CALL TO ORDER The regularly scheduled meeting of the Palm Desert Planning Commission was called to order by Chairman Berkey at 1 :03 p.m. in the Council Chambers of the Palm Desert City Hall . II . PLEDGE - Commissioner Kryder III . ROLL CALL Present : Commissioner Fleshman Commissioner Kelly Commissioner Kryder Commissioner Snyder Chairman Berkey Others Present : Ralph Cipriani - Associate Planner Ron Knippel - Assistant Planner Clyde Beebe - Director of Public Works Kathy Shorey - Planning Secretary IV. APPROVAL OF MINUTES A. Minutes of regular meeting of August 1 , 1978. Commissioner Fleshman, . Commissioner Kryder and Chairman Berkey, noted the following changes to the minutes : yr Page two, 4th paragraph, last word first sentence , change "adequate" to "appropriate" . Page four, 4th paragraph should read as follows : "Commissioner Kryder noted that the project would be an asset to the Community but objected to the proposed Change of Zone. He was also concerned with the use of the property if it should be sold at some future date, what would the project then become. Further, the current zoning should be respected or the Zoning Ordinance and General Plan might be revised. This is a good project but in a wrong location . " Page five , 4th paragraph from the bottom, "Silver Spur" should be "Arrow Trail" . Page six, 4th paragraph from the bottom, second sentence, "that" should read "said" . Page seven, 4th paragraph from the bottom, "Wallick" should read "Wallach" . Page eight , 5th paragraph from the bottom, "Archbuckel" should read "Arbuckle" , and "plan material" should read "plant material" . Page nine , 2nd paragraph after recess, change to read "Chairman Berkey noted that he is concerned with the continuance of business during the summer time and Ironwood has done a good job and it meets with his ap- proval . " On a motion by Commissioner Kryder, seconded by Commissioner Snyder, the minutes were approved as corrected; carried unanimously (5-0) . Minutes Palm Desert Planning Commission August 16, 1978 Page Two V. WRITTEN COMMUNICATIONS A. Letter from Ms . Jane Woolley regarding the Chacahuala Project and Retired Teachers ' Project . The response from Mr . Williams to Ms. Woolly was noted and approved by the Commission by a Minute Motion from Commissioner Snyder , seconded by Commissioner Fleshman , to receive and file the letter; carried unanimously (5-0) . ' VI . PUBLIC HEARINGS Chairman Berkey explained the Public Hearing procedures to those present . A. Case No . CUP 11-77 (Extension of Time) - ROGER D. FULLER, Applicant Request for a 1-year extension of time on the approval of a Conditional Use Permit (CUP 11-77) which provided for the construction of a 48-space parking lot within the R-3(4) zone between Ocotillo Drive and Sage Lane. Mr . Cipriani reviewed the case and noted that Staff recom- mends that the extension be approved. Commissioner Fleshman asked if there were any new conditions or if the application had been changed in any way. Mr. Cipriani stated that there were no changes to the origi- nal application . Chairman Berkey declared the Public Hearing open and asked if the applicant wished to speak at this time. BARBARA FULLER, 24 Greenoaks Drive, Atherton, CA addressed the Commission and stated that the reason for the request was that they had encountered many delays. Chairman Berkey asked if there was anyone wishing to speak in FAVOR or in OPPOSITION to the project . JOY CROSS , 73-218 Tumbleweed, asked if there would still be no entrance/exits on Tumbleweed. Mr . Cipriani stated that there were none. Chairman Berkey declared the Public Hearing closed and asked for the pleasure of the Commission. On a motion by Commissioner Kelly, seconded by Commissioner Snyder, the Commission approved the Extension of Time for Case No. CUP 11-77 by Planning Commission Resolution No . 391 ; carried unanimously (5-0) . B. Case Nos . CUP 07-77, 140MF and the Related EIR - ROBERT RICCIARDI , Applicant Mr . Cipriani noted that the applicant was not present at this time and suggested that the Commission move on to the next case. Minutes Palm Desert Planning Commission August 16, 1978 Page Three VI . PUBLIC HEARINGS (Cont . ) C. Case No. DP 02-78, COLUMBIA SAVINGS, Applicant Request for approval of an amendment to Standard Condition No. 4 for approved Case No . DP 02-78 to permit construction of the project in two phases. Mr . Cipriani noted a letter received from the applicant requesting that Building A not be constructed at this time but at a later date, which is a different request than the Staff Report notes . There was some discussion as to whether another extension of time would be needed and why the change of mind. Commissioner Snyder asked if sidewalks would still be done in Phase I . Mr. Cipriani explained that the problem with this development was the fact that there were two architects to begin with and now there were three, with the third one designing Building A. He also noted that the other Conditions of Approval would remain the same. Chairman Berkey declared the Public Hearing open and asked if the applicant would like to speak at this time. The applicant was not present & he asked if there was anyone wishing to speak in FAVOR or in OPPOSITION to the proposed project . Being none , he declared the Public Hearing closed and asked for the pleasure of the Commission. On a motion by Commissioner Snyder, seconded by Commissioner Kelly, the Commission approved the amendment to Case No. DP 02-78 Standard Condition No. 4 , by Planning Commission Resolution No . 