HomeMy WebLinkAbout1226 f CITY OF PALM DESERT CITY PLANNING COMMISSION MEETING DECEMBER 26 , 1973 The meeting of the Palm Desert City Planning Commission was called to order at 7 : 00 P.M. on December 26 , 1973 at the Palm Desert Middle School , followed by + the Pledge of Allegiance. ROLL CALL PRESENT: Commissioners CHUCK ASTON; JEAN BENSON; NOEL BRUSH; JAMES McPHERSON and Chairman HENRY C.LARK ABSENT: None Others Present: E. R. Asmus - City Manager (Interim) John Anderholt - Deputy City Attorney APPROVAL OF MINUTES The minutes of the Planning Commission meeting of December 10, 1973 were approved as submitted. IV. WRITTEN COMMUNICATIONS A. Letter request from Stotler & Kaplow for early consideration of K-Mart development. This project was originally continued until February 25, 1974 for a plot plan review. Commissioner Brush moved and Commissioner McPherson seconded that this review be moved up to January 7 , 1974 . Motion carried by the following vote: AYES: Aston, Brush, McPherson, Clark NOES : Benson B. Letter from Concerned Citizens re R. E. Kopstein multi-family development: 72-655 Parkview Carried over under New Business C. Letter from City Attorney Carried over under New Business V. OLD BUSINESS A. Plot Plan 1018 - G & S Construction - single family residence: 74-150 Covered Wagon r.r Due to the lack of plans for Commission review, this matter was continued. I i B. Plot Plan 1020 - Cornwall & Thorson - 7 detached carports : 7A-603 Shadow Hills Dr. Following discussions of the merits of the metal detached carports, it was moved by Commissioner Benson, seconded by Commissioner McPherson and unanimously carried that this application be denied. 1�rr VI . NEW BUSINESS A. Plot Plan approval of Kopstein Development 72-655 Parkview The City Manager reviewed with Council. the plot plan submitted for this development showing that approxi- mately one-third of the total area was being built upon the remaining parcel required to remain vacant in order to meet the restrictions on density. There was discussion on whether or not substantial construction had commenced as provided in Ordinance No. 12. . "Zr. Kopstein addressed the Commission stating that he had actually expended some $25 , 000 toward this development and in addition thereto has contractual obligations for materials and other commitments that would bring this amount to approximately $173 , 000. Following more discussion, it was determined by the Planning Commission that no substantial construction had commenced and that inasmuch as that finding had been made, plot plan and building permits were declared void as defined in Ordinance No. 12 . C Commissioner Aston roved and Commissioner McPherson seconded that this application be continued m and that applicant be required to come back on a re- submittal basis .for approval.. Motion carried by the following vote: AYES: Aston, Benson, Brush, McPherson, Clark NOES: None City Manager Asmus presented a letter from Hirschi, Healey and Healey, attorneys , requesting their client, Sun King, be included on the agenda. Commissioner McPherson moved, Commissioner Benson seconded, and motion unanimously carried that this be brought on -the agenda. Mr. Frank Hamerschlag, engineer of the above development, presented plans for mobile park , part of which is located within the City of Pala !desert and the balance within the Countv. It was indicated that the .first unit of the development consisting of a recorded tract of 289 lots is 909 complete while the second tentative tract man has been filed with Riverside County and consists of 350 proposed lots with a minimum size of 56 ' x 73 ' . It was explained to the Commission that the wow County of Riverside would not an Drove the second tract map of this development unless or until the property was all in the County. It was further explained that the matter was before the planning Commission in order for them to be apprised of the problems since the owners of the property were contemplating_ annexation of the area still outside the City, to the City. 2. 12/ 2b/73 i M . 1 VII . ORAL CO2-UNIUNICATIONS : None VIII . COMMENTS BY COPS 4ISSIONERS Commissioner McPherson offered the suggestion that perhaps an amendment to the City' s building codes pertaining to covered carports should be reviewed. The City :Manager suggested that any amendments relating to the requirement of covered parking would not involve the uniform building code but rather the zoning ordinance. He suggested that Piecemeal. amendments to the ^oning ordinance not be attempted except in instances where it was absolutely necessary but rather that a complete review and revision and adoption of a new city zoning ordinance could be part of the master plan studies . Commissioner Brush commented on the need for a Citv citizens committee, and the City Manager reported this matter will be discussed. by the City Council at its December 27 , 1973 meeting. IY.
