I. CALL TO ORDER Chairman Crites called the meeting to order at 7:00 p.m. If. PLEDGE OF ALLEGIANCE Commissioner Richards lead in the pledge of allegiance. III . APPROVAL OF MINUTES: Request for approval of the minutes of July 16, 1985. Action: Moved by Commissioner Downs, seconded by Commissioner Richards, approving the minutes as submitted. Carried 5-0. V. SUMMARY OF COUNCIL ACTION Mr . Diaz explained that no items directly impacted planning commission at the city council meeting of July 25, 1985. VI . CONSENT CALENDAR A. Case No. PMw 85-13 - R-K DEVELOPMENT, Applicant u.. MINUTES PALM DESERT PLANNING CO M1 I SS I ON AUGUST 6, 1985 Request for approval of a parcel map waiver to Ina allow adjustment of lot lines to eliminate knuckles at street intersections. Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, approving PMW 85-13 by minute motion. Carried 5-0. B. Case Nos. DP 09-80 and 221 MF - CHACAHUALA, LTD, Applicant Request for approval of a six month extension of time for a development plan and preliminary design review case to allow construction of a 117 unit condominium project in the PR-3 zone at the southeast corner of Homestead Road and Alamo Drive. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, denying DP 09-80 AND 221 MF by minute motion. Carried 5-0. C. Case Nos. PP 84-22, PMW 84-9, 276 MF and Development Agreement- RALPH SANTOPIETRO, Applicant Request for approval of a one year time extension for a precise plan of design, parcel map waiver, architectural commission approval , and development agreement for 12 units at the southeast corner of San Pablo and Santa Rosa. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, denying PP 84-22, PMW 84-9, 276 MF, and Development Agreement by minute motion. Carried 5-0. D. Case Nos. PP 84-23, VAR 84-3, and 270 MF - RALPH SANTOPIETRO, Applicant Request for approval of a one year time extension for a precise plan of design, zone variance, and architectural commission approval for triplex on the north side of Santa Rosa, 252 feet east of San Pascual . 2 MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 Action: Moved by Commissioner Downs, seconded by Commissioner Wood, approving PP 84-23, VAR 84-3, and 7.70 MF by minute motion. Carried 5-0. VII. PUBLIC HEARINGS A. Case Nos. GPA 85-4 and C/Z 85-3 - BIRTCHER-DUNHAM, Applicant Request for approval of a general plan land use element change from medium density residential (5-7 du/acre) to core area commercial and a change of zone from PR-6 (planned residential , six dwelling units per acre) to C-1 (general commercial ) for approximately 10.3 acres and a negative declaration of environmental impact for land bounded by El Paseo, Shadow Mountain Drive, San Pablo Avenue, and Larkspur Lane. Mr. Diaz outlined the proposal . Mr. Sawa noted that some letters had been received in favor and opposition. Chairman Crites opened the public_ testimony and asked the applicant to address the commission. MR. CURT DUNHAM, spoke in behalf of the zone change and described the proposed amenities. Chairman Crites asked Mr. Dunham if he had made an effort to meet with the surrounding neighbors. Mr. Dunham indicated that a letter had been sent stating that the plans could be viewed in his office. MR. ANDREW FELA, 144 S. Grand Avenue, gave an overview of the colored plans. Mr. Diaz explained to the commission that the plans before them were for informational purposes only and not under consideration. Chairman Crites suggested a motion of continuance after taking puhlic testimony. He also discussed staff's checklist nos. 16 and 20 regarding traffic circulation and the height ordinance. Commissioner Richards felt that with the possible removal of the present development a greater effort should be made to notify tenants 3 MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 as well as owners in the surrounding neighborhood. He also suggested qM0 media coverage. Chairman Crites expressed concern regarding the intensity of use and questioned the rezoning to C-1 without knowing impacts. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the zone change. MR. JOE STEIN spoke in favor of the zone change and in approval of a destination hotel which would provide easy access to all shops on E1 Paseo. MR. JOHN BAKER, 73-520 Joshua Tree, spoke for several neighbors to express concern regarding traffic. He felt that if the applicant kept the proposed development within city standards it would be acceptable. MR. BOB SNYDER, a Shadow Mountain condominium owner, felt that the bungalows should be eliminated and the zone changed to C-1 . He expressed concern regarding C-1 zoning along Shadow Mountain Drive and suggested splitting the zone on the lot with C-1 facing E1 Paseo and multi-family residential along Shadow Mountain. MR. TED GANNON agreed with keeping the multi-family residential