CALL TO ORDER The regularly scheduled meeting of the Palm Desert Planning Commission was called to order by Chairman Berkey at 1 :05 p .m. in the Council Chambers of the Palm Desert City Hall . �. MINUTES of the regular meeting of the Planning Commission of January 31 , 1978 . Commissioner Kelly noted that on page six, second �r.. paragraph, lst sentence "any longer" should be deleted. On a motion by Commissioner Kelly, seconded by Commissioner Kryder, the minutes were approved as amended; carried unanimously (5-0) . V. WRITTEN COMMUNICATIONS Mr. Cipriani noted that all written communications received would be covered under the appropriate cases . VI . PUBLIC HEARINGS Chairman Berkey explained the Public Hearing process to those present . A. Case Nos . CUP 18-77 and 67C, HUGHES INVESTMENTS , Applicant Request for appraval of a Conditional Use Permit and Preliminary Design Review to construct and operate a grocery store , restaurant, and related retail shops in a commercial center within the C-1 , S .P . zone generally located east of Highway 74 and north of E1 Paseo . +i�r. Mr. Cipriani noted that the applicant had giveri a verbal request that the case be continued indefinitely. On a motion by Commissioner Reading, seconded by Commissioner Kelly the case was cont inued indefinitely; carried unanimously (5-0) . Case No. PM 11796, CHARLES HAVER AND ASSOC. , Applicant Request for approval of a Tentative Parcel DRap to both divide and assemble various parcels of land for develop- � ment purposes at a site located north of El Paseo and � east of Highway 74 within the C-1 , S .P, zone. � � Mr. Cipriani noted that the applicant had requested an inde- finite continuance and he then stated the reasons for the staff recommending that the case be denied without prejudice which include : The applicant has asked for an indefinite continuance for related Case No. CUP 18-77 in order to greatly modify the proposed develop- ment which will necessarily require a revised tentative parcel map; and, as the Planning Commission is confronted with time constraints which compel the Commission to take action on submitted parcel maps during a limited time period, the applicant ' s request for an inde- finite continuance makes it imperative to act on the submitted parcel map at this time . On a motion by Commissioner Snyder, seconded by Commissioner Reading, the Commission denied the request without prejudice by Planning Commission Resolution No. 333; carried unanimously (5-0) . VII . OLD BUSINESS A. City Council request for Study and Report on Case No. C/Z 12-77. Commissioner Kelly noted that the minutes from the City Council � meeting did not change her mind and that by recommending R-1-12, 000 � she was acting on behalf of the citizens. Commissioner Kryder concur- red with Commissioner Kelly . Commissioner Snyder read a statement sum�arizing the views of t�.he Commission (see Exhibit A) . Commis- sioner Reading noted his agreement with Commissioner Snyder. Chair- man Berkey agreed with the other Commissioners and read his state- ment (see Exhibit B) . Commissioner Kelly asked that the comments of the Commission at this meeting be forwarded to the City Council and perhaps the Council would take a second look at the request . Commis- sioner Snyder asked to review the Staff report prior to its going to the Council . On a motion by Commissioner Kelly, seconded by Commissioner Kryder, the Commission reaffirmed their previous recommendation of R-1-12, 000 to the City Council ; carried unanimously (5-0) . B. Status Report on the Cove Communities By-Pass Project. Mr. Cipriani noted a letter received from CVAG (see Exhibit C) noting that CVAG will present the problem to the Technical Advisory Committee on February 23, 1978. Chairman Berkey noted that since CVAG was handling the situa- _� tion that Staff could discontinue their study but keep in touch with � CVAG as to their progress. � VIII . NEW BUSINESS A. Advanced Planning Program for 1978-80 Mr. Cipriani noted that two major and two minor studies could be handled by the Staff in the coming year and that the housing element has to be completed by July of 1979 . He also noted the im- portance of a Specific Plan covering the area west of the Palm Valley Channel. There was some discussion as to the location of the BLM land. Minutes Palm Desert Planning Commission February l5, 1978 Page Three VIII . NEW BUSINESS (Cont . ) Chairman Berkey noted the land behind the dikes east of Highway 74 should be considered. Commissioner Reading asked if the flood control issue would be covered. It was noted that this was covered in the Master Drainage Plan. Commissioner Kelly noted that a minor study should be the school situation. '�""' There was some discussion regarding what happens after a representative from one of the agencies speaks. Mr. Cipriani indi- cated that nothing usually happens as the speakers usually generalize . Chairman Berkey suggested that a minute motion or memo to the City Council noting the concerns of the Planning Commission might be appro- priate. Cammissioner Snyder stated that a plan should be created that would get end results. Commissioner Kelly stated that the Commission has initiated several important issues and results have come about that are noticable and perhaps some pressure should be applied to the school district. Mr. Cipriani noted that the third item on the list of future studies could draw on all the resources we have heard and use their information in this study. Commissioner Snyder suggested that each Commissioner give serious thought to each of the subjects and give their opinions at the next meeting. Chairman Berkey stated that the matter would be continued to the next meeting to be discussed further at the Study Session prior to the meeting. IX. DESIGN REVIEW BOARD ACTIONS A. Review of cases acted on by the Design Review Board at their � meeting of February 7, 1978. Mr . Cipriani reviewed Case No. 40C and informed the Commission of the completeness of the Case and how much the City, Staff and the Design Review Board appreciated this type of application. He then re- viewed Case No. 71C and noted that the Design Review Board had re- luctantly approved _ alternat ive 'C' of the revised landscaping plan. Mr. Cipriani noted that Staff was suggesting that the sidewalks be deleted and stepping stones used in their place. Commissioner Snyder commended the Design Review Board for coming up with something new. Mr. Cipriani then reviewed Case No. 109MF and stated that the plans had been submitted a year ago bu� were held updu� ta