I. CALL TO ORDER
The meeting was called to order at 7:05 p.m. by Chairman Wood.

IV. APPROVAL OF MINUTES: January 18, 1983
Unanimously approved as submitted.
V. SUMMARY OF COUNCIL ACTION
Mr. Diaz reviewed the actions of the council from the meeting of January 27, 1983.
VI. CONSENT CALENDAR

All matters listed on the consent calendar are considered to be routine and will be
enacted by one roll call vote. ?here will be no separate discussion of these items
unless members of the planning commission or audience request specific items be
removed from the consent calendar for separate discussion and action.
A. Case No. CUP 15-80 (Renewal) - FRANZ TIRRE - Approval of an one year
time extension for a conditional use permit to allow construction of a ten
unit condominium project in the R-3 zone at the southeast corner of Las
Palmas Avenue and San Gorgonio Way.
Rec: Approve as presented.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to approve
the one year time extension to February 2, 1984. Carried unanimously 4-0.
VII. PUBLIC HEARINGS
A. Continued Case No. CUP 03-81 (Amendment ��1) - JACK O. Vf/ISE (WISE
PALM DESERT ATHLETIC CLUB), Applicant
Request for approval of an amendment to a conditional use
permit to allow an addition to a racquet club in the R-3 (4)
� zone at the northeast corner of Alessandro Drive and San
Carlos Avenue.
Mr. Sawa reviewed what had happened at the last meeting and stated that he had
met with the applicant and discussed the issue of parking and the applicant has required
the employees to use the parking lot. It was also noted that future expansion would
attempt to minimize on-street parking. He reviewed the conditions of approval and
recommended approval.

Commissioner Crites thanked the staff and the applicant for their cooperation and
stated he was pleased with the outcome.
Commissioner Kryder was satisfied with staff's investigation of the problems
discussed but felt that a parking problem would still exist in the future.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation. �
MR. JOHN WALLING, 45-260 Club Drive, architect and coordinator of the club,
stated that every effort was being done to rectify a commission's parking concern.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this matter. There being none, the public hearing was closed.
Commissioner Kryder stated that if development continued on Alessandro a parking
problem will eventually exist; the applicant, in requiring the employees of the club to park
in the parking lot, would not resolve the potential problem.
Moved by Commissioner Richards, seconded by Commissioner Crites, to adopt
findings as recommended by staff. Carried unanimously 4-0.
Moved by Commissioner Richards, seconded by Commissioner Crites, to adopt
Planning Commission Resolution No. 837, approving Amendment ��1 of CUP 03-81, subject
to conditions. Carried unanimously 4-0.
B. Continued Case No. PM 19077 - CHARLES GIBBS, Applicant
Request for approval of a parcel map to create one
industrial parcel in the S.I., S.P. zone located on the north
side of 42nd Avenue, 312 feet west of Eclectic Street. ,�
Mr. Diaz explained that the applicant had requested for another continuance and
because only two continuances are allowed staff is recommending that this matter be
continued to March 1, 1983, rather than February 15, 1983.
Moved by Commissioner Kryder, seconded by Commissioner Richards, to continue
this matter at applicants request to the meeting of March 1, 1983. Carried unanimously
4-0.
C. Case No. CUP 16-82 - GALLERIA PROPERTIES, Applicant
Request for approval of a conditional use permit to allow a
2000 sq.ft. restaurant in the C-1 zone located at the
southeast corner of Ocotillo Drive and El Paseo.
Mr. Joy indicated in reviewing the staff report that the development would be
approximately 35 parking spaces deficient, but staff felt there was sufficient justification
to conclude there would not be a parking problem. Staff's conclusions were based on the
size, location and future clientele of the restaurant. Staff recommended approval.
Commissioner Crites felt there would be an on-street parking problem because of
the location of the proposed restaurant.
Chairman Wood opened the public hearing and asked if the applicant wished to �
make a presentation.
MR. JIM FOXX, 73-111 El Paseo, explained that this case would be an approval of
a conditional use permit for a restaurant but there presently is not a specific restaurant
proposed. The approval would expedite the process when and if someone leased that area
for a restaurant.
Chairman Wood requested for anyone to speak in FAVOR or OPPOSITION to this

