PLANNING COMMISSION MEETING
October 14, 1975
7 p.m. - City Hall Council Chambers
I. CALL TO ORDER
The regular meeting of the Palm Desert Planning Commission was called to
order by the Chairman at 7:02 p.m. on October 14, 1975 in the City Hall
Council Chambers.

IV. APPROVAL OF MINUTES
The minutes of September 29, 1975 were amended as follows :
Page 1 , Public Hearing: A first paragraph was added as follows :
Chairman Seidler noted that all items on the Agenda had been reviewed
and discussed prior to the meeting for the purpose of obtaining a
full understanding of staff's reports. No decisions are made during
Study Session; and they are open to the public.
Page 5, Paragraph 5: The second line was corrected to read as follows :
District Commercial instead of Resort Commercial .
Commissioner Van de Mark moved, Commissioner Mullins seconded the motion to
approve the minutes as amended. Motion carried unanimously.
V. WRITTEN COMMUNICATIONS
Paul Williams referred to the Fall 1975 CVAG President' s Newsletter dis-
tributed to the Planning Commission for information only. Included in
this newsletter was a schedule of upcoming CVAG meetings. Those Planning
Commissioners who wished to attend any of these meetings were urged to
go; and were directed to contact Paul Williams prior to attending the
meetings.
VI . PUBLIC HEARING
Paul Williams commented that the Planning Commission had met from 5:30 to
7:00 p.m. , at which time they reviewed the Zoning Ordinance. Included was
a review of the list of changes proposed at their meeting of September 29
for Sections 25.1 thru 25. 14 as to their completeness; and a new list of
changes proposed by staff pertinent to Sections 25.15 thru 25.46-2. No
decisions were made during this Study Session which was open to the public.
two Chairman Seidler advised that the first case under Public Hearing was the
continued Public Hearing on the new Zoning Ordinance. He added that the
Planning Commission would operate under the same guidelines in effect at
the last meeting. Any person wishing to discuss any sections of the
Zoning Ordinance after the Planning Commission had a chance to review the
document was welcome to do so.

Paul Williams first reviewed those changes and points raised at the
last meeting of the Planning Commission with regards to the residential
zones. Staff recommended amendments to this list of changes which
were as follows:
Page 25.9 (2) , Article 25.9-5.03 Minimum Lot Depth - To correct a
typographical error, the minimum lot depth was
amended to read Two hundred (200) feet.
Page 25.11 (3) Article 25.11-5.09 add to the end of the phrase
except where the property is adjacent to the R-1
district,) the building height shall be limited to
... one (1 ) story.
Page 25. 12 (3) Article 25.12-5.10 add to the end of the phrase
except where the property is adjacent to the R-1
district,) the building height shall be limited to
one (1 ) stogy.
Chairman Seidler asked for the Commission's comments regarding the first
changes as reported back by the Staff. There were no comments.
Chairman Seidler then asked for comments from the audience regarding the
changes just discussed or any items thru Sections 25.14.
Mr. George Ritter, 73-899 Highway 111 , suggested a change to Article 25.12-3
to increase the number of maximum hotel units from 18 to 36 units. Paul
Williams explained the justification for the Planning Commission and Staff
recommending 18 units versus 36 units. There were no further questions
or comments regarding the Zoning Ordinance thru the residential zones.
Paul Williams then reviewed the remaining Sections of the new Zoning
Ordinance, section by section, beginning with the Planned Commercial
Districts; and answering questions and clarifying sections as he went
along.
�..r Throughout the duration of the meeting, the following members of the
audience commented on various sections of the ordinance.
Hank Everhart, 73-196 Highway 111 , commented on Section 25.16-5. 12,
Special Standards.
Robert Hubbard, 52 Standiford Drive, Rancho Mirage, commented on
Articles 25.16 General Commercial District (Cl ) and Article 25.17
Professional/Office District (C2); and Section 25.5-3.
Enos Reid, representing Ironwood commented on Section 25.5-3,
Continuance of Previously Granted Variances, Conditional Use
Permits, Permits, and Licenses.
George Ritter, 73-899 Highway 111 , commented on the following
Sections: 25. 16-5.12, Special Standards , 25.18-5.03, Resort Center
Development Standards #4a; 25.20-7.14, Perimeter Screening; 25.32-8.01 ,
Minimum Residential Structure Size; 25.37-1 .01 , Height Considerations;
25.39-3. 11 , Lapse of Conditional Use Permit; 25.39-4.03, Required
Drawings; 25-41-6.03 Environmental Impact-Mitigation Measures #3;
and 25.42-5, Determination of Compliance with Required Conditions.
Don Shayler, 73-893 Highway 111 commented on Article 25.16, General
Commercial District (Cl ) and Article 25.17, Professional/Office
District (C2) .
Throughout the meeting, the Planning Commission made minute motions
to approve various changes throughout the text which were as follows:

Commissioner Berkey moved that Article 25.17, Professional/Office District
(C2) be deleted from the Ordinance. Commissioner Van de Mark seconded the
motion. After further consideration, Chairman Seidler asked if Commissioner
Berkey would like to amend his motion to include permitted uses of the (C2)
zone which were not found in the (Cl ) zone to the (Cl ) zone. Commissioner
Berkey amended his motion to reflect this change. Commissioner Van de Mark
seconded the amended motion which carried 3-1 . Commissioner Mullins voted
no; and Commissioner Wilson was absent.
It should be noted that Commissioner Wilson had to excuse himself from the
meeting for personal reasons.
Commissioner Mullins moved that restaurants, except for drive-in or drive-thru
be included in the Cl zone under conditional uses. Commissioner Berkey
seconded the motion that carried unanimously.
Commissioner Berkey moved that Page 25.40 (1 ) remain in the Ordinance;
and that the balance of this section with reference to "Group B" in Section
25.40-2 be deleted. Motion died for lack of a second.
The Planning Commission then reviewed Resolution No. 92 prepared for the
purpose of adopting Chapter 25 of the Palm Desert Minicipal Code by
Ordinance. After a brief discussion #4 of the resolution was revised
to read:
4. That it does recommend to the City Council , that they adopt the
new Zoning Ordinance by 7 separate ordinances , in the following
increments.
25.1 through 25.6
25.7 through 25.14
25.15 through 25.18
25.19 through 25.21
25.22 through 25.31
25.32 through 25.38
two 25.39 through 25.45
The Commission felt that approving the Ordinance in sections would
be more organized for the City Council 's review and approval of the
various sections.
Chairman Seidler entertained a motion for adoption of Resolution No.
92 with the amendments as indicated in Exhibit B, approving and recommend-
ing to the City Council , the Adoption of Chapter 25 of the Palm Desert Muni-
cipal Code. Commissioner Van de Mark moved that the Planning Commission
adopt Resolution No. 92 as corrected indicating the change to #4 and
with the changes to the Ordinance as outlined in Exhibit B. Commissioner
Mullins seconded the motion which carried unanimously.
