CALL TO ORDER Chairman Miller called the meeting to order at 1 :02 p.m. II . PLEDGE OF ALLEGIANCE - Commissioner Berkey III . ROLL CALL Members Present : Commissioner Berkey Commissioner Kryder Commissioner Richards Commissioner Wood Chairman Miller Staff Present : Ramon Diaz , Director of Environmental Services Stan Sawa , Principal Planner Steve Smith, Associate Planner Linda Russell , Planning Secretary Others Present : Barry McClellan , Director of Public Works Eric Vogt , Fire Marshal IV . APPROVAL OF MINUTES : September 1 , 1981 Commissioner Kryder noted a correction on page one, last sentence to read: "Commission also felt that since Design Review Board does have the right to assess the aesthetic value of signs; they should still substantiat their findings. " Motion was made by Commissioner Wood , seconded by Commissioner Richards , to approve the minutes , as amended . Carried 5-0 . V . SUMMARY OF COUNCIL ACTION Mr. Diaz reviewed the actions of the Council from the meeting of September 10 , 1981 . VI . CONSENT CALENDAR A . DP 10-79 -MACK DEVELOPMENT - Request for a one year time extension for development plan for 116 unit condominium project in PR-5 zone on south side of Country Club Dr . , east of Monterey Avenue . (one year time extension granted Sept. 17 , 1980) Minute motion was made by Commissioner Berkey, seconded by Com missione Wood , to approve a one year time extension . Carried 5-0 . VII . PUBLIC HEARINGS tow A. Case No. CUP 09-80 - PALM DESERT MOBILE ESTATES C/O HOUSLEY ASSOCIATES , Applicants Request for approval of a Conditional Use Permit and Associated Variance to allow 24 additional mobile home spaces in an existing 144 space rental park on 18 .8 acres in the R-1-M zone (Conventional Single Family/Mobile Home Resi- dential District) on the west side of Portola Avenue , south of the Whitewater Storm Channel . Mr . Sawa reviewed the staff report concluding that because required findings could not be met staff recommended denial of a requested parking modification. Since findings could be made for the requested permit, staff recommended approval . MINUTES PLANNING COMMISSION SEPTEMBER 16 , 1981 There was a brief discussion, for clarification, regarding the cul-de- sacs and accesses. Mr. Sawa stated that the fire marshal would be requiring emergency access from other cul-de-sacs. Staff recommended that the emergency access to Magnesia Falls be changed to a regular entrance-exit, and stated a 40 ft. radius at the bulb of the north cul-de-sac might have =o be provided for emergencies , if emergency to Portola Avenue is unacceptab Commissioner Richards asked why they were being required to put up a,t ft. high masonry wall along the Whitewater Storm Channel if there were no adjacent residents. Mr. Diaz replied that the wall along the channel could be deleted . Commissioner Berkey requested that the draft Planning Commission Resolution state the number of additional spaces in the first paragraph, to read : "to allow a maximum of 24 additional spaces. " Chairman Milleropened the public hearing and askedfor applicant's testimony. MR. HAROLD HOUSLEY , 74040 El Paseo , reviewed all the conditions and requested that Condition Nos . 13 , 15 , and 19 be deleted . Commissioner Richards asked staff about Condition No. 13 , which re- quired the applicant to provide full public half street improvements, dedi- cation and traffic safety lighting on Magnesia Falls Drive. Mr. Diaz explained that since there have always been traffic problems from the park to Portola, this condition was being recommended by staff in order to provide additions or improvements to the park . Commission believed that there may have been some understandi relating to Magnesia Falls dedication and improvement requirements . w■o MR. RAY VAN ALSTINE, 2806 Palmberry Street, Lakewood, owner of Palm Desert Mobile Estates, stated that an agreement was made and it was not economically feasible for him to improve Magnesia Falls. He also requested that the access to Magnesia Falls be retained as emergency access for security reasons.' He explained that since there was an existing chain link fence along the north and west property line and there were no existing adjacent residents , he should not be required to put up a masonry wall . Mr. Vogt, Fire Marshal , stated that electronic controlled gates could be installed for the access to Magnesia Falls , and then explained his requirement of a water system to provide enough water flow . Commissioner Richards asked staff if any compromise could be made with the required street improvement. Mr. Diaz replied that there could not but the City Council could waive the condition. Mr. Diaz did state that Condition No. 19 , requiring the 6 ft. masonry wall on the north and west side , could be deleted . Commissioners Wood and Richards agreed that this requirement should be imposed ( street improvement) , since it could be setting a precedent for other developers. Commissioner Richards suggested Condition No. 19 h,e deleted . Chairman Miller called for public testimony. There being none 1 hearing was closed . Commission agreed to leave the required Condition for street improvements in and informed the applicant he could appeal this to the City Council . Condition No . 