case. There being none, the public hearing was closed.
Moved by Commissioner Crites, seconded by Commissioner Kryder, to adopt
findings as recommended by staff. Carried unanimously 4-0.
Moved by Commissioner Kryder, seconded by Commissioner Crites, to adopt
�„ Plannng Commission Resolution No. 838, approving CUP 16-82, subject to conditions.
Carried unanimously 4-0.
D. Case No. CUP 01-83 - PALM DESERT COMMUNITY CHURCH, Applicant
Request for approval of a conditional use permit to allow
the operation of a preschool for a maximum of 52 children
located in the R-1, S.P. zone at 47-321 Highway 74 in an
existing church.
Mr. Joy reviewed the staff report and indicated that the apparent need for such a
facility encouraged the applicant modify the request from 24 to the maximum 52 children.
Mr. Joy noted a change to Condition No. 4 to read as follows: "Any future fencing be
either a decorative block wall, wrought iron to match existing fencing, or with snailvine
vegetation planted adjacent to it in five (5) gallon containers placed two (2) feet on
center." This condition is in conjunction with a State law that requires 75 sq.ft. of
outdoor space for each occupant, which must be enclosed by a fence or wall. Staff
recommended approval.
Commissioner Crites asked why Condition No. 3 applied only to an occupancy load
exceeding 50. (Note: Condition No. 3 refers to fire alarm system and exit doors
requirements). Mr. Diaz explained that it is a fire code requirement.
Commissioner Kryder asked if the applicant wished to expand the hours of
�, operation in the future, would it require an amendment to this conditional use permit.
Mr. Diaz replied that it would not unless a condition of approval was added to specify that
it be required.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation.
MR. RICHARD KI1'E, 73-015 Skyward, representative, explained that the students
would be 2%z to 5 years of age; the 3-hour daily operation would consist of 2% hours of
learning; the play area would be expanded as required; because of the walled fence, the
noise impact would be eliminated. He stressed the need for such a facility in this area
and requested approval.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case.
KATHRYN WOOD, 72-645 Thrush Rd ��1, property owner adjacent to this proposed
preschool, stated that the majority of property owners in the condominium units adjacent
to this preschool are retired senior citizens. She felt this use would create a great noise
impact and eventually encourage young parents to locate in an area she believed to be for
retired senior citizens. She strongly opposed the preschool.
RUTH DEVf/OLFE, 72-631 Thrush, also strongly opposed the preschool because of
the probable noise impact.
� JANE BARNE?T, 72-680 Raven, asked if the school was in operation now with 24
children enrolled because she had heard it was. She also felt there would be a noise and
traffic impact. She requested commission to discuss and review the matter further.
BEVERLY CANNIZZARO, 74-022 San Marino Circle, teacher for the school, stated
that there were a lot of misunderstandings and proceeded to explain that this facility is
not like a public school. The time spent for playtime would be %2 hour each day; she
emphasized that the facility is education oriented and would be very closely supervised.

Commissioner Crites felt that the preschool facility could change in the future
from what is being proposed. He suggested a condition be added to restrict the hours of
playtime.
Mr. Kite, in answering the question of Ms. Barnett, explained that 24 children are �
presently enrolled but the school is not in operation. They would be open to the �

community and their idea is to give high quality Christian Montessori education; it would �
not be a day care center. +�
Chairman Wood closed the public hearing and asked for the pleasure of the
commission.
Commissioner Crites felt that the noise impact would to some extent carry over to
the adjacent neighborhood and therefore, suggested a condition be added to address this
concern.
Commissioner Kryder pointed out that a conditional use permit is approved with
the understanding that the commission has the ability to revoke the permit if any
violations occur. He felt a restriction for playtime is not necessary.
Commissioner Richards felt the preschool would be located in an area where it is
properly zoned for this use and explained that a preschool represents a good use for a
church and is very much needed in this city.
Chairman Wood stated he was sympathetic to the concerns of the Indian Creek
Villa owners but it would not be fair to disallow this preschool to operate in the area
proposed.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt
findings as recommended by staff. Carried unanimously 4-0. �
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt

Planning Commission Resolution No. 839, approving CUP 01-83, subject to conditions.
Carried unanimously 4-0.
E. Case No. PP 02-82 - 1AMES SA"fTLEY, Applicant
Request for approval of a precise plan of design to allow
construction of a three unit apartment in the R-2 (5) and
R-2, S.P. zone at the southwest corner of San Pablo
Avenue and Royal Palm Drive.
Mr. Sawa reviewed the staff report and conditions of approval; staff recommended
approval.
Chairman Wood asked since this property is in the AO-1 flood zone, if a fill would
be required. Mr. Sawa replied that there would. Chairman Wood was concerned about a
possible problem of the grade being much higher than existing neighboring properties.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation. The applicant was not present. Chairman Wood asked if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none, the public
hearing was closed. �
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt '�
findings as recommended by staff. Carried unanimously 4-0. �
Moved by Commissioner Crites, seconded by Commissioner Richards, to adopt
Planning Commission Resolution No. 840, approving PP 02-82, subject to conditions.
Carried unanimously 4-0.
