There were no deletions or corrections to the minutes of the December 30, 1974 meeting. Comtrlissioner tailson moved and Commissioner Mullins seconded that the minutes be ap�roved as submitted which was unanimously carried. V. ��IRITTE�3 COT��U'IUNICATIONS - Noi1e �"' VI . PUBLIC HEARING p,. Continued Case ��To. Change of Zone - 81-73-P� - s�'�.AL� MOSS PROPvRTIES - Th.e consideration of a request to change the zone from jd-2 (Controlled Development) and R-2-�D00 (i7ulti�ale Development) and R-2-5000 (Multiple Fami�,,y Dwellings) to C-P-S (Scenic I�ighway Commercial) , R-3 (�esidential) , and T1-A (ilatural Assets) on property located west of Painters Path and south of the westerly eYtension of Avenue 44 - ([1-2 , R-2-5000) was discussed by Staff. It was Staff ' s recomrnendation that the case be continued until March 17 , at which time it was hoped that the �eneral Plan would be comnleted. After a presentation by Staf£, and no one wishinu to be heard, a motion was r.zade by Co�unissioner 1`Zullins and seconded by Commissioner �ailson that the case be continued to March. 17 , 1975 . Said motion was unanimously carried. B. Continued Case No. ICAP A?'�E��IDMENT - 03-7�o- - H. McCJ1Z'IIC�- Consideration o� a requEst to amend the Palnl Desert Interim Core Area Plan by deleting an indicated automobile drive- way connection from El paseo to the rear parking area in the general vicinity of Lot 29 , Block S , Palm Desert �,,,,, subdivision. Said pa�cel located northerly of and adjacent to El Paseo, approximately 400 feet easterly o� the inter- section of El Paseo and San Luis �ey. P•Zr. Williams recommended that since no analysis of the prototype Block had been comnleted yet that the case be continued to June 30, 1975 . He stated that the an�.lysis would be completed by June. Planning Commission ��Ieeting -2- January 13, 1975 1��r. Harold McCormick, ��5-800 Shalem, Indian tiaells addressed the Commission and stated that his client was ready to go ahead and objected to continued delays . Commissioner Van de Mark asked if their plans were all ready to submit or if they were just waiting for the Planning Commission to act. Mr. NTcCormic�c stated that they were waiting for the Plan- nin� Corimission to act and expressed th.e desire that he did want to uo ahead with the plans . Commissioner Mullins discussed the driveways between El Paseo and Iiighway 111 and stated they hated to see �"' it delayed for an additional six months after being continued from 1Vove�ber 18 , 1974. He asked how tt�e proto- type block was cor.linv. P�Ir. Williams answered Commissioner T�ullins ' inquiry that the driveway access may not be needed. He stated that a meeting schedule was being established on the prototype block analysis . Commissioner 5dilson indicated that he agreed with Commissioner T��ullins that six months seemed to be an unreasonable length of time, especially since P'Ir, r'lcCormick has had this �roject in front of the Planning Commission for several months . I�e suggested that he would like to give the Staff time to prepare a renort and su;gested that this be continued for two weel{s . Commissioner Seidler restated Commissioner T�Tilson' s sug- gestion that one of the alternatives be to continue for six months or continue for two weeks and have the Staft make a final recommendation of yes or no and asked if , it would be acceptable to Mr . I�ZcCormick. T�r. McCormicl. answered that it would be acceptable and �"" commented that he had spoken to Mr . ?�obert Ricciardi regarding seeing the plot plan on Bank of America. Mr. Robert Ricciardi, 73-700 Hi�hway 111, agreed that he had seen the layout for Banlc of America and a�reed that there would be a driveway comin� into the project adjacent to the property because they would like a drive-up window. Conunissioner Seidler asked Staff to review these things as stated by Mr. P.icciardi and to make a determination to whether this proj ect should be approved so t�Ir. R'IcCormick can go ahead and submit plans for building on this property or whether the City would be willin� to go ahead and state th�.t there is going to be a drive-throu�h area, therefor, placinb the City in a position of de�iding on acquisition of the lot in the future. :Ie spoke about the Core Area Plan and that it was not the intent to stall T�Ir. T�cCormick' s request but whether these drive throu�h areas should infact rer.lain as indicated on ti�.e Core Area Plan. Staff indicated that there was a special Planning Commis- sion meeting proposed for the 27th of January and suggested to have the case continued until tlzat meeting. � A motion was