PALM DESERT PLANNING COMMISSION MEETING

I. CALL TO ORDER
The regularly scheduled meeting of the Palm Desert Planning
Commission was called to order at 7:00 p.m. by the Secretary of the
Planning Commission in the City Hall Council Chambers.

Commission adjourned the meeting to August 2, 1979 at 7:00 p.m. in

The adjourned meeting of the Palm Desert Planning Commission
was called to order at 7:00 p.m. by Chairman Snyder in the City Hall
Council Chambers.

IV. APPROVAL OF MINUTES
A. Approval of Minutes of meeting of July 18, 1979.
On a motion by Commissioner Kryder, seconded by Commissioner
Fleshman, the Minutes of July 18, 1979, were approved as written; carried
unanimously.
V. WRITTEN COMMUNICATIONS - None
VI. PUBLIC HEARINGS
A. Case No. PM 14647 - Gerald J. Chazen, Applicant
Request for approval on a Parcel Map to divide approx-
imately 15.52 acres into two (2) parcels within the
P.C. - 3, S.P. (Planned Commercial Regional , Scenic
Preservation) Zone, generally located at the corner of
Highway 111 and E1 Paseo, approximately 420 feet west
of Plaza Way.

Mr. Crump presented the case, noting that the Parcel Map boundaries
were in conformance with the approved Development Plan for Parcel 1 (D.P. 05-
79). Mr. Crump pointed out that the proposed Parcel Map would divide the
area approved for development from the area not yet approved and stated that
Staff would recommend approval of this case.
There were no questions from the Commissioners at this time, so
Chairman Snyder asked if the applicant wished to make a presentation.
ROBERT RICCIARDI, Architect for the project on Parcel 1,
questioned Page Two of the Staff Report regarding street
improvements which are required.
Mr. Crump clarified the statement contained in this Staff Report.
Chairman Snyder then declared the Public Hearing open, asking if
anyone present wished to speak in FAVOR or OPPOSITION to the request. There
being none, he declared the Public Hearing closed.
On a motion by Commissioner Fleshman, seconded by Commissioner
Berkey, Case No. PM 14647 was approved by adoption of Planning Commission
Resolution No. 514 as presented; carried unanimously (4-0) .
B. Case No. TT 14417-TRANSCOPIC DEVELOPMENT CORPORATION -
Applicant
Request for approval of a 10 lot Tentative Tract Map
for condominium purposes on approximately 2.2 acres
in the P.R. - 6,S.P. Zone, on the north side of 44th
Avenue, approximately 610 feet west of Cook Street.
Mr. Crump presented this case, noting that the proposed Tentative
Tract Map was filed in order to implement an approved Development Plan for
the site (D.P. 07-79) . Mr. Crump noted that the proposed Tentative Tract
Map was the same as the Development Plan previously approved with the ex-
ception of the entry gate design for which plans have not yet been finalized.
Staff noted that the proposed Tentative Tract Map was acceptable and recommended
approval of this case.
Chairman Snyder asked if the applicant wished to make a pre-
sentation.
ANTHONY TSE, representative for the project, stated he
did not wish to make a presentation, and that he con-
curred with all conditions.
Chairman declared the Public Hearing open, asking if anyone
present wished to speak in FAVOR or OPPOSITION to this request. There
being none, he declared the Public Hearing closed.
Commissioner Fleshman questioned the need for Special Condition
No. 1. He felt that as worded it may be necessary for the applicant to
come back to the Commission for a modification if the fifty percent open
space is not achieved. The Commission generally agreed that Staff could
calculate required open space.

Fleshman, Case No. TT 14417 was approved by adoption of Planning Commission
Resolution No. 515 as presented; carried unanimously (4-0) .

C. Case No. TT 14645-RODNEY J. BARTOW, Applicant
Request for approval of a Tentative Tract Map
to divide approximately 1.25 acres into five
lots within the R-1, 10,000 (Single Family,
Residential , 10,000 sq. ft. minimum lot size)
Zone generally located on the south side of
too Homestead Road between Beverly Drive and Highway
74.
Mr. Crump presented this case, noting need for an additional
Special Condition Nos. 3 and 4. Special Condition No. 3 was presented
as follows, "If tract is to be graded prior to all building permits
being issued, a program for Soils Stabilization shall be submitted to
and approved by the Director of Environmental Services. " Special
Condition No. 4 was presented as follows, "If, after City Staff
research, it is determined that the access easement illustrated along
the east boundary of the tract is under public control , subdivider
shall install curb and street improvements as required by the Director
of Public Works. " It was stated that with these two Special Conditions,
Staff would recommend approval of this request.
Chairman Snyder asked if the applicant wished to make a pre-
sentation.
ROD BARTOW, Applicant, stated concurrence with the conditions.
Chairman Snyder declared the Public Hearing open, asking if
anyone present wished to speak in FAVOR or OPPOSITION to this request.
There being none, he declared the Public Hearing closed.
On a motion by Commissioner Fleshman, seconded by Commissioner
Kryder, Case No. TT 14645 was approved by adoption of Planning Commission
Resolution No. 516 adding Special Conditions No. 3 and 4 as stated above;
carried unanimously (4-0) .
D. Case No. TT 15082-DON LAWRENZ (C/O Paul Loveridge) ,
Applicant.
Request for approval of a Tentative Tract Map to
create a one (1) lot subdivision for commercial
condominium purposes on approximately .30 acres
within the C-1, S.P. (General Commercial , Scenic
Preservation) Zone, located on Panorama Drive 180
feet south of Highway 111.
Mr. Crump presented this case, noting that development of the
subject property was previously approved under Design Review Case No. 114C.
Mr. Crump recommended approval of this case.
The applicant was not present, so Chairman Snyder declared the
Public Hearing open, asking if anyone present wished to speak in FAVOR or
OPPOSITION to this request. There being none, he declared the Public
Hearing closed and asked for the pleasure of the Commission.
On a motion by Commissioner Kryder, seconded by Commissioner
%no Berkey, Case No. TT 15082 was approved by adoption of Planning Commission
Resolution No. 517 as presented; carried unanimously (4-0) .

