Case No. ZOA 16-91 (City of Palm Desert, Applicant). Mr. Kevin Swartz, Associate Planner, reviewed the staff report (staff report is available at www.cityofpalmdesert.org). She inquired if this height exception request would ordinarily be considered in the General Plan process. Mr. Swartz responded that it could. However, the request was initiated by the City Council. Secondly, the General Plan primarily focuses on the Highway 111 corridor and San Pablo Avenue. He referred to a City map and pointed to Office Professional zones. He said that staff concurred with the recommendation by the City Council to initiate the ZOA. Commissioner DeLuna asked if the ZOA was inte o be part of the General Plan process, and to be considered as a whol would be presented to everyone. Mr. Stendell replied that he could not s . s s and agreed Mr. Swartz. Mr. Stende that historically Fred Waring Drive used to be a Multi-Family Residential z e, and over the years it has been given a Flex zone. He explained that property owners were able to apply for a Change of Zone for an Office Professional zone. He expressed that the City of Palm Desert has been good at creating zones that are flexible to allow the City's City Council and Commissions to act upon something if it makes sense. Commissioner Del-una clarified that the height exception request could occur during the General Plan Update process. Mr. Stendell replied yes. Commissioner Pradetto said that architectural meri bjective, and he felt that Palm Desert has done a good job in the past d what it would mean when plans come through. Mr. Swartz responded that it would b ething away a rectangle or square box; however, that is why City has an Arc tural Review Commission. Chair Greenwood asked if a project com add 25 feet in height, would it go through the Precise Pla ess then to lanning Commission for review. Commissioner Pradetto inquired if there were any discussions on any sort of measurable return, such as energy efficiencies. Mr. Swartz responded that it was not discussed. With no testimony offered, Chair Greenwood declared the public hearing closed. Commissioner DeLuna commented that she does not have a problem with considering concepts with height exceptions. As the City moves forward, she would like to see a unified and concerted overall analysis of the City's future. They first went through the Strategic Plan process with ood set of conditions. Thereafter, they went into the General Plan Update ss with much at stake for the City's future. She said there is an orderly ss in place for a timely transition, keeping the bigger picture in mind. erted that there is no reason to pervert that process to pull out on pec , have it considered separately or prematurely when it could be of an enti cess. For many years architects have complained that ceilings are too low and there is not enough room for equipment. With that said, she moved for approval. Commissioner DeLuna interjected that she already made a motion to continue the request to a date uncertain. Mr. Stendell responded that it would need to be reviewed by the Architectural Review Commission and the Planning Commission for approval. Jill Tremblay, City Attorney, made clear that Commi. ner DeLuna made a motion to continue this matter to a date uncertain, s ould coincide with the General Plan Update. She stated that there needs a second to the motion or Commissioner DeLuna could amend or withdr tion. Commissioner DeLuna asked if there is no cond, doe need to withdraw her motion. Property Description: The project site is located on the Sacred Heart Catholic School campus, located at the northwest corner of Fred Waring Drive and Deep Canyon Road. The total site consists of approximately 13.1 acres and includes a church sanctuary, administrative offices, parking facilities, landscape and perimeter improvements, and a preschool thru eighth grade school campus. Sacred Heart Church and school have been in operation at the site since 1984. B. This element adds interest to the building and helps distinguish it from other classroom space at the site. No new landscape is proposed with this building and site improvements. Analysis A. Site Plan Changes The classroom building massing and design are similar to the existing church and school site. The building has a maximum building height of 17.5 feet, with most of the building massing at a height of 14 feet. In addition, the building provides horizontal movement by recessing building portions by more than five (5)feet along the north and south elevation. These vertical and horizontal building offsets provide relief from the building massing, and the addition of a metal panel canopy helps to further break up the building and add interest. The roof design also integrates a screening method for any roof-mounted HVAC equipment. The building is setback more than 24 feet from the western property line,which requires a 15 foot setback. In addition, the building is setback more than 20 feet from the southern property line. The building exceeds setback standards for this zoning district and complies with the maximum building height for the zone. B. Land Use Compatibility The Sacred Heart Catholic School has operated at its current site since 1984. In 2005,the Planning Commission approved the expansion of the school to include a maximum of 540 students and 81 preschoolers.The addition of this classroom does not affect existing school enrollment. The new building complies with setback standards and maximum height limits imposed on this zone.The building is also located a substantial distance from the properties to the north and east. However, existing single-family homes exist to the west and south of the classroom building.The new classroom is located at the same distance as other classroom buildings along the western property line. In addition,an alleyway and street cul-de-sac are immediately to the west of this site and no home backs directly to the new classroom. An existing home is located to the south of the new classroom. The new classroom is separated from the home by an existing (20-foot emergency access road and a six(6)-foot high block wall. Because of this separation, it is anticipated that the new classroom will have minimal impact on the adjoining property. In addition, the relocation of the existing playground equipment awayfrom the adjoining