The regular meeting of the Palm Desert Planning Commission
was called to order by the Chairman at 7 : 02 P .M, on April 22 , 1974
at 7 : 02 P .M.

V . APPROVAL OF MINUTES
A. Minutes of the Planning Commission meeting of 4/8/74
were approved as submitted .
VI . WRITTEN COMMUNICATIONS - None
Commissioner Brush entered the meeting at 7 : 06 P .M.
VII . PUBLIC HEARING
A. CUP-13-74-PD - HOME BUSINESS DEVELOPMENT (West side
of Deep Canyon, North of Driftwood) CUP to allow
` conversion of 22-unit apt . complex to a planned
�"' residential development . Continued from 4/8/74 at
request of applicant to comply with fire requirements .
Planner Dupree advised this CUP had been continued
several times since November 1973 at applicant ' s request . He
said if the property were subdivided it would require fire
protection and additional dedication of Sunrise Lane . This
would necessitate applicant applying for a variance which would
be difficult to justify. He said several requests are received
in their County offices and they continually advise the appli-
cants that an apartment or hotel complex is not conducive to
dividing up into condominiums . County recommended denial be
made without prejudice .
Chairman Clark opened the public hearing .
There were no proponents or opponents .
Chairman closed the hearing .
Commissioner Aston moved , Commissioner Brush seconded
that CUP-13-74-PD be denied without prejudice . Motion carried .
unanimously .
� VIII . OLD BUSINESS
A. P . P . 1083-PD - MISSION BELLE HOM�S (Continued from
4/8/74 . ) Applicant requested plot plan approval to
construct 19 one-story frame & stucco , single family
dwellings on 19 R-1 lots scattered through 2 separate
areas ; one area is located N of Hwy 111 and W of Deep
Canyon; the other lies N of Avenue 44 and W of College
of the Desert .
There was discussion concerning parking , building
size , room size , neighborhoods , etc . The Commissioners had
previously familiarized themselves with the building sites .
Commissioner McPherson moved , Commissioner Brush
seconded that P . P . 1083-PD be approved subject to staff con-
ditions including approval of proper landscaping and fencing .
Motion carried by the following vote :
G AYES : Aston; Brush ; McPherson; Clark

IX. NEW BUSINESS
A. P . P. 1071-PD - JAMES BROWN CONSTRUCTION C0.
Request for plot plan approval to construct 48
dwelling units , 16 one-story, frame & stucco ,
triplex buildings . One triplex building to be
constructed on each of 16 existing lots . Located
northerly of Avenue 44 , W of Joshua Drive .
Mr . Hurlburt recommended continuance for further
consideration of the parking arrangement and building size .
Commissioner Brush moved , Commissioner McPherson
seconded that P . P . 1071-PD be continued to May 20 , 1974 for
further study of parking and building size . Motion carried
unanimously .
B. P . P . 1072-PD - JAMES BROWN CONSTRUCTION C0 .
Request for plot plan approval to construct 28
dwelling units in 14 one-story , frame & stucco
buildings on 7 lots . N of Highway 111 and E of
Deep Canyon Rd .
'�"' Mr . Hurlburt recommended continuance for further
consideration of building size , parking , and water problem as
the property is in the Deep Canyon Water Company district .
Commissioner Brush moved , Commissioner Aston seconded
that P . P . 1072-PD be continued to May 20 , 1974 for further study ,
that the air conditioning be removed from the roof , that appli-
cant consult with staff in regard to arrangement of swimming
pools , adequate fire protection , and consideration of other
recommendations made by staff . Motion carried unanimously .
C . P . P . 1076-PD - MR. & MRS . DAVID 0'MALLEY - Request
for plot plan approval to construct a 9-unit ,
one-story, concrete block, commercial building .
Located on W side of San Pablo Dr . , approximately
150 ft . northerly of Iiwy 111 Frontage Road .
Commissioner McPherson moved , Commissioner Aston
seconded that P . P . 1076-PD be approved subject to staff con-
ditions , but deleting condition ��8 . Motion carried unanimously .
D . P . P . 1084-PD - ROBERT H. RICCIARDI - Request for
plot plan approval to construct a one-story
addition to an existing commercial building .
� Located rear of existing building fronting on the
N side of El Paseo approximately 500 ft . W of
Portola Ave .
Mr . Hurlburt said the second reading of a new
parking ordinance will be given at the Council meeting on
April 25th, and recommended continuance until the new
ordinance is adopted .

Commissioner Aston moved , Commissioner Brush
seconded that P . P . 1084-PD be continued until May 6 , 1974
for staff study of parking . Motion carried unanimously .
X. ORAL COMMUNICATIONS
Robert Ricciardi, 73-700 Highway 111 , requested more
than five (5) minutes . He felt that the Commission was not
allowing citizens to be heard . He spoke on the parking lot
situation.
� Bernie Leung asked how densities are being studied and
if there were a member of the staff certified to make such a
study . Mr . Iiurlburt informed him that the City employs a
consulting engineering firm.
Harold Howsley, Iiome Business Development , requested that
the public hearing on CUP 13-74 be reopened as he was not
present earlier . Attorney Erwin said the decision to deny
without prejudice had been made, and that some of the audience
had already left and the hearing could not be reopened at this
time. Planner Dupree said if applicant appealed to the City
Council there would be no filing fee .
XI . COMMENTS
A. City Manager
Mr . Hurlburt said he would like to study building
size and covered parking at a study session.

Commissioner McPherson asked Planner Dupree
�""` if Durco Construction could be on the May 6 , 1974 agenda .
Commissioner Brush said he would like to have
landscaping on a study session agenda .
Commissioner Benson said she thought the five
(5) minute limitation under oral communications should be
changed to "reasonable time" .
Commissioner Brush inquired about the speaker
system. Mr . Hurlburt will follow through .
Chairman Clark urged the Commission and audience
to attend the Citizens Advisory Committee meeting in progress
at the Community Church.
