CALL TO ORDER The meeting of the Palm Desert Planning Commission was called to order by the Chairman at 7 : 08 P .M. on March 25 , 1974 at the Palm Desert Middle School . II . PLEDGE OF ALLEGIANCE �+wr III . Asmus City Attorney - David Erwin County Planner - Keith Downs IV . APPROVAL OF MINUTES A. Minutes of the Planning Commission meeting of March 11 , 1974 were approved as submitted . V. WRITTEN COMMUNICATIONS - None VI . PUBLIC HEARINGS A. CUP-11-73-PD - JAMES BROWN - Conditional Use Permit '�""` to create a common recreatinn area (swimming Pool) on property currently being rebuilt as a 16-unit apartment complex - Candlewood (Case continued at 3/11/74 meeting) The Chairman opened the hearing . Planner powns explained the application is for a swimming pool only and recommended approval subject to the staff report . A short discussion followed . The Chairman closed the hearing . Commissioner McPherson moved , Commissioner Brush seconded that CUP-11-73 be approved subject to staff conditions . VII . OLD BUSINESS A. P . P . 1065-PD - CASITAS IDIVESTMENT FUND APTS . NW corner CandlPwoo� & Panorama Ln . (6 units , 2 bldgs . ) (�ontinued from 3/11/74 for �eport of water flow) Mr . George Schultejann , County Fire Department , � explained this application had been continued for the purpose of his Department conducting further water flow tests . He stated that he had conducted fire flow tests at other locations in the past , however , the fire hydrant best located to serve the subject property is currently inoperative and the water company has not been able to restore it to service. In dis- cussing with the developer , he stated they arrived at an alternate solution, that the developer install a dry suction hydrant connected to the swimming pool as a back-up . HE� realized this was unusual and not totally satisfactory but it could be considered acceptable if the Planning Commission so approved . He stated he had been assured by the Panorama Water Company that the inoperable condition of hydrants would be corrected . Mr. Hurlburt reminded the Commission that on April 3rd there will be a study session on the entire water flow question and related problems . Commissioner Benson stated there is so much development in this area that assessments should not be �r.r made on one project ; the entire area should be protected , Mr. Schultejann said that the Fire Department policy is to concern themselves with one specific development at a time . He felt that considering the phase of the structure in this instance the pool would be an ample supply of water to draw from, whereby a fire truck can pull up to the street , connect a hose and draw water from the pool with its own pump . Chairman Clark moved , Commissioner McPherson seconded that condition 466 be modified to include two conditions : first that the swimming pool shall be kept perpetually full of water and , second , that a dry suction hydrant as approved by the County Fire Chief shall be installed from the swimming pool to the curbside . Motion denied by the following roll call vote : AYES : McPherson; Clark NOES : Aston ; Benson ; Brush B . P . P . 1063-PD - PAUL THORYK BLDG . - 3 commercial buildings (Continued to 3/25/74 for revisions in parking and Fire Department reports . ) Mr. Asmus stated this matter was continued for � revisions in parking and Fire Department clearance . Commissioner McPherson moved , Commissioner Brush seconded that this application be continued to April 8 , 1974 . C . Tentative Tract ��4980-PD - Modifications in conditional approval Planner powns reported the applicant is requesting a minor change in the approved conditions of Tentative Tract 4980-PD . Applicant requested that the conditional approval be modified by the requirement to dedicate and improve Marlbouro Drive because the property is not owned by the developer and ownership cannot be acquired . Planner powns recommended that condition 2f of the approved conditions be deleted and condition 2a be modified to read as follows : "Palms to Pines Highway shall be improved with match-up asphalt concrete paving and concrete curb and gutter located 38 ' from the center line with a 50 ' half width dedicated right of way. In addition , the Frontage Road shall be improved with 32 ' of asphalt concrete paving and concrete curb and gutter on both sides within a 40 ' dedication right of way as approved by the city engineer , � Discussion followed wherein it was explained that the street was not necessary for development of this tract but it would be needed in the future to provide circulation for undeveloped property to the south. It was pointed out that dedication and improvement could be required when the property to the south is subdivided . 2 Chairman Clark moved , Commissioner Aston seconded that the conditions of this tentative map approval be modified as recommended . Motion carried unanimously. D . P . P . 1068-PD - DEEP CANYON CONDOMINIUM SUBDIVISION M.B . JOHNSON - CUP approved , 189 single family dwelling on SW corner Deep Canyon & 44th E . Tentative Tract 4�5075 - DEEP CANYON CONDOMINIUM SUBDIVISION - M. B . JOHNSON (Same as "D" above) � Mr . Asmus explained this project is situated on 4' acres . It is proposed to construct 189 detached , single family , one-story dwellings around greenbelts which contain swimm'.ng pools and landscaped areas . Project will be con- structed in 5 units varying from 32 to 46 units in each. Density is 4 . 4 dwelling units per acre overall . Approval of plot plan was recommended subject to 12 conditions which are standard in nature . The question of parking on the cul-de-sacs was discussed . Mr . Dan Salerno , architect , stated that with respect to the parking of boats , trailers , etc . , they would be prohibited by deed restrictions which they would present to the Commission. He said the front door for the units is on the common area. The garage is to the rear or on the street side ; parking bays have been located wherever it would be natural for a guest to park. Walks from the parking area are provided between the buildings so guests can reach the common area as well as the front entrance to the units . There will be parking in driveways , one guest parking space per unit is being provided throughout . He estimated 30 to 40 parking bays throughout the project , providing 163 parking spaces . In addition , there are 2 parking spaces in each garage equipped � with automatic door openers . Staggered buildings resu].t in driveways ranging in length of 10 ' to 20' in front of the garages . Mr . Hurlburt comment.ed he had not had an opportunity to study this project and was definitely concerned about the parking and suggested he and Mr . Asmus thoroughly study this project together . Applicant agreed to a 2-week continuation . Commissioner Benson moved , Commissioner Brusy seconded that this be continued to April 8 , 1974 . Motion carried unanimously . Meeting was recessed at 8 : 05 P .M. Meeting was called to order at 8 : 15 P .M. F. P . P . 