I. CALL TO ORDER
The rescheduled meeting of the Palm Desert Planning Commission
was called to order at 6:56 P.M. by Chairman Snyder in the City
Hall Council Chambers.

IV. APPROVAL OF MINUTES
A. Minutes of regular meeting of December 19, 1979.
Mr. Crump noted the following correction:
On page 2, 3rd paragraph, the first sentence should read: "Commissioner
Berkey noted that at the last meeting it was stated that the Fire Marshal
recommended denial of this projecte "
� Upon motion made by Commissioner Miller, seconded by Commissioner
Berkey, the Minutes of December 19, 1979, were approved as amended. Carried
unanimously (3-0) .
V. WRITTEN COMMUNICATIONS - NONE
VI. PUBLIC HEARINGS
f�. Continued Case No. VAR 07-79 - ERNEST W. HAHN, INC. , Applicant
Request for approval of a Variance to the Zoning Ordinance to
increase the height of arking lot light standards from ten (10)
feet to twenty-five (25� feet within the PC-3, S.P. (Planned
Commercial , Regional Center, Scenic Preservation Overlay) and
PR-6, S.P. rezoned to R-3 (9) , (Multi-family Residential , max.
1 d.u./9000 sq. ft. ) zones, generally located at the northwest
corner of Highway 111 and Monterey Avenue.
Mr. Crump presented this case indicating that the Commission received
a detailed written report from the Staff, indicating the considerations for
this subject.
Chairman Snyder stated that this was an unusual situation and that
consideration might be given to changing the City Zoning Ord�nance rather
than granting a Variance. He then opened the Public Hearing asking if
�'' anyone present wished to speak in FAVOR or OPPOSITION to this case.
MR. WILLIAM LYLE, Representative of Hahn Co. , 200 Continental Blvd. ,
E1 Segundo, felt the suggestion was logical but asked for the approval of
the Variance because of time elements.
Chairman Snyder stated he was concerned with the residents 'opinions
in the area. He also expressed his concern with how much light halo the
parking lot lights may create.
Mr. Lyle stated that there are several other shopping centers near
the City .with this type of lighting. He wo ld like to show o e Qf tbem to
the Comm�ssion if it were possible. He exp�ained what type o� l �ght�ng was
used in these other centers and it proved to be acceptable to the cities.

Chairman Snyder closed the Public Hearing. He asked if it would
be accep�able to Mr. I'_yle if they approve the Variance subject to
changing the City Zoning Ordinance. Mr. Lyle again stated that time was
of essence.
� Commissioner B�erkey stated he would like to delay this request
until the next meeting for a chance to see another nearby center's lighting
sys tem. ,,,,�;
Chairman Snyder also requested a line-of-site study for 25 feet high
poles. Mr. Lyle agreed.
Chairman Snyder explained that the Commission approved a Variance
before, and afterward received a negative response from the public. He
further stated that the Commission must be consistent, therefore, suggested
a continuance to the meeting of January 16, 1980. The Public Hearing was
reopened.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Miller, Case No. VAR 07-79 was continued to the meeting of January 16,
1980. Carried unanimously (3-0) .
B. Case No, TT 14997 - PRO-CON DEVELOPMENT/T & D INVESTMENTS,
, Applicants
Request for approval of a Tentative Tract Map for 24 lots to
allow 20 condominium units, recreational area and common open
space on approximately 4.5 acres within the PR-5 (Planned
Residential , 5 d.u.jac, ) zone, generally located on the south
side of Hovley Lane, 2400 feet east of Monterey Avenue.
Mr. Crump reviewed the staff report and stated that the site plan �,;
has not been evaluated by the pesign Review Board, but conditions could
be added to guarantee the map's conformance to the final plan approved by
the Design Review Board. Ne recommended approval to the City Council .
Commissioner Berkey pointed out this request was premature since it
has not been evaluated by the Design Review Board and the Commission
should follow correct procedures.
Chairman Snyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSTTION to this case�
MR. WILLIAM FITCH, Wildan & Associates, stated he could not speak
for the owner but would answer any questions�
Commissioner Berkey asked if the Commission needed the applicant' s
concurrence for a continuance? Mr. Crump replied that it was essential .
Mr. Fitch stated he could authorize a continuance and would do so.
Mr. Crump added that a written concurrence from the applicant would be
desirable also.
Upon motion made by Commissioner Mi11er, seconded by Commissioner
Berkey, Case No. TT 14997 was continued to the meeting of February 5, 1980.
Carried unanimously (3-0) .

