Recommendation By Minute Motion, approve the applicant's request for a one-year time extension for Case Nos. PP 06-18/CUP 06-15 until November 8, 2018. Background Analysis A. Property Description On November 8, 2007, the City Council adopted a resolution approving a Precise Plan and Conditional Use Permit application for an 88-room hotel and restaurant pad at 75- 144 Gerald Ford Drive, east of Cook Street. The site is approximately 2.21 acres in size and undeveloped. B. Zoning and General Plan Designation Zone: Planned District Commercial (PC-2)/Freeway Commercial Overlay (FCOZ) General Plan: Employment C. Adjacent Zoning and Land Use North: City Limits — Union Pacific Railroad South: P — Public Institution — CSUSB Palm Desert Campus East: PC-2 — Commercial Development West: PC-2 — Commercial Development Analysis Since the project's original approval, the City has adopted a new General Plan and has made several updates to the Zoning Ordinance and Zoning Map. The changes do not affect the property and hotel development is still permitted at the site. The project has received approval for time extensions in the past. Most recently, on October 20, 2015, the Planning October 17, 2017 — Planning Commission Staff Report Case Nos. PP 06-18/CUP 06-15 Time Extension Page 2 of 2 Commission approved a two-year time extension, which extended the project's entitlements until November 8, 2017. The applicant is seeking financing for the development of the project and a one-year time extension will allow the applicant to maintain the existing entitlements. As conditioned, the project conforms to the goals and policies of the General Plan and the Zoning Ordinance. Palm Desert Municipal Code Section 25.72.030K1-3 allows applicants to extend project entitlements for one-year increments, subject to Planning Commission approval. The Planning Commission may grant additional approvals, providing that there are no changes to zoning regulations that would impact the plan. General Plan and zoning standards have been updated since the original project approval; however, none of the changes impact the project's use or approved development standards. Architectural Review Commission Recommendation The proposed building was presented to the Architectural Review Commission (ARC) at two separate meetings (September 12 and September 26, 2017). At the September 26, 2017, ARC meeting, the Commission stated that the design and materials make for a very attractive building, with clean architectural lines and elements. The Commission also stated that the building's tower elements have the appropriate massing in the right locations. There was discussion regarding the exposure of the north elevation and how the building provides storefront glass and awnings facing Fred Waring Drive, so it appears open and inviting. The ARC approved the project with a 7-0 vote. Executive Summary Approval of staff's recommendation will allow the applicant to create a new parcel within the existing parking lot at the Walmart Neighborhood Market shopping center, and construct a new 6,800-square-foot retail building. When the center was developed, it was parked at 5.1 parking spaces per 1 ,000 square feet. The current parking standards have been reduced for retail centers at 3 parking spaces per 1 ,000 square feet. The proposed building eliminates 25 parking spaces, and the site will be parked accordingly per code. As proposed, the project will comply with parking and with all other development standards established in the City's Zoning Ordinance. October 17, 2017— Planning Commission Staff Report Case Nos. PP 16-396 and TPM 37320 Page 2of5 Backqround Analysis A. Property Description: The project site is located on the southeast corner of Fred Waring Drive and Highway 111. On October 12, 1989, the City Council approved Case No. PP 89-21 to construct 56,865 square feet of retail divided into three buildings: • Main building was 46,442 square feet (Toys "R" US). • Second building was approximately 7,000 square feet (Jiffy Lube). • Third building approximately 3,000 square feet (Pizza Hut). The site currently has a hotel, Springhill Suites by Marriott and the Flying J gas station. The existing access points off of Fred Waring Drive and Highway 111 were constructed and will remain. The proposed retail building will only alter and reconfigure the main parking lot. B. Zoning and General Plan Designation: Zone: PC-(3), SP/Planned Commercial (Regional Retail), Scenic Preservation General Plan: Regional Retail C. Adjacent Zoning and Land Use: North: PC-(3), Scenic Preservation/Waring Plaza Shopping Center, Commercial Uses South: PC-(4), Scenic Preservation/Springhill Suites by Marriott East: PC-(3), Scenic Preservation/Shopping Center, Commercial Uses West: PC-(3), Scenic Preservation/Desert Crossing Shopping Center, Commercial Uses Project Description The project includes a tentative parcel map to create the new .18-acre parcel for the building pad. The new 6,800-square-foot building will be located along Fred Waring Drive. The front of the building will face the internal parking lot, while the rear of the building will face Fred Waring Drive. The building will also be located on the west property line abutting the gas station. In order to accommodate the new building, 25 parking spaces