392; carried unanimously (5-0) . taw B. Case Nos. CUP 07-77, 140MF and the Related EIR ROBERT RICCIARDI , Applicant Request for approval of a Conditional Use Permit and Preliminary Design Review and consideration of the related EIR to allow construction of an access road within the Cahuilla Hills Area. Mr. Cipriani reviewed the cases and the Conditions and noted the Design Review Board' s concerns. He also noted that if the appli- cant complies with the Hillside Overlay Zoning, all concerns should be addressed sufficiently. Mr. Cipriani stated that Ron Knippel is doing a study in this area and that this project ties in with the study. Chairman Berkey declared the Public Hearing open and asked if the applicant would like to speak at this time . ROBERT RICCIARDI , 73-700 Highway 111 , addressed the Commission , stating that the CUP request will allow for better access for the people that live in the Cahuilla Hills and that the street would be a loop street that will tie into other streets in the area. Chairman Berkey asked what the legal status of the right-of-way was and if it is recorded. Mr . Ricciardi noted that the easement is recorded and that they have the permission of one of the property owners, but not the other . CUP 07-77, 140MF and the Related EIR (Cont . ) Commissioner Snyder asked if the applicant had considered a bridge. Commissioner Fleshman asked for a short discussion on alternatives not mentioned in the EIR. Commissioner Fleshman also asked about the composition of the road and the maintenance of said road. In addition the future impacts of the project and prob- able alternatives should be discussed. Mr. Ricciardi noted that he would be responsible for the road until the property is sold and that it is his intent to have the proposed road con- nect to existing roads. Mr. Cipriani stated that the Director of Public Works, Clyde Beebe, had requested that the case be continued to allow time to discuss with the applicant other alternatives. Commissioner Snyder asked if Special Condition No . 6 does not give enough protection. Mr. Beebe stated that he would like more time; that the map does not show enough; and that a topographic map would be helpful . Chairman Berkey asked how long a continuance would be needed. Mr. Beebe stated that at least 4 weeks would be necessary to allow time for the Engineer to get proper maps. Mr . Ricciardi stated that if the Engineer or Mr. Beebe would walk the area, he would get all the information he needs. A topographic map would s, Ji be too costly. He asked that the Commission either approve this or nothing. He stated that he felt that this would be an advantage to the City. Commissioner Kryder asked if this is a loop road as proposed, would it be a major avenue in the future and is it designed and engineered to handle future growth. He also noted that he did not feel street lights were necessary at this time. Mr. Ricciardi confirmed that the street would handle future growth. Commissioner Snyder asked if the applicant would like a continuance as the Commission can not forget the Codes and Zoning Requirements without justification . Commissioner Kelly stated that the road and the future of the area is the concern and that the agencies contacted did not address both concerns . Commissioner Fleshman again asked for possible potential al- ternatives being futher discussed in the EIR. Mr. Ricciardi stated that the City will bear no costs so why does the City care if the road is built as h he will bear the cost himself . Chairman Berkey asked if another Condition would be called for to ask for the verification and legality of the easement . This would become Special Condition No. 7. Mr . Ricciardi asked for a 30 day continuance or more. On a motion by Commissioner Fleshman, seconded by Commissioner Kelly the Cases were continued to October 3, 1978, to allow time for study on possible alternatives; carried unanimously (5-0) . Consideration of proposed Sun King Effluent Reuse Line to be constructed by C.V.C.W.D. Mr. Cipriani reviewed the request and noted that it is in compliance with the adopted Palm Desert General Plan . Some discussion followed as to whether this had been done in the area before - Mr. Cipriani noted, believed it to be first time; what is the quality of water - this is secondary level of treatment ; and it was noted that this is a widespread practice . On a motion by Commissioner Kryder , seconded by Commissioner Kelly, the Commission approved the proposal by Planning Commission Resolution No. 393; carried unanimously (5-0) . IX. DESIGN REVIEW BOARD ITEMS A. Review of Cases acted on by the Design Review Board at their meeting of August 8, 1978. Mr. Cipriani reviewed the cases noting that Case No. 91C should be deleted as it will be discussed at the next meeting ; Case No. 89C easements are main concern , needs additional 4 ' setback, applicant was advised to ask for a 20% adjustment ; Case No . 90C east elevation is subject to further review by Design Review Board. On a motion by Commissioner Fleshman, seconded by Commissioner Kelly, the Board approved the actions of the Design Review Board by Planning Commission Resolution No. 394; carried unanimously (5-0) . X. DISCUSSION ITEMS A. Proposed CVAG Development Policies After an indepth discussion by the Commissioners regarding the proposed policies, the Commission on a motion by Commissioner Snyder, seconded by Commissioner Kryder, directed the Secretary to forward the Commissions previous write up and gain a concensus from adjacent cities to be forwarded to the City Council prior to filing the comments with CVAG; carried unanimously (5-0) . Chairman Berkey asked Noel Brush if he would like to speak to the Commission on this subject . NOEL BRUSH, 73-082 Bel Air , stated that the Commission should not give up on their concerns and that they should still let CVAG know that the City is not satisfied. Mr. Cipriani noted some additional discussion items received f.00 late from the Riverside County Planning Department . Case No. CUP 2119-E, staff had no comments ; Case No . CUP 2104-E, staff felt more information was needed as to the projects compatibility with the desert and adequacy of proposed landscaping; and, Case No . CUP 2114-E staff objects to the possibility of a recreational vehicle park as part of future development and that the site should be developed as one integrated mobile home park with development standards equalling those of the adjacent Palm Desert Greens Mobile Home Park. On a Minute Motion by Commissioner Fleshman, seconded by Com- missioner Snyder, the Commission directed the Secretary to forward the above comments to the Riverside County Planning Commission; carried unanimously (5-0) . Planning Commissioners Commissioner Kelly asked if it was true that there were two projects named Plaza Del Sol . Mr. Cipriani noted that this was true and that that was how the applicant wanted it . XIII . ADJOURNMENT On a motion by Commissioner Snyder, seconded by Commissioner Fleshman , the meeting was adjourned at 2 : 52 p .m. ; carried unanimously (5-0) . RALPH J .
