CALL TO ORDER The meeting of the Palm Desert Planning Commission was called to order by the Chairman at 7 : 01 P .M. on April 8 , 1974 at the Palm Desert Middle School . �rrn II . Commissioner Benson entered the meeting at 7 : 03 P .M. V. WRITTEN COMMUNICATIONS �""" None VI . OLL� BUSINESS A. CUP-13-74 HOME BUSINESS DEVELOPMENT CORP . (West side of Deep Canyon , North of Driftwood) . CUP to allow conversion of 22-unit apt . complex to a planned residential development . Continued from 2/11/74 and 3/25/74 for applicant to furnish evidence of ability to comply with fire requirements . Mr . Hurlburt said applicant had requested a 2-week continuance . Commissioner Brush moved , Commissioner Aston seconded that CUP-13-74 be continued to April 22 , 1974 , at the request of the applicant . Motion carried unanimously . B . CUP-04-73 DURCO CONSTRUCTION - 5 units SE corner Ocotillo & Tumbleweed Lane . Continued from 3/11/74 at request of applicant . Planner Dupree said this request had been continued twice before and that the applicant is asking another con- � tinuance in order to redesign the project . It was originally submitted as 2-story and is presently being redesigned as a 1-story . Mr . Dunham, 71-888 Vista Del Rio , Rancho Mirage, requested six weeks continuance to May 20 , 1974 . Commissioner Brush moved , Commissioner Aston seconded that CUP-04-73 be continued to May 20 , 1974 . Motion carried unaimously . C . CUP-07-73-PD DURCO CONSTRUCTION - 20 unit condo- minium, 6 buildings on NE corner Highway 74 & Verba Santa. Continued from 3/11/74 in order to verify allowable density . Planner Dupree said under the current zoning 21 . 8 units would be allowed . This project is for 20 units , with one covered parking space per unit . Total height of the building is 16 ' . Unit sizes are approximately 1 , 344 sq . ft . Staff recommended approval subject to conditions . �r.r The Chairman opened the hearing . There were no proponents or opponents . The Chairman closed the hearing . Commissioner Benson commented that since there is a master plan being developed she did not think the maximum density should be allowed at this time , that it is not con- sistent with what the city is trying to do . In addition, she did not think the parking was adequate . Chairman Clark said the hold area was on uncommitted property , and this was in a committed area . Commissioner McPherson moved , Commissioner Aston seconded that CUP-07-73 be approved subject to staff condi- tions . Motion carried by the follosing vote : AYES : Aston; Brush; McPherson; Clark NOES : Benson D . Tentative Map Tract �65075 DEEP CANYON CONDOMINIUM �'�` SUBDIVISION - M. B . JOHNSON (SE corner Deep Canyon & Avenue 44) 189 single family dwellings . Continued for City Manager to study project parking . Mr . Hurlburt said he had gone into more detail on the parking . He had been primarily concerned about the on- street parking and finds t�ey will have a total of over four parking spaces per unit with two of these being covered parking , . 86 in driveways , and the remainder on-street parking . He recommended approval based on staff conditions . He said the applicant had subsequently brought in more plans which c�nn:ot be acted on tonight but wants to eliminate two residences and a swimming pool and in their place construct a tennis court and on-street parking . The staff was directed to bring this matter before the Planning Commission when the plans are finalized . Commissioner Brush moved , Commissioner Aston seconded that Tentative Tract ��5075 be approved subject to staff conditions and , in addition, that the driveway condi- tion be satisfactorily resolved with the staff . Motion carried unanimously . E . P .P . 1068-PD - DEEP CANYON CONDOMINIUM SUBDIVISION � (SE corner Deep Canyon & Avenue 44) M. B . JOHNSON (CUP has been approved) . 189 single family dwelling plot plan approval (same project as (D) above . Continued for City Manager to study project parking . � Mr . Hurlburt said staff recommended approval , subject to conditions . Commissioner Aston moved , Commissioner Brush seconded that P . P . 1068-PD be approved subject to staff conditions . Motion carried unanimously F . P . P . 1063-PD - PAUL THORYK COMMERCIAL BLDG. (NW corner E1 Paseo & Sage) Continued from 3/25/74 . City Manager had asked continuance for revisions in parking and Fire Department reports . ir.r Mr . Iiurlburt said the Fire Department report had been submitted with list of conditions which are standard . Regarding the parking , 53 spaces are needed , based on 1 for every 250 sq . ft . , however , only 48 parking spaces are pro- vided for . Mr . Dunham, developer , urged approval subject to 4 additional parking spaces in lieu of 5 , as it would require a redesign program and they would lose 8 ' in the patio area . They are dedicating a 10 ' strip on the alleyway and have a letter of approval from the property owner to that effect . Attorney Erwin said a recorded document should be added as an additional condition. Commissioner Brush moved , Commissioner Aston seconded that P . P . 1063-PD be approved subject to staff conditions and , in addition , that applicant obtain the 4 additional parking spaces and record the document providing for use of the adjoining property for parking . Motion carried unanimously . G . P . P . 1066-PD - IRONWOOD COUNTRY CLUB - Tentative Tract 5554 - S of Portola, W of Mariposa Dr . � Plot Plan approval continued from 3/11/74 . CUP & Tentative Map have been approved . Continued for applicant to develop in greater detail plans for landscaping , location of comfort stations and a more precise grading plan . Mr . Hurlburt said staff had approved the landscaping and grading plans but that the rest rooms are still unacceptable to staff due to the setback problem. He read the 3 staff conditions . Don Shayler, engineer , Pacific Rim, said they would be agreeable to delete the restroom request . Commissioner Brush moved , Commissioner Aston seconded that this plot plan be approved subject to staff conditions and deletion of the restroom facilities from the perimeter area . Motion not brought to vote . Mr . Shayler questioned condition 4�3 . Chairman Clark said that Ordinance No . 