The regula_r meeting of the Palm Dese.rt Planning Commission
. was called to c�rder by Secretary Paul A. Will.iams due to the absence
of Chairman Berkey. On a motion by Commissioner Kryder , seconded by
` Commissioner Kelly, the Commission nominated Commissioner Snyder to
� be the Temporary Presiding Officer; motion carried. (AYES : Kelly,
Kryder; ABSTAIN: Snyder) .

Planning Commission .
Tdr. Williams noted the following corrections to the minutes :
Page Two, 3rd paragraph , after Public Hearing add the
word "open" .
Page Two , 4th paragraph, lst sentence, delete seCond
"southwest" .
Page Four, 6th paragraph, after Commissioner Kelly add:
"stated she had received calls asking about, " etc .
Page Four, next to last p�ragraph "speak in behalf"

VI . PUBLIC HEARINGS
Temporary Presiding Officer Snyder announced that prior to
this meeting, the Commission had met in a Study Session for the
purpose of clarifying the staff recommendations . No decisions were
reached. He then explained the Public Hearing procedures to those
present .
A. Case Nos. C/Z 02-78 and Related Draft EIR, CHACAHUALA �ir
LTD. , Applicant
Reqest for approval of a Change of Zone from R-1
20, 000 to PR-4 on a 37. 8 acre parcel located south
of Little Bend and north of Mesa View extended be-
tween Alamo and Arrow Trail and related Draft EIR.
Mr. Williams reviewed the case and noted the related develop-
ment plan. He also reviewed the correspondence received from Mr .
Fred W. Griggs, Jr . , President of Silver Spur Ranchers Association
and h4r . Leland Scheu. Regarding the EIR, Mr . Williams noted a late
response received from the South Coast Air Quality Control District .
Staff recommends approval of the Change of Zone to PR-4 and certifi-
cation of the final. EIR.
Temporary Presiding Officer Snyder declared the Public Hearing
open and asked the applicant to speak at this time .
I . HAROLD HOUSLEY, 73-700 Highway 111 , Engineer on
project , and representative of Chacahuala, addressed
the Commission and noted that a planned unit develop-
ment is the best project for the area involved and
he would answer any questions. ::�

Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in FAVOR of the project .
WILLIAM ALEXANDER, 48-698 Desert Flower, representing
the California Teachers Association which owns 11 acres
adjacent to the property, noted their approval of the
pro j ect .
EUGENE KAY, owner of property north of development ,
gave his approval of the project .
KAY CRAIG, Belair and Alamo , spoke in favor.
TOM 0` SULLIVAN, 72-990 Homestead, spoke �.o the Commission &
asked to have a few things clarified regarding the traf-
fic on Homestead and Alamo and the density.
1�4ARGARET KAY, lives across from Mr . O' Sullivan , spoke
in favor of the project as the developers have met all
the conditions.
DICK ARNOLD, 73-722 Santa Rosa, stated it is an excel-
lent proposal in the way it deals with the drainage
control problem.

wishing to speak in OPPOSITION of the project .
ROBERT HAVER, 73-360 Broken Arrow, noted his concern
for traffic, lighting, and flood control .

FRED GRIGGS, 73-549 Feather Trail , representing
Board of Directors of Silver Spur Ranchers Asso-
ciation , spoke noting his objections to the Change
of Zone of PR-4 from R-1-20, 000 and to the addi-
�,,,,, tional traffic that will be created. He stated
two problems that should be solved or completed
before any development should be considered and
that is the flood and drainage control issue and
the completion of the proposed �ire station .
MRS . HARRY NUDD, 73-409 Little Bend Trail, opposed
due to flood control problem.
JOHN MCMANN, 73-269 Broken Arrow, opposed due to
flood control problem.
ED PECK, 73-610 Buckboard Trail , opposed due to
the flood control problem not being completely
solved and the density should be lower.
HAROLD BIRD, 47-967 Sun Corral Trail , opposed due
to the flood control issues , tra�fic and it would
lower the value of adjacent homes.
Temporary Presiding Officer Snyder asked if the applicant would
like to make a REBUTTAL at this time.
Mr,. Housley noted that Littl.e Bend Trail would be an
�,,,, extension of Homes�ead and that Alamo would be widened
and Chia would be extended. Also, drainage from the
south side of Portola (extended) would cut off and
divert to Deep Canyon Channel . He stated that for
normal rainfall sufficient drainage is being provided.
Mr. Housley noted that he had met with the people from
Silver Spur and that the plans had been modified.
A. T. WILKES , Architect for the project , addressed
the Commission noting various points about the careful
planning of the channeling of the water, which would
only benefit adjacent homes; original zoning as stated
in the Riverside County General Plan is 3-5 units per
acre; the proposal is less dense than the R-1 next to
the proj�ct; he does not feel that Silver Spur will
be affected by any additional traffic; the tennis
courts will be adjacent to present tennis courts and
they will be recessed plus low glare lights will be
used; lots were placed carefully with regard to the
view and sun control ; and, project will bring about
money for flood control .
GENE SCOTHORN, Consulting Engineer, noted that the
proposed drainage is in line with the Master Drainage
Plan for the City, and that the developer can only
'�+° deal with the drainage of the property involved and
that big floods are a regional problem. He also stated
that adjacent property owners would benefit from drain-
age control within the project and that the City is re-
quiring the developer to contribut'e to off-site drainage
facilities and that no run off from this project should
affect Silver Spur .