along Shadow Mountain Drive. He stated that he would prefer to see a hotel and shops rather than some of the other possible uses allowed under a C- I zone. He recommended that the commission make a decision to rezone the present zoning. MR. LLOYD WICKSTROM, 73-415 Shadow Mountain, spoke in opposition to the Dunham development. He felt that a buffer zone was needed between residents on Shadow Mountain and shops. He also felt that the traffic could present a problem and did not want to see any unwanted precedents set. MR. BOB RICCARDI , 45-275 Prickly Pear Lane, stated commercial zoning should be consistent along El Paseo. He suggested the lot be zoned to align east and west ( i .e. commercial on the north, residential on the south) . He felt El Paseo needed a hotel/store for an anchor and that aesthetics and viability should be considered. He mentioned the possibility of landscaped screening along Shadow Mountain Drive. He recommended zoning the lot C-1 and 9-3 with the possibility of zoning all C-I with the certainty of a hotel development. 4 r/ MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 MR. BERNIE LEUNG, expressed concern as a resident of Shadow Mountain. He felt Shadow Mountain should remain residential . He suggested zoning the lot C-1 to mid part and R-3 along Shadow Mountain, while providing underground parking and providing a park or condominiums on the top fronting Shadow Mountain. MR. MIKE BAL.ENT, 73-435 Shadow Mountain Drive, was concern about height and the blocking of his view. Mr. Diaz indicated that the height limit was 25 feet. Commissioner Richards felt that the economic feasibility of a hotel on El Paseo should be considered. Commissioner Erwood requested that staff give more input at the next meeting as to protecting Shadow Mountain residents with a 7.one of C-1 along El Paseo and residential along Shadow Mountain. Chairman Crites expressed a wish to see a specific project tied to the zone change by a development agreement. Mr. Dunham stated that if the rase was being continued, any �..• interested persons could view the plans in his office. Commissioner Richards requested that the applicant go into the community to get names and addresses of people in favor of the project. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, continuing GPA 85-4 and C/Z 85-3 to September 3, 1985. Carried 5-0. A FIVE MINUTE RECESS WAS CALLED AT 8:43 P.M. THE PLANNING COMMISSION SUSPENDED THE ORDER OF THE AGENDA AT THIS POINT. E. Case No. ZOA 85-3 - CITY OF PALM DESERT, Applicant Request for approval of a zoning ordinance amendment implementing Palma Village Specific Plan recommendations creating the Senior Housing Overlay (S.O. ) and reducing height maximums in the R-2 and R-3 zones. 5 MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1965 Mr. Drell gave a summary of the case. r► Chairman Crites opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION. MR. TOM STARR spoke in favor of the amendment. Commissioner Richards requested that exhibit "B" regarding the height maximums and flat versus pitched roofs be sent to the architectural commission for review. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, approving the findings as presented by staff. Carried 5-0. Case No. C/Z 84-19 - HOLMBERG AND TONER, Applicants .r Request for approval of a change of zone from R-2 to R-3 5.0. for the block bounded by San Pablo Avenue, Catalina Way and San Gorgonio Way. Mr. Drell explained that the next three public hearing items were zone changes from recommendations of the Palm Valley Specific Plan Committee. He showed a video presentation of the sites. Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the request. There being no one, the public_ testimony was closed. Chairman Crites asked for a motion by the commission. Action: Moved by Commissioner Wood, seconded by Commissioner Richards, approving the findings as presented by staff. Carried 5-0. HOWARD BIBBY, an adjarent resident, requested that the wall height he lowered next to his residence. Mr. Leung indicated that the site would have to be looked at to determine the amount the wall could he rediired on that one side only. Case No. PP 85-20 - LEPAN-LEVY, Applicants Request for approval of a precise plan of design and negative declaration of environmental impact to allow 28 apartment units on an 87,250 square foot property in the R-� 18,000 (3) S.P. zone located north of Verba Santa between the Frontage low Road and Ocotillo. Mr. Diaz outlined the salient points of the staff report and added the condition of installation of sidewalks. Chairman Crites expressed concern regarding street size, the double car garages, parking standards, and the quality of the overall plan. Mr. Diaz concurred that the design could be improved. Chairman Crites 2pened the public testimony and asked the applicant to address the commission. MR. RRANKO 1_FPAN, explained that the road width was 15 feet in two or three places and the rest was 30 feet. Mr. Lepan also discussed the roan exits .and frontage roads. