PALM DESERT PLANNING COMMISSION MEETING
TUESDAY - JANUARY 2, 1979

I . CALL TO ORDER
The regularly scheduled meeting of the Palm Desert Planning
Commission was called to order by Chairman Kelly at 7 : 00 p.m. in the
City Hall Council Chambers.

IV. APPROVAL OF MINUTES
A. Minutes of regular meeting of December 20, 1978
On a motion by Commissioner Berkey, seconded by Commissioner
Kryder , the minutes of the December 20, 1978, meeting were approved as
written; carried unanimously (5-0) .

VI . PUBLIC HEARINGS
Chairman Kelly announced that prior to this meeting, the Com-
mission had met in a Study Session for the purpose of clarifying the
staff recommendations. No decisions were reached. Chairman Kelly
then explained the Public Hearing procedures to those present .
Commissioner Fleshman excused himself from the first case due
to a conflict of interest , and left the room.
A. Continued Case No. DP 20-78 - ALLARCO DEVELOPMENT, LTD. ,
Applicant
Request for approval of a Development Plan for an
800 unit Country Club project on approximately 405
gross acres at the northeast corner of Cook Street
and Country Club Drive. PR-3(U.A. ) Proposed Zoning.
Mr. Crump reviewed the staff report and the Conditions of Ap-
� proval .
Commissior�er Berkey asked how the elevations on the flag lots
would be controlled and if a typical grading plan is submitted would
it be sufficient for the flag lots. He also asked if staff would have
any control .
Mr. Crump stated that the gradings would be shown on the
Tentative Map when it is submitted and that the Design Review Board
could have the opportunity to review the grades.

Commissioner Snyder commented that perhaps there should be
some notation as to whether the staff should approve the elevations.
Chairman Kelly declared the Public Hearing open and asked
if the applicant would like to speak at this time. �

GEORGE WHITNEY, Box 4433, Palm Springs, applicant , "'�
addressed the Commission and referred to Special
Condition No. 3 and asked that this be as approved
by the Design Review Board. He also stated that a
complete grading plan would be presented to the
Design Review Board. Mr. Whitney noted, in response
to a question from Commissioner Kryder, that the
the different elevations would be terraced to allow
each lot a view.
Chairman Kelly asked if there was anyone wishing to speak
in FAVOR or in OPPOSITION to the proposed project . Being none, she
declared the Public Hearing closed and asked for the pleasure of the
Commission.
Mr. Williams noted the letter from the City of Indian Wells
stating its acceptability.
On a motion by Commissioner Kryder, seconded by Commissioner
Berkey, the Commission, by Planning Commission Resolution No. 441 ,
did recommend approval of the Development Plan to the City Council
with the following additions to the Conditions of Approval :

Special Condition No. 3 - add to the last sentence, �
"shall be provided as per Design Review Board require-
ments. "
Add Special Condition No. 9 - Applicant shall provide
a preliminary grading plan.
Add Special Condition No. 10 - Developer shall be re-
sponsible for maintaining Cook Street to the main en-
trance.

Request for a Change of Zone from R-1-9, 000 to PR-4 ,
a preliminary Development Plan for 40 dwelling units
and related preliminary Design Review on approximately
7 . 965 acres located on the west side of Deep Canyon
Road and north of 44th Avenue.

Mr. Williams reviewed the staff report and the Conditions of �
Approval and noted a letter of objection from Mr . Gerald Orlin. It
was also noted that the applicant had made a revised application
to PR-5 instead of PR-4.
Chairman Kelly asked about the adjacent zoning and if this
project would be compatible.
Chairman Kelly then declared the Public Hearing open and asked
if the applicant would like to speak at this time.

ROWLAND SWEET, 73-535 Pinyon, applicant representa-
tive, referred to the letter of objection noted by
Mr. Williams and gave the Commission some pictures
of the area to review. He stated that the church
has done extensive landscaping in the area and
� that a row of trees has been planted where the
wall is being required. He asked if this would be
sufficient .
Chairman Kelly asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the proposed project .
JIM CRISPMAN, 43-770 Florine, presented a petition
(Exhibit A) to the Commission from 28 homeo�°ners
in the area objecting to the Change of Zone. He
also noted his objection to the size of the lots
and he stated that the lot owned by the church
on Florine is the messiest lot in the block. He
also referred to a conversation he had with Mon-
signor McNellis regarding the proposed project .
He mentioned the following as his concerns: density
being increased; if property sold, new use applied;
control of residents; and, adjacent property being

Chairman Kelly declared the Public Hearing closed
if the a�plicani, wished to make a REBUTTAL at this time.
Mr . Sweet asked if the project a� proposed was
� in conformance with the zoning as requested.
Mr . Williams stated that the exterior. dedicated public
street is not to be calculated in the available land area.
MONSIGNOR MCNELLIS addressed the Commission and
stated that his intent had been to provide some
place for elderly parishioners on fixed incomes
to live. He also noted that the area is kept
up n, ,�he trees �rimmed when it is needed.