1073-PD - DESTINATION RESORT CORP . (PE.LM DESERT RACQUET CTUB) 33 unit condo at 45-730 San Luis Rey (Tract 4�5277-PD approved) Mr . Asmus reported this application is for approval of phase l , consisting of 33 units in 11 buildings . The final project will consist of 108 units . Staff recommended apprcval subject to the conditions of tract map 5277 and in addition thereto the standard conditions attache� to the �, staff report . Mr . Asmus stated that if the Commission approves this application subject to the terms and conditions as outlined it would only be giving basic approval to building location and elevations since other pertinent plot plan data has not beer. provided . Discussion followed regarding revisions that should be considered in the plot plan review process . Mr . Asmus offered the opinion that the tendency to submit part of the information in detail required under Ordinance 12 makes a great deal of work not only for the Commission but also the staff and the applicant as well . 3 Mr . Jerry Levers , speaking for the applicant , requested Planning Commission approval to install a traffic island within the public dedicated right of way which would prohibit left-turn movements onto San Luis Rey Aven.ue by tenants of the development . In response to a question from Chairman Clark, Mr . Asmus stated that he saw no objection to such a control device and that in his judgment it could be removed from the right of way at any time if it create�. a problem at some future date . The question arose regarding the requirement of �"` underg.rounding utilities currently located within the public dedicated right of way along San Luis Rey Avent.e . Mr , John Sanborn, engineer for the project , said that the line was in the existing city right of way, was of extremely high voltage and that the cost for undergrounding the facilities to be required would cost about $95 . 00 per front foot . Commissioner Benson moved , Commissioner Aston seconded that P . P . 1073-PD be approved subject to staff conditions ; that the construction of Club Circle be included as a part of phase 1 and that the right turn island suggested be provided at the intersection of Club Circle and San Luis Rey , and subject to the undergrounding of the overhead electrical lines on San Luis Rey unless staff determines the cost to be economically prohibitive . Motion carried unanimously . VIII . NEW BUSINESS A. P . P . 1075-PD - Single family dwelling & tennis courts - Lot immediately South of 44-712 San Benito Circle Mr. Asmus explained that applicant desired to build � a single family dwelling and tennis court on a separate lot immediately south of applicant ' s home . He reported the proposed dwelling would not , in his opinion , detract from the neighborhood but that in order tc provide one parking space for a vehicle which is necessary for a single family dwelling , a somewhat unorthodox method of providing access to the parking space is required . In addition, the plot plan as submitted called for a 6 ' high chain link fence around most of the tennis court while it is generally agreed a minimum of 10 ' fence is normally reqt.ired around a tennis court . Since the fence is within the front and side yard set-back area a variance would be required in order to install tre higher fence . Discussion ensued regardi.ng the alternative of combining lots 57 and 58 into one parcel whereby an accessory building or guest house would be a permitted use so long as it is on the same parcel of land as the main structurF . Mr . Asmus reported that the applicant was not agreeable to com- bining the two lots. He did indicate that. so long as the parcel remained as a separate parcel there would not be a means whereby the city could prevent subsequent sale of the lot containing the new dwelling and tennis court . Commissioner Brush moved , Commissioner Benson seconded that the applicant be denied . Motion carried '�,.,r unanimously. B . P . P . 1070-PD - JEHOVAH WITNESSES CHURCH BLDG . , 44th Ave . , North side between Fairhaven & Adonis Mr . Asmus stated this plan consist�s of 4 lots , 66 , 157 sq . ft . , and a one-story frame structure propo:;ed with 4 , 676 sq . ft . Plot plan would prcvide 92 parking 4 spaces , maximum height of building is 15 ' 8" . 3% of the parking area must be landscaped . Staff recommended approval subject to conditions. Commissioner Aston moved , Commissioner Benson seconded that this project be approved subject to staff conditions , plus a detailed landscaping plan for around the building be presented for staff approval . Motion carried unanimously . I �''�"' C . P . P . 1074-PD - CORSICAN VILLAS TENNIS COURTS Mr . Asmus related the history of the Corsical Villas project and stated that applicants were now asking plot plan approval to construct tennis courts that would serve the devel.opment at the northwest corner of Portola Avenue and Buckboard Trail . Mr . Asmus recommended denial of the application but indicated tr.at if the Commission desired to approve same it could be approved subject to the staff conditions . Questions were directed relating to access to the tennis courts as well as availability of parking space for the tennis court users . Mr . Scott Biddle, developer , informed the Commission that they were not contemplating any parking by the users of the court since the courts intended use would only be for those living within the project area . Discussion followed among members of the Commission regarding the type of lighting, if any, and also the possibility of limiting the time when the lights could be utilized . Mrs . Nutt , President of the Silver Spur Ranchers Association , advised that the Association had no objections to the tennis courts as outlined . �Ir.n Commissioner McPhersor� moved , Chairman Clark seconded that the plot plan be approved subject to staff conditions with lighting to be permitted subject to staff review of both lighting and landscaping . Motion carried by the following vote : AYES : Aston ; Brush; McPherson ; Clark NOES : Benson IX. ORAL COMMUNICATIONS Mr . Ed Smith requested the Durco Construction project on Fairway & Cook be placed on the April 8th agenda . Xi. COMMENTS BY COMMISSIONERS Chairman Clark announced the City Council Study Session Wednesday, March 27th at 7 : 30 A.M. at Irene ' s Restaurant . XI .
