The meeting of the Palm Desert City Planninr; Commission
was called to order at 7 : 05 P .M. on Januar.y 21 , 1974 by Chairman
Clark at the Palm Desert 'Kiddle School, followec� by the Pl.edge

Chai.rman C1ark recommended that since a1,I the above
communications pertained to I�-P1art development which was
being considered later on the agenda , that any action be

Water System Improvements - Conformity with General
Plan
The Chairman opened the hearing .
Planner Dupree explained that the District proposes
� to install 12-�nch water main.s and fire hydrants on t�oth
sides of State Highway 111 betweeri Par. k View nrive and rtirage
Road . Under the Ca]_ifornia Governm�nt Code an agency wishing
to install public facilities is rey �-i.red to submit to tt�e local
Planning Commission having jurisdict ° �;n whether it is in con-
formance with the general plan . Pla1��-�r Dupree s�id this was
in conformance with the gener.al plan and recommended approval
and that the Coachella Vall.ey County Water district be so
notified .

so advised . Motion unan.imously carried .

Planner Dupree advised that the applicant had
requested this matter be continued. until February 25 , 1974 .

F . CUP ��09-73-PD - EoDorado Homes - East of Hwy 74
South of Tamarisk - Installation of four paddle
tennis courts to a planned residential development .
The Chairman opened the hearing .
�""' Planner Dupree recommended approval subject to
certain conditions . Commissioner Penson questioned tlie
lighting . John Salinero , 72-629 Willow, associ.ated with
the developer offered to delete the lights . Dick Clifford ,
73-442 Goldfield , and Mrs Landis , 73-427 Tamarisk, urged
that lighting be e?.iminated .
City Manager Asmus read in full a Resolution from
the Palm Desert Property Owners Association requesting
this be tabled due to the recent e�cess rainwater carrying
debris from this project onto public streets ; that a
satisfactory revised grading plan be presented which will
provide some effective water holding areas with9_n the
project ; that Desert Lily south of Grapevine be repaired
to correct substandard paving over sewer tr�nches , repairs
to chuck holes damaged by heavy truck traffic ; that adequare
study be made to provide some transition to the low density
area to the south; and that conformance with new Pal� Desert
Master Plan may be determined .
George Ser.vice , 72-897 Ta�arisk=, entered into the
record a petition signed by 26 residents on Tamarislc
requesting the Commission to seriously consi�er before
granting any further building permits to appli.cant .

P1rs . Cyrus Potts , 73-300 Willow, cal.led attention
to the silt coming down Desert Lily as a result of improner
drainage , and felt the developer had not lived up to his
agreement .
Pir . Fred Bellamy, 1102 Sandniper , suggested all
projects be continued until a Planning Commi�ssion is
developed .
Mr . Salinero stated that an outside engineer had
been called in and it was his finding that their project
had not beer_ the cause of the recent damage .
The Chairman closed the hearing .
Chairman Clark commented that a great deal of
damage was done to homes below the project area and that
the situation was being studied to see whether the water
was channeled as a result of this development . .
Commissioner Benson was concerned that if that
� much damage had been caused by the recent rain , additional
` building would increase more �aater run-off .

Commissioner Brush moved , Commissioner Aston
seconded that the CUP be approved subject to condition
(1) that the development shall conform substantially with
� Exhibit "A" which is on file in the offi_ce of the County
Planning Department ; that condition (2) be revised to read :
That the paddle tennis courts not be lighted ; that condi-
tion 3 include "On site landscaping" to be planted and
maintained by the owners . P4otion carried by the follo�aing
vote :

install retail and commercial parking lot to
serve retail use - North of Larrea St . , West .
of Portola
The Chairman opened -- the hearing.
Planner Dupree stated this was for additional
commercial parking for 28 automobiles and recommended
approval subject to conditions imposed t�y the County.
City Manager Asmus read a letter from Lois
i Warnacutt opposing the proposed commercial parking lot
in the area .

Commissioner McPherson moved , Commissioner I3rush
seconded that this request be approved subject to condi- '
tions approved by the County . Motion unanimously carried .
H . CUP ��11-73-I'D - James Iirown - Construction of a
swimming pool to serve 16-unit complex
The Chairman opened the hearing .
Planner Dupree recommended a 30-day continuance
due to the fact that there is litigation pending on this .
property.
Commissioner Brush moved , Commissioner Benson
seconded that this matter be continued un.til rebruar.y 25 ,
1974 . Niotion unanimously carried .
VI . OLD Bi.1SINESS
Due to the large number of people standing , Item H
was taken up first .

H. P .P . 1030 - Stotter & Caplow - K Mart Development
Planner Dupree showed a revised elevation drawing
submitted by applicant . He advised there were no changes
to site planning . The - County considered this to be a
substantial improvement .
Chairman Clark commented that legally an open
hearing is not required , however , due to the interest
he recommended the matter be opened for 30 minutes .

Mr . Elliott Caplow, 4404 Van Alden , Tarzana , said
that at the previous meeting he had been requested to make
modifications on the drawing , which had been done . He
introduced Mr. Harry Krueper , traffic consultant , wfio
explained results of their traffic study and presented a
' comprehensive report to each Commissioner , and read a
letter from the Division of Highways offering no opposition .

