PALM DESERT PLANNING COMMISSION MEETING
TUESDAY - SEPTEMBER 20, 1983

I. CALL TO ORDER
Vice Chairman Richards called the meeting to order at 2:00 P.M.

IV. APPROVAL OF MINUTES: September 6, 1983
Moved by Commissioner Downs, seconded by Commissioner Crites, to approve the
minutes as submitted; carried unanimously 5-0.
V. SUMMARY OF COUNCIL ACTION
Mr. Diaz reviewed the actions of the council for the meeting of September 8, 1983.
VI. CONSENT CALENDAR
All matters listed on the consent calendar are considered to be routine and will be
enacted by one roll call vote. There will be no separate discussion of these items
unless members of the planning commission or audience request specific items be
removed from the consent calendar for separate discussion and action.
A. Case Nos. DP 04-81, TT 15634, 225 MF - SAN CLEMENTE GROUP
DEVELOPMENT CORP. AND ENGINEERING SERVICE CORP. - Request for
approval of a one year time extension for a development plan, tentative
tract map, and design review case to allow 51 condominium units on 10.5
acres located on the south side of Parkview Drive, west of Fairhaven Drive.
B. Case Nos. DP 10-79, 203 MF - LOMA LINDA ANESTHESIOLOGY MEDICAL
GROUP, AQUARIUS, JOHNNY & CAROL JOHNSON - Request for approval
of an one year extension for a development and architectural commission
case for a 116 unit condominium project in the PR-5 zone on the south side
of Country Club Drive, east of Monterey Avenue.
Mr. Diaz explained that because of extenuating circumstances, this was the fourth
request for a time extension on Item B. The applicants are new owners of this
project.
MR. MIKE GRANT, attorney for owners, 4200 Orange Street, Riverside,
explained that the present owners have only been owners of this project for
one month. They became owners as a result of a foreclosure, no long term
decisions have been made but hoped to get approval for this time extension.
Commissioner Richards felt that this would set a precedent, and therefore, was not
in favor of approving another time extension.
Commissioner Erwood felt that these owners were being penalized for other's lack
of action.
Chairman Wood asked staff if the owners were aware of the city's procedures in
terms of extensions.

Mr. Grant explained that these owners made a loan expecting to get principal and
interest back but instead got property back.
Commissioner Richards responded that when they entered into a contract they
should have been aware of the possibility of problems like this arising.
Commissioner Crites concurred.
Moved by Commissioner Richards, seconded by Commissioner Downs, to approve
Item A of the consent calendar, for a one year time extension, and deny Item B,
being a fourth request for time extension. Carried 4-1 (Commissioner Erwood
voting Nay; he was in favor of approval for both requests). vow
VII. PUBLIC HEARINGS
A. Case No. CUP 12-82 (Amendment) - TOWER GARDEN RESTAURANT and
RICHARD ROEMER, Applicants
Request for an amendment to a conditional use permit (for
a restaurant/bakery) to allow an expansion of 708 sq.ft. for
dining purposes in the C-1, S.P. zone located at the
northeast corner of Sage Lane and El Paseo (73-260 El
Paseo).
Mr. Diaz stated he had received a telepone call from the applicant stating he may
request a continuance at the time of this hearing.
Chairman Wood opened the public hearing and asked if the applicant was present.
MR. JOHN BAKER, explained that their attorney could not be present at
this time and requested a continuance.
Moved by Commissioner Crites, seconded by Commissioner Richards, to continue
this case to October 4, 1983, 7:00 p.m. per applicant's request. Carried
unanimously 5-0.
B. Case No. DP 06-81 and TT 17794 Amendment Nos. 1 - ALEX ADAMEK and
ROBERT RICCIARDI, Applicants
Request for approval of a 71 unit condominium
development on approximately 14.25 acres within the PR-5
(Planned Residential, 5 d.u./acre) zone generally located on
the south side of Hovley Lane, 330 feet west of Portola
Avenue.
Mr. Joy reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation.
MR. ROBERT RICCIARDI, 73-725 El Paseo, concurred with staff's
recommendation and was present to answer any questions.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.
The commission was concerned with the architecture, specifically the colors and
landscaping.
Mr. Ricciardi provided another rendering which showed the design of the
development more specifically and explained the concept of the design.
Moved by Commissioner Downs, seconded by Commissioner Richards, to approve
findings as recommended by staff; carried unanimously 5-0.
Moved by Commissioner Downs, seconded by Commissioner Richards, to adopt