19 was deleted . Motion was made by Commissioner Richards, seconded by Commissioner Kryder , to adopt findings as recommended by staff. Carried 5-0 . 2 MINUTES PLANNING COMMISSION SEPTEMBER 16 , 1981 Motion was made by Commissioner Richards, seconded by Commissioner Wood , to adopt Planning Commission Resolution No. 742 , approving the Conditional Use Permit , as amended . Carried 5-0 . B. Case No. PM16258 - WARMINGTON - KARMA GROUP and WAGNER-STANFORD CONSULTANTS , Applicants Request for approval of an 18 month time extension of an approved 4 lot tentative parcel map for fin- ancing purposes of a hotel development on 29 .29 acres within the PC ( 4) , S .P . ( Planned Commercial Resort, Scenic Preservation Overlay) zone located at the southwest corner of Highway 111 and 44th Avenue. Mr . Sawa reviewed the staff report and recommended approval . Chairman Miller opened the public hearing for applicant testimony. MR. BRUCE STANFORD , Representative, 74075 El Paseo, was present for any questions the Commission might have and requested approval . Chairman Miller then asked for public testimony. There being none, the public hearing was closed . Motion was made by. Commissioner Berkey , seconded by Commissioner Kryder, to adopt Planning Commission Resolution No. 743 , approving an 18 month time extension. Carried 5-0 . . taw C. Case No. ZOA 10-81 - PRECISE PLAN ORDINANCE FOR CITY OF PALM DESERT , Applicant Consideration of an amendment to the Palm Desert Zoning Ordinance creating Section 27 .73 establish- ing Precise Plan requirements and procedures for all construction other than single family dwellings. Mr. Diaz presented the staff report stating that because this ordinance would impact other sections of the Zoning Ordinance , and the Zoning Ordinance was to be revised, staff would recommend that testimony be taken and the matter then continued indefinitely . Commissioner Berkey suggested that the Planning Commission's review of Design Review Board's actions be retained in some manner in any proposed revisions . Mr. Diaz indicated some type of information procedure could be retained in any ordinance revisions. Chairman Miller opened the public hearing, and there being no testimony the hearing was closed . Motion was made by Commissioner Wood, seconded by Commissioner Kryder, to continue this matter indefinitely and instructed staff to implement the proposed regulations in the Zoning Ordinance. Carried 5-0 . D. Case No . ZOA 11-81 - OFFICE PROFESSIONAL ZONE ORDINANCE FOR CITY OF PALM DESERT, Applicant Consideration of an amendment to the Palm Desert Zoning Ordinance creating Section 25 .25 establishing an Office Professional District . Mr . Diaz reviewed the proposed amendment and recommended approval . MINUTES PLANNING COMMISSION SEPTEMBER 16 , 1981 VII . PUBLIC HEARINGS ( cont. ) Commissioners Kryder and Richards stated that some of the uses permitted, as a right, require a Conditional Use Permit: Art Galleries, Art Studies, Financial Institutions and Commercial Parking. Commission felt that- Beauty Colleges and Barber Schools should e deleted entirely from the proposed ordinance. Commissioner Berkey felt that front setbacks adjacent to nonresidential property should not require an average of 15 ft. Chairman Miller opened the public hearing; there being no one wishing to testify the public hearing was closed . Motion was made by Commissioner Richards, seconded by Commissioner Kryder , to adopt Planning Commission Resolution No. 744 , recommending to the City Council approval of Zoning Ordinance Amendment, as revised. Carried 5- 0 . VIII . DESIGN REVIEW BOARD ITEMS Preliminary plan approvals by the Design Review Board at their meeting of September 8 , 1981 , requiring Planning Commission confirmation . Case No. 225 MF - SAN CLEMENTE GROUP DEVELOPMENT Mr . Smith reviewed this proposed project and recommended approval . Motion was made by Commissioner Richards, seconded by Com missic r Wood , to adopt Planning Commission Resolution No. 745 , confirming De ' n Review Board ' s actions of September 8 , 1981 . Carried 5-0 . IX . MISCELLANEOUS ITEMS - NONE X . ORAL COMMUNICATIONS Mr. Ortega, Assistant City Manager, gave a brief report on the money being allocated to the City , which is $70 ,000 , by Riverside County Housing and Community Development. He explained that this money should be used for community services needs benefiting the low-moderate income residents. Mr. Ortega provided the Commission with a list of needs and asked that they give a recommendation before October 8th. Commissioner Kryder suggested that the City submit an application for the Community Services District for water distribution improvements. Commi- ssion agreed. Minute motion was made by Commissioner Richards , seconded by Commissioner Kryder, to recommend to the City Council that application be made for Community Services District for water distribution improvemen'' . Carried 5-0 . XI . COMMENTS - NONE XII . ADJOURNMENT Motion was made by Commissioner Richards, seconded by Commissioner Wood , to adjourn the meeting at 3 : 15 p.m. Carried 5-0 .