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being no one, the public testimony was closed. 11 MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 Chairman Crites commented that he felt the project needed a better design. Commissioner Downs felt that the driveway width should he investigated. Commis-;inner Richards also expressed concern regarding the garage doors. Mr. Diaz suggested a two-weak continuance. PP 85-21 and PMM 85-15 - WILLIAM ALEXANDER, Applicant Request for approval of a 48,000 square foot two story office/warehnu�e buiiding and negative declaration of environmental impact located in a service industrial zone on the west side of Corporate Way, 260 feet north of 42nd Avenue. Mr. .loy outlined the staff report and suggested the addition of conditions for an additional 25 foot setback, sidewalks along Corporate Way, and the requirement of a parcel map waiver if consolidation occurs. Mr. Joy also indicated that the applicant would like to shift the huilding southward to eliminate building in r� the storm drain easement area. Commissioner Richards clarified that there was a zero lot line and asked aboi.it adjoining parcels. Mr. Joy indicated there were no structures at the present time. Chairman Crites gpened the public testimony and asked the applicant to address the commission. MR. ALFXAND FR felt that the installation of sidewalks could he a problem for the safety of patrons. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being no one, the public testimony was clnsed. Commissioner Richards asked for clarification regarding the allowance of zero lot line. Mr. Joy indicated that a previous proposal by Mr. Solomon had been approved with a zero lot line. rI MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 Chairman Crites expressed opposition to having a zero lot line. Commissioner Wood commented that maintenanre problems occur when two properties have walls facing each other with spare in between. Chairmen Crites also expressed concern regarding the possibility of R-1 property developing next to a wall with a zern lot lino. He felt that mitigation mpasures sho.i l d not be placed on the other property owner. He felt that a lot line setback provides protection for both property owners, Moved by Commissioner Richards, seconded by Commissioner Wood to approve the findings as presented by staff. Vote: ?-3 (Crites, Downs, Frwood voted no) . Not carried. Commissioner F rwood noted that a resolution of denial wou l d have to he prepared. Mr. Diaz explained that in terms of open space, an application had been filed and the individual would bear the mitigation. Commissinner Downs requested a reopen of discussion to allow him a change of vote. Moved by Commissioner Onwns, seconded by Commissioner Richards, to rr.. reopen the discussion. Carried 3-2 (Crites and Erwood voted no) . Commissioner Richards stated that the commission could not grant a zero lot line in one rase and not another. He also stated that if a commissioner is against a particular proposal , he should state those reasons why. Commissioner Richards asked staff if there were any rasps where a zero lot line was not allowed. Mr. Joy indicated that a 25 foot setback was required next to R-1 . MR. GFORGE RFRKFY, Joshua Tree, explained that. the ownership of both properties in question was the same and that there was no objection to the setback being placed all on that one property. He felt that if a 25 foot setback was needed, the commission could require it on the adjacent property. Chairman Crites spoke in opposition to the burden of a setback being placed on only one property owner. Action: Moved by Commissioner Wood, seconded by Commissioner Richards, approving the findings as presented by staff. Carried 4-1 (Crites voted no) . Chairman CritP, spoke regarding the length of the agenda. He instrurtPd staff to consult him if there were more than five or six public hearing items on the agenda and if a study session was called. Chairmen Crites requested that an agenda he prepared for all study sessions. C. Commissioner Wood felt there should be a time frame for the initiation of puhlir hf�aring items. Commission agreed to continue this matter. D. Commissioner Frwood indicated that on a previous tour with the city coiinc_il , they had indicated that sidewalks in the city were desirable. Commissioner Richards stated that he would like to hear from the coirnr. il on this matter; he felt that it was a pnIicy derision . Commissioner Erwood moved to send a recommendation to c_ntinril for sidewalks throughout all the city, inrluding industrial areas. Motion failed due to a lack of a second. IX.