made by Commissioner Wilson that this public hearing be continued until January 27 , Commissioner Van de Mark seconded the nnotion, and it was carried 4-0 . VII . OLD BUSITIESS - T1one VIII . NEI�J SUSINES� Mr. C�Iillians sAoke about two of the items under New Business having been discussed on December 9 , 1974 durin� the General Plan Hearing. The City Council thouUht that these two items Planning Commission r�eetin� -3- January 13 , 1975 and two others merited additional study and as a result referred these items back to the Commission for review prior to the City Council ' s action on a continued hearin� on the General Plan set for January 20. A. The first item deals with th.e Saint Mar�aret ' s EpiscoAal Church and their five acre parcel of land alon; State Highway 74. They wished to have it desivnated for hi�h-density residential to facilitate the creation of a proposed housing complex for retired citizens . It was the Staff' s recommendation that the Plannin� Commission recommend to the City Council that the parcel be designated as Institutional (General) . It was the feelin� of the Staff that perha�s this ;,� desi;nation more closely fit the development requested by the church. On that basis the Council referred this request back to the Planninb Commission for study and a report to be forwarded to their body for their consideration on their next public hearin� on the General Plan which would be on January 20 . r�r. Robert B. Cummings , consultant in housing for the elderly, spoke about the project and their request . He stressed the point that the citizens would be in good health and that it would not be a convalescent hospital . It is anticipated that federal funds , either throu�h section 231, or under section 202 would be used. I�e also referred to the density stating that there would be approximately 12 persons per unit . Staff stated that a new designation of Institutional General would give the Planning Commission more con- trol since it would require a public hearing on a C .L'.P . before the actual approval by the Architectural Review Board of the site. Comr.iissioner Van de Mark moved by minute motion that the Planning Commission recommend the land as Insti- ,�,,,, tutional General and that Council adopt this use for this particular property. Commissioner Niullins seconded the motion, and it was carried uanimously. B. Discussion of a request dated December 5 , 1974 fro�n Jim Chapman, representinv Bekins Pronerty Management ComPany to change the land-use designation from Medium Density Residential to Specialty Commercial for the parcel at the southwest corner of E1 Paseo and State Highway 74 as referred bac�: by the City Council. Staff recommended that the Planning Commission recom- mend to the City Council that the parcel be designated as 1"Iedium Density Residential . Staff had received a letter dated January 13 from T2r . Chapman, a representative of the Bekins Propez�ty Mana�ement Connpany requesting that the land be left at P�Iedium Density Residential . Staff made note that if the applicant feels he would like to �ursue this change in the future he can go through the actual request for a General Plan amendment and rezoning and the neighborhood can be notified and be fully aware of what is being �onsidered by the City. Commissioner 1`Zullins moved by minute motion that the � parcel be designated as Medium Density Residential and be recommended to the City Council. Commissioner Van de RZark seconded the motion and the vote was unanimous . C. There was a discussion of a request dated January 2 , 1975 , from F.T. Kieley that the land-use designation for Section l, Township 5 South, Range 6 East , S .B.B .&M. be chanoed to Very Lo�a Density Residential as referred back by the City Council. Staff reported that 20 acres Planning Commission P�Ieeting -4- January 13, 1975 were east of Highway 74 and the remaining 632 acres west of Highway 74. A major portion is shown as Very Low Density. The applicant was requestin� that this designation be given to the full property so that he could obtain credit in terms of the acreage , though he admits in his letter that he proposes to build only on the flatter portion of the side. The Staff reported agreement with the applicant from the standpoint that the entire property should be shown as 1-3 units per acre. The Staff was of the opinion that the 20 acres east of Highway 74 has additional problems with """ regards to drainage. This is a substantial flood plain and perhaps more analysis should be made with regards to protection of this side prior to the granting of the land use