some undergrounding problem. He noted that the air conditioners would be relocated. On a motion by Commissioner Reading, seconded by Commissioner Snyder, the Commission approved the actions of the Design Review Board by Planning Commission Resolution No. 334; carried unanimously (5-0) . X. DISCUSSION ITEMS Mr. Cipriani noted some late items received from the Riverside County Planning Department. With regard to TT No. 11909 it is not in Palm Desert ' s Sphere of Influence; PM No. 11349, no comments ; PM No. 11908, no comments; and, C/Z No. 2363, IRWIN SIEGEL, Applicant , Mr. �,,,,, Cipriani noted that the Change o� Zone request is not warranted at this time and it does not comply with adjacent property which is Del Safari . Mr. Cipriani noted a draft letter that if approved by the Com- mission would be forwarded to the County Planning Department stating the recommendations of the Commission . On a motion by Commissioner Snyder, seconded by Commissioner Reading the Commission directed the secretary to forward the Commissions� recommendations which are in compliance with the staff recommendations to the Riverside County Planning Department ; carried unanimously (5-0) . DISCUSSION ITEMS (Cont . ) Mr. Cipriani noted a letter forwarded to the Planning Com- mission from Mr. Gary Wiedle of CVAG, received �rom the Office of Planning and Research of the State of California in which they note that they are conducting three three-day planning trainin� programs during 1978. Mr. Wiedle wants an indication of the interest that the Commission might have. Commissioner Snyder stated that CVAG - should be notified that the CQmmission is willing to participate. On a motion by Commissioner Snyder, seconded by Commissioner Kelly the Commission agreed to participate in the program; carried unanimously (5-0) . XI . ORAL COM�7LTNICATIONS - None XII . COMMENTS A. City Staff r.Zr. Cipriani introduced Mr . Ronald KnippPl to the Commission stating that he would be the new Assistant Planner. He also noted that the Study Session prior to the February 28th meeting would begin at 5 : 00 due to the length of the agenda. Mr. Beebe noted an error in the Design Review Board minutes that were with the Resolution pertaining to the actions of that Board. Mr. Cipriani noted that the minutes were correct as written . Commissioner Kelly asked if the Painters Path parking � problem had been resolved. Mr. Beebe stated that the condi- '� tions would take care of the parking problem and that if necessary it would be required that the street be resurfaced. Commissioner Reading asked Mr. Beebe if there were any more signs to be installed at the San Diego Federal Savings site on San Pablo. Mr. Beebe stated that the signs and street surface markings were on the drawing board. Commissioner Kry- der stated that the Planning Priorities Committee , which he was a member of, had decided that the street would have a 2- way left turn lane and he asked Mr. Beebe if this was still being considered. r�r . Beebe noted that the street was wide enough and that it would definitely be considered. Gommissioner Reading also asked Mr. Beebe if there was a si�nal light planned �or San Luis Rey. Mr. Beebe noted that it was a City project and was in the works . Commissioner Reading asked if it would be possible to use Redevelopment monies �or the project . Mr. Beebe noted he would check into it . B. City Attorney - Not Present C. Planning Commissioners Commissioner Kryder referred back to the letter received from CVAG with regard to the By-Pass stating that he felt a committee was not what needed but that some teehnical adv3ce was needed and a decision made after this advice is reviewed and then a committee formed. He suggested that a technical advisor be hired and send his advice to CVAG. Minutes Palm Desert Planning Commission February 15, 1978 Page Five XII . COMMENTS (Cont. ) Chazrman Berkey noted that the best way to do this is with the right representation . A representative from Cal- trans and the County should be the guiding light as the proposed routes are within their territory. He noted that Supervisor McCandless was interested. It was suggested that the Staff draft a letter stating the Commissions comments �.•+ and forward it to CVAG. Commissioner Kryder stated that he would help the Staff with the letter. It was suggested that a letter be sent to the supervisor requesting that the County go to Caltrans and ask for an Engineer' s design of a by-pass. Mr. Beebe noted that a feasibility study would take into consideration the economics and the right-of-ways involved. Chairman Berkey gave some background on what had happened 20 years ago when the State had acquired the right-of-ways from Palm Springs almost to Cathedral City. It was to be used as a by-pass/expressway north of Highway 111 . The people fought the issue and the State abandoned the idea. XIII . At that meeting, I discovered that your Planning Commission, as well as representatives from other Cove Communities, are extremely interested in the problem of high-density traffic on Highway 111. At that meeting, I indicated that the Coachella Valley Association of Governments' staff and facilities could be used by you and other interested parties to help facilitate youur studies regarding the Highway 111 situation. �f I am now able to re�ort that on January 31, 1978, the CVAG General Assembly met and among other things, requested that the Association of Governments conduct a study regarding possible alternate routes to Highway 111. This subject was brought up by Mayor Russell Beirich, City of Palm Springs, who commented that this ongoing problem has been considered from time-to-time and further stated that he felt that it would be appropriate now for CVAG to study this problem in detail and recommend viable solutions. The General Assembly directed me to present this problem to the Technical Advisory Committee which meets on February 23, 1978, and ask this c�roup of_ City Managers to recommend a method for CVAG to study this problem. I expect that the Technical Advisory Committee will suggest the creation of a special committee to study this problem which would include all CVAG member agencies, as well as representatives from the Cities of Indian Wells, Rancho Mirage and CALTRANS. We will be in further contact with your City regarding our study of alternate routes to Highway 111, but inasmuch as your Planning Commission has voiced a concern about this matter in mid January, I thought that you would be interested in the recent developments that have taken place at the CVAG level.