Mr. Williams reviewed the renderings of the proposed project
and pointed out various aspects of the project .
There was some discussion about the wall required around the
prop��qT ���er�t projects and areas.

„o ��sioner Berkey stated that a walled in community doe� not
usually promote devaluation of property values to adjacent Land and
with the entrance on Deep Canyon it should not effect the residents on
Florine to any great degree. He noted that density is the only real
question at this time. Commissioner Berkey noted 'nis fear of setting
' ' a president by increasing the density and that it should remain at PR-4
�,,,` � and a total of 31 units. At this time Commissioner Bei•key made a
� � motion to approve a Change of Zone from R-1 9, 000 to PR-4, the motion
.::; �, was secorded by Commissioner Kryder.
� � �'� Commissioner Fleshman stated that he �as concerned with the
_� � i garages and he suggested th�t the applicant make one a carport and the
:�� � other a garage.

Commissioner Snyder stated that he agreed with Commissioner
Berkey and noted that th�re is a need for this type of housing in the
area. He noted his concern with the comments of the adjacent property
owners. He then noted his agreement with Commissioner Fleshman with
regard to the garages and carports.

Commissioner Fleshman asked ab�ut the setbacks on the units
that back onto Florine. ��r. Williams su�gested that the corner �
units be deleted and possibly the applicant could take out the
interior units and bring the outside unit� in further to allaw for
better setbacks.
Commissioner Berkey �mended his motion to include th� aadition
of Special Condition No. 4 - Off-street parking shall be a combination
of a single garaae and single carport �er unit ; and, �re deletion of
�'pecial Condit�on No. 2 . Commissioner Kryder a�r�ed and amended his
second.
Ch�irman Kelly st,�ted that a PR-4 will provide what the church
w?,nts and will be co=npatible with :he area.
Mr. Sweet asked about h�,ving 2 garages at ��ne end
of the unit and the 2 carports at the other end.
Mr . Williams stated that it would b� better to have a gara�e
and a carport wiih the carport next to the porch area.
The motion made by Co��imissioner Bv��key was carried unanimously
(5--0) .
C. Case Nos, C/Z 14-78 and 'TT J.4032 - RIDGEWQOD LTD. ,
Appli�ant
Request for a �;'hange of Zone from PR-4 and O.S.
to R-2 8 , 000(8) and a tentative subdivision for
238 single family residential lots, one common
lot and a Public Park on approximately 80 acres
located at the southeast corner or the intersec-
tion of Portola Avenue (extended) and Country
Club Drive.
ll�r. Williams reviewed the staff report and noted a revised
site plan. He then reviewed the conditions of approval and the revised
Resolutuion to comply with the revised site plan. This would create
233 lots, 6 common lots, and 227 maximum dwelling units.
There was some discussion about blowsand, lot widths, and pools
' for each unit , and whether �he applicant will have to apply for a
Variance or a Conditional Use Permit with regard to lot lines.
Chairman Kelly declared the Public Hearing open and asked
if the applicant wished to speak at this time.
FRED AR114STRONG, 221 W. Dwyer Rd. , Santa Ana,
addressed the Commission and noted that the
project had been designed with zero lot lines
in mind. He asked about the wall requirement
in Special Condition No. 5 stating that a 4
ft . solid wall with an additional 2 feet of
non solid wall was planned. He also asked
about Special Condition No. 14. a. stating
the park site would be a part of phase 4 ,
with a total of 5 phases.
On a suggestion by Commissioner Fleshman, Special Condition
No. 14. a. was changed to read - "Irr�vocable offer to dedicate the
park site subject to the approval of the City Attorney.