Meeting was recessed at 9 : 05 P .M. and called to order
at 9 : 20 P .M.
The following opponents spoke concerning architecture ,
traffic problems , merchandise , etc . : Richard R. Stewart ,

Potts , 73-300 Willow, who read a letter from her husband ,
Mr. Cyrus Potts , which was entered into the record ; Robert
Callendar , 1702 Sandpiper , who read a letter which was
entered into the record ; Adolph Deutsch, 1713 Sandpiper ;
Robert Ricciardi, 73-700 Highway 111 , Florence Hafers

Mr . Elliot Canlow, John Sanborn, and Harry Krueger
� spoke in rebuttal . Mr . Capl.ow indicated that he would not
rebutt any of the comments made by citizens regarding
� uart ' s operation but would confine his rebuttal to the
question of the architectural design of the building and
tne traffic circulation. He indicated that he had complied
with the Commission ' s request regarding some_ redesign on
the building and further that he had expended a great deal
of time and effort in developing a thorough study of the
circulation problem. Mr. 5anborn supported Mr . Caplow' s
rebuttal statement and also rebutted the statement of Mr .
Ricciardi regarding sight distance coming west on Highway 111 .
The Chairman closed the meeting .
Chairman Clark commented he had been unable to get any
information from the State concerning a traffic study .
Commissioner Benson stated she did not think they should
consider the $80, 000 proposed income as that was not included
in the budget to begin with.
Commissioner McPherson moved , seconded by Commissioner
Benson that because of the traffic congestion incidental to
major commercial use , the lack of studied general plan for
commercial development , the incompatibility with residential
area adjacent to development , and long term effect of project
on community without opportunity for this Commission and
w Council to study the same , that the application of Stotter
and Caplow for a K Mart and other stores at Highway 111 and
El Paseo be denied . Motion carried by the foll_owing vote .

Planner Dupree explained there were originally four
separate homes applied for and that applicant was not
requesting approval for two of the four . Applicant stated
� he was submitting plans for the two houses and would delay
the other two until these two are sold .
Commissioner McPherson moved , Commissioner Brush
seconded that P .P . 1040-PD be approved . Motion unanimously
carried.

Plan�er Dupree said this matter was heard on
December 10, 1973 and continued until this meeting ,
Applicant explained this shed would be used for lawn
mowers and garden equipment only.

� seconded that this plan be approved . Motion unanimously
carried .

Planner Dupree stated this property had a zoning
chanoe whicti would now allow only 28 units . i-ie said there
were four alternatives : (1) Denial due to zoning ; (2)
Continue and allow applicant to redesign the project ;
(3) approve with 28 units , elim"inating certain Uuildings ;
(4) or applicant may choose to withdraw the case and
apply for a change of zoning ,
Commissioner Brush moved , Commissioner Benson
seconded that the Commission permit withdrawal . Motion
unaninously carried .
E. P . P . 1032-PD - Frank Purcell (the Wood Nail)

Kd .
Applicant I'rank Purcell , 389 Crestview Dr . , Palm
Springs , explained this would be a retail business in the
� form of a home improvement center ; no outside lumber storage;
interior to contain lumber , hardware and housewares ; 17 , �00
sq . ft . of storage and sales floor area ; contemplate expan-
sion to 25 , 000 sq . ft . ; trucks loading and unloading would
be hidden from view by a screened wall .

Chairman Clark commented that the Commission is
concerned with all Four sides of the building and that
colored drawings and elevations should be submitted .
Commissioner McPherson moved , Commissioner Brush
seconded that this matter be continued until February 11 ,.
1974 to permit applicant to submit colored drawings.

18 . 30 (G-P-S) Plot Plan No . 1050-PD , a shopping center
site North of El Paseo , East of Lupine Lane .
Mr . Carver , developer , asked for a continuance so he
could provide the proper information to the Commission .
Commissioner McPherson moved , Commissioner Benson
seconded that this matter be continued until February I1 ,
1.974 . Motion unanimously carried .
VIII . ORAL COMMUNICATIONS
�, Bill Carver stated there should be more communication
between the applicant and Commission , what material is
needed , when it is needed and what requirements are
expected in order to be heard . He felt there should be
sufficient time to review the information.

Ed 1'eck suggested plans be available on the Friday
ten days prior to the Commission meeting .
Robin Barrett urged better preparedness on the part
of the Commission .
'�, City Manager Asmus asked the Commission to decide
on which type of structures they wanted colored drawings .
It was agreed by this Commission to require color. ed
drawings on all commercial buildings and mtilti-dwe2lings
over six units .
A lengthy discussion ensued on the best procedures
for handling applications for plot plans , C:UP ' s and
variations and for better coordination between the City
and County in scheduling and prepartion. It was agreed
to adjourn to Monday , January 18 , 1974 at 7 : 00 P .M. at
the Santa Fe Federal Savings and Loan.
Meeting adjourned at 12 : 25 A.M. , Januar.y 22 , 1974 .
