I. CALL TO ORDER
The regularly scheduled meeting of the Palm Desert Planning Commission was
called to order at 7:00 P.M. by Chairman Miller in the City Hall Council
Chambers.

IV. APPROVAL OF MINUTES
A. Minutes of the meeting of March 18, 1981.
Motion was made by Commissioner Berkey, seconded by Commissioner Richards,
to approve the Minutes as written. Carried unanimously (4-0) .
V. WRITTEN COMMUNICATIONS

Letters were received by Caldwell Banker and Highway 111 Associates; they
were discussed during study session.
VI. PUBLIC HEARINGS
A. Case Nos C/Z 02-81, DP 02-81, DP 03-81, TT 15633, TT 15640 and
PM 17474 - SUNRISE COMPANY and ENGINEERING SERVICE CORPORATION,
Applicants
Request for approval of a Change of Zone, two (2) Tentative
Tract Maps, a Parcel Map and two (2) Development Plans, to
allow construction of a 1,650 dwelling unit residential pro-
ject and Administrative Office, on property located at the
southeast and southwest corners of Cook Street and Country
Club Drive.
Mr. Diaz informed the Commission that due to a publication error of the legal
notices it was necessary to readvertise and continue these cases to April 15, 1981.
He noted that the applicant was notified and was not present.
Chairman Miller opened the Public Hearing and asked if anyone present wished
to speak in FAVOR or OPPOSITION to this case. There were none.
�"' Motion was made by Commissioner Berkey, seconded by Commissioner Richards,
to continue these cases to April 15, 1981. Carried unanimously (4-0).
B. Case No. PM 17452 - ARLE CORPORATION (CHARLES GIBBS) , Applicant.
Request for approval of a Tentative Parcel Map, to allow
the creation of industrial lots within the S. I. , S.P.
(Service Industrial , Scenic Preservation Overlay) and
O.S. (Open Space) zone, located at the southwest corner
of Hovley Lane and Cook Street.

Mr. Diaz stated that the applicant requested a continuance for further
study. Staff concurred.
Chairman Pliller opened the Public Hearing and asked if anyone present wished
to speak in FAVOR or OPPOSITION to this case. There were none.
Motion was made by Commissioner Berkey, seconded by Commissioner Kryder, to
continue this case to May 5, 1981. Carried unanimously (4-0). ,,,�„
PUBLIC HEARING ITEM "C" WAS REFERRED TO AT A LATER TIME OF TNE MEETING.
D. Case No. DP 04-80 and 204 MF - J.M. PETERS COMPANY and BALLEW/
MCFARLAND, INC. , Applicants
Request for approval of a one year time extension of a
Development Plan and re1ated Design Review case to allow
a 156 unit deve1opment with related recreational amenities
and open space on approximately 34.06 gross acres located
at the northeast corner of Nov1ey Lane and Cook Street in
the PR-5, S.P. (Planned Residential , max. 5 d.u./acre,
Scenic Preservation Overlay) zone.
Mr. Diaz presented this case recommending approval subject to the original
conditions.
Chairman Miller opened the Public Hearing and asked if the applicant wished
to make a presentation.
PATTY MARTIN, Ballew-McFarland, stated she would answer any questions the
Commission might have. �
Chairman Miller asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the Public Hearing was closed.
Motion was made by Commissioner Kryder, seconded by Commissioner Richards,
to approve this case by adoption of Planning Commission Resolution No. 694, subject
to the original conditions contained in Planning Commission Resolution No. 587.
Carried unanimously (4-Q).
VII. OLD BUSINESS - NONE
VIII. NEW BUSTNESS
A. Case No. GPA 01-80 - CITY OF PALM DESERT, Applicant
Referral from City Council of General Plan Update for the City
of Palm Qesert.
Mr. Diaz reviewed the main concerns exeressed which were Resort Commercial
Land Use Designations. and dual designations of 2 park sites. He indicated that the
City Council requested a thorough study of these concerns. Mr. Diaz gave the options
available to the Planning Commission: (1) adopt the General Plan with the areas desig
nated as Resort Commercial to be held in abeyance till s�udy is completed; or, (2)
adopt the General Plan with the understanding that the Resor� Commercial areas are +�
under study by Commission, and could be subject to General Plan Amendment.
Commissioner Richards further clarified this matter to the audience and
asked Mr. Diaz when the study would be completed. Mr. Diaz replied that it may
be ready by April 15th.
Chairman Miller asked if anyone present wished to speak on this matter.

