Chairman Crites e;<pressed concern regarding the ultimate completion
of phase II and commission discusspd alternatives such as requiring
phase II completion prior to certificate of occupancy issuance and
construction of both phases �t the same time.
Chairm�n Crites opene� the public testimony and asked the �pplicant
to address the comnission.
MIR. WENUELL F�YLEE, �pplicant, e;lprPssed �oncurrence to the terms
of the agreement and felt that the city would be well protected
by the development agreement.

After discussion, commission felt some control was needed and
ma:�imum incentive provided for the applicant to complete phase II.
Chairm�n Crites recommended that if after '24 months project number �
is not completed 15 units in ph�se I be required to c�vert to lower
and moderate income housing.
Commissioner Richards suggested a continuance to allow the commission
to receive something in writing.
Chairm�n Crites suggested continuing the matter to later in the
meeting to allow the applicant and staff to work out the specific
wording. Chairman Crites asked if anyone present wished to speak: in
FAVOR or OPPOSITIaI to the propased. There was no testimony.

Moved by Commissioner Liowns, seconded by Commissioner Richards, ta
continue the discussion until further in the meeting to allow staff

ComR�issioner Richards felt the commission should laok. at projects
that have conversion features and require park•ing spaces between
ofFice and warehouse requirements.
Commissioner powns noted that previously approved projects in that
are� did not have adequate off-street parking. Mr. f�rell indicated
that office uses could be limited to the number of parking spaces
allowed.
Commissioner Wood ask.ed if conversion to office spaces could be done
without the owner coming to the city for the alterations. Mr. Di�z
�eplied yes. Commissioner Wood felt that park:ing should be
controlled from the outset.

multi-fami. ly residential to achieve conforming
status.
Mr. Dreil outlined the salient points of the staff report.
Commissioner Wood felt standards should be brought up-to-date to
comply with the ordinance, as long as more than a mediocre job was
done.
Commissioner Richards agreed with the process but expressed concern
regarding a limit to what can be asked of the applicant by the city.
He felt a percentage af appraised value or number of square feet
should be used as a guideline, instead of having the subjective
opinions of the architectural comR�ission.

Mr. Uiaz e;Kplained that the applicant could appeal to the council if
they didn`�t agree with the decision of the architectural commission.
Chairm�n Crites o ened the public testimony and asked if anyone
present wished to speak in FAVOR or OPPO.SITION to the proposed.
MR. ED WARLi, Las Falmas Villas and Olive Tree, outlined the
present sit��ation of those projects, insurance coverage, and
noted that the applicant had final say on whether to upgrade or

Request for consideration of an amendment ko the
Falm Desert Zoning Ordinance Section 2S.Sh
general provisions relaking to hotel development
standards.
Mr. Smith o��tlined the salient points of the staff report and
recommended that commercial subcommittee concern #4 be elimin�ted
and made a policy of the commission.
Commissioner Uowns suggested that "adjacent to" be inserted in #2 to
read ". . .within the building itself, attached or adjacent to the
building, together with room service for hotel guests. "
Commissioner Fcichards e:<:pressed agreement with the elimination of
M4, but felt that the �ommission should look into possible "motel"
structures for along Interstate 10. Chairman Crites ask.ed if an
overlay could be created for that area. Mr. Dia� replied that a
differentiation coulci be made. Commissioner Richards felt on-going
revenue structures should be co�sidered. Chairman Crites suggested
that staff should be instructed to ex:amine and address this issue.
„r, Mr . Di.az e:�pressed concern for allowing cheaper motel/hotel
developments along Interstate i��. Commissioner Wood noted that t.he
recommendation of the subcommittee seemed to support citizen, council
and staff feelings on this matter.
Mr. Smith noted that � north sphere study would be done and the
consultants could address the "motel standard" issue sep�rately from
the hotel st�ndards. Commission directed staff to bring this matter
to the �ttention of the consult�nts for review as part of the north
spherp study.
Commissioner powns noted that as part of earlier discussions the
committee talked about a motel park for that area. Commissioner
Richards felt that there were specific areas where changes in
stand�rds could be allowed and did not want this possibility
precluded.
Chairman Crites opened the public testimony and asked if anyone
wished to speak in FAVOR or OPPOSITION to the proposed. There being
no one, the public testimony was closed.