Commissioner Kryder asked if there was an outlet from the
project onto Mesa View. �Zr. Williams stated no.
Temporary Presiding Officer Snyder declared the Public Hear- �
ing closed and asked for the pleasure of the Commission. `�

Commissioner Kryder stated that it is a well thought out
development and that the project is a good one for the area. He
then noted that the drainage and flood control is his main concern
��r�r��that he wants more time to study the draft EIR.

Temporary Presiding Officer Snyder requested that Staff make
certain determinations with regard to the land down stream and the
traffic problem.
Commissioner Kelly asked for further study to be done on the
traffic situation.
On a motion by Commissioner Kryder , seconded by Commissioner
Kelly, the cases were continued to July 5, 1978 for further study;
carried unanimously (3-0) .
Mr. Housley asked what was to be done now. Mr . Williams stated
that Staff is to address the City ' s responsibilities with regard '�
to drainage and also Staff will provide more information on traffic �
and access. �
Temporary Presiding Officer Snyder noted that the Planning
Commission needs additional input from Staff , the applicant gave a
fine presentation.
B. Case Nos. DP 09-78 and 126MF - CHACAHUALA, LTD. , Applicant
Mr . Williams noted that these cases had been reviewed with
the related Case No. C/Z 02-78 and that they should be continued to
the meeting of July 5, 1978. On a motion by Commissioner Kryder
seconded by Commissioner Kelly the cases were continued; carried
unanimously (3-0) .
C. Case Nos. DP 05-78 and 117MF - TERRA INDUSTRIES , Applicant
Request for approval of a Development Plan and Pre-
liminary Design Review for a 200-unit condominium
project to be located on approximately 33 acres at
the northwest corner of Fairhaven Drive and 44th
Avenue.
Mr. Williams reviewed the cases and passed out pictures of �
sirnilar projects already developed in other areas . He then noted "�
the concerns of the Design Review Board and letters from the City
of Rancho Mirage and Mr . Balch. Mr. Williams noted the applicants
letter presented earlier in the day addressing the concerns of the
Design Review Board. One of the main concerns with the project is
that the parking areas are too tight .
Mr. Williams stated that Staff is recommending denial of the
project.

C. Case Nos. DP 05-78 and 117MF (Cont . )
Temporary Presiding O�ficer Snyder declared the Public Hearing
open and asked if the appiicant wished to speak .at this time.
ROBERT KRIESE, of Terra Industries , addressed the
Commission and stated that the Design Review Board
�"` had not considered the application properly. He
reviewed the various points of the letter presented
today. Mr. Kriese noted that the proposal is similar
to Portola Del Sol . He suggested that perhaps car-
ports instead of garages would be better. Mr . Kriese
further stated that there would be one guest parking
space per unit and that parking spaces would be signed
as guest parking only and violators would be towed
away.
DANIEL SALERNO, architect for the project , addressed
the Commission and pointed out that the units would
be very private and that this concept has won awards
in other areas. He noted that there is a 50 ft .
width in the garage area and that there will be guest
parking throughout the project . There are limited
recreational �acilities because they are trying to
keep the homes at an affordable price . Mr . Salerno
noted that cedar material would be used instead of
shake and that there would be a fully enclosed garden
for all units.
� Temporary Presiding Officer Snyder asked if there was anyone
� wishing to speak in FAVOR or in OPPOSITION to the proposed project .
Being none , he declared the Public Hearing closed and asked for the
pleasure of the Commission .
Commissioner Kryder stated that he felt the Commission was re-
viewing the case prematurely due to the comments of the Design Review
Board.

