CALL TO ORDER The regularly scheduled meeting of the Palm Desert Planning Commission was called to order at 7:00 p.m. , by Commissioner Kryder in the City bow Hall Council Chambers. II. PLEDGE OF ALLEGIANCE - Commissioner McLachlan III. ROLL CALL Members Present: Commissioner Kryder Commissioner McLachlan Commissioner Richards Commissioner Berkey Excused Absent: Chairman Miller Staff Present: Ramon A. Diaz, Director of Environmental Services Stan Sawa, Principal Planner Steve Smith, Associate Planner Patricia Armitage, Clerk Typist Others Pesent: Barry McClellan, Director of Public Works IV. APPROVAL OF MINUTES A. Minutes of the meeting of June 17, 1981 . Motion was made by Commissioner Berkey, seconded by Commissioner Richards, to approve the minutes as submitted. Carried unanimously (4-0) . V. SUMMARY OF COUNCIL ACTION Mr. Diaz reviewed Council Action of the meeting of June 25, 1981 . VI. PUBLIC HEARINGS Commissioner Berkey asked that he be excused at this point. A. Case No. PM 17452 - S & G ENTERPRISES, HOUSLEY ASSOCIATES, and ARLE CORPORATION, Applicants. Request for approval of a Tentative Parcel Map to allow the creation of industrial lots within the S. I. , S.P. (Service Industrial , Scenic Preservation Overlay) and O.S. (Open Space) zone, located at the southwest corner of Hovley Lane and Cook Street. Mr. Sawa reviewed the staff report and indicated both orally and on the map, the major improvements required. He noted that the present proposal is to create 33 Parcels for industrial use;-with a remaining Parcel of 57+ acres in size. Commissioner Richards asked if the 57+ acres were shown on the map. Mr. Sawa replied that they were but reduced in size. PUBLIC HEARINGS (CONTINUED) Commissioner Kryder inquired as to whether it was ever considered in Parcels 4, 5 and 6, to have access through easements on the adjacent lots rather than Hovley. Mr. Sawa replied that it was considered, however he felt that with proper buffering and with joint use driveways, there would be no problem with access onto Hovley. .rr Mr. Diaz indicated that Parcels 4, 5 and 6 abut Hovley Lane and that we would be hard pressed to prohibit access to Hovley entirely. Commissioner Richards asked if Residential Developments were proposed across the street. Mr. Sawa responded affirmatively. Commissioner Kryder opened the Public Hearing and asked if the Developer was present and wished to speak. MR. GEORGE BERKEY, JR. , 72-963 Skyward Way, Palm Desert, California, stated that he agreed to the conditions of approval except 3, 22,23, 24 and 26. On No.3, he indicated that he would like to go on record that he reserves the right to negotiate the drainage fees prior to the recording of the final map; since all drainage would be retained on site. MR. BERKEY, JR. , also wished to delete Conditions 22, 23 and 24, because he felt that the street access to these lots is more related to design and use of any particular building and should be treated on a case by case basis. Commissioner Kr_yder asked if there was anyone else who would like to speak in FAVOR or OPPOSITION to this case. Nobody wished to speak in the audience. saw Commissioner Kryder then asked Staff if they had a response to the Appli- cant's request. Mr. Diaz indicated that regarding Condition 23, Staff would have to disagree with the applicant because of the configuration of Parcel 1 and its proximity to the intersection of Hovley Lane and Cook Street and the fact that access is available from other streets. Relating to Hovley access, the City should limit direct vehicular access to Cook Street and Hovley Lane. Regarding Condition 24, Mr. Diaz concurred with the applicant that this Condition could be deleted entirely, since access to Hovley Lane could be controlled through the Development Plan process. Cross easements and access rights could be required at that time. Mr. Diaz indicated that Condition 26 relating to fire fees would be imposed at the time of building permits and in effect carries no weight with the Tentative Tract Map, but should remain to alert prospective purchasers. Mr. Sawa indicated that there was one Condition that was omitted and should be added, that Condition required a perimeter wall and landscaping, subject to Design Review Board approval . Commissioner Kryder asked if Staff would like to comment