CALL TO ORDER Chairman Wood called the meeting to order at 2:03 p.m. II. PLEDGE OF ALLEGIANCE - Commissioner Richards III. ROLL CALL Members Present: Commissioner Crites Commissioner Downs Commissioner Richards Chairman Wood Excused Absent: Commissioner Kryder Staff Present: Ramon Diaz Phil Joy Linda Russell IV. APPROVAL OF MINUTES: June 7, 1983 Moved by Commissioner Crties, seconded by Commissioner Richards, to approve the minutes as submitted. Carried unanimously 4-0. (Note: Staff noted a change in the minutes on page 5, paragraph 10, should read "It was noted that Commissioners Richards and Kryder ....") V. SUMMARY OF COUNCIL ACTION Mr. Diaz reviewed the actions of the council for the meeting of June 9, 1983. VI. CONSENT CALENDAR All matters listed on the consent calendar are considered to be routine and will be enacted by one roll call vote. There will be no separate discussion of these items unless members of the planning commission or audience request specific items be removed from the consent calendar for separate discussion and action. A. Case No. TT 14032 - McLAIN DEVELOPMENT CO. Request for a one year time extension for tentative tract map covering a 206 unit development on 60.13 acres at the southeast corner of Portola Avenue and Country Club Drive. B. Case No. CUP 04-81 and 150 C - ROMEO'S STEAK HOUSE Request for a one year time extension for CUP 04-81 and 150 C for an addition to an existing restaurant at 73-340 Highway 111. Rec: Approve consent calendar items as presented by staff. Commission felt there was a policy set for the number of time extensions which could be granted; because it was not clear as to how many can be granted, staff was instructed to review the matter and report back at the meeting of July 5, 1983. Moved by Commissioner Richards, seconded by Commissioner Downs, to approve consent calendar item TT 14032; due to needed clarification of policy regarding extensions, consent calendar item CUP 04-81 and 150 C was continued to the -1- MINUTES PALM DESERT PLANNING COMMISSION JUNE 21, 1983 meeting of July 5, 1983. Carried unanimously 4-0. VII. PUBLIC HEARINGS A. Case No. CUP 10-83 - PALM DESERT ELKS LODGE, No. 2660, Applicants Request for approval to use an existing suite for a lodge hall, a Class 1, categorical exemption for CEQA purposes located on 74-225 Palm Desert Drive South. Mr. Joy reviewed the staff report and recommended approval. Commissioner Downs, being a member of this lodge, expressed a possible conflict of interest and excused himself from this item. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. The applicant was present for any questions the commission might have. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case; there being none, the public hearing was closed. Moved by Commissioner Richards, seconded by Commissioner Crites, to approve the findings as recommended by staff. Carried 3-0-1 (Commissioner Downs abstained). Moved by Commissioner Richards, seconded by Commissioner Crites, to adopt Planning Commission Resolution No. 866, to approve CUP 10-83, subject to conditions. Carried 3-0-1 (Commissioner Downs abstained). VIII. MISCELLANEOUS ITEMS Requested study session discussion: A. JOHN D. STILES - Ordinance revision permitting drive-through restaurants. MR. JOHN D. STILES, of Smoketree Realty, stated his client, Naugles Restaurant, wants to locate off the northeast corner of Monterey Avenue and Frontage Road. He felt this type of restaurant with a drive-through facility properly designed would benefit the city. Because present ordinances preclude the use, he was requesting that code be revised to permit drive-through restaurants. Commissioner Crites asked Mr. Stiles if he perceived a litter problem with drive- through restaurants. Mr. Stiles replied that the same litter potential would result as in nondrive-throughs. Commissioner Richards felt that since the city had denied drive-throughs to existing restaurants, it would be unfair to allow competitors to have them now. Commissioner Crites felt that if the policy was improper it should be changed and not be continued merely because others were refused. He stated he would like to see staff study the matter. Commissioner Downs noted that Palm Springs changed their policy recently and permit drive throughs now. Commissioner Richards agreed that it was not a good policy and did not know why it was made to begin with, but major competitors were denied drive-throughs facilities because of that policy. -2- MINUTES PALM DESERT PLANNING COMMISSION JUNE 21, 1983 Mr. Diaz stated that because restaurants require a conditional use permit staff would recommend the requirement of drive-throughs be added to the permit. Chairman Wood was apprehensive about allowing drive-throughs and felt that key considerations should be location and layout. After further discussion, it was agreed that Chairman Wood and Mr. Diaz would relate the feelings of the commission and staff to the city council at their June 23, 1983, study session, and ask if they wished this matter to be further considered. B. JOHN HOOTEN - Proposed housing development in the industrial zoned area south of Hovley Lane east of Cook Street. This was continued to July 5, 1983, per applicant's request. C. McBAIL COMPANY, Mike Gallagher - Proposed housing development in the R-1 12,000 zone, southeast corner of Portola Avenue and Country Club Drive. MR. MIKE GALLAGHER, of McBail Company, presented an affordable housing concept to the commission, with the thought of 12 units per acre and the 20% affordable housing provision to be provided by units priced at the developers cost with a development agreement from the city to waive as many fees as possible (i.e. park, signalization, drainage and plan check fees). The general feeling of the commission was that this proposal was very different than a previous one they approved (One Quail Place, Dennis Martin), and would involve the city in various ways. They felt this would present a problem and would be more of a policy matter. Commissioners felt that their only involvement should be in the density change request; they suggested to Mr. Gallagher to consider an alternative layout of the plan and building design. IX.