The Commission indicated that the purpose of this continuance was to
' allow the applicant to submit plans through the Design Review process.

C. Case No. TT 15634 - SAN CLEMENTE GROUP DEVELOPMENT CORP. ,
Applicant
Request for� approval of a Tentative Tract Map for 9 lots to
allow const.ruction of 51 condominium units on approximately
10.5 acres within the PR-7, S.P. (Planned Residential , 7
d.u./ac. , Scenic Preservation Overlay� zone, generally located
on the sout.h side of Parkview Drive, west of Fairhaven Drive.

Mr. Crump presented this case reviewing the staff report and
stated that this map does not propose individual unit lots. He
reviewed the illustrated map and recommended approval to the City
Council .
Chairman Snyder opened the Public Hearing asking if anyone
present wished to speak in FAVOR or OPPOSITION to this case.
� MR. JACK NEWVILLE, Engineer, 71-537 Highway 111, Rancho Mirage,
stated his concurrence with the conditions.
Chairman Snyder closed the Public Hearing.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Miller, Case No. TT 15634 was approved by adoption of Planning Commission
Resolution No. 560, as submitted. Carried unanimously (3-0) .
D. Case No. TT 15724 - VICTOR SUN, EVERETT DEVELOPMENT, Applicant
Request for approval of a Tentative Tract Map to subdivide
a parcel into 8 individual lots and one private street on
approximately 4.35 acres within the S. I. , S.P. (Service
Industrial , Scenic Preservation Overlay) zone, generally
located on the north side of 42nd Avenue, 600 feet west of
Cook Street.
Mr. Crump presented this case illustrating how the parcel would
be subdivided. He also stated that some of the problems related to this
request were based on the original Parcel Map. He indicated that the
conditions specified the terms under which the division would be acceptable
and recommended approval .
�" Commissioner Berkey asked if the City was in a position to enforce
improvements on the parcel map. Mr. Crump answered that the City is able
to enforce public improvements but other improvements would have to be
mutually agreed upon between the subdividers.
Chairman Snyder asked if the applicant cared to make a presentation.
MR. VICTOR SUN, Irvine, California, asked staff to clarify the responsi-
bilities relative to improvement of private streets and 42nd Street.
Mr. Crum� stated that it was the original Parcel Map subdivider's
responsibility but the improvements were a prerequisite to implementing
this Tentative Tract.
Chairman Snyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none,
the Public Hearing was closed.
Upon motion made by Cpmmissioner Miller, seconded by Commissioner
Berkey, Case No. TT 15724 was approved by adoption of Planning Commission
Resolution No. 561, as submitted. Carried unanimously (3-0) .
E. Case No. CUP 03-75 (Amendment) - PORTOLA DEL SOL OWNER's
ASSOCIATION, Applicant

Request for approval of an Amendment to a Conditional Use
Permit to allow construction of two (2) Tennis Courts and
one Jacuzzi within the common recreation area of Portola
Del Sol Condominium Qevelopment located on the east side
of Portola Avenue, at Catalina Way.

Mr. Crump presented this case illustrating the changes for the
proposed amendment. He stated that it was not known whether the owners
of the units affected by the proposed courts (night lighting) concurred
with this request. He pointed out that representatives of the association
would be verifying th�e concurrence from the adjacent dwelling unit owners.