'"�� �"/,,����1�Commissioner Kelly stated that planned PR zoning uses the word
�X``' ���'u��que" and that this proposal does not follow that definition . With
���--��'�regard to Portola Del Sol it is not coming out as proposed. The pro-
�, ject should remain single story so the view is not destroyed.
Temporary Presiding Officer Snyder indicated that the case should
be continued to give the applicant time to solve its problems with the
Design Review Board. Mr. Williams noted that the Design Review Board
would like alternatives. Some discussion followed regarding what would
happen if the Commission rejected or continued the cases. Mr. Williams
noted the Design Review Board is stating that the basic concept is
wrong. The applicant could appeal the Commission ' s decision to the
City Council .
Mr. Kriese asked that the cases be continued to discuss
further the motor court concept with the Design Review
Board. He asked when the next Design Review Board meet-
�, ing would be.
117r. Dick Arnold stated that all they wanted was a fair-
shake.
Mr. Williams noted that the next Design Review Board meeting
would be June 6, 1978, and that this case would be first on the agenda.
On a motion by Commissioner Kelly, seconded by Commissioner
Kryder, the cases were continued to July 5 , 1978; carried unanimously ( 3-0).

D. Case N�. CUP 04-78 - HOPE LUTHERAN CHURCH, Applicant
Request for approval of a Conditional Use Permit
for a church-school complex partially developed,
at the northwest corner of Portola Avenue and
Fairway Drive .
Mr. Williams reviewed the case noting the conditions of
approval , both standard and special .
Temporary Presiding Officer Snyder declared the Public Hearing
open and asked if the applicant would like to speak at this time.
�HARRY SCHMITZ, 43-900 Primrose, President of Hope
����r��Luthern Church, addressed the Commission, noting
�y� ��'` � that the Church operates a non-profit pre-school
o�,.
`�'` I_��,� �.nd the first phase of the project will provide
�° ��
_��'i��"" ��.� additional classrooms for this purpose . He then
� addressed himself to Special Condition No . 2 which
requires curb and gutter . Mr . Schmitz noted that
" the church had already paid for curb and gutter
and that if they are required to put curb and gutter
in, it would cause the runoff to run onto adjacent
: property and cause erosion .
GARY WIEDLE, 74-110 Old Prospector Trail , addressed
the Commission and spoke regarding Standard Condi-
' tion No. 5 . He noted that the church does not feel
it should have to bear the burden of the cost and
that putting the property in an assessment district
for the future total area would be a better solution.
Mr. Wiedle requested that Condition No . 5 be deleted.
RICK �iOLDEN, 44-615 Santa Margarita, architect for
the project and Vice President of the Church, addres-
sed the Commission and noted that he had used a court-
yard concept to buffer the noise from the schoolrooms.
He stated that the parking lot would be enclosed with
a wall and landscaped.
Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in FAVOR of the project .
MR. SILVERTON, resident across the street on Fairway,
stated that he approved the project but objected to
the entrance/exit on Fairway .
Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in OPPOSITION of the project .
ASEL AMELIAR, 74-085 Fairway Dr. , spoke in opposition
to the exit on Fairway.
MR. GALLO, resident across from parking lot , spoke in
opposition to the traffic problem that already exists
on Portola and also he objected to the exit on Fairway.
CARL AMELIAR, 74-085 Fairway, stated that the wall will
not disguise the fact thatit ' s �. parking lot and that
a higher wall with more landscaping would be helpful .
Also objected to exit on Fairway.

Temporary Presiding Officer Snyder asked if the applicant would
like to make a REBUTTAL at this time.
Mr. Holden addressed himself to the entrance/exit
on Fairway and noted that it is a hazard to pull
�` out on Portola and he felt that this was a safer
pattern.
I . HAROLD HOUSLEY, Engineer on project , Chairman
of the Building Committee, noted that an exit
is needed on Fairway and he also stated that
churches do not cause depreciation to adjacent
dwellings.
Some discussion followed regarding locating the parking lot on
Lantana instead of Fairway.
Commissioner Kelly asked Mr. Beebe to comment at this time.
Mr . Beebe noted that there is no problem with an exit/entrance
on Fairway and he would prefer only one exit/entrance on Portola.
Commissioner Kelly asked about the perimeter wall and if a gate
could be used.
Mr . Holden stated that there would be a wall on all
street sides, that the north entrance on Portola
� would be right turn only, and due to the varied times
'' of use , a gate would not betoo practical .