property is expected to improve noise levels in this vicinity. Environmental Review The Director of Community Development has determined that the proposal to construct a new classroom building on the site qualifies for an exemption under the California Environmental Quality Act(CEQA) as the site is substantially improved and is served by existing utilities. Staff is recommending that the Planning Commission adopt a Notice of Exemption for the purposes of CEQA. Executive Summary Allied Real Estate Partners has partnered with the Desert Arc and the City's Housing Authority to provide affordable housing units for high functioning special needs adults on the Desert Arc campus. The 1.84 acre site is undeveloped and will be improved with 36 residential units and a community building for the residents. A mix of one- and two-story buildings is proposed for the site. The buildings are oriented around a central courtyard that includes a community pool and sports court, and a walking path is provided around the project perimeter. Landscaping and hedges are provided along the western and southern property line to limit visual access into the site. Staff is recommending approval of the proposal. Staff Report Case No. CUP/PP 16-102 Page 2 of 6 May 17, 2016 Architectural Review Commission The City's Architectural Review Commission (ARC)reviewed the proposed classroom building and site plan improvements at their meeting on April 26, 2016. The Commission voted 8-0-0 in recommending approval of the community facility and recommended modifications to the railings, building articulation, and showing the location of the air conditioning units on the residential buildings. Community Meetings The applicant held two community meetings at the Desert Arc property to present their plans to surrounding properties owners of the Sagewood and Palm Court neighborhoods. The first meeting on November 5, 2015, was attended by more than two dozen property owners interested in the project. In that meeting the property owners express concerns about loss of privacy and ongoing dust and noise issues at the site. The applicant updated their plans based on those comments and is installing a dense landscape hedge and trees plantings along the western and southern property lines. Dust and noise impacts are expected to be mitigated by the development of the lot. On May 5, 2016, the applicant held their second community meeting. Three neighbors, and nearly two dozen families and special needs adults attended. Neighbors did not voice any additional concerns with the proposal.The other attendees inquired about the operations of the community and voiced support for the project. Background A. Property Description: The Desert Arc campus is a 5.28 acre property located at the southeast corner of Sagewood Drive and Country Club Drive. The campus consists of administrative offices, educational programs, vocational training, and employment opportunities forthe developmentally disabled. At the southern portion of the campus is a 1.84 acre undeveloped site controlled by the City's Housing Authority. B. The new residential units are comprised of 32 one-bedroom units and four (4) two- bedroom units. All units are designed specifically for high functioning special needs adults. The units are one and two stories in height and arranged around a central courtyard that includes a swimming pool, sports court, and recreation space. The western and southern property boundaries are lined with new landscape and walking paths. Access to the property is provided to the north and connects to Country Club Drive and Sagewood Drive. There will be 25 parking stalls, 10 of which are covered and are provided along the eastern property line. The clubhouse building is 8,579-square-feet and includes a multi-purpose room, media/game room, fitness center, gymnasium, kitchen, and meeting rooms. The building is located at the northern portion of the site and functions as the entrance to the project. As such, the building massing and architectural style are more distinguished than the other portions of the site. All of the residential units are pre-manufactured off-site and assembled in pods. All units have flat roofs and the single-story units have a small raised portion to allow for natural light. Finishes on the buildings include cement panels, wood siding, and stucco. Building colors are desert tone including tans, off-whites, browns, and orange. Analysis A. Site Plan Clubhouse The clubhouse building is 26 feet in height and below the maximum building height of 35 feet permitted in this zone. The main massing of the building is shown at a height of 16 feet, while a vaulted standing seam metal roof provides a vertical element to the building at a height of 26 feet. Building finishes include stucco, metal paneling, wood (ipe) screening on metal framing, rammed earth walls, and concrete planters. Residential Units The 36 residential units are arranged behind the clubhouse building to form a centralized courtyard and community space. Units closest to the clubhouse are two stories and approximately 24 feet in height. Two-story buildings near the western boundary of the property are setback between 35 feet and 30 feet. Two-story buildings near the eastern boundary of the property are setback between 50 feet and 65 feet from the property line. There are no perimeter setback standards for this zone. Units along the southern portion of the site are single story and approximately 13 feet in height. The buildings are setback 20 feet from the western property line and 22 feet from the southern property line. The architectural style of the clubhouse and residential units, including the use of materials and color scheme, is compatible with surrounding multi-family and single- family uses. B. Land Use Compatibility Multi-family residential and private recreational facilities are listed as conditional uses in the "Public Institutions" (P)zoning district. As such, the applicant has applied for a Conditional Use Permit to consider these uses. Two-story, multi-family apartments abut the Desert Arc campus along its eastern property line, and single-story detached single-family homes are located along western and southern property lines. The proposed units are 24 feet in height, which match the height of the existing two-story apartments to the east.Although