SUMMA NCIL ACTION Mr. Ryan Stendell, Director of Community Development, summarized pertinent March 10, 2016, City Council actions. He mentioned that on May 2 through May 13, the City is going to have a temporary demonstration of improvements to the community along San Pablo Avenue. On Saturday, May 7, San Pablo Avenue will be closed between San Gorgonio Avenue and Alessandro Drive for an event called Vision San Pablo. PRELIMINARY MINUTES PALM DESERT PLANNING COMMISSION MARCH 15, 2016 Commissioner DeLuna inquired if anyone has surveyed the current merchants along the San Pablo Avenue and El Paseo corridor. Mr. Stendell replied yes. Staff handed out flyers to the merchants for a community meeting. At the meeting, merchants expressed their concern with homelessness issues. However, most of the merchants agreed that if the City could be successful with the plans for the San Pablo corridor, a lot of those issues should fade away. Chair Greenwood asked if it is the City's intention t the right-of-way and road improvements, which would be the catalyst for to development. Mr. Stendell replied yes. He said that once the' rove is are completed, the City expects private developers to foll suit. He cts a lot of the improvements to be done within the next to five years. REQUEST FOR CONSIDERATION of a Conditional Use Permit (CUP) to construct an 80-foot diameter multi-use pavilion structure to be used for special events at the Entrada del Paseo property located at 72-565 Highway 111. Case No. CUP 16-25 (City of Palm Desert, Applicant). Mr. Kevin Swartz, Associate Planner, reviewed the staff report (staff report is available at www.cityofpalmdesert.org). Staff recommen approval of the CUP, and offered to answer any questions. Commissioner DeLuna asked what determines event and an ongoing event. Mr. Stende onded that all programming for the proposed pavilion had not been discuss . He stated if there is a creative way to use the space that would provide a great community event; the City would like to do it. Commissioner DeLuna asked if the proposed space is intended to compete with the COD Street Fair. Mr. Stendell replied no. Mr. Stendell answered that a fee schedule had not been developed. He said that it would be a nominal fee. Commissioner DeLuna asked if the structure would be funded by redevelopment funds. Mr. Stendell replied yes. Vice Chair Campbell asked if the pavilion would be anent. Mr. Swartz replied that is correct. Vice Chair Campbell also asked if the rs would have ut up their own canopies. With no testimony offered, Chair Greenwood declared the public hearing closed. Vice Chair Campbell moved to waive further reading and adopt Planning Commission Resolution No. 2666, approving Case No. CUP 16-25, subject to conditions. Notice of Determination — Negative Declaration Recommendation Waive further reading and adopt Planning Commission Resolution No. 2667, recommending that the City Council adopt Zoning Ordinance Amendment (ZOA) 16-91 to Section 25.16.050 Development Standards, Table 25.16-5. Executive Summary On February 11, 2016, the City Council directed staff to initiate a ZOA to add a provision to allow for height exceptions within the (O.P.) Zone. The current height limit is 25 feet, and staff is recommending that the height exception could allow up to a maximum of 35 feet. The additional height would allow for a more high quality building design as well as enough height to adequately screen all roof top equipment. Each request would be reviewed on a case-by-case basis under a Precise Plan application, and approved by the Planning Commission. Staff Report ZOA 16-91: O.P. Height Exception Page 2 of 3 April 5, 2016 Background /Analysis At its January 28, 2016 City Council meeting, Councilmember Jonathan requested that staff look into the possibility of adding a height exception process to the O.P. Zone when deemed appropriate. On February 11, 2016, the City Council approved and directed staff to initiate a ZOA. The current height limit within the O.P. Zone is 25 feet when more than 65 feet from residential zones. Over the years, many developers have expressed that the existing 25- foot height limit restricts high quality building design. Office operators are requesting greater interior ceiling heights, which forces the design of the buildings to appear boxlike with few architectural details. Also, developers need adequate room for internal mechanical equipment, and having enough height to adequately screen roof mounted equipment. There is currently no language in this chapter of the municipal code that would allow the Planning Commission or City Council to approve a height exception. This staff report includes two exhibits depicting the current height and the proposed height. Section 25.16.050 — Development Standards Below is the current Table 25.16-5 for building heights for the commercial and industrial districts. Under the O.P. Zone the current height limits are 18 to 25 feet. Staff believes having a provision in place to consider a height exception on a case-by-case basis will lend itself to more attractive buildings and add flexibility in design that property owners enjoy in Palm Desert. The added language still preserves building heights to setback distances adjacent to residential zones while allowing the Planning Commission to review and approve a request, if deemed appropriate. Environmental Review In this case, staff completed an initial study to review the potential impacts of the ZOA and has determined that there are no significant impacts associated with the proposed code changes, since all new projects would be reviewed under a Precise Plan application. Therefore, staff has prepared a notice of intent to adopt a negative declaration for CEQA purposes. ZOA 16-91 NOTICE OF INTENT TO RECOMMEND APPROVAL TO THE CITY COUNCIL FOR CONSIDERATION TO ADOPT A ZONING ORDINANCE AMENDMENT TO ALLOW A HEIGHT EXCEPTION PROCESS FROM 25 FEET TO 35 FEET WITHIN THE OFFICE PROFESSIONAL ZONES SUBJECT TO APPROVAL BY THE PLANNING COMMISSION The City of Palm Desert (City), in its capacity as the Lead Agency for this project under the California Environmental Quality Act (CEQA), completed an Initial Study to review the potential environmental impacts of adopting the Zoning Ordinance Amendment and has determined that the proposed Zoning Ordinance Amendment will not have a negative impact on the environment as individual development proposals will undergo additional environmental review as part of the Conditional Use Permit process prior to any development. Proiect Location: City-wide, within the Office Professional (O.P.) Zones. Recommendation: Staff is recommending that the Planning Commission adopt a resolution supporting the Zoning Ordinance Amendment and allow the item to move forward to a public hearing before the City Council. Public Hearing: The public hearing will be held before the Planning Commission on April 5, 2016, at 6:00 p.m.. Comment Period: Based on the time limits defined by CEQA, your response should be sent at the earliest possible date. The public comment period on this project is from March 25 to April 5, 2016. Public Review: The Zoning Ordinance Amendment is available for public review daily at City Hall. Please submit written comments to the Planning Department. If any group challenges the action in court, issues raised may be limited to only those issues raised at the public hearing described in this notice or in written correspondence at, or prior to, the Planning Commission hearing.
