandro include lighting. A continuation of lighting into the parking lot not only provides nighttime security and visibility but maintains a consistent look and feel for the Alessandro project. All lighting fixtures are pole mounted to a height of 20 feet and are fully shielded to focus light downward and not into surrounding properties. The light source and shielding comply with the Municipal Code, and staff supports the lighting and light levels proposed with this parking lot. In addition, the screen wall and taller shade trees will block light further limiting lighting impacts on surrounding residents. C. Findings of Approval: Findings in support of this project can be made and are included in the resolution to the Planning Commission.
