Chairman Crites cailed the meeting to order at 2:00 p.m.

Consideration of May 6, 1986 meeting minutes as amended.
Action:
Moved by Commissioner powns, seconded by Corrnnissioner Wood, approving
the minutes of May 6, 1986. Carried 3-0.

staff to bring copies of the staff report and minutes from that
meeti�g regarding the time allowa�ce for the temporary hank facility.

withdrawing item #A from the consent calendar. Carried 3-0.

8. Case No. PMW 86-7 - KWL ASSOCIATES, INC., Applicant
Request for a parcel map waiver to consolidate
lots l , 2, 3, 8 31 block A-3 into one parcel .

Action:
Moved by Commissioner Wood, ser_onded by Commis5ioner powns, approving
the consent calendar by minute motion. Carried 3-0.
VII . PUBLIC HEARINGS
A. Continued Case No. ZOA 86-4 - CITY OF PALM DESERT, Applicant
Request for approval of an amendment to section
25.28.030 (General Commercial Distrir_t) of the
code of the city of Palm Desert relating to
convenience stores and liquor selling
establishments.
Commissioner Wood noted that he was not present for the previous
meeting's discussion and indicated that he would have to abstain.
Mr. Philiips indicated t.hat he could check the code to see if it
could be adopted on that kind of vote. Chairman Crites felt that the
commission would not want to pass the resolution without more members
being present.

Mr. Diaz stated that some concern had been expressed regarding the
hours of operation provisian and asked if there would be some
re-thought to the provision if that section were deleted for
convenience stores and/or markets. Commissioner powns stated that
no definition of a public nuisance had been given and recommencied a
continuance.
Mr. Diaz indicated that the hearing would be re-advertised to cover
all commercial areas.
Chairman Crites opened the public testimony and asked if anyone
wished to speak in FAVOR or OPPOSITION to the proposed.
MR. VAN TANNER, 46-033 Sagewood, stated he was directly behind
the new Lur_ky center and had problems with having a tavern
300'-500' away. He indicated that he would like to be advised
in writing prior to any limiting of hours of operation.
Chairman Crites indicated that. a motion would be in order to continue
the hearing and instructed staff to bring both a draft and a modified
resolution striking nuisance and hours to the meeting.
Mr. Diaz noted that there would be a delay because of the renoticing
`... of the public hearing for all commercial areas.
Action:
Moved by Commissioner Wood, seconded by Commissioner Uowns,
continuing ZOA 86-4. Carried 3-0.
Commissioner Wood requested a copy of the ordinance for review prior
to the next meeting.
B. Case Nos. PP 86-18 and PMW 86-5 - JIM RODGERS, Applicant
Request for approval of a 40,000 square foot
office/warehouse project and lot consolidation
located in a service industrial zone on the
east side of St. Charles Place, 500 feet north of
Mediterranean.
Mr . Diaz outlined the salient points of the staff report. and
recommended approval .

Chairman Crites opened the public testimony and asked if the �
appiicant. wished to address the commission. The applicant signaled
affirmation to the conditions.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed. There being no one, the public testimony
was closed.
Action:
Moved by Commissioner Wood, seconded by Commissioner powns, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Wood, seconded by Commissioner powns, adopting
Planning Commission Resolution No. 1147, approving PP 86-18 and PMW
86-5, subject to conditions. Carried 3-0.
C. Case Nos. PP 86-19 and PMW 86-6 - DENNIS FREEMAN, Applicant
Request for approval of a 40,000 square foat
office/warehouse complex in a service industrial
zone located at the southwest corner of Eclectic
and Hovley Lane.

Mr. Diaz outlined the request and recommended approval . �
Chairman C:rites opened the public testimony and asked if the
applicant wished to address the commission.
MR. ROBERT RITCHEY, 45-120 5an Pablo, architect, stated that he
had no problems with the conditions except for the deletion of
direct acr_ess onto Hovley. He felt the access onto Hovley was
viable for the project and no access would inhibit fire
department access. Mr. Diaz noted that the fire department had
reviewed the plans and had expressed no concern. Mr. Diaz
indicated that some parcels do not have any access other than
Hovley, but. noted that the city strives to minimize the number
of curb cuts. Mr. Ritchey felt that one more curb cut would not
be a large detriment. Mr. Ritchey stated that problems created
by no access would be the loop around for truck delivery,
creation of a race track, trucks mingling with cars, creation
of dead ends, and from a marketing standpoint. Mr. Ritchey
indicated that service entrances would be to the rear and the
front would be office type entrances.

Mr. Diaz expressed opposition to granting access onto Hovley. He
felt access from Corporate Way was sufficient.
MR. DENNIS FREEMAN, owner, stated that he was looking at the
project aestheticaily as well as traffic wise. He informed
commission that the project would have warehouse spaces. He
felt that the best effect for circulation would be not to sweep
all around the building, which could create traffic and
congestion problems within the development.
Chairman Crites closed the pubtir_ testimony.
Commissioner Wood stated that he saw no reason to change the
recommendation from staff. Commissioner powns concurred.
Action:
Moved by Commissioner Oowns, seconded by Commissioner Wood, adopting
the findings as presented by staff. Carried 3-0.
Moved by Commissioner powns, seconded by Commissioner Wood, adopting
Planning Cortmission Resolution No. 1148, approving PP 86-19 and PMW
86-6, subject to conditions. Carried 3-0.

VIII. MiSCELlANEOUS
Mr. Oiaz commented that a letter had been received from Mr. Germain
and noted that there was a problem with the proposal in the PR zone.
He indicated that staff would look into the matter, resulting with a
possible revision to the PR zone. Commission concurred. "