on Condition 22. Mr. Sawa reaffirmed the need for this Condition which required the recordation of direct vehicular access prohibition to Hovley Lane from Parcels 2, 8 and 9. MINUTES PALM DESERT PLANNING COMMISSION JU14E 30, 1981 PAGE THREE VI. PUBLIC HEARINGS (CONTINUED) Commissioner McLachlan asked if Staff was suggesting that they wall off Parcels abutting Hovley. Mr. Sawa replied that this was not being suggested, that Staff would want one six foot wall on the westerly boundary between parcels 34 and lots 9 to 18 as part of the Tract's improvements. Mr. Diaz indicated that applicant's request relating to drainage fees is set forth in the Ordinance and the right to discuss the amount, is in that Ordinance; so Condition No. 3 should stand as it reads. MR. BERKEY, JR. , stated that he wasn't prepared to comment on the wall as yet. Mr. Sawa indicated that Staff would require one uniform wall . MR. BERKEY, JR. , replied that he didn't object to this. Mr. Diaz stated that he wished this request be placed under Condition No. 24 and would read: "Applicant shall install a six foot masonry wall on the easterly boundary of Parcel 34". It was then decided that Conditions 3, 22 and 23 be retained, that 24 be deleted and replaced by a Condition requiring the addition of a perimeter wall . Commissioner Kryder closed the Public Hearing. Commissioner McLachlan moved and Commissioner Richards seconded to adopt the findings as recommended by Staff. Carried 4-0. Commissioner McLachlan moved and Commissioner Richards seconded to waive further reading and adopt Planning Commission Resolution No. 727 , a Resolution of the Planning Commission, of the City of Palm Desert, setting forth its findings and approving a Tentative Parcel Map for this case. Carried 4-0. Commissioner Berkey returned to his seat at this point. B. Continued Case Nos. DP 05-81 and TT 14080 - T & D INVESTMENTS, and WAGNER STANFORD CONSULTANTS, Applicants. Request for approval of a Residential Development Plan and Tentative Tract Map to allow construction of 47 condominium units on 10 acres in the PR-5 (Planned Residential , maximum density 5 d.u./acre) zone, located on the north side of Hovley Lane, 2,600' east of Monterey Avenue for which a Negative Declaration was previously certified. Mr. Sawa reviewed the staff report and indicated that the Development Plan had first been reviewed by Planning Commission on June 2, 1981 , and continued to June 17, 1981 . The applicant then requested a continuance on June 17, 1981 , to this meeting. Commissioner Kryder asked if there were any questions from the Commissioners, there being none, he opened the Public Hearing and asked if the applicant was present. MR. ART ESSEX - WAGNER STANFORD CONSULTANTS, 74-075 El Paseo, Suite A-7, Palm Desert, California, stated that he was present to represent his client and agreed to follow the recommendations of Staff. Mr. ESSEX replied that nothing had changed and that he had read the letter All from Barry McClellan, Director of Public Works , which listed certain conditions that should be considered for approval of this case. Simi Commissioner Kryder asked if anyone else wished to speak in 'FAVOR or OPPOSITION to this case. There being none, he closed the Public Hearing. Commissioner Richards moved and Commissioner McLachlan seconded to adopt the findings as recommended by Staff. Carried 4-0. Commissioner Richards moved and Commissioner McLachlan seconded to waive further reading and adopt Planning Commission Resolution No. 728 approving the Residential Development Plan. Carried 4-0. Commissioner Richards moved and Commissioner McLachlan seconded to waive further reading and adopt Planning Commission Resolution No. 729 , recommending to the City Council approval of Tentative Tract Map 14080. Carried 4-0. C. Continued Case No. DP 15-79 - MAYER GROUP, INC. , Applicant. Approval of a 12 month time extension for an approved resi- dential development plan and related design review case, to allow construction of 264 condominium units and a 9 acre public park on 39.1 acres within the PR-7 d.u./acre, Scenic Preservation Overlay) zone, located at the northeast corner of Country Club Drive and Monterey Avenue. Mr. Diaz reviewed this case indicating that the applicants have asked for an extension of Tentative Tract 16015. This continuance