CALL TO ORDER The regular meeting of the Palm Desert Planning Commission was called to order by the Chairman at 7:00 p.m. on March 17, 1975 at the Palm Desert Middle School. w.r. II. PLEDGE OF ALLEGIANCE III. ROLL CALL Present Commissioners: GEORGE BERKEY, ED MULLINS, WILLIAM SEIDLER, MARY K. VAN DE MARK, S. ROY WILSON Others Present Paul A. Williams - Director of Environmental Services Jeff Patterson - City Attorney Representative Freeman Rader - Associate Planner Sam Freed - Assistant Planner IV. APPROVAL OF MINUTES Commissioner Wilson moved, Commissioner Mullins seconded the motion to approve the March 3, 1975 minutes as submitted. The motion was unanimously carried. V. WRITTEN COMMUNICATIONS � Mr. Williams presented the following two items and recommended the � correspondence be received and filed. l. A letter from William Reynolds and William Garrett dated March 5, 1975 explaining the variables of adopting the Redevelopment Plan at different times in the future. 2. A letter from Mayor Clark urging greater citizen input at the Planning Commission study sessions on the new Zoning Ordinance. The Commission concurred. VI. PUBLIC HEARING Chairman Seidler explained the public hearing procedure. A. Case No. Variance-01-75/LARRY LACKS & H. A. McCORMICK: Request for a variance from the requirements of the Palm Desert Zoning Ordinance, Section 18.12 (Off-Street Parking Requirements)for Lot 21 and Lot 29, Block S, Palm Desert Unit No. l, located on the north side of El Paseo, between San Luis Rey and Portola. (C-P-S) Freeman Rader presented the Staff Report requesting a variance � to allow a relaxation of off-street parking requirements in order to permit construction on Lots 21 & 29 of the Prototype Block to conform with the existing development pattern in the area. Mr. Rader ex- plained that space required for additional parking coul.d not be used for that purpose because the circulation and parking plans which were being designed for the Prototype Block would render it unusable for parking. After reviewing the Prototype Block proposals, Mr. Rader recommended that it be moved by Resolution No. 40 that the Planning Commission approve the request for a variance. -2- Chairman Seidler then opened the public hearing. First to address the Planning Commission was: 1. H. A. McCormick 45-800 Cholame Indian Wells, California Mr. McCormick wished to state that he felt the case had been presented very well by Mr. Rader and had no additional comments to make. �..r There being no further comments, the public hearing was closed. Mr. Williams then addressed the Commission by stating it should be noted that the Architectural Review Board had carefully reviewed this case and indicated that what was being presented to the Commission was a result of its f indings. Commissioner Berkey moved, Commissioner Van de Mark seconded the motion to approve Planning Commission Resolution No. 40. The motion was unanimously carried. B. Continued Case No. C/Z-01-73 PD - GERALD MOSS PROPERTIES: Con- sideration of a request to change the zone from W-2 (Controlled Development) and R-2-5000 (Multiple Family Dwellings) to C-P-S (Scenic Highway Commercial) , R-3 (General Residential) , and N-A (Natural Assets) on property located west of Painters Path and south of the westerly extension of Avenue 44. (W-2 and R-2-5000) (Continued from January 13, 1975) Paul Williams explained that this matter was continued (for the second time) for the purpose of the completion and adoption of the Zoning Ordinance and Zoning Map, at which time the evaluation could occur without a zoning issue problem. Since the Zoning Ordinance and �,,,�, Map is being developed, an additional continuance of the change of zone request hearing to June 16, 1975 would allow sufficient time for the completion of these two matters. Mr. Williams also indicated that the applicant had reviewed this matter and is in full agreement with the continuance. There being no further comments, Commissioner Mullins moved, Commissioner Wilson seconded the motion to grant a continuance of the hearing to the Planning Commission Meeting of June 16, 1975. The motion was unanimously carried. VII. OLD BUSINESS - None VIII. NEW BUSINESS A. Case No. 8C - H. A. McCormick: Consideration of a request for plot plan approval to permit construction of a commercial building on Lot 21, Block S, Palm Desert Unit No. l, located north of the intersection of El Paseo and Prickly Pear Lane (C-P-S) . B. Case No. 9C - Larry Lacks: Consideration of a request for plot plan approval to permit construction of a commercial building on Lot 29, Block S, Palm Desert Unit No. l, located on the north side of El Paseo, approximately 400 feet east of San Luis Rey r"" (C-P-S) . Freeman Rader presented the Staff Report on Case No. 's 8C and 9C; and added that one additional condition be included on the attached Conditions of Approval for both cases which reads as follows: -3- 18. Prior to the issuance of any building permits, an easement will be granted to the rear off-street parking area for use by the public. Mr. Rader then recommended the adoption of Resolution No. 41 approving both cases. Chairman Seidler suggested that any future items of this nature should be presented as separate items and adopted by separate iwr resolutions. Commissioner Wilson asked if the applicant was in full agreement with the additional condition as added. Mr. McCormick replied, yes. Commissioner Van de Mark moved, Commissioner Mullins seconded the motion to approve case no. 8C by the adoption of Resolution No. 41. The motion was unanimously carried. Commissioner Wilson moved, Commissioner Van de Mark seconded the motion to approve case no. 9C by the adoption of Resolution No. 42. The motion was unanimously carried. IX. ORAL COMMUNICATIONS Chairman Seidler then addressed the audience by stating that any person wishing to discuss any item not on the agenda, may address the Planning Commission at this time before adjournment to the study session on the Zoning Ordinance. First to address the Planning Commission was: 1. Jack MacFadyen 73070 Shadow Mountain Drive Palm Desert, California t�rrr Mr. MacFadyen explained that he had come this evening to find out just how interested the citizens of Palm Desert were to find out what the Planning Commission was doing. He indicated he had prepared a list of those present and from what he could surmise, the individuals in attendance were here only because they had an item on the agenda. Needless to say, he was very surprised about the poor attendance since there seemed to be considerable hubub in the city with charges being made that the citizens haven't had an opportunity to say or change anything. He summarized by stating that from this time forth, he planned to attend the Planning Commission meetings to hear what is being said and done in the city of Palm Desert and to have his opinions and ideas heard. Chairman Seidler indicated that five or six more people were expected to attend the study session, but on the average, we have approximately eight people in attendance, other than the Commission and the Staff, to provide citizen input. STUDY SESSION The Planning Commission conducted a Study Session to study the proposed articles of the Zoning Ordinance which deal with the Industrial Service Zone and the Planned Residential Zone. -4- XII.