Cliairman Kelly asked if there was anyone wishing to speak
in FAVOR or in OPPOSITION to the proposed project . Being none, she
declared the Public Hearing closed and asked for the pleasure of the
Commission.
� Commissioner Fleshman suggested that the green belt area be
varied. Chairman Kelly asked if there could be another common pool
area. The applicant agreed that this is a good idea if a spot can
be found.
Mr . Williams suggested that Special Condition No . 4 have the
following added to the second sentence - "except for street F & Q.
He also suggested that Special Condition No. 6 be delet�d.
Commissioner Fleshman suggested that Special Condition No. 5
have the following added to it - "of solid wall . "
Mr . Williams also added Special Condition No . 15 - "The ap-
plicant shall provide an additional pool in the northern portion of
the subdivision. "
On a motion by Commissioner Snyder , seconded by Commissioner
Berkey, the Commission recommended approval to the City Council
a Change of Zone from PR-4 and O. S to R-2 8 , 000(8) by Planning Commission
Resolution No. 443 ; and, recommend approval to the City Council of a
revised tentative subdivision Uy Planning Commission Resolution No. 444
with the noted changes and additions to the Conditions of Approval ;
carried unanimously (5-0) .

D. Case No. CUP 16-78 - C. G. DUNHAM, Applicant
Request for approval of a Conditional Use Permit
to permit a 1,440 sq. ft . restaurant and a re-
lated variance to reduce the required parking
from twenty-two spaces to seventeen spaces in
the E1 Paseo Village located southerly of and
adjacent to El Paseo between Sun Lodge Lane and
Lupine Lane, C-1 , S.P. zone district .
Mr. Crump reviewed the staff report and Conditions of Approval
for the case.
There was some discussion regarding the use of variances for
parking and whether the Ordinance should be changed so this does not
happen quite as often. First item of the last WHEREAS of the Resolu-
tion was cieleted.
Chairman Kelly declared the Public Hearing open and asked if
the applicant wished to speak at this time.
GARY LOHI4iAN, 71-888 Vista Del Rio, Rancho Mirage,
representing the applicant , addressed the Commis-
� sion and stated that the restaurant will probably
be a breakfast and lunch type of restaurant .
Chairman Kelly asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the proposed project . Being none, she de-
clared the Public Hearing closed and asked for the pleasure of the
Commission.
On a motion by Commissioner Berkey, seconded by Commissioner
Kryder, the Commission appraved the Conditional Use Permit by Planning
Commission Resolution No. 445; carried unanimously (5-0) .

E. Case No. CUP 17-78 and 1P, CITY OF PALM DESERT,
Applicant
Request for a Conditional Use Permit to allow
the construction of a neighborhood fire station �
and related preliminary Design Review on approxi-
mately 1 . 1 acres located westerly of the westerly
terminus of Silver Spur Trail , northerly of Por-
tola Avenue (extended) , PR-7 zone district .
Mr . Williams reviewed the staff report and the Condi�ions
of Approval and noted the concerns of the Design Review Board.
There was some discus,�ion with regard to the drainage and
elevations. Commissioner Fleshman noted that the City should obtain
a drainage easement from the Chacahuala project .
Chairman Kelly declared the Public Hearing open and asked
the architect for the project if he would like to speak at this time.
FRANK URRUTIA, 73-350 El Paseo, Architect , noted
that a drainage easement through the north side
would be the best solution. He then noted that
there would be an evaporative cooler above the
shop area.
Chairman Kelly asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the proposed project .
JOE TARATORA, 48-271 Silver Spur Trail , asked
about the height of the building and asked
how the Commission would handle the height and "
drainage problems when they have no answers at
this time.
Mr. Williams noted that this is only a conceptual plan and
the drainage problems will have to be worked out before they can
proceed with final drawings.

��� addition of Special Condition No. 4 - "Elevations and grades shall be
returned to the Planning Commission for review after approval by the
Design Review Board. And, Special Condition No. 5 - "Necessary ease-
ments shall be obtained for drainage purposes; " by Planning Commission
Resolution No. 446; carried unanimously (5-0) .

IX. DESIGN REVTEW BOARD TTEMS
A. Consideration of the cases reviewed by the Design Review
Board at the meeting of December 26, 1978.
After some lengthy discussion regarding the access problems
on Portola the Commission rejected Case No. 102C on that basis, but
approved Case No. 103C, 104C & 105C on a motion by Commissioner
Fleshman, seconded by Commissioner Berkey, by Planning Commission
Resolution No. 447; carried unanimously (5-0) .