will be eliminated. The new parking configuration includes reciprocal access and parking easements throughout the center. Vehicle access to the site will remain along Fred Waring Drive and Highway 111 . PP 16-396 and TPM 37320 Page 3 of 5 The applicant does not have any signed tenants, and anticipates dividing the building into three to four retail tenant spaces. A. Architecture: The building's architecture maintains a contemporary theme with flat roof lines, architectural pop-outs, awnings, recessed windows, warm earth tone colors, and thick architectural elements. The proposed building is single-story in height with roof lines between 22, 26, and an overall height of 31 feet. The building is oriented where the storefronts are facing the parking lot and the rear of the building is facing Fred Waring Drive. The proposed building focuses on the rear elevation by creating architectural spaces with storefront glass and awnings on three elevations (south, north, and east). This will allow for a more open and inviting retail building. The overall building design includes: desert colors, plaster finishes, foam cornice details, aluminum frame windows and doors, awnings, storefront glass, and red roof tile. All rooftop equipment will be screened from all public views. B. Landscape: The project includes landscaping around the building, along Fred Waring Drive, and within the parking lot. The landscape design consists of a desert theme, with species requiring minimal water usage. The proposed landscaping along Fred Waring Drive and along the east elevation facing the access driveway will be heavily landscaped with canopy shade trees and a variety of shrubs. The parking lot will consist of Palo Verde shade trees and some shrubs. Overall, the landscape design will blend with the existing landscape, while maintaining low water usage. The applicant has provided a detailed landscape plan, which is attached to the staff report. Final landscape plans will be submitted to the City's Department of Community Development and the Coachella Valley Water District (CVWD) for review and approval. Analysis The proposed project requires approval of a Precise Plan and Tentative Parcel Map by the Planning Commission. The project complies with all development standards including setbacks, building height, parking, lot coverage, and land use compatibility, as well as the Subdivision Map Act. Land Use Compatibility: The land use designation is Regional Retail within the General Plan and zoned PC- (3) and Scenic Preservation. The PC-(3) regional commercial center provides a unified area for commercial uses which offer a wide range of goods and services, including comparison and convenience shopping, entertainment, cultural, and recreational uses. The district provides for large-scale, large-format, commercial development that serves the broader region and is generally located around major intersections. Staff believes that the proposed project maintains a land use that provides an attractive building design that will help update the shopping center. The project will also provide retail options for the surrounding area and for the hotel guest within the Springhill Suites by Marriott. The retail businesses will operate in the same manner as the other retail uses within the City. The new building will not interfere with parking as determined by staff and the proposed use would complement the adjacent uses in the vicinity. B. Parking: When the shopping center was developed, it was parking at 5.1 parking spaces per 1 ,000 square feet, totaling 288 spaces. Section 25.18.050 Parking Requirements states retail uses require three (3) parking spaces per 1 ,000 square feet. If the shopping center were built today, the code would require 185 parking spaces (including Pizza Hut building), which is a difference of 103 parking spaces. The project includes the removal of 25 parking spaces reducing the total parking spaces to 263, which is more than sufficient. Based on the amount of parking in the existing shopping center, staff believes that there is adequate parking available to accommodate the proposed project. Environmental Review This project has been reviewed in accordance with the CEQA. Staff has found this project to be categorically exempt, under Class 32: In-fill Development Projects, of the CEQA. Because of the categorical exemption, no further environmental review is necessary. PP 16-396 AND TPM 37320 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 171" day of October 2017, hold a duly noticed public hearing to consider the request by PCG Palm Desert, LLC, for approval of the above-noted project request; and WHEREAS, according to the California Environmental Quality Act (CEQA), the City must determine whether a proposed activity is a project subject to CEQA. If the project is subject to CEQA, staff must conduct a preliminary assessment of the project to determine whether the project is exempt from CEQA review. If a project is not exempt, a further environmental review is necessary. The application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act," Resolution No. 2015-75, in the Director of Community Development has determined that this project is categorically exempt, under Class 32: In-fill Development Projects, of the CEQA. Because of the