designation on the 20 acres east of Highway 74. Mr . T. Kieley, 2777 East Borisco, Palm Springs , stated that he understood the Staff' s request to be that when proper flood control is provided that the land would be considered. Mr . Kieley felt that it would not be a great expense to �et flood control. Commissioner Van de Mark asked what provided protection of the property on the southerly side. Mr. Kieley answered her that there was a dike installed already on the south side of the pro- perty and from the bridge to the toe of the mountain. Commissioner Wilson was concerned with the Staff' s recommendation that the entire area be zoned Very Low Density. He felt that this development was at ""�"` the last of the main entrances to our City. Commissioner Van de Mark agreed that it should be designated Very Low Density and to not include the mountain areas in that amount . Mr . Robert Ricciardi, 73-700 Highway 111, stated that similar problems had existed in Palm Springs . He stated that the zoning ordinance of Palm Springs states that you must have a 50 percent open area so that you can have open areas . He stated that he felt that by restricting Mr. Kieley on his property that the Planning Commission would be restricting him too much. He stated that he would rather see him not so restricted but restrict him by the zonin� ordinance. Commissioner Wilson stated that he would rather be on the safe s�.�ie by having a Very Low Density desig- nation of the flat area. Chairman Seidler stated that he thought there were several considerations in addition to what the Plan- ning Commission has : 1) This property is outside ,�, the boundaries of the City and in the County area. He said that the Planning Commission should �ive the flexibility to permit a development that can build a 3-5 density units per acre. He didn' t feel that it was the intention of the map as so drawn to have it 1-3 on only the flat land. He felt that number l , consistency and number 2 , for that area to be developed 1-2 is certainly not excessive of what can be built on that acreage which is approximately 1/3 of th� 632 acres . Planning Commission i�ieetin� -5- January 13 , 1975 Commissioner Mullins agreed that it ' s appropriate land use designation for that area. Commissioner Wilson asked how much of the 640 acres were flat, developed land. Staff stated that approximately 1/3 of the site is developable. Commission Wilson moved that the Planning Commission recommend to the Council that this area remain as shown on the General Plan as developed by Wilsey & Harn. Commissioner Van de Mark seconded the motion. Before a vote ensued, Commissioner Van de Mark asked ""` how the Planning Commission could make a compromise to use 1/2 of it . Mr . �d Peck, 73-610 Buckboard Trail, stated that it would allow nine to the acre on the flat area and thought this would be the similar approach on show- ing the flat area at 5-7 to the acre . Commissioner Seidler then entertained the vote on the motion. Commissioner l�ilson and Van de Mark voted yes and Commissioner Seidler and Mullins voted no. Because of the tie vote no action could be concurred and the tie vote would be given to the Council as the Planning Commission' s recommend- ation. D. The discussion of a request from Elmer C. Rigby, M.D. to desibnate a 9 acre, triangular-shaped parcel located at the southeast corner of the intersection of Portola Avenue and the tdhitewater Storm Channel for commercial use , as referred back by the City Council then ensued. � Dr. F.igby spoke to the Commission about his request and his past experiences in trying to get the area designated commercial . After some discussion the Commissioners voted on a motion made by Commissioner j�Jilson and seconded by Commissioner Tlullins that the Planning Commission a;ree with Staff' s recommendation that the Commission recommend to the City Council that the parcel be designated as Medium Density Residential . The vote was unanimous . E . Determination of whether proposed Cook Street Waste- water Collection Line is in compliance with proposed Pal�n Desert General Plan was then discussed. After some discussion the Commission agreed with Staff' s recommendation that it was in compliance and to approve Planning Commission Resolution No. 29 . Commissioner P�ullins made the motion that they approve Planning Comm��sion R�sQJ�t�i���n :No, �9__��� ��anm�ssioner Van de P�ark seconded the motion. The vote was unanimous . IX. ADJOURNMENT Chairman Van de Mark moved, Commissioner Mullins seconded the meeting be adjourned until January 27 at 7 : 00 P.M. at the IuIiddle School .