Commissioner Kryder stated that low wall landscaping and berm-
ing would improve the situation.
Temporary Presiding Officer Snyder stated that possibl� another
condition could be considered stating that proper and adequate land-
scaping should be used on wall adjace�t to residential areas .
Mr . Williams noted that under the Ordinance , parking lots ad-
�acent to residential lots are required to hav� a minimum 32 foot
Q��gh wall .
�<v��r�� ' Commissioner Kelly asked if the driveway could be moved closer
��to Portola. Mr. Williams indicated that it could be moved 20 feet or
,-�=�f1 so closer to Portola. He also noted that the undergrounding could be
� ;�waivered under the Ordinance. '' r r � ��,;, `_

�, Mr. Williams suggested the following revision to Standard -Con __,-__
'�' tion No. 5 - "Al1 overhead utility distribution shall be undergrounded
as a part of construction of said lines. " Also Special Condition
No. 4 could be added to read - "Proposed driveway along Fairhaven shall
be moved westerly with the approval of the Director of Public Works
as a part of Phase II . " Mr. Williams then noted that all the special
conditions should read as "as a part of Phase II" .

Kryder, the Commission approved Case No . CUP 04-78, with the noted
changes, by Planning Commission Resolution No. 360 ; carried unanimously
(3-0) .

E. Case Nos. CUP 03-78 and 124MF - WARREN SLAUGHTER, Applicant
Request for approval of Conditional Use Permit and
Preliminary Design Review to allow the extension
of an existing driveway, the creation of a pad for
parking, the improvement of an existing driveway
and a water line extension on a parcel located
within the Hillside Overlay District . �`
Mr. Williams reviewed the cases and noted on an aerial photo
the area involved and proposed changes . He then reviewed the condi-
tions of approval .
Temporary Presiding Officer Snyder declared the Public Hearing
open and asked if the applicant wished to speak at this time .
WARREN SLAUGHTER, noted his agreement with the
conditions.
Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in FAVOR or in OPPOSITION to the proposed project .
Being none, he declared the Public Hearing closed and asked for the
pleasure of the Commission .
On a motion by Commissioner Kelly, seconded by Commissioner
Kryder, the Commission approved Cases No . CUP 03-78 and 124MF by
Planning Commission Resolution No. 361 ; carried unanimously ( 3-0) .
F. Case Nos . DP 08-78 and 125MF - ROGER BOYAR DEVELOPMENT,
Applicant . `�

Request for approval of a Development Plan Amendment
and Preliminary Design Review to provide for a peri-
meter wall and landscaped areas which would separate
the existing phase of the Kings Point condominium
project �on Lot l and a portion of Lot 2 of the recorded
tract from future development of the project .
Mr . Williams reviewed the cases and the conditions of approval
including the Design Review conditions .
Temporary Presiding Officer Snyder declared the Public Hearing
open and asked the applicant if he wished to speak at this time .
STUART GREEN, noted his agreement with the conditions
and stated he would answer any questions.
Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in FAVOR of the project .
JAMES BURBON, lawyer representing the property owners ,
stated that an agreement had been reached between the
applicant , the property owners and the residents of
the present development and that he would like a few �
things clarified with regard to encroachment , the �
existing roadway being moved, the location of the wall
in question , when will the wall go in and what type
of wall it will be.

wishing to speak in OPPOSITION to the project .

F. Case Nos. DP 08-78 and 125MF (Cont . )
MR. STINE, 46-806 Shadow Mountain Drive, spoke about
the condition of the road in the area involved and
that it has not been repaired from the storm in 1976 .
He noted that there are no provisions for drainage
�•► ���� n Shadow Mountain Drive . He objected to the increase
������ in traffic which will occur and he asked if Green Way
���� (� �� il be a public street . It was noted that it would be .

��""�� There was some discussion about easements, drainage and the
tennis courts.
DAVID MAYBERRY, resident of Kings Point , asked
if the tennis courts will be lighted and if they
will have to be approved by the Design Review
Board at a public hearing. He noted that the
residents object to lighting and that the current
courts are not lighted. It was noted that the
- Design Review Board meeting is not a public

Temporary Presiding Officer Snyder asked if the Commission could
make this decision or would it have to be left up to the Design Review
Board. Commissioner Kelly asked if the courts are to be recessed.
Mr. Williams indicated that if the courts are to be lighted they have
to be recessed and that it is part of Design Review Condition No . 1
'�' that the tennis court lighting proposal be submitted to them as a part
of the final construction drawings .
Mr. Green asked that the case be continued so that
he can deal with the lighting issue as he was not
prepared. He asked that the composit?on of t:�e
wall be decided here.
Mr . Williams noted that slumpstone had been suggested and that
a Design Review Condition No. 4 could be added to read - "Proposed
adobe slumpstone wall separating the original project from the subject
project, shall be constructed prior to the construction of any dwell-
ing units . "
Mr. Green agreed that he would fence the construction
site from existing units.
MRS . FRIEDLANDER, resident of Kings Point , noted that
the wall is necessary for security and construction

� � Commissioner Kelly noted that the location of the tennis courts

Kryder , the Commission approved Case Nos. DP 08-78 and 125114F with
the noted condition added, by Planning Commission Resolution No . 362 ;
carried unanimously ( 3-0) .