A FIVE MINUTE RECESS WAS CALLED AT 3:49 P.M.
A. Conti�ued Case No. PP 85-39 - SANBORN AND RYLEE, Applicant
Mr. Diaz read the praposed condition that stated that in the event
that phase II is not completed within the required 24 months and
phase I has been completed, the developer shall provide �5 affordable
units of conventianal senior housi�g units within phase I: 8 units
for lower income households and seven units for moderate income
households as shawn in e:hibit '2, until such time as project II is
completed and certified for occupancy.
Mr. Erwin indi.cated th�t the condition was acceptable and commission
concurred.

bRUCF DORMAN, G R� D, agreed to the conditions and stated he
felt the three ye�r period was too long to hold the 1.d4 acre
parcel for employee parking and suggested a compromise of two
yEcil'S.
Chairman Crites noted that jacaranda trees were not good tanopy
trees and suggested that the landscape �rchitect re-evaluate the
materials used far landscaping.
MF.. BRAII HUTTON, outlined the amenities of the project for the
commission.
Chairman Crites asked is anyone prese�t wished to speak in FAVOR or
OPPOSITION to the p�oposed.

MIF. BRUCE ABRAMS, a citizen of Rancho Mirage, expressed concern
for parking overflow onto Park View, felt there should be no
driveways onto Park: View, and also fel.t khat applicant should
pay a share of the Park View widening. He also expressed
concern for the overall high density of the �rea due to the
College of the De�ert, Palm Lesert Town Center, and Rob Hope
Cultural Center.
C�mmissioner Ri.chards ask:ed staff why the applicant had not been
required to provide a share oF the Park View widening. Mr. Diaz
replied that the appli.cant would not utilize Park View to a great
e;:tent. Chairman Crites felt that the applicank should participate
in the assessment since the people would use P�rk: View to access
Monterey. Mr. Diaz suggested that the �pplicant agr�e to join an
a.ssessment district for a reasonable amount. Commissioner Richards
suggested the applicant post a bond for '25'/, and also suggested that
the adjace�t city participate also.
MR. HAf;RY McCLELLAN, 7�:-'Zli� E1 Faseo, described the type of
bridge to be installed.

MR. WIL�IAM HARTMAN, an adjacent homeowner, indicated concern rl
over street parking, concrete berming and entry onto Highw�y
111. Mr. Di�z e>:plained reciprocal easements and rights of
access onto Par{:. View. It was determined that the concrete
berming had been installed by the Coachella Valley Water
District. Mr. Dia� felt that Mr. Hartman had grounds for a
variance due to the �oncrete berming.
Chairman Crites closed the public testimony.
After further discussion, cammission determined that the applicant
should contribute $Sn,C�O�� for the widening of the Park� View bridge
crossing the Palm Valley channel and that the applicant should hold
the 1.U4 �cre parcel for a period of two years.
Commissioner Wood felt th�t the condition requiring the applicant to
contribute �5U,U00 was unfair.

B. Request of George Fax for day hearing.
Mr. Di�z explained that the landscape plans for the Fox project would
be coming to the commission for review �nd stated that the applicant
indicated that he would not be able to attend an evening meeting and
wa.s requesting a day mpeting.
Commission concurred that this was acceptable.

Moved by Commissioner Richards, sPconded by Commissioner Wood,
allowing the public hearing for the George Fo;<: landscape pl�ns to be
�., revi.ewed at a day meeting by minute motion. Carried 5-0.
C. Noames Pool Acquisition.
Mr. Smith reminded commission that at study session during the
discussion concerning the property at the southwest corner of
Highway 111 �nd Fred Waring Drive the commission had indicated that
the Hoames Fool property must be included in any comprehensive
development plan for the property.

recommending by minute motion th�t, if necess�ry, the city�'s
redevelopment agency proceed to acquire the Hoames Pool property as