12 gives all rights for plot plan approval, that the grading had been discussed at the last meeting and he did not see why such detailed information should be required when it has not been required for other � projects . Chairman Clark moved that requirement ��3 be eliminated . Motion died for lack of a second . Mr. Shayler said prior to recording the subdivision map , the developer would like permission to begin grading of the site and underground facilities . Attorney Erwin said before anything could be done the developer would be required to submit grading plans . 3 Commissioner Brush moved , Commissioner Aston seconded that P .P . 1066-PD be approved subject to the 3 staff conditions , plus the addition of ��4 : "Construction of grading and utilities may commence prior to recordation of a final subdivision map and prior to issuance of building permits for dwelling structures . " Motion carried unanimously . VII . NEW BUSINESS A. P . P . 1083-PD - MISSIONBELLE HOMES - 19 single family dwellings (one story) . Lots are located �.+ in various parts of Palm Desert N of Highway 111 , W of Deep Canyon & South of Avenue rr Mr . Hurlburt recommended approval subject to staff conditions . Planner Dupree recommended that a condition ��5 be added : "Dry sewer system be provided at the street that would enable eventual connection in the event of a sewer trunk line being established on the street . " Mr . Hurlburt said 2 petitions had been received containing 28 names from the Palm Dell Estates opposing this project . Commissioner Benson commented she could see 1 or 2 homes , but that a large scale such as 19 homes would be a different case . She also brought up the Palm Desert Community Water District problem in this area . Mr . Russell Mills , 74-065 Goleta , Palm Desert , Pacific Western Development , said the homes would sell for approximately $30 , 000 and that they had built numerous other homes in the area. � Chairman Clark said he would like to see some of the other houses before making a decision and requested the applicant to submit addresses . Chairman Clark moved , Commissioner Brush seconded that P .P . 1083-PD be continued for two weeks in order to allow the Commission more time to study this project . Motion carried unanimously. B . CUP-Ol-74-PD - THETA LOGAN - Permit to establish a pre-school located on the S side of Guadalupe Ave . , 400 ft . E of Monterey Rd . Planner Dupree said this is a request for a pre- school to accommodate 10 children ; that there are no residences immediately adjacent to subject property; and that staff recommended approval subject to conditions and adding 3 more : (1) That the hours of operation be confined to 7 : 30 :A.,M, t^ 6 : 00 P .M. on weekdays ; that a:ny : sigi� �per�ini�_t_e.d "be a �.aximum of 4 . 4 sq . ft . subject to approval of City Manager ; and that the permit be good for one year expiring one year from today and allow the applicant to reapply at that time and also allow the Council not to renew the permit at the end of a year if they find it incompatible to the area. �r.r Theta Logan, applicant , said she had been licensed by the State Welfare Department since 1958 , that she has a fenced yard , has not requested a sign and does not want one , that she had a letter from her only close neighbor who has no objection, and that she would like to be open by 6 : 30 A.M. for the working parents who have to be at work by 7 : 00 A.M. 4 The Chairman opened the hearing . Mr . Roy Cariar , 150 S . Rancho Santa Fe Road , San Marcos , owner of the lot adjacent , felt if the school were expanded to 10 children it would make it difficult for him to dispose of the lot . June Goff , 73-051 Catalina , asked if this is permitted what would prevent future money making projects in the area . Planner Dupree said within the provisions of an R-2 zone a request for a day school is allowed with a �rrr CUP , that it does not establish a precedence for other businesses to move in . The Chairman closed the hearing . Commissioner McPherson moved that CUP-Ol-74 be approved subject to staff conditionsm that condition ��6 be amended to read 6 : 30 A.M, to 6 : 30 P .M. ; that condition ��7 be deleted ; and that the permit be issued for one year and one day from today. Motion seconded by Commissioner Aston and carried unanimously . C . CUP-12-74-PD - SUMMERFIELD DEVELOPMENT CORP . Request for a permit to establish a planned residential development on property located on the S side of Highway 111, adjacent to the westerly city limits of Indian Wells in the City of Palm Desert . Planner Dupree recommended continuance to May 6 , 1974 for completion of Environmental Impact Report . This is agreeable to the applicant . Commissioner Brush moved , Commissioner Benson seconded that CUP-12-74-PD be continued to May 6 , 1974 �"` for completion of the Environmental Impact Report . Motion carried unanimously . D . Request Planning Commission to initiate a zone change for the Sun King Annexation Planner Dupree explained that after annexation of the Sun King property , it is necessary that it be zoned . Commissioner Aston moved , Commissioner Brush seconded that the Planning Commission initiate a .zone change on subject property . Motion carried unanimously . VII . ORAL COMMUNICATIONS Mrs . Jerry 0'Malley questioned why her commercial store building was not on the agenda . The City Manager will follow th'rough on this tomorrow morning . VIII . COMMENTS BY COMMISSIONERS None IX.