Request for approval of a Tentative Tract Map to
create an 81-lot subdivision to provide for 80 �

Mr . Williams reviewed the case and the conditions of approval
and noted the staff ' s recommendation of approval .
Temporary Presiding Officer Snyder declared the Public Hearing
open and asked if the applican� wished to speak at this time .
BILL L0, noted his agreement with the conditions .
Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in FAVOR or in OPPOSITION to the project . Being
none , he declared the Public Hearing closed and asked for the plea-
sure of the Commission .
On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the Commission approved Case No. TT 12556 by Planning Commis-
sion Resolution No. 363 ; carried unanimously (3-0) .
H. Case No. TT 12725 - WILLARD �. JORDAN , Applicant
Request for approval of a Tentative Tract Map to �
create a 5-lot subdivision to provide for 4 con-
dominium units and common open space on a . 42
acre parcel located east of Highway 74, north of
Verba Santa.
�7r. Williams reviewed the case and its conditions of approval
and tn.e indica.ted the Staff ' s recommendation of approval .
Temporary Presiding Officer Snyder declared the Public Hearing
open and asked if the applicant wished to speak at this time.

his agreement with the conditions and the Staff ' s
recommendations.
Temporary Presiding Officer Snyder asked if there was anyone
wishing to speak in FAVOR or in OPPOSITION to the project . Being
none, he declared the Public Hearing closed and asked for the plea-
sure of the Commission.
On a motion by Commissioner Kelly, seconded by Commissioner
Kryder, Case No . TT 12725 was approved by Planning Commission Re-
solution No. 364; carried unanimously (3-0) .

Parks and Recreation Commission - CITY OF PALM DESERT, �
applicant .
Mr. Williams noted that due to the lateness of the hour, the
Parks and Recreation Commission had requested that the hearing be
continued to June 14, 1978.
On a minute motion by Commissioner Kelly , seconded by Commis-
sioner Kryder , the case was continued to June 14, 1978 ; carried
unanimously ( 3-0) .

VIII . OLD BUSINESS
A. Continued discussion of the Christina Sinatra Youth
Center Brochure.
Temporary Presiding Officer Snyder noted that it was a fine
proposal and that the City Council should take action. This was
taken as a motion and seconded by Commissioner Kelly; carried un-
� animously (3-0) .
IX. NEW BUSINESS
A. Consideration of proposed projects to be undertaken
by C.V.C.W.D.
Mr. Williams reviewed the proposed projects with the Commission
and noted that they are in conformance with the adopted Palm Desert
General Plan .
On a motion by Commissioner Kryder , seconded by Commissioner
Kelly, the Commission approved the proposed projects as being in
conformance with the adopted Palm Desert General Plan, by Planning
Commission Resolution No . 365; carried unanimously (3-0) .
X. DESIGN REVIEW BOARD ITEMS
A. Review of Cases, acted on by the Design Review Board at
their meeting of May 23 , 1978 .
Mr. Cipriani reviewed Case No. 47C and noted that he had drawn
� in the trash enclosure area which was acceptable to the applicant . _
The Commission indicated a willingness to remove the parking barricade
shown on the east side of the project in order to create a driveway
thereby eliminating two parking spaces . The Commission believed this
modification would improve access and circulation for the p•roject .
Mr. Cipriani noted that these modi�ication� would b� shown on the
final construction drawings.
On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the actions of the Design Review Board were approved by Plan-
ning Commission Resolution No . 366; carried unanimously (3-0) .

XIII . COMMENTS
A. City Staff
Mr. Williams noted that the date had been finalized
for the tour of the City for Friday, June 16 , to start
� at 8 : 30 a.m. He also noted that on June 10, from 9 : 30 a.m.
to 3 : 30 p.m. there would be a Planning Workshop in Indio.
Those Commissioners present noted their intention to attend.

C. Planning Commissioners
Commissioner Kryder asked if the Commission would be
receiving a copy of the proposed City budget for 1978/79 .
Mr. Williams noted that they should be receiving it shortly.
Commissioner Kelly asked if the curb and gutters re- '
quired on the Hope Lutheran Church case should not have
been a standard condition . It was noted that they should
have been.
XIX. ADJOURNMENT
On a motion by Commissioner Kryder, seconded by Commissioner
Kelly, the meeting was adjourned at 11 : 20 p.m. ; carried unanimously
(3-0) .