E. Case No. VAR 06-79-EGS METRO, Applicant
Request for approval of a Variance from off-
street parking standards to permit construction
of a 5,120 sq. ft. commercial building in the
Market Basket Center in the C-1 S.P. , (General
Commercial , Scenic Preservation Overlay) Zone
r. located on the north side of E1 Paseo, west of
Larkspur Lane.
Mr. Crump presented the case indicating the past history of
the site. It was noted that this parking Variance was filed as a result
of the recent request to build a 5,120 sq. ft. commercial building facing
El Paseo. Staff presented parking calculations for the site and reommended
approval of the case.
Commissioner Kryder questioned the design of the planter on
the north side of the proposed building. It was pointed out that this
was a raised planter because of the grade differential .
ROBERT RICCIARDI , Architect for the project, made a short
presentation and concurred with the conditions.
Chairman Snyder declared the Public Hearing open, asking if
anyone present wished to speak in FAVOR or OPPOSITION to this proposal .
There being none, he declared the Public Hearing closed and asked for
the pleasure of the Commission.
Commissioner Fleshman lead a discussion among the Commissioners
regarding special conditions and additional site improvements.
w On a motion by Commissioner Berkey, seconded by Commissioner
Fleshman, Case No. VAR 06-79 was approved by adoption of Planning Commission
Resolution No. 518 as presented; carried unanimously (4-0) .
F. Case Nos. DP 01-78 (Amendment) and VAR 01-78 (Amendment)-
PDR ASSOCIATES, Applicant
Request for approval of an amendment to a previously
approved Development Plan and off-street parking
Variance to allow additional restaurant area and
reduce commercial area in the P.C. (4) , S.P. Zone
(Resort Center Planned Commercial , Scenic Preservation
Overlay) on property located at the northwest corner
of State Highway 111 and 44th Avenue.
Commissioner Fleshman left the room at this time because of a
conflict of interest.
Mr. Crump presented the case noting the background of the site.
It was pointed out that the parking Variance as now requested would be
similar to the original Variance approved. Staff noted that approval of
the case was recommended.
Applicant was not present, so Chairman Snyder declared the
Public Hearing open, asking if anyone present wished to speak in FAVOR
or OPPOSITION to the request. There being none, he declared the Public
Hearing closed and asked for the pleasure of the Commission.
On a motion by Commissioner Kryder, seconded by Commissioner
Berkey, Case Nos. DP 01-78(Amendment) and VAR 01-78(Amendment) were
approved by adoption of Planning Commission Resolution No. 519, as
presented; carried (3-0-1 with Commissioner Fleshman abstaining) .
Commissioner Fleshman returned to his seat at this time.

IX. DESIGN REVIEW BOARD ITEMS
A. Consideration of continued Case No. 116C, BEN BARNUM,
Applicant. ,
Mr. Sawa presented the item, stating that applicant had reached
an agreement with the adjacent property owner to purchase 4 feet of the
front portion of the lot; noting that this would eliminate the walkway
between the two parcels.
Applicant was present but did not speak.
B. Consideration of cases acted on by the Design Review
Board at their July 24, 1979 meeting.
Mr. Sawa presented Case No. 181 MF & 182 MF and noted that the
conditions of approval were attached to the minutes of the meeting of
July 24, 1979.
Betty Williams representing Lewis Homes of California was
present but did not speak.
On a motion by Commissioner Fleshman, seconded by Commissioner
Berkey, Case Nos. 116C, 181 MF & 182 MF were approved by adopting Planning
Commission Resolution No. 520 as presented; carried unanimously (4-0) .
X. DISCUSSION ITEMS
A. Consideration of revised schedule for general plan update.
Mr. Crump explained to the Commission that scheduling of the
General Plan update would require one additional month.
B. Consideration of portions of Riverside County EIR No. 93,
concerning cove Communities General Plan Amendments.
Mr. Crump summarized the Environmental Impact Report for the
PLanning Commission.
Commissioner Snyder stated that the leapfrog development is not
desirable and hard to control . Commissioner Kryder stated that each
development should be looked at individually. Commissioner Berkey stated
that he felt commercial center land use allocation on Bob Hope (South of
Ramon) was unnecessary and unwise. He additionally stated that the 120
acre shopping center (at Bob Hope and Ramon Road) is not in an appropriate
location. Commissioner Fleshman stated that the felt the County should
not be in the development business. He additionally stated that the
Countys attention to details is poor.