is to resolve the question of fire protection for the project which is outside' the five minute response area. He stated that Staff recommends that the request be continued to July 15, 1981 . Commissioner Kryder then opened the Public Hearing and asked if there was anyone present who would like to speak in favor or against this case. MR. EDWARD CAPLAN, 700 East Tahquitz-McCallum Way, Palm Springs, California, requested that this continuance be denied. He based his objections on the feeling that since changes had occurred in the Mayer Group, the developer was not prepared to fulfill his obligations to the City. He stated that it would be of no benefit to the City of Palm Desert to approve this continuance. Mr. Diaz responded that grounds for denial of time extensions had already been established by the Courts and that it is now up to the City to assure that the commitments that have been made are carried out. He also stated that since the Mayer Group was not present, this request should definitely be continued. Commissioner Kryder stated that he hoped Mr. Caplan would understand this. He then asked if there was anyone else present who would like to speak in FAVOR or OPPOSITION to this case. Nobody wished to speak. Commissioner Richards moved and Commissioner McLachlan seconded to continue this request to the meeting of July 15, 1981 . Carried 4-0. D. Case No. CUP 04-81 - ROMEO PULUQI and GEORGE RITTER and ASSOCIATES, Applicants. Request for approval of a Conditional Use Permit to allow the addition of 832 square feet of dining area (442 square feet indoors, 390 square feet outdoor patio) to an existing restaurant on .38 acres within the C-1 , S.P. (General Commercial , Scenic Preservation Overlay) zone, located at 73-340 Highway 111 . PUBLIC HEARINGS (CONTINUED) Mr. Sawa reviewed this report. He mentioned that the existing entry to the restaurant would be removed and that because of major remodeling, that Staff recommends that two pole signs be removed from the property and a new sign program be submitted. He also reviewed the findings and justifications for a Conditional Use Permit. He stated that Staff felt the request was acceptable subject to Conditions. Mr. Sawa indicated that the Design Review Board had reviewed and approved preliminary and final drawings for the proposed addition, at their meeting of June 23, 1981 . He recommended that by Minute Motion Resolution No. 730 be adopted. Commissioner Kryder asked if the Commissioners had any questions. They had none. He then declared the Public Hearing open and asked if there was anyone who would like to speak in FAVOR or OPPOSITION to this report. MR. ROSS STOUT of GEORGE RITTER AND ASSOCIATES, 73-899 Highway 111 , Palm Desert, California, stated that he was present to answer any questions if there were any. There were none. Commissioner Kryder then declared the Public Hearing closed. On a motion by McLachlan, seconded by Berkey, the findings were adopted as recommended by Staff. Motion carried 4-0. Commissioner McLachlan moved and Commissioner Berkey seconded to waive further reading and adopt Planning Commission Resolution No. 730 , approving the Conditional Use Permit and Design Review Case. Carried 4-0. ..r VII. CONSENT CALENDAR - NONE VIII. DESIGN REVIEW BOARD ITEMS - Preliminary plan approvals by the Design Review Board at their meeting of June 23, 1981 requiring Planning Commission confirmation. Case No. 149 C - RURAL STORES, INC. Mr. Steve Smith indicated that this property involves a 7,100 square foot commercial building at the east side of San Pablo Avenue. The site plan is shown with parking in the front. Commissioner Kryder questioned if there was parking in the rear. Mr. Smith replied that there was parking for 13 in the rear and 15 or 16 spaces in the front, that the final plan will show additional parking in the rear. Mr. Diaz indicated that in order to meet parking requirements they were forced to go this way. It would supply ample parking. Commissioner Richards moved and Commissioner McLachlan seconded to adopt Resolution No. 731 confirming Design Review Board actions. IX. MISCELLANEOUS ITEMS - NONE X. ORAL COMMUNICATIONS Commissioners expressed their desire that a "Get Well Message" similar to a Resolution be prepared for Chairman Miller. XI. ADJOURNMENT: 8:00 P.M. /� R MON A.
