I . CALL TO ORDER
The regular meeting of the Palm Desert Planning Commission
was called to order by the Chairman at 7 : 05 P .M, on May 20, 1974
at Palm Desert Middle School.

IV. APPROVAL OF MINUTES
A. Minutes of the Planning Commission meeting of May 6 ,
1974 were approved as submitted .

A. CUP-04-73-PD - DURCO CONSTRUCTION - 5 units SE corner
Ocotillo & Tumbleweed Lane. (Continued from 4/8/74 to
allow applicant to redesign project from 2-story to
1-story . )
Planner Dupree said applicant had requested a 6-month
continuance . He said this is an excessive period of
time for an extension, that it should be continued for
a maximum period of 30 days or that applicant withdraw
his application .
Mr . Curt Dunham, 71-888 Vista Del Rio , Rancho Mirage ,
requested withdrawal .
Commissioner Aston moved , Commissioner Benson seconded
that CUP-14-73-PD be withdrawn. Motion carried unanimously .
B. CUP-Ol-74 - DURCO CONSTRUCTION - Request for plot
approval for a 92-unit condominium development West of
and adjacent to Cook St . between Hwy 111 and Fairway .
Commissioner Brush entered the meeting at 7 : 10 P .M.
�, Planner Dupree displayed exhibits and recommended
approval subject to staff conditions .
Attorney Erwin recommended elimination of the last
three lines of condition ��2 . Planner Dupree concurred .
The Chairman opened the hearing .
Mr . Curt Dunham said these would be one-story units
with at least 75% of the units with 1 , 790 sq . ft . There would
be 9 swimming pools and the units would sell from $55 , 000 to
$60 , 000 .
Mrs . Alice Breece, 74-741 Candlewood St . , asked if
the western boundary was coming up to where Candlewood ends .
She said there was a water problem which makes a lake in front
of her house.
Planner Dupree said the drainage problem should come
� up at the time of the subdivision map , item VIII . D .
Mr. Mel Craig , Planning Director for the City of
Indian Wells , said they were concerned about the location of
the tennis courts and their immediate vicinity to Indian Wells
R-1 property . He said they were not particularly against the
proj ect itself .
The Chairman closed the hearing .
Commissioner McPherson moved , Commissioner Aston seconded
that CUP-01-74-PD be approved subject to staff conditions as
amended . Motion carried unanimously .
VII . OLD BUSINESS
A. P . P . 1071-PD - JAMES BROWN CONSTRUCTION C0. - Request
for a plot plan approval to construct 48 dwelling units
in 16 one-story , frame & stucco , triplex buildings . One
triplex to be constructed on each of 16 of 20 already
developed lots . Located northerly of Avenue 44 , W of
Joshua . (Continued from 4/22/74 for further study of
parking and building size . )
� Mr . Williams said he had thoroughly reviewed the
project and found the parking in front is not considered
appropriate ; the density is excessive; the one-bedroom units
being 680 sq . ft . and the two-bedroom units being 800 sq . ft .
is too small; and that the project as a whole is not satisfac-
tory and he recommended denial .
Commissioner Brush moved , Commissioner Aston seconded
that P . P . 1071-PD be denied . Motion carried unanimously .
B . P .P . 1072-PD - JAMES BROWN CONSTRUCTION C0. - Request
for plot plan approval to construct 28 dwelling units
in 14 one-story , frame and stucco buildings on 7 already
developed lots . S of Hwy 111 and E of Deep Canyon.
(Continued from 4/22/74 for further consideration of
building size, parking and water problem. )
Mr . Williams recommended denial per staff report .
Commissioner Brush moved , Commissioner Aston
seconded that P . P . 1072-PD be denied . Motion carried unanimously .
Evelyn Young submitted letter of opposition and
petition opposing the project , for the record .
VIII . NEW BUSINESS
�,,, P . P . 1 MF - MARRAKESH BUILDING AND COUNTRY CLUB
Request for plot plan approval for a 34-unit con-
doninium on 36 lots located East of Marrakesh Dr .
and North of Haystack (T . T . 5904) .
Mr . Williams recommended approval subject to staff
conditions .
Commissioner McPherson moved , Commissioner Brush
seconded that P . P . 1 MF be approved subject to staff conditions .
Motion carried unanimously .