categorical exemption, no further environmental review is necessary; and WHEREAS, the proposed project conforms to the Subdivision Map Act; and WHEREAS, the project conforms with the Planned Commercial (PC-3) zone and Scenic Preservation Overlay with the type of retail in-fill development; and WHEREAS, the project maintains a land use pattern that provides an attractive building design that will help update the shopping center. The project will also provide retail options for the surrounding area and for the hotel guest within the Springhill Suites by Marriott; and WHEREAS, the General Plan encourages retail development along and around major intersections such as Fred Waring Drive and Highway 111; and WHEREAS, the project meets the intent and purpose of the Regional Retail District within the General Plan by providing retail development along and around major intersections such as Fred Waring Drive and Highway 111 that will serve the residents of the community; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, the Planning Commission did find the following facts and reasons, which are outlined in the staff report, exist to justify approval of said request: PLANNING COMMISSION RESOLUTION NO. 2709 Findings of Approval: 1. That the density of the proposed subdivision is consistent with applicable general and specific plans. The property is designated Regional Retail (RR) within the General Plan. The designation is to provide a variety of large-format retail, commercial services, lodging, entertainment, and restaurant activity along or around major intersections. The proposed in-fill project falls within the intent of purpose of the RR designation by adding a retail building along Fred Waring Drive within a large retail center that will serve the residents of the community and the hotel on-site. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. The design and improvements of the proposed subdivision have been reviewed by the Planning Department, Economic Development, Fire Department, and Public Works Department for consistency with the General Plan and emergency services. The project is part of a developed shopping center where all street and utility improvements, circulation patterns, and drainage improvements have been constructed and meet all requirements of the General Plan. All existing perimeter streets are in conformance with the General Plan. There are no specific plans for the property. 3. That the site is physically suitable for the type of development. The existing commercial site has been developed and in operation for over 20 years, and the new .18-acre parcel will be suitable for the new retail building proposed. Environmental and traffic studies were prepared for the original development and the new project will not require additional studies. In addition, existing commercial developments have successfully constructed similar types of development in the immediate vicinity. No obstacles to development of surrounding sites were experienced and, due to the proximity and similarity of the proposed development, it's reasonable to conclude that the site is physically suitable for it. 4. That the site is physically suitable for the proposed density of development. The property allows for in-fill commercial developments and the proposed density is minor with a 6,800-square-foot building. Directly north, south, east, and west are properties with similar uses, site layout, and density are consistent with surrounding development. 5. That the design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and unavoidably injury to fish or wildlife or their habitat. For purposes of CEQA, the project is categorically exempt, under Class 32: In-fill Development Projects. The design of the project will not cause substantial environmental damage or injure fish or wildlife or their habitat since the surrounding area has been developed with similar land uses. In addition, the project will pay into the Coachella Valley PLANNING COMMISSION RESOLUTION NO. 2709 Multi-Species Habitat Conservation fund for the development of raw land. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. The design and layout are in compliance with all grading requirements and the properties will be developed in accordance with the Uniform California Building Code. Pedestrian access is provided along Fred Waring Drive. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. The parcel map identifies the use of this area, and the applicant is responsible for the maintenance of the retention. Surrounding perimeter City streets are built-out to the General Plan designation and the developer will complete minor improvements within the existing commercial parking lot. NOW, THEREFORE, BE IT ORDAINED BY THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS: 1. That the above recitations are true and correct and constitute the findings of the Planning Commission in this case. 2. That the Planning Commission does hereby recommend approval of the Precise Plan of design and Tentative Parcel Map 37320, as proposed. The development of the property described herein shall be subject to the restrictions and limitations set forth herein, which are in addition to the approved project and all Palm Desert Municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 6.