VIII. NEW BUSINESS (cont. )
MR. ROBERT HUBBARD, 22 Stanford, Rancho Mirage, expressed his appreciation
for the further study and explained why the designations needed further clarifi-
cation. He indicated he would like to participate in any discussion and would
furnish any information staff might need.
Commissioner Berkey asked for Mr. Hubbard's opinion on eliminating all of

the resort commercial designations.
Mr. Hubbard felt that all commercial areas should be designated as General
Cor�nercial in the General Plan but when there is a proposed development it should be
reviewed to see how it would fit in that particular area.
MR. JOSEPH RAPKIN, 37-700 Dumille Road, Rancho Mirage, made comments regard-
ing the appropriateness of the resort commercial designation and asked the
Commission to continue their position as previously stated on the property at the
corner of Highway 111 and Deep Canyon Road.
Mr. Diaz explained that all areas designated as resort commercial should be
studied and not only this one particular area.
Commissioner Kryder felt that any imput given from this discussion could be
used for all resort commercial areas. Commissioner Berkey agreed and also felt
that any imput on whether the commercial designations could be divided into several
type of commercial uses, would be considered.
Mr. Diaz stated that if the Commission felt all resort commercial designations
should be deleted, this can be recommended to the City Council . Commissioner Kryder
stated that this matter needed additional individual study. Commissioner Richards
stated that they should proceed in the manner originally stated.
Mr. Diaz reviewed the alternatives: (1) eliminate some resort commercial
�"' designations, (2) eliminate all , or, (3) eliminate none.
After further discussion the Commission agreed that a written report prepared
by staff was needed indicating specifically the City Council 's request and describing
the alternatives.
Mr. Hubbard again stated he would be happy to provide any information the
staff might need in this study.
AT THIS TIME PUBLIC HEARING ITEM "C" WAS CONSIDERED.
VI. PUBLIC HEARINGS _
C. Case No. CUP 02-81 - ROBZN SHOU, Applicant
Request for approval of a Conditional Use Permit to allow '
the operation of an electronic games arcade in a 1,000
square foot building within the C-1, S.P. (General Commer-
cial , Scenic Preservation Overlay) zone, located at 73-180
Highway 111.
Mr. Diaz presented this case stating that staff's concerns were off-street
parking and control of impacts on nearby residents. He pointed out that the suite
in which this use would be located would only be allocated 4 parking spaces, while
�, staff felt 10 were required. Staff did not feel these impacts could be mitigated,
therefore, recommended denial .
Commissioner Berkey asked staff if there could be appropriate conditions
imposed on this use if it were to be approved.
Mr. Diaz replied that some of the conditions could include: (1) limited
hours, (2) specific trial period of time (6-9 months) for the use, (3) if during
that time, complaints area received the matter could be reviewed and rescinded,
if necessary.

Chairman Miller opened the Public Hearing and asked if the applicant wished
to make a presentation.
MR. ROBIN SHOU, 73-196 Highway 111, stated he understood and concurred with
the conditions stated by Mr. Diaz.
Commissioner Kryder asked Mr. Shou if security would be provided. Mr. Shou �
stated he had planned to hire a security guard if he felt it was necessary. �
Commissioner Kryder asked if there would be two employees at all times. Mr.
Shou replied that there would.
Commissioner Richards asked Mr. Shou if he would be renting the equipment.
Mr. Shou replied that he would be �iving a percentage of the income of the machines
to the machine owners.
Chairman Miller asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the Public Hearing was closed.
Motion was made by Commissioner Berkey instructing staff to prepare a
Resolution of �Approval and present it to Commission at the meeting of April 15, 1981,
seconded by Commissioner Kryder. Carried unanimously (4-0).
COMMISSION RETURNED TO NEW BUSINESS ITEM GPA O1-80.
Mr. Diaz explained to the Commission the City Council 's position regarding
dual designation on the Sand Dunes Park and Date Palm Preserve. The Co►rnnission
voted in a Minute Action to instruct Mr. Diaz to inform City Council that they would
continue to recommend the dual General Plan designation of open space and 3-5 d.u/acre
residential on both of those open space sites. The reasons sited were to avoid un-
due delays in processing future Development Plans, and more importantly, to give �
private property owners in these areas a sense of direc�ion as to what type of devel �
opment could occur if the land did not remain open space.

XII. COMMENTS
Commissioner Richards requested an update on the Portola Dip problem. Mr.
Diaz stated he talked with the Director of Public Works, Mr. Clellan, who indicated
that Coachella Valley Water District is communicating with Vintage Properties and
the problem should be resolved soon.
XIII. ADJOURNMENT
Motion was made by Commissioner Richards, seconded by Commissioner Kryder,
to adjourn the meeting at 7:55 p.m. Carried unanimously (4-0) .
