HomeMy WebLinkAbout1204 MINUTES PALM DESERT PLANNING COMMISSION MEETING TUESDAY - DECEMBER 4, 1984 7:00 P.M. - CIVIC CENTER COUNCIL CHAMBER 73-510 FRED WARING DRIVE A STUDY SESSION WAS HELD PRIOR TO THE MEETING IN THE COUNCIL CHAMBER CONFERENCE ROOM, AT 6:00 P.M. I. CALL TO ORDER The meeting was called to order at 7:00 p.m. H. PLEDGE OF ALLEGIANCE Commissioner Erwood lead in the pledge of allegiance. III. ROLL CALL Members Present: Buford Crites, Chairman Bob Downs Richard Erwood James Richards Members Absent: Ralph Wood Staff Members Present: Ray Diaz Dave Erwin Stan Sawa Phil Drell Phil Joy Al Cablay Tonya Monroe IV. APPROVAL OF MINUTES: Consideration for approval of the minutes of November 20, 1984. Action: Moved by Commissioner Downs, seconded by Commissioner Richards, to approve the November 20, 1984, minutes as submitted. Carried 3-0-1 (Commissioner Erwood abstained.) V. SUMMARY OF COUNCIL ACTION Mr. Diaz summarized the actions of the city council at its November 28, 1984, meeting. VI. CONSENT CALENDAR NONE. VII. PUBLIC HEARINGS A. Continued Case No. CUP 01-82 (Amendment #0 - FOUNDATION FOR THE RETARDED OF THE DESERT, Applicant tow Request for approval of an amendment to a conditional use permit to allow the use of a structure with patio cover at the rear of the existing building and other minor exterior additions in the P (public) zone located at the southeast corner of Country Club Drive and Sagewood Drive. Mr. Sawa reviewed the staff report and recommended approval of the findings and adoption of the proposed resolution. He noted that the homeowners association had reviewed the plans and indicated they had no objections to the revised plans. Commissioner Downs asked for and received clarification regarding traffic circulation. MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 4, 1984 Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. WENDELL VEITH, 45-275 Prickly Pear Lane, architect, asked for and received clarification regarding several findings. Mr. Diaz suggested the elimination of four parking spaces to create good traffic circulation on the west side of the project. '"" Chairman Crites suggested that condition #10 be modified that the project would have complete vehicular circulation now. Chairman Crites asked if anyone present wished to speak in FAVOR of the project. MR. JUAN CASADO, 40-472 Silk Tree Court, spoke in favor of the project. MR. DON NANCE, 20-255 Sagewood, spoke in favor of the project. Chairman Crites asked if anyone present wished to speak in OPPOSITION of the project. Hearing no one, the public testimony was closed. Commissioner Downs indicated that he was in favor of the project as long as the vehicular circulation condition #10 was amended as previously stated. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried 4-0. Moved by Commissioner Richards, seconded by Commissioner Erwood, adopting Planning Commission Resolution No. 1013, approving CUP 01-82 (Amendment #1). Carried 4-0. v�r B. Case No. PP 84-24A, TT 20199, WARD DEVELOPMENT AGREEMENT - ROBERT L. WARD, Applicant Request for approval of a negative declaration of environmental impact, precise plan, tentative tract map, and development agreement to allow construction of 26 condominium units on 3.2 acres with the R-2 (7) S.P. and PR-7 zones (including a 25% density bonus for moderate income housing) located at the southeast corner of Park View Drive and Fairhaven Drive. Mr. Drell reviewed the background of the case and suggested that the commission recommend approval of the project to the city council. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. CHARLES MARTIN, architect, indicated that the applicant would only pay condition #14, school impact fees, under protest. Mr. Erwin replied that it was required. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this project. Hearing none, the public testimony was closed. Action: Moved by Commissioner Downs, seconded by Commissioner Richards, to adopt the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Richards, to adopt Planning Commission Resolution No. 1014, recommending approval of PP 84-24a, TT 20199, and the development agreement to city council, subject to condition. Carried 4-0. -2- MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 4, 1984 C. Case No. PP 84-12 - P.D. PARTNERS, Applicant Request to change building locations and modify a development agreement of an approved precise plan of design for 104 apartment units at the corner of Hovley Lane and Beacon Hill. Mr. Joy reviewed the staff report and suggested recommending the development to *am the city council. Commissioner Richards felt that the change in the design and architecture was better and that staff did a good job. Mr. Diaz explained that the architect was very cooperative. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. STEVE SULLIVAN, 73-730 Highway 111, architect, concurred with staff's presentation. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this project. Hearing no one, the public testimony was closed. Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, to approve the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Erwood, to adopt Planning Commission Resolution No. 1015, recommending approval of PP 84-12 Amendment #1, and DA-4 accompanying development agreement to the city council. Carried 4-0. Mr. Diaz noted that the previous plan was now void. D. Case No. PP 84-46 - GORDON VAN DER BOOM, Applicant Request for approval of a negative declaration of environmental impact and precise plan of design to allow construction of a 10,800 square foot industrial building in the S.I., S.P. zone on the west side of St. Charles Place, approximately 145 feet north of Mediterranean. Mr. Sawa reviewed this case and recommended approval of the project subject to the conditions. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. SVEN PUELICKE, 74-804 Vellie Way, offered no comment. Commissioner Downs asked if the building would be waffle crete. Mr. Sawa replied yes. r.. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the project. Hearing no one, the public testimony was closed. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried 4-0. -3- MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 4, 1984 Moved by Commissioner Richards, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 1016, approving PP 84-46, subject to conditions. Carried 4-0. E. Case No. PP 84-47 - LAWRENCE AND CAMILLE TODD, Applicant Request for approval of a Negative Declaration of Environmental Impact and a precise plan of design to allow law construction of a 5000 square foot commercial building within the C-1 zone located at the north west corner of DeAnza Way and the north side of Palm Desert Drive. Mr. Drell reviewed the staff report and recommended approval, subject to the conditions. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. STAN POLOWSKY, architect, agreed with staff recommendation. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this project. Hearing no one, the public testimony was closed. Commissioner Downs noted that this is the fifth building built where there is two- way traffic, and only one building has been built on the other one-way side. Action: Moved by Commissioner Erwood, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried 4-0. Moved by Commissioner Erwood, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 1017, approving PP 84-47 and a negative declaration of environmental impact, subject to conditions. Carried 4-0. VIll. MISCELLANEOUS ITEMS A. Case Nos. C/Z 84-11, PP 84-31, and TT 20351 - WESTAR ASSOCIATES, Applicants Resolution of denial. Mr. Sawa noted that the four findings as determined by the planning commission were present in the proposed resolution. Staff recommended adoption of the resolution based on the planning commission action at the last meeting. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried 3-0-1 (Commissioner Erwood abstained.) Moved by Commissioner Richards, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 1018, denying C/Z 84-11, PP 84-31, and TT 20351. Carried 3-0-1 (Commissioner Erwood abstained.) IX. ORAL COMMUNICATIONS NONE. -4- MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 4, 1984 X. COMMENTS Chairman Crites asked if the commission wished to delegate him to attend the December 13, 1984 city council meeting regarding the Westar case. Commission agreed. Chairman Crites requested that staff present the commission with data relative to future conflicts in regard to previous zoning. Mr. Diaz replied those properties with a low designation will be identified. Commissioner Richards received clarification regarding Ironwood wash area. XI.