B. P . P . 2 MF - KAVANAUGH PROPERTIES 9 CORSICAN VILLAS -
Phase 2) - Request for plot plan approval for a
50-unit condominium located West of Portola Ave.
between Buckboard and Haystack (T . T . 4605) .
Mr . Williams said this was the second increment
of the tentative map and recommended approval subject to
staff conditions .
Chairman Clark brought up the density of 9 . 95
units compared to 3 . 9 at Marrakesh, 1 , 000 feet down the road ,
two-story units , and the amenities of 1 swimming pool for 50
� units as compared to 1 swimming pool per 10 units at Marrakesh.
After further discussion , Commissioner Brush moved ,
Commissioner Aston that P . P . 2 MF be denied . Motion carried
unanimously.
C . P . P . 1080-PD - DURCO CONSTRUCTION - Request for plot
plan approval for a 92-unit condominium development
located West of and adjacent to Cook St . , between Hwy
111 and Fairway Drive (T . T . 4798) .
Mr . Williams recommended relocation of the tennis
courts to the center of the project . He also recommended staff
approval of the lighting be required prior to installation.
Commissioner Benson brought up the question of the
wall , whether the city wanted so many walled areas .
Mr . Curt Dunham said the original requirement of the
County was that it be a walled community. They feel it is
better to have a wall with a guard gate for security. He
thought that if the tennis courts were to be moved that they
go at the westerly end of the subdivision.
Mr . Hurlburt said that condition ��10 covers the

tennis court question.
Commissioner McPherson asked if the applicant would
be agreeable to providing more trash areas , to which the
applicant concurred .
Commissioner Brush moved , Commissioner Aston seconded
that P . P . 1080-PD be approved subject to staff conditions .
Motion carried unanimously .
D. Tract 4798 - DURCO CONSTRUCTION - 92 unit con-
dominium development West of and adjacent to Cook
St . between 111 and Fairway.
Planner Dupree recommended approval subject to staff
conditions and an additional condition ��13 as follows : "Pric�
to the issuance of a building or grading permit that a drainage
design be submitted to and approved by the Flood Control District
at the termination of Candlewood Street . "
Commissioner McPherson moved , Commissioner Aston
seconded that Tract 4798 be approved subject to staff condi-
tions . Motion carried unanimously .
� E. Tract 5567-PD - MERCURY ENTERPRISES - 326 units at
SE corner of Homestead Road and Hwy 74 .
Planner Dupree recommended approval subject to
staff conditions .
Commissioner McPherson moved , Commissioner Aston
seconded that Tract 5567-PD be approved subject to staff
conditions .

Commissioner Benson commented when this tract
was previously approved , it was approved 4 to l , that she
still intends to vote against it as she does not believe a
project of this size should be approved until the master
plan is prepared .
Motion carried by the following vote :
AYES : Aston; Brush; McPherson; Clark

F . Establishment of new Planning Commission meeting date .
Mr . Williams said staff was recommending that the
Planning Commission recommend to the City Council that the
Commission meeting be changed �o Monday , 10 days prior to the
� City Council meeting. Chairman Clark said he thought the
Commission members would prefer to keep one week free.
Commissioner Brush moved , Commissioner Benson
seconded that this be tabled for a study session. Motion
carried unanimously .
IX . ORAL COMMUNICATIONS
Mr. Ed Power , 45-278 Deep Canyon Road , representing
Desert Garden Apartments , said they originally had been granted
a permit for carports . Subsequently after incorporation they
were told they were denied . He wanted an idea on the thinking
of the Commission on carports so they may submit drawings .
Chairman Clark suggested plans be brought into staff
and he thought the Commission would be agreeable to what the
staff would propose .
� Dr . Eugene Kay , Homestead Rd . , asked if any thought
had been given to the drainage problem along Homestead and
Bel Air Rd . if Mercury Enterprises proceeded with their project .
Planner Dupree said this tract comes back to the Council
on Thursday to be set for public hearing and this may be pursued
by the Council at that time.
Mr . Harold Housley , engineer , said re : P . P . 1071 that
he was involved in testing with Mr . Schultejann and that
the water system does meet the minimum County fire requirements
and is ample for single family dwellings , but not for �:ultiple
units .