Planning Commission Resolution No. 887, approving Case Nos. DP 06-81 and TT
17794 Amendments, as conditioned; carried unanimously 5-0.
C. Case Nos. CUP 18-83 and PMW 04-83 - CHESTER DORN, Applicant
Request for approval of a conditional use permit and parcel
map waiver to allow construction of a retail commercial
building in a C-1 zone located between the Frontage Road
and Alessandro and on the north side of Alessandro Drive,
370 feet east of Portola Avenue.
Mr. Smith reviewed the staff report and stated one of staff's recommended changes
to the plan was that the applicant's proposed outdoor storage area be eliminated
and the area be landscaped. He reviewed the conditions and stated that the
applicant had agreed to these conditions. Mr. Smith added that a concern was
mentioned by an adjacent property owner in regards to drainage; staff felt drainage
would be adequate. Staff recommended approval.
Commissioner Erwood questioned the parking lot lighting and its impact on
adjacent residential areas. Mr. Smith replied that lighting has not been shown on
the plans yet. Mr. Diaz explained the applicant is required to submit a lighting
plan that would conform to the city's ordinance, which prohibits parking lot lighting
spillover onto residential areas.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation.
MR. CHESTER DORN, stated that they concur with staff's recommended
conditions.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.
Moved by Commissioner Crites, seconded by Commissioner Downs, to approve
findings as recommended by staff; carried unanimously 5-0.
Moved by Commissioner Crites, seconded by Commissioner Richards, to adopt
Planning Commission Resolution No. 888, approving Case No. CUP 18-83 and PMW
04-83, as conditioned; carried unanimously 5-0.
D. Case No. CUP 20-83 - MICHAEL BECKER, Applicant
Request for approval of a conditional use permit to allow a
2200 sq.ft. restaurant in a C-1 zone (General Commercial)
located on the west side of Painters Path, north of Fred
Waring Drive.
Mr. Joy briefly reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation.
MR. MICHAEL BECKER, 74-492 Azurite Circle E, agreed to staff's
recommended conditions and was present to answer any questions the
commission might have.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.
Moved by Commissioner Richards, seconded by Commissioner Crites, to approve
findings as recommended by staff; carried unanimously 5-0.
Moved by Commissioner Richards, seconded by Commissioner Downs, to adopt
Planning Commission Resolution No. 889, approving CUP 20-83, as conditioned;
carried unanimously 5-0.

E. Case No. PM 19504 - DAVID FREEDMAN & CO. and HOUSLEY
ASSOCIATES, Applicants
Request for approval of a parcel map creating two parcels
on 161.6 gross acres in the PR-5 and PC (2) zones, located
at the future southeast corner of Gerald Ford Drive (36th
Avenue) and Monterey Avenue, a Class 5 categorical
exemption for CEQA purposes.
Mr. Sawa reviewed the staff report and noted that there were conditions from the
director of public works that should be understood regarding drainage and
signalization fees and street improvements. He explained that the department of
public works recommended to the applicants that they request a deferment of
these conditions from the city council until a precise plan or further tentative
maps are requested.
Mr. McClellan added that the Palm Desert Municipal Code requires these fees and
improvements but they could be deferred by the city council until the project is
started. He added that the property is part of a future assessment district to
construct these public improvements.
Commissioner Crites asked if this development was in an area that would be
critical to the fringe toed lizard natural habitat. Mr. Diaz explained that it is in
the center of it but this request was for a division of property along existing zoning
lines, and at the development plan application level this concern will be addressed.
Mr. Diaz briefed the commission on the most recent developments concerning the
lizard issue.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation.
MR. GERALD DUPREE, 74-040 El Paseo, concurred with staff's
recommendation.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.
Moved by Commissioner Crites, seconded by Commissioner Downs, to approve
findings as recommended by staff; carried unanimously 5-0.
Moved by Commissioner Downs, seconded by Commissioner Richards, to adopt
Planning Commission Resolution No. 890, approving PM 19504, subject to
conditions; carried unanimously 5-0.
IX. MISCELLANEOUS ITEMS
A. Case No. C/Z 09-81 - WESTERN ALLIED PROPERTIES, INC. - Adoption of
Resolutions recommending certification of a Negative Declaration of
Environmental Impact and approval of a preannexation change of zone and
master plan of development for 675 acres located at the southerly boundary
of the City of Palm Desert, on the west side of Highway 74.
Moved by Commissioner Richards, seconded by Commissioner Crites, to approve
the findings as recommended by staff; carried unanimously 5-0.
Moved by Commissioner Richards, seconded by Commissioner Erwood, to adopt
Planning Commission Resolution No. 885, recommending to the city council

certification of a Negative Declaration of Environmental Impact; carried
unanimously 5-0.
Moved by Commissioner Richards, seconded by Commissioner Crites, to adopt
Planning Commission Resolution No. 886, recommending approval to the city
council of C/Z 09-81 and master plan of development; carried unanimously 5-0.

XI. COMMENTS
Commissioner Crites noted that because of the new design of the storm channel,
and due to the rains, he and other residents in the area of Cahuilla Hills are now
unable to get to their homes because of their roads being washed out.
Commission instructed staff to inform the council of this problem.
