CALL TO ORDER The regularly scheduled meeting of the Palm Desert Planning Commission was called to order at 1:00 p.m. by Vice Chairman Kryder in the City Hall Council Chambers. II. PLEDGE OF ALLEGIANCE Commissioner Berkey III. ROLL CALL Members Present: Commissioner Berkey Commissioner McLachlan Commissioner Richards Vice Chairman Kryder Excused Absent: Chairman Miller Staff Present: Ramon Diaz, Director of Environmental Services Stan Sawa, Principal Planner Steve Smith, Associate Planner Others Present: Bob Hardy, Associate Civil Engineer IV. APPROVAL OF MINUTES: June 2, 1981 Motion was made by Commissioner Berkey, seconded by Commissioner Richards, to approve the minutes as submitted. Carried unanimously (4-0) . V. SUMMARY OF COUNCIL ACTION Mr. Diaz review Council Action of the meeting of June 11, 1981. VI. , PUBLIC HEARINGS A. Continued Case No. DP 05-81 and TT 14080 - T&D INVESTMENTS, Applicants Request for approval of a Residential Development ,Plan and Tentative Tract Map to allow construction of 50 condominium units on 10 acres located on the north side of Hovley Lane, 2600' east of Monterey Avenue for which a Negative Declara- tion was previously certified. Mr. Diaz outlined the background of this application and said that staff had still not received the required revised plans. It was noted that this will be the second continuance for this applicant and that in accordance with Commission policy no future continuances can be granted. Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to continue this case to, June 30, 1981. Carried unanimously (4-0) . B. Continued Case No. PM 17452 - ARLE CORPORATION (CHARLES GIBBS) and RON MARTIN AND ASSOCIATES, Applicants Request for approval of a Tentative Parcel Map to allow the creation of industrial lots within the S. I. , S.P. (Service Industrial , Scenic Preservation Overlay) and O.S. (Open Space) zone, located at the southwest corner of Hovley Lane and Cook Street. PUBLIC HEARINGS (cont. ) for consideration at this meeting. Commissioner Berkey declared a possible conflict of interest. Motion was made by Commissioner Richards, seconded by Commissioner McLachlan, to continue this case to the meeting of June 30, 1981. Carried 3-0-1, with Commissioner Berkey abstaining. C. Case No. CUP 11-78 - ROMITTI'S WINE CELLAR, Applicant Request for an Amendment to a Conditional Use Permit and Associated Parking Variance to allow a restaurant to expand its eating area, 400 sq.ft. into an outdoor patio without providing additional required parking located at the northeast corner of E1 Paseo and Lark- spur Lane. Mr. Sawa advised the Planning Commission that the E1 Paseo Sandwich Shop request for outdoor seating was continued to the meeting of July 15, 1981, in order to allow further study of the ramifications of outdoor seating for various types of restaurants. Staff felt it would be appropriate to continue this request to July 15, 1981, so that it can be considered concurrently with the E1 Paseo Sandwich Shop request and outdoor seating policy. Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to continue this case to July 15, 1981. Carried unanimously (4-0) . D. Case No. C/Z 05-81 - CITY OF PALM DESERT, Applicant Consideration of a preannexation Change of Zone from R-1 (12,000) (Riverside County), to PR-5 (UA)(Planned Resi- dential , 5 d.u./acre, maximum density, upon annexation) for three parcels generally located north of Country Club Drive, west of Cook Street; and a Negative Declaration of Environmental Impact as it pertains thereto. Mr. Sawa reviewed the main points from the staff report and concluded by advising the Commission that this rezoning will complete the prezoning process in the north sphere area. Commissioner Kryder opened the Public Hearing and asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed. Minute motion was made by Commissioner Richards, seconded by Commissioner Berkey, to adopt findings as recommended by staff. Motion was made by Commissioner Berkey, seconded by Commissioner Richards, to waive further reading and adopt Planning Commission Resolution No. 721, a Resolu- tion of the Planning Commission of the City of Palm Desert recommending to the City Council a Change of Zone from R-1 12,000 (Riverside County) to PR-5 (UA) for three parcels generally located north of Country Club Drive, west of Cook Street and certification of a Negative Declaration of Environmental Impact. Carried unanimously (4-0). Now VII. CONSENT CALENDAR - NONE VIII . DESIGN REVIEW BOARD ITEMS - NONE IX. MISCELLANEOUS ITEMS A. Consideration of amendment to Redevelopment Agency boundaries. MISCELLANEOUS ITEMS (cont. ) Carlos Ortega, Assistant City Manager, was present and highlighted the salient points from the staff report on the proposed expansion of the Redevelopment Agency boundaries and the preliminary plan for the purpose of funding flood control facilities. The boundary approved today is a flexible one and can be changed at any point during the process. The ultimate size of area in the new boundaries will determine the amount of increment to be diverted to the Redevelopment Agency and hince will determine the length of time the funds will need to be diverted from other agencies. Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to waive further reading and adopt Planning Commission Resolution No. 722, a Reso- lution of the Planning Commission of the City of Palm Desert, selecting a project area, as amended, and approving a preliminary plan for the purpose of funding flood control facilities. Carried unanimously (4-0) . X. ORAL COMMUNICATIONS Mr. Diaz said he was in receipt of a letter dated June 8, 1981, from Aqua Terra Inc. , seeking permission to move their business location to 73-885 Highway 111, Suite 7. The existing occupant is permitted through a parking variance granted by Planning Commission. There will be no additional employees working from the premises. It was the consensus of Planning Commission that the requested occupancy could be allowed without amendment to the parking variance. XI.