there are no perimeter setbacks for this zoning district, the applicant has provided a 20-foot setback along the southern property line and a 30-foot setback along the western property line. In addition to the building setbacks, dense landscape plantings and hedges are provided to limit the visual impact of the buildings on surrounding properties. Most multi-family apartment developments provide a private recreation facility or clubhouse for their residents. The proposal to include a clubhouse facility at this site is compatible with other multi-family developments. The placement and height of the building is appropriate for the site and functions as an entry statementfor the development.The main mass and height of the building is also located the furthest away from surrounding single-family units which limits visual impacts on those properties. Staff supports the land uses proposed for this site as they are compatible land uses with surrounding residential properties.The architecture, landscape,and amenities offered bythe project are similar to other types of multi-family developments within the immediate vicinity. C. Circulation Access and vehicle circulation to the site are provided by an existing driveway and access easement from Country Club Drive. This driveway will serve as the primary access to the project. Emergency vehicle access will be provided along the eastern boundary and connect to the adjacent Las Serenas apartments. D. Parkinq A total of 25 parking stalls are provided for the residential community. Parking is predominately located along the eastern boundaryof the projectwith two handicap parking stalls located in front of the community building.The 25 parking stalls represent a parking ratio of 0.7 spaces per unit, which is well below the City's requirement for two spaces per unit. AB 744 requires cities to permit lower parking ratios when requested by the developer for special needs housing developments located within '/2 mile of a transit stop.As a special needs housing development, with a SunLine Transit stop directly in front of Desert Arc, the developer has requested to use a lower parking ratio for this project.Although AB 744 sets a maximum parking ratio of 0.3 spaces per unit, the developer will provide twice as much parking to accommodate residents and guests. The type of housing provided, and the types of residents served by this development, does warrant a reduction in required parking.Many of the residents cannot legallydrive and do not have their own vehicles. Employment opportunities and medical and retail services are located in close proximity to the project, and many residents could walk to adjoining commercial developments. Because of AB 744and the proximityof the projectto on-sitejob opportunities and surrounding commercial services, staff is supportive of the reduced parking ratio for this development. Environmental Review The Director of Community Development has determined that the proposal to construct the community building and residential units qualifies for an exemption under the California Environmental Quality Act(CEQA)as the site is substantially improved and is served by existing utilities. Staff is recommending that the Planning Commission adopt a Notice of Exemption for the purposes of CEQA. Findings of Approval Findings can be made in support of the project, and in accordance with the City's Municipal Code. That the proposed location of the conditional use is in accord with the objectives of this title and the purpose of the district in which the site is located. The purpose of the Public Institutions (P) zoning district is to provide areas suitable for development of educational, religious, and non-profit facilities. These specialized facilities offer a wide range of services that benefit the City and its residents, and as such, the zoning ordinance permit flexibility in land use decisions by providing a range of land uses to be considered through a PLANNING COMMISSION RESOLUTION NO. 2669 Conditional Use Permit. The proposal to develop special needs housing at this location complies with the City's goals and the objective of the zoning ordinance. The City's Housing Authority owns the land and it has always intended to develop the site as an affordable multi-family residential housing project. The project is less intense than originally envisioned by the Housing Authority and the type of housing provided is similar to surrounding residential properties in terms of building architecture, site density, and land use. 2. That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. The proposed location and development of this project at this site will be monitored and cared for by an on-site manager. Maintenance issues or resident complaints can be addressed on-site. As designed, and as conditioned, the project will not be detrimental to the public health, safety, or welfare, as the project is designed below the maximum height permitted by the zone, contains significant landscape screening to limit visual intrusion into surrounding single- family homes, and provides adequate off-street parking that exceeds maximums set by AB 744. In addition, because many of the potential residents will not drive in to or out of the site, vehicular traffic will be less than another type of housing development at this site. 3. That the proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. The proposed development complies with all provisions of P.D.M.C. Section 25.72.050 "Conditional Use Permit,"including the development standards of the Public Institutions (P) zoning district. An exception has been granted to reduce the off-street parking requirement from 72 parking stalls to 25 parking stalls based on limits set by AB 744. In addition, the residents of the project typically do not have their own vehicles and as such a reduction in parking can be supported for this project type. 4. That the proposed conditional use complies with the goals, objectives, and policies of the City's General Plan. The proposed development complies with goals and objectives of the City's General Plan, in that it provides a unique affordable housing product that specifically serves the developmentally disabled. This type of housing product is unique to the Coachella Valley region and is compatible with the services and operations of Desert Arc.
