CALL TO ORDER The special meeting of the Palm Desert Planning Commission was called to order by Chairman Berkey at 7:10 p.m. in the Council Chambers in the Palm Desert City Hall . +err II. PUBLIC HEARINGS Chairman Berkey explained the Public Hearing procedures to those present and announced that prior to this meeting, the Commission had met in a Study Session for the purpose of clarifying the staff's recommendations. No decisions were reached. A. CASE NO. CZ 07-76, PALM DESERT PLANNING COMMISSION, APPLICANT �rw Request that the Planning Commission consider a Change of Zone from S(Study) to PR-10(Planned Residential-10 Dwelling units per gross acre) , or other appropriate zones for property located northerly of and adjacent to 44th Avenue, south of Park View Drive, and east of the Palm Valley Storm Channel . Mr. Freed reviewed the case noting the various alternative zone designations which are: PR, R-1 , R-2, R-3, Combination Zone, and Commercial . Staff is recommending a PR-10 zone as it is an intermediate zone and would comply with the existing zones in the area. Discussion followed concerning applicants filing individual plans or group plans, concern for density on individual plans, different development plans for each property owner and all property owners complying with the PR-10 zone requirements. Chairman Berkey opened the Public Hearing and asked if anyone present wished to speak at this time. C RL MEISTERLIN, 73-261 Highway 111 , Palm Desert, (representing W property owners) spoke to the Commission noting that the plan c� ubmitted a few weeks ago is in agreement with all the property wners involved, the City needs this type of development, they will N, be medium-high density apartments, and in the price range that the average man could afford. ROLAND KING, Administrative Assistant, Palm Springs Clinic, spoke to the Commission pointing out that the property had been purchased several years ago with the advise of experts indicating that Avenue 44 is the best location for a professional building. Case No. CZ 07-76 (Continued) Commissioner Snyder asked to have it clarified as to the type of medical units planned, is it a hospital facility, any ambulance service, and how long before the proposed building would be started if approved. Mr. King indicated it would be like the Palm Springs Clinic, doctor offices consisting of a group practice, one location for all types of care, no overnight care, ambulance service very rarely, the clinic would have a health care plan, and estimated time for start of build- ing is two years or more. Mr. Freed pointed out that the submitted street plan does not cover the desires of the City, the lack of community orientated amenities and that staff sees no difference between the proposed medical center and other medical centers in existence or propoed in the area. Chairman Berkey asked if there were any further questions at this time. Being none, he declared the Public Hearing closed. Mr. Freed noted a letter received in OPPOSITION to the proposed project noting that it would affect the selling of present condominiums in the area (Exhibit A) . The Commission agreed that a zone of PR-10 and no higher would be the best zone for the area in question and it would agree with the zoning in Rancho Mirage. Chairman Berkey asked if there were any further questions at this time. Being none, he asked for a motion to approve Planning Commission Resolution No. 274. Moved by Commissioner Kelly, seconded by Commissioner Kryder; carried unanimously (5-0) . V. ORAL COMMUNICATIONS - None VI . COMMENTS A. City Staff - None B. City Attorney - Not Present C. Williams, Secretary Palm Desert Planning, Commission City of Palm Desert 45-275 Prickly Pear Lana Palm Desert, CA 92660 Re: Case No. C/Z 07-76 Dear Mr. Williams: This letter is to voice our objection to the above chancre of zone as proposed. We are developers of Tract 9396 adjoining subject proposal on the northeast side of Park View Drive, and have all City approvals necessary for the development of a 50 unit P.U.D. Final plans are complete and work is planned to start within 30 days. The proposed CZ will, if approved, have a decided negative impact on our project. Densities of surroundincr properties are well below the 10 D.U. proposal. The property to the north, although in Rancho Mirage and now designated as 10 D.U. , would in fact never be approved by Rancho Mirage for that density. The city fathers there are lookina that the parcel be significantly reduced. As an example, they suggested density of 3.7 D.U. for our project. The property to the east and west is single family lots. The south property is now designated PR 6, S.P. , similar to the PR 7, S.P. zoning that we are designed under. Our actual approved density turned out to be 5.6 D.U. A multiple zoning of PR-10 would be a decided sales deterent to our proposed development. We strongly urge that the Planning Commission reject the proposal for PR- d instead allow PR-6 as a reasonable compromise, and a compa able solution.