Chairman Snyde�r asked if the people had been notified? Mr. Crump �
stated that they were�.
Chairman Snyde�r opened the Public Hearing asking if anyone present
wished to speak in FP�VOR or OPPOSITION to this case.
MR. BILL DOOLE:Y, President of Homeowner's Association, 74-127
Catalina Way, Palm De�sert, stated that they held a meeting on July 14th,
regarding this reques�t, to take a vote. The results out of 100 units
were: 70-yes, 9-no, �'1-no reply. He stated that the people adjacent to
the north recreation area (proposed tennis courts) , out of 12 units,
voted: 10-for, and 2-no, for the night lighting. He had the written
proxies available for� in��t. These were attached by reference to the
resolution.
MR. ROB WHEATL.EY, 74-071 Catalina Way, Palm Desert, stated he
was in FAVOR of this project.
Chairman SnydE�r closed the Public Hearing.
Upon motion ma�de by Commissioner Berkey, seconded by Commissioner
Miller, Case No. CUP 03-75 (Amendment) was approved by adoption of Planning
Commission Resolutiori No. 562, as submitted, to include attachments.
Carried unanimously (3-0) .
F. Case No. C;UP 15-78 - E. GEORGE MARZICOLA, Applicant �
Request for a one year extension of time for a Conditional
Use Permit to create a 42 lot Industrial Planned Unit
Development: on approximately 34.7 acres within the S. I. ,
S. P. (Service Industrial , Scenic Preservation Overlay) zone,
located at the southeast corner of Cook Street and Hovley
Lane.
Mr. Crump pres;ented this case stating that considerations relative
to the perm�t had not: changed and the time extension on the Tentative Map
was approved by the City Council . He recommended approval .
Chairman SnydE�r opened the Public Hearing asking if anyone present
wished to speak in Fp,VOR or OPPOSITION to this case.
MR. DON STARKE:Y, Representative, 82-321 Orange, Indio, stated that
final processing time took longer than the time alloted.
Chairman Snyder closed the Public Hearing.
Upon motion ma.de by Commissioner Miller, seconded by Commissioner
Berkey, Case No. Cup 15-78 was approved by adoption of Planning Commission
Resolution No. 563. Carried unanimously (3-0) .

G. Case Noe C�UP 17-78 - CITY OF PALM DESERT, CALIFORNIA, Applicant
Request for� a one year extension of time for a Conditional
Use Permit to allow construction of a Fire Station on
approximate�ly 1.10 acres within the PR-7 (PLanned Residential
7 d.u./ac. ) zone, located at the northwester1y corner of the '
intersectic�n of Mesa View Drive (Extended) and Portola Avenue.
Mr. Crump presented this case stating that the Commission approved
the original CUP and that fina1 p1ans have been through the Design Review
approval process and further noted that bids would be� opened for construction
in February. Therefo�re, the extension would be necessary to accomodate this
schedule. He recomrr�ended approval .

Chairman Snyder opened the Public Nearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case.
MR. PAUL WILLIAMS, Director of Environmental Services, 45-275
Prickly Pear Lane, Palm Desert, added that there was only one person
,,�„ affected by this project, he attempted to contact him but received
no reply.
Chairman Snyder asked what the status was on Mesa View Drive
extension. Mr. Williams stated that the completion of this street would
be done by the time construction takes place for the Fire Station.
Chairman Snyder further discussed with Mr. Williams the projects
on Mesa View Drive.
Chairman Snyder closed the Public Nearing.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Miller, Case No. CUP 17-78 (time extension) was approved by adoption of
Planning Commission Resolution No. 564. Carried unanimously (3-0) .

IX. DESIGN REVIEW BOARD ITEMS
Consideration of cases action on by the Design Review Board at
their meeting of December 27, 1979.
�,, Case No. 190 MF - Mr. Sawa presented this case stating that the
Board reviewed the plans and did approve them with some modifications.
The applicant concurred with the revisions.
Case No. 193 MF - Mr. Sawa presented this case stating that these
were originally parking lots for the old models. When the models were
not needed anymore, the lots were landscaped. The association requested
that they sell both lots. The applicant submitted plans for a Duplex and
the Design Review Board approved it with one revision.
Case No. 127 C - Mr. Sawa presented this case stating that the
square footage of the proposed restaurant was within the area alloted
in the original approval . He reviewed the elevations and stated the
Design Review Board approved this also with two (2) minor revisions.
The applicant concurred with the revisions. He recommended approval .
Upon motion made by Commissioner Miller, seconded by Commissioner
Berkey, these cases were approved by adoption of Planning Commission
Resolution No. 565. Carried unanimously (3-0) .
